SPS engaging in Mortgage Service Abuse, Unfair Business Practices, Dealing in Bad Faith with deceptive and misleading practices causing a great deal of senseless stress and mental anguish by their action by feigning a Loan Modification and engaging in attempted equity thief by dragging their feet designed to increased cost and fees and unjust enrichment. SPS acted in Bad Faith by knowingly and purposely created a repayment plan the XXXX XXXX could meet. In XX/XX/2020 the homeowner contacted SPS to inquire for mortgage assistance and was told by an SPS representative that he would be placed in a 90 day no play plan due to Covid- 19 and that at the end of the plan the loan would be adjusted /modified by the recommendation of SPS. In one conversation with an SPS the callus representative the representative stated you dont own this house ; it is the Bank property. Causing the homeowner severe stress necessitating the XXXX session of XXXX health homeowner to XXXX counseling sessions. In XX/XX/2020 the homeowner attempted to resume the regular monthly PITI payment of {$2700.00}. However, the payment was rejected by SPS presentative saying that the payment needs to be made by mail in check or money order only, causing additional fees and delinquencies. Their Bad Faith behavior tactics of stalling delaying, deflection and denying thereby not allowing for the homeowner to receive a fair and just loan modification review. Next, the Proprietary Trial was denied because Insufficient Monthly Payment Reduction we could not reduce your principal and interest payment. However, you provide any NPV inputs, showing what the existing principal and interest payment is, what interest rate is, what principal and interest ( PITI ) payment is {$1900.00} vs the proposed {$2000.00} PITI payment, a mire difference of {$94.00}. We demand that SPS provide the calculation for income use to compute the {$7400.00} used by SPS as the homeowners income is an average of {$8500.00} a month, additionally request a review for any other programs as well as Proprietary Trial Modification. Upon appeal SPS sent correspondence dated XXXX XXXX XXXX Repayment Plan as follows : Total to Reinstate {$61.00}, XXXX Regular Pay Due During Plan {$32000.00} = 12 payments of {$2700.00} Total Repayment Plan Amount {$94000.00} Plan Payments 12 12 monthly payments of {$5400.00} Plus, the regular monthly payment of {$2700.00} Total monthly pay of {$8100.00} While in the attached the monthly income stated in SPS correspondence in response to CFPB Complaint # XXXX dated XXXX XXXX shows a monthly income of {$7400.00}. Consumer Complaint: My husband and I purchased my family home where I was born and raised in XXXX. In XXXX I was divorced and the home was solely mine through the divorce as a single mother. My mortgage was with XXXX XXXX. I filed a quit claim deed removing my ex husband and attempted to refinance to remove him from the mortgage. While refinancing Select Portfolio Servicing ( SPS XXXX ) bought my mortgage. They advised me they were not a bank but only a servicing company and I could not refinance through them. In the meantime I lost my job and they offered me a mortgage forbearance during XXXX. Not only did I lose my job but my daughter was schooled from home like most kids during that time and all my bills went up including electric, internet, food, etc. I was then advised after several months of missing payments that they forbearance was not possible because at one point in time we completed a modification through XXXX XXXX and there is now a balloon payment on the back of my mortgage. Because of that they could not put my missed payments on the back of my mortgage which meant I was misinformed by SPS in the beginning. They are now attempting to foreclose on my property because I am in default of my mortgage. I have contacted them several times for a resolution to this matter only to be told the only resolution was to pay more than double mortgage payments from {$1100.00} a month to {$2300.00} per month for one year. That is not possible. I resumed my mortgage payment in XXXX of XXXX and have been paying on time ever since. Upon googling SPS XXXX there are sooo many complaints out there from people with the same situation. Meanwhile in XXXX I applied to the XXXX XXXX XXXX XXXX XXXX XXXX XXXX for help with what I owe my mortgage company. On XX/XX/XXXX PHAF contacted SPS Servicing to get documentation on what was owed as I was approved for the process and SPS has failed to get back to XXXX to verify what is owed. They have contacted them several more times only for no one to once again get back to them. I have contacted my state representative for help with this matter ; XXXX XXXX and they advised me to file a complaint which is what I am doing now. They think it is very concerning. Last week I received an intent to foreclose letter as well as a copy of a letter that was sent to my homeowners insurance company with the intent to foreclose letter as well. XXXX has advised me once again they sent letter and made calls with no response. I now owe attorney 's fees on top of what is owed because they are not cooperating. PLEASE HELP ME!

