Consumer Complaint: TRANS UNION ONCE AGAIN REVERTED TO A 30-DAY LATE ON MY REPORT WHEN THEY REMOVED IT LAST MONTH. TRANS UNION DOES THIS EVERY OTHER MONTH AFTER SEEING THEY ARE REPORTING INCORRECTLY. THIS HAS BEEN AN ONGOING ISSUE SINCE XX/XX/year>. PLEASE ESCALATE TO THE LEGAL DEPARTMENT. SEE SCREENSHOTS AS PROOF THEY ARE RUINING MY CREDIT WITH THEIR INACCURATE REPORTING!!!!!!!!!!! Consumer Complaint: I, XXXX, XXXX XXXX, federally protected consumer, a natural living being of majority status conducting the style and condition of The Principle and Beneficial Equitable Holder, and not an infant/minor, have the right to make sure my private, non public information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX are all financial institutions by definition under that title. According to 15 U.S.Code 1681c-2, this is my official statement that all the listed accounts have been reported without my expressed written consent and therefore is a result of identity theft and must be removed. These accounts are not related to any transaction made by me, the consumer. I am the card holder which was issued to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX so that I can receive a open end account with them ; to receive payments with them and defer. I have opted out and rescinded any authority I may have given XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX to report about me to any XXXX party, and I have a right to privacy, which is attached to this complaint. TransUnion needs to provide strict proof that the alleged creditor ( XXXX XXXX XXXX XXXX XXXX ) is, indeed, the secured party and holder in due course of the aforesaid alleged original agreement in issue and has an enforceable perfected security interest therein pursuant to and in compliance with the Uniform Commercial Code ( U.C.C. ) Section 9-203, Section 9-204 ( 1 ), and Section 9-305, or equivalent sections of the Commercial Code of New York State OR remove the account immediately as it is a result of identity theft. TransUnion and its affiliates listed above are also in violation of the previous conditional cease and desist what was attached to the complaint ( s ) and Opt Out Notice ( s ) which have not been honored. Ive requested my consumer file numerous times and haven't received it, only my consumer report which still shows inaccurate non-public information. At XXXX XXXX XXXXXXXX XXXX XXXX, we dedicate ourselves to protecting consumer rights and assisting in resolving credit-related disputes in accordance with relevant laws governing financial transactions. We kindly request you to review XXXX XXXX 's concerns promptly so justice may be served in adherence with statutes like the Fair Credit Reporting Act ( FCRA ) and Consumer Financial Protection Bureau ( CFPB ) Regulations that oversee such matters. We are filing this dispute with respect to XXXX primary issues that have negatively impacted XXXX XXXX 's credit report as per her TransUnion account. The first point of contention refers to numerous Account Review Inquiries initiated by car dealerships without her explicit consent, which not only breaches XXXX 's privacy but also results in inaccurate portrayal of her creditworthiness. FCRA and CFPB norms explicitly prohibit sharing consumer data for marketing or promotional purposes unless approved through documented agreements with consumers like XXXX. Enclosed herein, you will find insufficient bank records and correspondence evidence showcasing a lack of interactions between my client and these respective car dealerships regarding any agreement regarding these inquiries. Furthermore, we wish to draw your attention to XXXX 's longstanding dissatisfaction and unaddressed disputes related to XXXX XXXX. As per FCRA guidelines, a credit bureau or debt collector has an obligation to investigate any contested information within XXXX days from receiving such requests and respond accordingly with valid findings or updates made over XXXX days ago regarding inaccurate negative listings about XXXX 's account by this party, no suitable resolution or communication has been received which warrants serious consideration given its direct violations of legal statutes regulating responsible financial practices. The unauthorized Account Review Inquiries by these car dealerships constitute a blatant disregard for XXXX 's privacy rights, which are well-protected under the provisions stipulated in the Fair Credit Reporting Act ( FCRA ). This has led to containing error information being added to her TransUnion report, impacting her credibility unfavorably. This statement suggest that their actions conflict with legalities surrounding consumer protection and invites necessary intervention from TransUnion in adherence with FCRA. We request that you address these discrepancies forthwith by removing any unauthorized Account Review Inquiries made by car dealerships and resolving our client 's dispute with XXXX XXXX as per FCRA stipulations. Such swift action on your part will help maintain accuracy in XXXX XXXX 's credit report while restoring her confidence in TransUnion as a reliable credit bureau. The unauthorized Account Review Inquiries by these car dealerships have brazenly invaded XXXX 's right to financial privacy as specified in U.S. Federal Regulations including the Fair Information Practices ( FIP ) and the Gramm-Leach-Bliley Act ( GLBA ). Such infringement undeniably breaches her trust in TransUnion 's ability to ensure secure handling of her sensitive data. This statement highlights her violated privacy rights under federal mandates that promote transparency, security, and control over private information related to credit reporting. In light of these unauthorized Account Review Inquiries initiated by certain car dealerships, we wish to draw your attention to FCRA section 1681e ( a ), which mandates that third-party credit reporting agencies have no god given right to obtain any personal information or review sensitive consumer information without their specific consent. Furthermore, under Gramm-Leach-Bliley Act ( GLBA ) and related state laws regulating trade secrets and commercial activity, any illicit access or handling of private data without due authorization may result in severe civil fines or penal consequences for the offenders. This segment stresses on her violated rights backed by federal provisions while warning such entities about possible legal repercussions should similar invasive activities persist. Consumer Complaint: On XX/XX/2024, I looked at my report, I sent a letter to TransUnion on XX/XX/XXXX asking them to Reinvestigate these accounts. * XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX On XX/XX/XXXX they sent me their investigation and said these accounts are complete and accurate. I looked at my report and noticed everything is still the same. And According to 15 USC 1681I ( 5 ) They are supposed to do this ( 5 ) Treatment of inaccurate information or Unverifiable information ( A ) in general, If, After any Reinvestigation under paragraph ( 1 ) of any information disputed by a Consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall... ( I ) promptly delete that item of information from the file of the consumer, or modify that item ( s ) of information, as appropriate, based on the results of the Reinvestigation : and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer and according to 15 USC 1681eb they are supposed to ensure this ( B ) Accuracy of Report. Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assume maximum possible accuracy of the information concerning the individual about whom the report relates. And According to 15 USC 1681s-2 this is supposed to happen ( A ) Reporting information with actual Knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is Inaccurate.
