Issue: Unauthorized transactions or other transaction problem

Subissue:

Consumer Complaint: I recently had {$3500.00} stolen from my account fraudulently and to put it lightly, the worst part about my situation was my experience with how TD Bank handled the incident rather than the fraud itself. On XX/XX/2021 at XXXX, I received a call from the real TD bank customer service number ( XXXX is what showed on my caller ID ). The Agent claimed to be XXXX with the TD Bank fraud department. XXXX with TD Bank advised that I had a few suspicious charges on my account from XXXX, New York. He asked for my permission to send these charges over to their fraud department and I said sure. All he needed me to do was reply Y to a series of normal cell phone text messages. At no point during this call did I visit TD Banks website, use their banking app, provide my private information to the caller, or request that funds be transferred out of my account in any way. The call ended with no other actions taking place. Unfortunately, what I did not know is that TD Bank had already granted this person access to my account without my involvement. I have now been told that the criminal used TD Banks XXXX service, a service that I have never used during my time with TD and did not use on that day either. The individual initiated twenty-three charges in total using TDs XXXX service. After the call, I went to check my account and realized something was fishy when I couldnt log into my mobile checking account. So I called the bank using the same number I always use. As instructed by TD, I notified the police of the event and have been working with a detective here in XXXX, MA. I have now submitted three fraudulent claims through TD customer service representatives and sent a record of the police report as well. The representative that I have been in touch with at my local TD branch has even submitted a letter of acknowledgment that my situation is legitimate. Furthermore, I have been calling customer service consistently to check up on the status of my claims and to ensure they have received all pieces of documentation to validate my case. Each time asking for my story to be repeated. I found out by way of calling customer service my claims of fraud have been denied. I have come to conclude that my story had been skewed and altered to fit TD Banks definition of a scam, even though the criminal clearly gained access to my account before ever calling me. TD Banks unwillingness to listen and the skewing of facts has made this a profoundly frustrating and long process.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: This is a complaint with TD Bank in regards to a credit card I have with them. Back in XXXX we missed a payment that was due on XX/XX/XXXX as well as missed a payment that was due on XX/XX/XXXX. We again missed a payment on XX/XX/XXXX but paid the next day on XX/XX/XXXX. So according to my calculations, we were only ever 61 days late for a payment, which is the largest lapse in payment on our TD credit card account. When we called to make the payment on XX/XX/XXXX, the person on the phone informed us of a program called the Re-age program that would help us catch up on our past due balance which was over {$600.00} at that point. We were told that we could split up the payment to {$200.00} a month for 3 months which was the duration of the Re-Age program. Once those 3 months were up, we would go back to making the minimum payment due. Our issue is, we were told over the phone that our new payment due date under the Re-Age program was now going to be on the XXXX of the month for the next 3 months. So, XXXX, XXXX and XX/XX/XXXX. The problem is, they never noted this on our account and we didn't realize that they still had our payment due date listed as the XXXX of the month. We didn't realize this until we checked XXXX XXXX and saw that TD had listed us as delinquent payments for months and months, completely destroying our credit score. We've called TD bank numerous times since we discovered our credit score and not only has our credit score been affected but we were charged late fees erroneously. The frustrating part is, they have no records in their system that this new payment date of the XXXX was discussed, which it was. TD claimed that they would launch an investigation to go over recorded phone calls that we've had with them since XX/XX/2020 to prove that what we are saying is factual. I've repeatedly been calling TD to check on the status of this investigation and it appears every time that no investigation has been launched. If all calls are recorded as they say they are, there would be numerous call where this new payment date of the XXXX is referenced, At this point, TD has done absolutely nothing to correct this and it's affecting us trying to by a house because of the hit our credit score has taken due to TD incorrectly reporting us month after month.