Consumer Complaint: Since XXXX of XXXX, after hardships related to COVID and abandonment, ( now 3 years ) of my spouse, I started to experience financial hardships and struggled to keep up with my mortgage. From the beginning of this hardship period, I've been mislead, jerked around, been given little to no help, offers to rectify and aide my situation. I've never been clear on anything talking to under qualified and limited information customer service rep. 's at SPS. I was not offered any programs or given any information about services I could potentially qualify for. I made it clear I did not understand where I was at and fees or penalties accruing on my mortgage. I felt at that point I was severely jerked around and taken advantage of as my home has a good deal of equity I feel it became predatory at that point and their object was to make it difficult for me to gain rights to my home forcing me out. I asked about a forbearance, and from XX/XX/XXXX until XX/XX/XXXX I was unclear and did not even know if I was in forbearance until my daughter in law called and spoke for me trying to clear up confusion and at that point we then found out they had placed forbearance in place XXXX XXXX. My daughter in law had just weeks before gone on the SPS website submitting a letter to request help and requesting a loan modification further explaining my situation. I did not hear from SPS, no one let me know any consideration of anything was being made. No one offered me options, no one discussed anything with me further to see what would benefit me or what I could afford or anything. Instead I am told I have 3 months to figure it out and balloon payment would be due. I asked about the short time frame and got a full run around of a conversation I was completely lost in and very confused. They were impatient and not willing to take the time to explain procedures or benefits to programs that I would be able to afford and keep my home. I continuously receive phone calls wanting money they know I cant possibly come up with as this has been stated from the beginning. I get statements that are confusing with large chunks of money being demanded and still not options or help of any kind. This XX/XX/XXXX, while believing I was at the end of forbearance, I found out that they had drained my entire bank account of the only monies I receive to live on from Social Security of {$850.00} a month, ( I am suing my spouse for support and have started court proceedings last month. ), leaving me not a penny, no notification they were going to do this leaving me completely devastated not able to buy food, medications needed, nothing what so ever. So I feel nothing has been accomplished other than their intentions of forcing me out of my home and taking advantage of a devastated senior and bullying me for the rights to my homes equity. I pleaded my heart out to them explaining my devastation, needs, and to hear absolutely nothing was not only embarrassing but devastating as it was my last hope. This has caused great stress further causing complications to my health and suffering.

Consumer Complaint: I applied for a loan modification with Select Portfolio Servicing ( SPS ). I used XXXX XXXX XXXX ( XXXX ) as my mediator. I have been trying to find help for over 10 years. XXXX contacted SPS in XXXX of 2021. My interest rate would change from 4 % to 8.85 % in XXXX of 2021. My monthly payment would go from {$1100.00} to {$1900.00}. Plus I have {$100000.00} in back interest due from my loan with XXXX who sold the loan to XXXX XXXX. The cause of back interest is related to the loss of my job and my wife 's job due to XXXX ( as descibed below ). My wife and I refinanced the mortgage XXXX years ago to pay for her XXXX XXXX XXXX XXXX XXXX. The refinance was with XXXX. This is all prior to the XXXX XXXX XXXX. I stayed at home with my wife during her XXXX for over a XXXX year period. I was XXXX XXXX XXXX months after my wife XXXX I did not find a job for XXXX years. In XXXX of 2021, XXXX spoke with SPS to put my mortgage into forbearance. My credit score dropped from XXXX to XXXX by XXXX because SPS did NOT report to the credit services/bureaus that I had was in forbearance. SPS offered to keep my loan interest at 4 % if I rolled the {$100000.00} into the total loan of {$310000.00} ( value of house is {$210000.00} + {$100000.00} ). If I accepted the offer XXXX would be paid {$6000.00} for their services. I refused the offer. XXXX then offerd to do a forensic audit for {$4700.00}. I paid for the audit and an expert witness statement. They found that there are illegalities with the processing of the mortgage exchange beteeen the various finance companies. XXXX believes that I can use the forensic report as leverage to negotiate with