Consumer Complaint: Made several attempts with my loan servicer " SPS '' " Select Portfolio Service '' for loan modification after exercising my rights as per the Cares Act-Freddie Mac Loan to request mortgage loan relief -after Forbearance. I have maintained my current normal monthly payments after the allowed 18 month forbearance period. Repeatedly I have requested a payment " Deferral Plan '' Every response from the Servicer has been a denial, with no explanation other than I don ' t meet the requirements. Instead I have been offered a {$82000.00} -12 month repayment plan with a balloon payment at the end. Needless to say I can not afford I believe the proposed plan is in contradiction to what is afforded me under the Cares Act Effective as XX/XX/22 the servicer has sent me " Notice of Default as well as " foreclosure referral letter '' I simply would like a " Deferral repayment Program and the Default notices retracted

Consumer Complaint: I had a Mortgage for more than XXXX years with XXXX XXXX XXXX, the XXXX of XXXX my mortgage was tranfered to Select Portfolio Servicing Inc. XXXX. I have been working with The Va Mortgage Assistance Program to help keep my account up to date. My job was severely affected by the outbreak of XXXX AND XXXX XXXX XXXX XXXX XXXX XXXX XXXX. VA Mortgage Assistance Program has been great! for the last XXXX months they have [ along with myself ] tried to reach out to them to simply get the amount of past due payments in order to send the fund to their company but they will not respond. The State of VA calls XXXXtimes per week and i call more than that. I have spoken with numerous people but nothing has changed. My family needs whatever help you may be able to offer.

Consumer Complaint: I had SPS as my loan servicer for 15 years. I refinanced my loan in XXXX of this year and SPS was paid in full. I contacted SPS in regards to the unearned interest that is due to me by law. They responded that they were forwarding my letter to the proper department and I have not heard from them since. They are required by law to remit the unearned interest to me within 5 days. SPS has failed to do that or respond to my request.

Consumer Complaint: The mortgage servicer Select Portfolio Servicing, Inc. ( SPS ) provided a trial modification dated XX/XX/XXXX. In which the first trial payment was to begin on XX/XX/XXXX. XXXX ) Select Portfolio Servicing, Inc, ( SPS ) was made aware on XX/XX/XXXX, that the our financial situation had changed and the trial payment of {$2900.00} would not be affordable and we requested a new review for a lower payment because of the with the current information regarding our lower income. XXXX ) Select Portfolio Servicing, Inc, ( SPS ) however provided a denial letter of modification and then stated that would not review the file for a reduction in monthly payment as previously stated. Instead, SPS entered a sale date for XX/XX/XXXX, and continued to refuse any and all options for loss mitigation assistance. XXXX ) We however never turned down modification but requested a second review which SPS stated they would provide. SPS stated they would be willing to look at other options However, they have to this date continued to deny any assistance review. I believe SPS has decided to foreclose on our home because they think they can turn a profit and are stripping us of our equity, by forcing a foreclosure sale date. XXXX ) The actions of Select Portfolio Servicing, LLC are consistent with XXXX XXXX. Dual tracking occurs when a mortgage servicer continues to foreclose on a borrower 's home while simultaneously considering the borrower 's application for a loan modification or other foreclosure avoidance options. This practice violates federal law ( 12 C.F.R. j 1024.41 ) which ; The Consumer Financial Protection Bureau, which was established by the Dodd-Frank Wall Street ReforXXXX and Consumer Protection Act of XXXX, issued mortgage servicing rules that, after being codified into federal law, went into effect as of XX/XX/XXXX. Among other things, the rules restrict dual tracking. XXXX ) SPS has established a history of misleading practices pertaining to CFPB guidelines and Dodd-Frank Act which I have detailed in a Qualified Written Response.

Consumer Complaint: I am currently in the process of selling my home and I received a previous payoff amount of $ XXXX which was reduced thanks to your help! However, I received a payoff quote from the mortgage title company which stated that I still have a payoff amount of $ XXXX even though almost $ XXXX was forgiven. I contacted my relationship manager with Select Portfolio on XX/XX/2022 at about XXXX eastern time and I was told about the breakdown but there was almost $ XXXX in fees and other services included and when I inquired about the other fees I did not receive a definitive answer. I was told the fees came from my bankruptcy attorney which makes no sense because he was confused about the fees as well. There is also a $ XXXX XXXX on the property from Select Portfolio that was not filed in the bankruptcy but they are now seeking payment for, I assumed the $ XXXX was 20 % of the mortgage and included with the $ XXXX payoff balance from before. Select Portfolio Servicing is making it difficult for me to sell my home and time is running out for me to sell as the closing date continues to change and I'm afraid the buyer will walk away if we continue to delay. My question for Select Portfolio is where is the additional $ XXXX in fees and other services are coming from and why was the $ XXXX XXXX not filed in the XXXX XXXX so that it could have been paid off. I assume this was included in the $ XXXX mortgage payoff and this company is attempting to double dip. Thank you for your assistance!

