Consumer Complaint: I sent notarized documentation to XXXX XXXX XXXX XXXX XXXX to include a Notice of Dispute and a copy of my state drivers license as proof of identity. The drivers license has my signature on the front of the identification. I requested certified accounting documentation from XXXX XXXX XXXX XXXX XXXX in response to a recent credit report. XXXX XXXX XXXX XXXX XXXX states the account was allegedly charged off but charged offs are considered general income by Internal Revenue Services, but the information is still being reported which is inaccurate. XXXX, XXXX, and Transunion all state they do not report income. This information is contradictory and inaccurate. XXXX XXXX XXXX XXXX XXXX has failed to investigate my inquiry but somehow the information has come back verified and accurate according to XXXX, XXXX, and Transunion. The letter I received is proof of deceptive practice and failure to investigate a dispute claim by consumer. I have requested to opt out of this account being reported to my Consumer reports until I receive certified documentation that the account has been charged off by IRS standards. 12 CFR 1016.1 gives me the right to opt-out of the sharing of my nonpublic personal information and I want to exercise my right immediately. Also, 15 U.S. Code 6802 supports my rights to opt out of non-public personal information. Consumer Complaint: So, here 's the rundown. You know that Fair Credit Reporting Act ( 15 USC 1681 section 602a )? Apparently, it tells consumer reporting agencies to play nice, be fair, and respect our privacy. Well, as the consumer, I threw my weight around, reminding them of my rights under 15 USC 6801 Congress insists financial institutions keep their hands off our private info. Now, there's this thing about entities feeding info to credit agencies, calling them " financial institutions. '' Supposedly, they're supposed to follow rules. According to 15 USC 1681 section 604a ( 2 ), if a consumer like me gives written instructions, they can dish out a consumer report. But, here 's the twist the financial institution and the big names, credit bureaus never bothered to get my written consent. So, consider any kind of consent, whether it was spoken, gestured, or whatever, totally cancelled by yours truly. Now, about these big shots not bothering to tell me about my right to shut them down thanks a lot, 15 USC 6802 ( b ) ( c ). All 3 bureaus thought it was cool to toss negative items on my credit report without my say-so, which, surprise, surprise, is against 15 USC 1681C ( a ) ( 5 ). Hold on, it gets better Section 1681s2 ( A ) ( 1 ) A of the U.S. Code screams, " Dont give false info to consumer reporting agencies. '' But XXXX and XXXX missed the memo and are breaking the rule. And then there's 15 U.S. Code 1681e, saying every consumer reporting agency should have their act together with " reasonable procedures. '' They're not really following these supposed " reasonable procedures. '' Last but not least, 12 CFR 1016.7 says I can slam the door shut on their reporting services whenever I want and guess what? I'm slamming it shut now. So, these guys better fix things fast, or they're in for a legal storm.
