Consumer Complaint: The Telephone Consumer Protection Act is a separate federal law that regulates any entity that uses the telephone to do business. It applies to debt collectors, because they often or always limit themselves to phone or mail communications in their efforts to collect debts. Like the FDCPA, the TCPA is a strict liability statute that imposes damages of {$500.00} per call meaning that damages can mount quickly for someone accused of making daily or weekly calls that violate this law. However, the Federal Communications Commission has adopted regulations that clarify when, how, and to what extent the TCPA applies to debt collectors ; so it is important for debt collectors who face TCPA claims to use counsel who is familiar with this area and who knows what might and might not be violations. Consumer Complaint: On XX/XX/XXXX I was called by TD Bank ( XXXX ) XXXX which is an accurate phone number for the bank. I was told that there was suspected fraud on my account and they needed to confirm some of my transactions on my checking account. He asked for the last 4 of my SS # which I provided as this is commonly requested to verify my identity. He then proceeded to recite transactions in my account. Some were valid and some weren't. That is when he started what he referred to as initiating a fraud claim. He provided me with a fraud claim # as well. At this time he told me he needed to send me a account confirmation code to my cell phone as well. When I called TD bank the next day to check on the status of the fraud situation, since I received an email that I had insufficient funds in my account, I was told that they never called me and that someone must've spoofed their phone number to make it look like it was TD bank. At this point I realize that someone presenting themselves as a TD bank rep, fraudulently induced me into supplying the last 4 of my SS # and other information to obtain access to my account. This person obviously stoIe my identity by logging into my account and transferring my money around under the pretense that they were a TD bank representative. I learned from the branch that someone logged in, transferred money from my savings account to my checking account and then sent all of the checking account money by EFT to a XXXX payment. I have never heard of XXXX, never used or set up an account with XXXX and also never opted in with TD bank to be a part of XXXX at all. Both my saving and checking accounts were cleared out. I was instructed to obtain a police report which I did get. How was my user name and password obtained? This is actually the XXXX time with TD bank that I have had fraudulent activity. The first time was unauthorized charges. This time is obviously much worse since my account was cleared out of a total of {$2200.00}. Does TD bank not monitor the location of where someone is logging in from? if so, they would see it was not my usual location. Also, as for XXXX, if I never used their service before and then they suddenly see a payment being sent by someone not enrolled in their service, doesn't that flag something on their end? My last question is shouldn't TD bank and all banks ask you to opt in to XXXX? I find it quite dangerous that if someone gets access to my online information again that they can just sent my money anywhere they want. TD bank is in the process of their XXXX day investigation but I wanted to report this fraudulent inducing incident directly. TD bank is saying that I have a XX/XX/XXXX chance of getting my money back and from what I see, within the laws, they are liable to return my funds. XXXX XXXX of the XXXX XXXX Police Dept ( XXXX XXXX, NY ) provided a Central Complaint # XXXX and said my " identity theft report '' will be ready in 3 to 5 days.

Consumer Complaint: On XX/XX/22 my mobile device an XXXXXXXX XXXX XXXX was stolen. I contacted XXXX only to fine the device I insured with XXXX XXXX + did not cover theft. ( Why would anyone buy insurance that did not include theft ( Guess I should have read the 20 page disclaimer ) In any case I cancelled the the subscription, which I received a confirmation email from them. Unfortunately I have continued to be billed by TD Bank XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) which does the billing for XXXX for this service. I have spent hours on the phone on two occasions getting passed from customer representative to customer representative with no progress. I disputed the charge and was notified by XXXX that the charging company has to remove the disputed charges which TD Bank has not done and are now reporting these charges as delinquent on my credit report. A short while ago my credit score was at XXXX. It is now at XXXX due to these erroneous charges from a subscription that was cancelled on XX/XX/22. The current amount in collections is {$47.00}. I have sent proof of the cancellation to TD Bank customer support and to XXXX with no resolution. NOTE in the screen shot from my credit report the billing dates past due compared to the cancellation date in the email.

Consumer Complaint: I have encountered what looks like a deceptive practice in how TD Bank runs a 0 % promotional interest rate for new purchases. The statement does not include info about the promotional rate or indicate when the rate actually ends. My request to TD bank for this information did not produce a full answer, and I ended up being charged some interest I was not expecting to be charged. The statements include an " IMPORTANT MESSAGE '' at the bottom of the first page, but it refers to a section of the payment information block that doesn't exist. All in all, I think this is rather deceptive. I wound up being charged {$51.00} in interest that I think was not properly charged.

Consumer Complaint: Accounts were opened under my name by TD Bank. I called several times spoke with customer service and fraud/security. Accounts were to be closed. Then debit cards were mailed to my previous address and forwarded to me. No fraud alerts or info was provided to XXXX. As a result there has been a failed attempt with XXXX XXXX and account opening at XXXX XXXX where 2 small deposits were made to my current bank account with my credit union. I had to place a freeze on my XXXX and the 3 major credit bureaus to try to protect myself from any further fraud. TD Bank was obligated to alert XXXX of this event to block any further incidents. Because I was not their member no responsibility was taken and I am having a trickle affect as a result. There has to be an accountability to financial institutions to protect consumers from becoming victims of theft. The thieves are more advance than multi billion dollar financial institutions.
