Consumer Complaint: I am writing you as the Beneficial Owner of the reporting account, chose-in-action with you as the National CRA and reporting unlawfully converted chose-in-action accounts with the data furnishers, each associated with my social security administration card number, you are the resulting trustee based on the maxim a trust will not fail for want of a trustee. Meaning you are the trustee by default without the need of a formal appointment. As fiduciary, I am witnessing you aiding, abetting racketeer-influenced corrupt organization data furnishers involved in involuntary servitude, peonage, and debt bondage with unfair and deceptive trade practices in violation of the 2022 National Defense Authorization Act. CRAs, like many organizations with user, terms of use, account, and any other public-facing agreements, are crafted and executed by the unauthorized practice of law by a corporation or trust as a systemic-wide custom. As fiduciary, you have not held up to the duty of loyalty, prudence, and disclosure. Currently, there is a breach of good faith and fair dealings with your implied agreement for the use of my personal private information, a breach of trust, a breach of fiduciary duty, and a conflict of interest between you as fiduciary and myself as the beneficial owner of the account. The estate nor beneficial owner of the reporting account benefits from your adverse reporting of any detail, other than paid as agreed or paid-in-full in the revenue-generating reports sold to members and subscription holders known as data furnishers. 12 CFR 1022.142 - Prohibition on inclusion of adverse information in consumer reporting in cases of human trafficking. Failure to block/remove specific adverse information such as payment status is a violation of the FCRA Section 605C.

Consumer Complaint: I am writing to formally dispute the presence of a charged-off account on my credit report. I believe there are inaccuracies and potential violations of the Fair Credit Reporting Act ( FCRA ), specifically 15 USC 1681eb. I have reviewed my credit report, and the aforementioned account is adversely affecting my creditworthiness. I am disputing the accuracy of this information for the following reasons : 1. Lack of Verification : I request that creditor provide verification of the charged-off account in question, including the date of first delinquency, and any other relevant information supporting the accuracy of this entry. 2. Non-Receipt of 1099-C Form : As of XX/XX/2024, I have not received a Form 1099-C ( Cancellation of Debt ) from the creditor for the charged-off debt. According to IRS guidelines, creditors are required to provide this form when a debt is cancelled or forgiven. Failure to do so may violate tax regulations. 3. Violation of 15 USC 1681eb : I believe that the reporting of this charged-off account without proper verification and documentation may be a violation of the Fair Credit Reporting Act, specifically 15 USC 1681eb . I request that the creditor investigate this matter thoroughly. Please provide a detailed investigation into the accuracy of the reported charged-off account, and if it is found to be inaccurate or incomplete, I request its prompt removal from my credit report. Additionally, I request that you investigate the failure of this Creditor to provide the Form 1099-C, as this may have tax implications for which I am not currently informed. I appreciate your attention to this matter and expect a timely response within the XXXX period stipulated by the FCRA. If you are unable to complete the investigation within this timeframe, I request that you inform me of the delay.
