There is a fraudulent account with XXXX XXXX Manage with a balance of {$5600.00} with orginal creditor XXXX. I HAVE NEVER HAD AN ACCOUNT WITH XXXX, i have XXXX XXXX. There is a fraudulent loan with the name of XXXX XXXX for {$990.00}, I have never done business with this company. There are XXXX fraudulent student loans with US DEPARTMENT OF ED for {$3100.00} and {$3100.00}, but i have never attended a college before. Consumer Complaint: I am a victim of identity theft and I sent formal dispute letters and supporting documents to Transunion informing them of the theft of my identity. In the dispute letter, I listed the fraudulent accounts and fraudulent inquiries that are reporting on my credit file, and asked them to delete the fraudulent items and block them from re-reporting per California Civil Code 1785.16 ( k ). This law states : If the victim submits police report to a credit bureau listing the fraudulent accounts, the credit bureau must promptly and permanently block the information about those accounts and inform the credit grantors that the information has been removed. A decision to unblock must defer to documentation the consumer provides from the source or from public records, unless the credit reporting agency has substantial reason based on specific, verifiable facts to doubt the documentation provided by the consumer. California Civil Code 1785.16 ( k ). [ Preempted by H.R. 2622, 205, FCRA 605 ( i ), 15 U.S.C. 1681c ( i ), and by renewal of 15 U.S.C. 1681t ( b ) ( 1 ) ( E ) ]. I provided both a police report detailing the theft of my identity from the XXXX XXXX Police Department and a FTC Identity Theft Report, both of which listed all the fraudulent accounts and inquiries that I was disputing and requesting to be blocked, in addition to a copy of my drivers license. These disputes were sent to Transunion at the beginning of XX/XX/XXXX and the beginning of XX/XX/XXXX. I called Transunion to check the status of my dispute in XXXX and was informed by a representative that the disputes were being processed. After my disputes were processed some of the fraudulent accounts and inquiries that were reported were removed from my credit file, however some of the fraudulent information remained on it. The fraudulent account that is still being reported on my Transunion credit file is from XXXX XXXX XXXX, partial account number : XXXX. The fraudulent inquiries still reporting on my Transunion file are : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX I have called Transunion after submitting my formal disputes attempting to resolve this issue and have this fraudulent information removed from my credit file, but have not been successful in resolving this matter. My rights have been violated as a victim of identity theft. Transunion did not follow the laws stipulated in the California Penal Code listed above by removing and blocking this fraudulent information. I would like to submit this complaint in a last attempt to resolve this matter directly with Transunion before exploring my options with my legal representative. This fraudulent information which is being reported on my credit file with Transunion is preventing me from conducting important personal business matters. It needs to be removed immediately as stipulated by state and federal law.