SPS or to sue the finance companies. What I want/need : someone to review the forensic report, if their findings are accurate, I want to file a lawsuit against XXXX, XXXX, and SPS finance companies regarding all the misconduct and possible predatory loan practices involved. I am only two months behind, I paid in XXXX, didn't pay in XXXX and am unable to pay for this month ...... That being said. I am also tring to get CA Mortgage Relief. I applied. Then I check and without out notice I find out that my loan servicer decided to tell CA Mortgage Relief that I was not deliquent in my payments and therefore they canceled my application. I mean make up your mind SPS. Right? So, please help this XXXX indvidual who is waiting on the XXXX termination appeals process to get payments in order to pay back their loan servicers. Since I don't have income they refuse to offer me forbearance, but you should re-read the other XXXX complaints I have already made. Also, if you have tried to call or anything like that my X cloned/hacked my phone, so I am not guranteed any calls. His name is XXXX XXXX and his wife XXXX XXXX is equally guilty. Consumer Complaint: I am writing this letter to get support and help to stop the foreclosure on my mortgage. Until XX/XX/XXXX I was unemployed due to XXXX. I lost my job in XXXX of XXXX. I received unemployment compensation for XXXX year, which ended in XX/XX/XXXX. During the time I received unemployment, I was unable to pay the full amount of my mortgage which was {$1000.00}, so I paid the interest/escrow on my mortgage which was {$650.00}. In XXXX of XXXX, I informed the mortgage Servicing Company ( Select Portfolio ) that my unemployment ran out and I was not able to pay the interest/escrow on the mortgage. They offered me a request for Mortgage Assistance during this time. As I explained to them, I did not have any income and could not provide banking statements because they would not show any income information. I could provide an electricity bill and water bill. The relationship XXXX that I spoke to at that time told me my best option would be to apply for a XXXX relief forbearance. I was granted forbearance from XX/XX/XXXX to XX/XX/XXXX. However, that did not cover the entire span of time for which I needed assistance. I needed assistance from XX/XX/XXXX to XX/XX/XXXX. The forbearance allowed me to temporarily suspend my payments, but it did not allow me, as the borrower, a chance to benefit from other XXXX relief programs. Most people who were in this situation were given money towards their mortgage or their payments were put on the back of their loans. Instead, the mortgage servicer for my account took the 7 months of past-due mortgage and put my house in foreclosure. It didn't matter that I requested or applied for Mortgage Assistance, and I handed in all my documentation. It didn't matter that I showed them I was adversely affected financially by XXXX, and I did not have work during that time. It didn't matter that when I got a job in XXXX of XXXX that I paid my mortgage every month on time. Additionally, since I've taken out this loan in XXXX, my mortgage balance has not decreased from {$170000.00}. That said, I believe this mortgage XXXX XXXX his charged me fees for things that I should not have been charged for. I feel like I have been taken advantage of, to the degree that I believe I am the victim of fraudulent practices being levied against me. There is no way that I should owe {$170000.00} for an original loan that was {$90000.00}. I took a second mortgage out on this home in the amount of {$130000.00}. Again, I am not understanding how I now owe almost double what the original loan was. I would like to file a formal complaint against this servicing company, and I no longer want my loan managed by this company. I also need assistance in finding another lender to refinance this home for a better interest rate. I do not want to be under a mortgage XXXX XXXX. I really need some help and support to manage this situation as I am in NO WAY attempting to default on my debt. I fully intend to pay my debt, as has been shown by my attempts to continue to pay even when unemployed, as well as my resumption of full payments once I resumed employment. It is egregious for this company to be gouging me the way they are, putting myself and my daughter in jeopardy of being homeless and being unwilling to work with me when the entire country was negatively impacted by this horrible pandemic. Any assistance you can lend would be greatly appreciated. I was discriminated against because they put my house in foreclosure while I was working on a mortgage assistance program. The mortgage lender did everything they could to take my house instead of providing programs to support me.
