Consumer Complaint: I was placed on a forbearance relief program as a direct result of COVID-19 by Select Portfolio Servicing ( " SPS '' ) on XX/XX/XXXX. SPS is the mortgage servicer for the lender XXXX XXXX TRUST, MORTGAGE-BACKED NOTES. Upon exiting this forbearance agreement, I was placed into foreclosure on XX/XX/XXXX. SPS delayed my modification application by 5 months routinely rejecting the paperwork I initially submitted on XX/XX/XXXX, and not acknowledging receipt of all required forms received. My appeal for a modification has also been denied for the reason that the servicing agreement between the lender and SPS does not permit home retention options to be provided for my non-federal loan even though they promote home retention options on their website for those affected by COVID. The portion of that servicing agreement is not being disclosed citing it is a proprietary legal agreement. I have been impacted by XXXX where I experienced one of the early cases of the XXXX resulting in being hospitalized and absent from work for a total of 10 months between XXXX affecting my income which caused me to become delinquent. Even though I have been impacted by XXXX, my lender is unwilling to work out a repayment plan through the Connecticut XXXX XXXX so a law date could be set for the transfer of property shortly. SPS is aware I can afford to pay the monthly mortgage payment now that my health has improved and is still uncooperative with offering any home retention solutions.

I have waited the legal Thirty ( 30 ) days required by the State of Delaware and State of Maryland. I now want a full release of the lien ( s ), satisfaction of lien ( s ) release and full confirmation that my property is free and clear with the XXXX XXXX of Delaware - Recorder of Deeds office. This has gone on way to long and I will not wait another day to have this completed as it only takes a couple of minutes for Select Portfolio Servicing Inc. Consumer Complaint: SPS has been very fraudulent and dishonest with me on several occasions. 1 ). On two occasions when I have written to enquire of dishonest activities, I have received letters from SPS stating that I called to state I was struggling financially. SPS will then offer more 'fishy ' deals rather than reviewing the complaints. This is very dishonest because I never called SPS. 2 ). I have asked twice for a payoff amount to my mortgage and I have been given two different quotes with a difference of several thousands of dollars 3 ). SPS has on several occasions without adequate verification dishonestly charged fees and Escrows of several thousands of dollars to mortgage accounts. This is so wrong I am sincerely asking for a thorough audit of this company to review its financial irregularities. Please see attached.

Once the plan was over I was told that I do not qualify for any mortgage assistance after and the lump sum has to be paid or else I need to go into foreclosure or sell my property. Consumer Complaint: XXXX Loan # XXXX Re : Short Sale To Whom It May Concern : I know that XXXX XXXX is the investor and not the servicer on this loan, but I am doing all that I can to expedite this matter as it is extremely time-sensitive. With all due respect, I urgently need the short sale approved so we can move to close escrow. It was just approved at XXXX good through XX/XX/2022. That buyer came down with XXXX and was hospitalized. I submitted the backup offer at XXXX. Your BPO expired and you did a new one and somehow increased the value by almost {$100000.00}. I have sent you a higher offer of XXXX and the net amount to SPS and the investor is now over 90 % of current BPO valuation. The buyers have paid a decent sum of money to extend their rate and lock it in. They have sold their house to buy this one. We are all waiting on SPS ( and XXXX XXXX ) and the short sale approval letter to move to close and they call me every day for an update, day after day. RESPECTFULLYwe just need the short sale approval letter so we can move to close and get this bad debt wiped off your books. The house needs {$300000.00} of work, mold remediation, and construction to make it livable. Despite current sales in the area, the last BPO is incorrect and the BPO prior to this one is exactly what this house is worth. THAT SAID, the buyers have agreed to raise their offer by {$25000.00} to {$970000.00}. SPS will not tell me what they need to net, which is such an imbecilic practice and makes the short sale process, which is already long and tedious, even longer with unneeded offers and counter-offers ; just tell me what you need! Even your own reps in the Ombudsman Dept and Short Sale Dept agree with me on this point. It makes no fiscal common sense to play the guessing game on what the investor needs to net in this market. PLEASE escalate this short sale file and please issue the short sale approval letter in the new buyers name so we can all move to close. The buyers have a ticking clock on their rate, are living out of suitcases, and I do not want to start over from square one on this short sale. Everyone is committed to closing, ASAP. Somehow Select Portfolio Servicing added an additonal {$2900.00} to the loan as attorney fees for a foreclosure which was dismissed one year prior to the transfer of my loan. I had appeared before Judge XXXX XXXX XXXX, Circuit Court oXXXX XXXX XXXX, Illinois, chancery Division Mortgage Foreclosure Section on Monday, XX/XX/XXXX for a foreclosure preliminary hearing and was referred to XXXX XXXX XXXXXXXX XXXX XXXX attorney for XXXX XXXX XXXX XXXX. After contacting XXXX XXXX XXXX in writing the foreclosure case was dismissed on XX/XX/XXXX, eight months prior to being transferred to SPS. ( See attached XXXX XXXX XXXX. XXXX. ) Also, loan deferrment agreement between XXXX XXXX XXXX and XXXX XXXX XXXX list attorney fees at {$470.00}. ( See attached ) I also contacted XXXX XXXX XXXX who attest fact that only the loan amount of {$49000.00} ( the loan balance ), and {$470.00} ( attorney fees ) were transferred with the loan and they did fax me a copy of that transaction. Consumer Complaint: This complaint is related to the difficulty in obtaining a deferral agreement or modification agreement from Select Portfolio Servicing Inc and XXXX. I am in the process of refinancing with a new mortgage lender to avail of a lower rate. Everything was going well until I came across this problem with obtaining this specific document. I have contacted SPS multiple times since early XX/XX/XXXX. I was told to contact my former Mortgage lender XXXX ( an entity of XXXX ) who originally issued this deferral. XXXX sold my account to SPS in XXXX. I have contacted XXXX in hopes that they will be able to provide me this document, but to no avail. Both lenders denied that they have this document. Meanwhile, this back and forth process with these two companies, SPS and XXXX, caused my refinance to be put on a halt. As a result, I may lose my chance for a better rate. I am hoping that with your help I will get a much faster response and a positive outcome. Thanks.