Consumer Complaint: Here is the letter I sent to the Ombudsman at Select Portfolio Servicing : Dear SPS Ombudsman, I am writing you at this time to make clear my intentions for withholding my mortgage payments. I have been trying for over ten years to ascertain the true and legal note holder, who, based on the original XXXX XXXX Mortgage XXXX XXXX, Deed of Trust, that I signed on XX/XX/XXXX, has been assigned or retains the right to legally collect my mortgage payments, that I have been sending to SPS monthly. In XXXX of the many QWRs that I have mailed you for over ten years, you repeatedly state this entity as the note holder : XXXX Bank, XXXX, successor trustee to Bank XXXX XXXX, NA, successor in interest to XXXX Bank, XXXX, as trustee, on behalf of the holders of the XXXX XXXX XXXX Certificates, XXXX XXXX XXXX is the owner of the account, and SPS is the mortgage XXXX of the account. My read of that long list is that you are claiming that the XXXX XXXX XXXX XXXX is the owner and holder of my Deed of Trust XXXX The problem with that claim is that based on a thorough investigation by a professional chain of title investigation : Based on the most recent XXXX XXXX XXXX XXXX remittance report, your ( my ) loan is not included or reference in this XXXX! It simply is not there! I signed The Deed of Trust, ( the note ), on XX/XX/XXXX was with XXXX XXXX Mortgage XXXX XXXX XXXX ( XXXX ) According to the California XXXX of XXXX, this business entity ( AMN ) was suspended or forfeited by both the XXXX of XXXX and XXXX Tax Board as of XX/XX/XXXX. On XX/XX/XXXX, the name XXXX XXXX Mortgage XXXX XXXX XXXX was surrendered whereby they were not licensed in the State of California at that time. The DOT was written on XX/XX/XXXX, XXXX YEARS AFTER THEY CLOSED BUSINESS! Based on the above and many less-than-legal assignments, the true and legal owner of my note is murky, possibly unknowable, or no longer exists! My fear is that I XXXX be paying the wrong entity or that my loan no longer belongs to anyone. Or worse, the true and legal owner of my mortgage emerges and demands XXXX years of payments that were misdirected. The actions I am taking are out of desperation to find the truth about my mortgage. If and when SPS or anyone can provide a legally justified mortgage account where you can document the disbursement of my payments and debits to either the XXXX XXXX XXXX or any legal successor I will gladly repay all of the missed payments and resume my monthly payments regularly. Consumer Complaint: Good morning, My complaint is against Select Portfolio Servicing , Inc . Since XX/XX/XXXX I've had homeowners on my residence, my homeowners insurance expires XX/XX/XXXX of XXXX. Prior to XX/XX/XXXX I had forced insurance on my residence via SPS. Once I secured my insurance for the year SPS should have stop the forced insurance. They did not instead they placed hazard insurance on me/mortgage of {$2500.00} per year which comes out to {$200.00} per month. How many different insurances do I need for a townhome? The HOA has what's known as a master insurance on all units? so why am I paying for Insurance I don't need or require? All this was explained to SPS yet they still chose to ignore my complaint. My insurance provider sent SPS a copy of my insurance and they acknowledgement receiving it but still continue to charge me for hazard insurance. From the month of XXXX until current XXXX SPS owes me {$200.00} x 6 months = {$1.00}, XXXX I would like my money refunded and not have to continue to pay hazard ins. there is also the matter of when my mortgage was modified my attorney advised then then mortgage company to take the PMI off my mortgage. SPS fail to do so. So from the time they were advised to take off the PMI I would like that money back as well.

Consumer Complaint: In XXXX little many Americans my wife and did a forbearance on our home. She had lost XXXX of her jobs and I was not able to work. The whole time we were in forbearance we were told at the end of the Forbearance that there would several options to help us out. Not 1 time was I every told that at the end I would have to pay a lump some amount to retain our home. I was told my wife and I didnt make enough money to support the motifcations. I was told they could possible put the amount hold to the back of the loan or even do a post forbearance, but none of this is done. They arent trying to help at all. Im currently on XXXX and feel like we are now being taking advantage of, because we have a house worth $ XXXX and we owe {$230.00}, easy quick turn around to just foreclose. Also, applied for XXXX XXXX XXXX XXXX!! After fighting since XXXX I finally have started receiving my XXXX in XXXX of XXXX. ( {$2600.00} ) now according to my application that I applied for, we were declined because we make {$1100.00} to much. At the time of the forbearance, XXXX, ect I wasnt receiving help! But its not fair to use income I just started receiving, for issues that occurred when I wasnt receiving anything. Its not right. If would have applied in XXXX or XXXX before I received my XXXX we would have been approved! Thats not right! Someone needs to help get this straight! They are going to kick a XXXX father and his family out of their house during the holidays! I can afford to make my parents.

Consumer Complaint: In XXXX I received a modification from my mortgage lender. When COVID came, I tried to stay current with my payments, but I could not and defaulted in XXXX of XXXX. I called my lender for assistance and was told to go on the website and put in my loan number and fill out the application. When I put my loan number in an application came up that was 2 pages and did not ask any income or expense questions. I filled out the application and sent it in. I then received an approval for double my current payments and then a balloon payment of {$29000.00}. I ran into a hardship from the pandemic and now I am afraid I am going to lose my house. I can not afford to double my payment from {$1500.00} to {$3100.00} and then come up with almost {$30000.00} in 12 months. I just want to be able to get caught up from the pandemic and resume my payments that were affordable. I feel as though my lender is putting me in a position to fail and I would like to keep my home.