Issue: Managing an account

Subissue: Banking errors

Consumer Complaint: I bank with TD Bank in XXXX XXXX, Florida. In XXXX fraudulent charges were made to my account, so the account was closed and we ( XXXX XXXX and I ) opened a new account with TD. However, we were told the account would still receive deposits for 60 days and then close automatically, nothing more we needed to do. Fast forward to yesterday XX/XX/2021. XXXX and I both had our stimulus checks deposited to the " closed '' account. I went to my local branch first thing in the morning and spoke to XXXX. XXXX then called and spoke to a XXXX, who said the checks were indeed in the old account and he was move them to the new, saying I would see this change tomorrow XXXX XX/XX/2021 ). I check this morning and no deposits. I go back to the branch and talk to XXXX again, and again she calls and speaks to someone from TD. They tell her yes, it is being moved from one account to the other and would take a couple days. But then, in the same breath they tell XXXX no, it was sent back to the IRS. I spoke to a Supervisor for TD and they said legally they can not hold money in a closed account. However, even though I was told it would close automatically, it did not. It has been frozen this entire time which is why it was able to receive the deposit at all. I, just like many others, needed that money badly. It was not a closed account, I went to the bank first thing, I was given false information on several occasions, and they could have moved the funds. Even my local branch is in awe that they sent the deposits back. I want to sue for the emotional, mental and financial stress this has caused.

Issue: Problem with a lender or other company charging your account

Subissue: Transaction was not authorized

Consumer Complaint: Hello, I am writing to complain that TD Bank let a company charge me over 5 seperate times with the amount equally XXXX dollars. It wiped out my account and took my tax return money. I have used this place before but I did not receive the purchase they claimed I made. I have told this to TD Bank several times, I have wrote the company numerous emails requesting actual proof and was provided nothing. TD Bank denied my original claim within a day. That is how I know they did not look into the matter at all. To add insult to injury, they wouldn't credit my account, even temporarily while they figure it out but had no problem taking my money out of my account. TD Bank claims the amount is too high for a " provisional credit '' but that is completely untrue, as they have credited other customers accounts for larger amounts in the past. This is not the time to be withholding someone's money when there is a pandemic going on. I am completely disappointed in TD Bank and I want a resolution now.

Issue: Problems at the end of the loan or lease

Subissue: Unable to receive car title or other problem after the loan is paid off

Consumer Complaint: I have contacted TD Auto finance to receive the title for my XXXX XXXXXXXX XXXX XXXX. I paid a fee to receive my title. I was told it was sent in the mail. I never received my title. Instead the company sent a Lien release termination statement. I took the document to the Department of Motor vehicles in Florida. They do not accept this as a title. I called the same company and was on hold and sent through a continual loop of returning to the main menu. When I finally spoke to someone the employee told me to hang up and keep trying the number again. She then put me on hold and after 30 minutes to call was disconnected. I still do not have a title for my vehicle.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: On XX/XX/XXXX I spoke with Target Card Services regarding a delinquency record posted on my credit file. My account showed a transaction of {$9.00} posted on XX/XX/XXXX. This transaction caused my account, which previously was paid off, to hold a balance for that amount unbeknownst to me. The account went into past due balance for over a month for non-payment. I told the Rep that the charge was not made by me nor anyone in my household. As a result, The Target Card Services Rep suggested that I submit a dispute to the credit bureaus and stated that the information would then be corrected. On XX/XX/XXXX I contacted Target Card Services again regarding a letter sent to me stating the decision they made to decline the dispute made with the three major credit bureaus concerning my account. " Information is correct '' was the result of the dispute. The representative basically said she " didn't think it was fraud '' and declined to update the information. After explaining this to Target Card Services, several times, my dispute was denied. How can I be held liable for an unauthorized charge made on my account resulting in delinquency? I was unaware of the charge as well as the balance. I've been a customer since XXXX and I have NEVER made a late payment. My account is now current as I paid the past due amount ( even though I didn't make the purchase ) to avoid more negative reporting. On XX/XX/XXXX I mailed a certified letter to Target Card Services, again explaining my case. I will attach this letter below.

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: I opened an account with Nordstrom in the fall of XX/XX/2019. I've used the card and made payments. I lost my card and ordered a replacement card, and that card number I stored in my phone with other logins etc. That phone was compromised and several accounts were used without my authorization. I filed a police report and identity theft claim with the FTC. The account was removed from my credit report but later added back. I don't wish to go back and fourth trying to dispute the debt, I'd rather take full ownership of the fraudulent purchases and pay the card off in full. Its now in a charged off state wit several late payments and is drastically affecting my credit report. I want to make an arrange to settle the debt it full.
