Consumer Complaint: I am writing to file a formal complaint regarding the unauthorized reporting of transaction and late payment history on my credit report by XXXX, TransUnion, and XXXX. This action appears to be in violation of the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S. Code 1681a and 1681b. According to 15 U.S. Code 1681a, a " consumer reporting agency '' is defined as any person that regularly engages in the practice of assembling or evaluating consumer credit information for the purpose of furnishing consumer reports to third parties. Additionally, a " consumer report '' is defined as any communication bearing on a consumer 's credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living. However, 15 U.S. Code 1681a ( 2 ) ( A ) ( i ) excludes reports containing information solely as to transactions or experiences between the consumer and the person making the report. Therefore, reporting transaction history on my credit report is considered illegal under this exclusion. Furthermore, the reporting of late payment history without proper verification and authorization is also in violation of the FCRA. As a consumer, I have not provided authorization for the inclusion of transaction and late payment history on my credit report, nor have I consented to such reporting. Therefore, the actions taken by XXXX, TransUnion, and XXXX are in direct violation of the FCRA. I kindly request that the Consumer Financial Protection Bureau investigate this matter thoroughly and take appropriate action to address the unauthorized reporting of transaction and late payment history by XXXX, TransUnion, and XXXX. Enclosed with this letter, you will find copies of relevant documents, including my credit report reflecting the unauthorized reporting. Thank you for your prompt attention to this issue. I was never late, for the consumer reporting agency has assumed a vital role and has a responsibility to report consumer information to the best of their ability with maximum accuracy. I have never been late on payments for the accounts that I Included is a screenshot inside of this complaint on dates of XX/XX/2023 and XX/XX/2023. Please investigate and provide proof with statements showing that these payments were late. If proof cant be provided, I demand that these payments be updated to be paid as agreed on time as they should be due to the fact that I was never late.
