Consumer Complaint: We closed on a mortgage with a prepaid escrow account that was well over-funded. The servicing was transferred to SPServicing before our first payment was even due. I realized our escrow was over-funded and requested an escrow review. They did the review to find the same conclusion and said a check would be mailed. They claimed the check was mailed XXXX via regular mail but has not been mailed ( and verified by them ) and today is XXXX They claimed property taxes were paid XX/XX/XXXX but were never paid. I paid them myself so as not to be late. As of today, they claim they are talking to escrow to get the money but they already told me the check was cut but not voided ... and just needed to be mailed. I requested XXXX as the check is for XXXX XXXX I have been on the phone with them over 6 times since XXXX XXXX XXXX trying to get this resolved. The escrow account no longer shows the overage and is correct, but the check is still not in my possession over a month since they said it was mailed. I have lost opportunity to use that money for investment, interest gain, and life ; not to mention it is not theirs to keep. The taxes, had I not known, would be delinquent causing fees and interest to be paid and a lien if we never did anything about it. They rarely let me talk to anyone other than the rep that answers the phone. I'm not sure if this is illegal but feels like it.

Consumer Complaint: We have been trying to work at length with work with the company. We were heavily effected by XXXX XXXX and have been actively working to get all of our finances put together after the absolute devastation of it. My wife also has a rare hereditary bXXXX XXXXXXXX that requires routine XXXX XXXX XXXX XXXX during the heaviest part of the pandemic shut down we were unable to get some of these done and with alot of XXXX XXXX in our area leaving or quitting because of not wanting to get the XXXX. We have had to start all over with some and the rest are over XXXX hours away so it poses an extra bit of stress with work and being able to make/take phone calls to handle things. We have had some forbearance options in the past. I was not paid for a year due to the company shutting offices down because of covid. We have been in constant contact with the company and were told that we could get the account modified. During some of this process as we continue to send in all requested information and contact those we were told to do so. In the midst of these the note holder has changed several times between XXXX XXXX XXXX and XXXXXXXX XXXX in UT, CA, etc. We never know who we are working with. We have been told over and over we qualify- I served in the XXXX XXXX XXXXXXXX and they have said that is part of why we qualify. We work with someone at length and then try to follow up and are told that they no longer work there and that there is a " high turnover '' - how this is something that we should be punished for when we are acting in good faith providing all that is asked and even made recent payments. One of which was sent via wire and were returned minus the total amount that was sent. They have two payments that have somewhere in their suspense account. Have been battling for over a year - We just want to be current and pay our monthly amount and have them follow through. They have been very inconsistent. They really need to honor it

A rep ( XXXX ) stated that this is because I don't have escrow in my account. I asked how is that not possible. She stated that she could not explain the increase and had no knowledge of how to explain. She also stated that " several '' calls came in regarding the extremely high increase and that she was not given a reason to give. She also stated that there has been numerous complaints about Select Portfolio 's practices.

Consumer Complaint: This is in reference to complaint # XXXX. Where SPS states that the mortgage payment of {$780.00} does not include Flood Insurance. In correct it does. I have attached several documents that prove that SPS is charging me for Flood Insurance. If you go to Table 3 you will see the property taxes for XXXX which are {$160.00} Plus the payment of {$560.00} which is Principal and Interest. bring the total mortgage payment to {$720.00} as seen on SPS History spread sheet from XXXX. Then on XX/XX/XXXX SPS starts charging me {$780.00}, when I asked they stated it was due to Property Taxes going up. Incorrect! the Property Taxes from XXXX ( {$160.00} ) to XXXX ( {$160.00} ). As seen again on table 3 and Table 4. so if you add {$560.00} + $ XXXX {$720.00} which is correct for the monthly mortgage payment. Now for XXXX you add $ XXXX XXXX XXXXshould now be the monthly mortgage payment. So if you take {$720.00} - $ XXXX {$55.00} difference. Which by the way when you add $ XXXX $ XXXX {$780.00} which means SPS is adding Flood Insurance to the monthly statement. Which clearly shows that SPS has to adjust my monthly mortgage payment from {$780.00} to {$720.00}. because to reach the payment of {$780.00}. Look at page where it states SPS flood Ins policy {$1800.00} for 12 months, which will then be the difference of {$55.00} per month. so how SPS state that {$780.00} is correct. When based on their XXXX paper work it states it cimpletely different???

Consumer Complaint: After my Mom passed away, her family inherited her home. During the Probate processXXXX XXXX XXXX XXXXXXXX, the lender, transferred the mortgage servicing to Select Portfolio Servicing ( SPS ). However, after the transfer, SPS claimed that we were not authorized on the account and denied us access to the account, including payment information. Consequently, they initiated foreclosure proceedings on the home. Despite our efforts to obtain information on the payoff amount needed to rectify the foreclosure debt, SPS has refused to provide it. They instructed us to contact their attorney for the redemption period cure amount, but their attorney has not been responsive. It seems they are deliberately delaying the process, preventing us from resolving the debt and retaining our family 's home.

I have been sick for years as a result I am not privy to the details pertaining to the mortgage or financials regarding the house. The house was bought by the lender in XX/XX/XXXX. We asked for an extension to reorganize our assets and have the ITS remove the lien against the house. My husband worked in other states and overseas because he was an independent contractor. The result was that he did not pay some of his taxes in the US. Whike trying to rectify that with the IRS, I had it had skin since XXXX, I was hired by the county of XXXX on XX/XX/XXXX. I was not able to proceed to work after three months of training. I XXXX go on XX/XX/XXXX. In the meantime we sought help from an Attorney to help us remain in the home shoe we try to figure out how to vacate and where we would live next. The house was our only investment. We couldnt even refinance. I am the administrator of the estate, We need certain assurances and to legally occupy the house with known limits as to how long we can be in the home. Also my husband told me that he paid off the mortgage and the house was supposed to be a safety net for our kids.

Consumer Complaint: I am in receipt of SPSs Corporate Advance History, claiming charges/fees for FC ATTY FEES, PROP INSPECTIONS, PROP VALUATIONS and FC COSTS XXXX For example there are fees in the amount of {$2400.00} on XX/XX/XXXX labeled as FC COST and for {$1700.00} FC ATTY FEES, but no invoice was provided, and no attorney name is listed, as to who this amount was paid too? Also, on XX/XX/XXXX a fee for {$390.00} for a PROP INSPECTION, which is an excessive amount and the same day a fee of {$390.00} for PROP VALUATION. These are excessive and duplicate fees that are not allowed under the DEED of TRUST. On XX/XX/XXXX TITLE CURE COST {$420.00}, no invoice or company named to know if this service was performed. Fees charged on XX/XX/XXXX for {$250.00} with an invoice marked Exceeds the Life of the Loan. There are multiple examples like this for the entire time this account has been with SPS. There are many more errors and missing information, that I have requested many, many times. Now they have sent a foreclosure sale notice with incorrect amounts owed from years of adding excessive fees. There are multiple examples like this for the entire time this account has been with SPS. Also, there is an error in regard to the recording of the Substitute Trustee recorded in the court records XXXX XXXXXXXX XXXX on XX/XX/XXXX. In that document it says that the beneficiary is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXXXXXXXXXX XXXX XXXXXXXX XXXX, as XXXX on Behalf of the Holders of the XXXX XXXX XXXX XXXX XXXX XXXX and Asset-Backed XXXX XXXX XXXX. On XX/XX/XXXX received a response to a Notice of Error I submitted regarding the owner of this loan. SPS indicated that the owner/investor had not changed, but the trustee had changed to XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX , as Trustee, as successor-in-interest to XXXX XXXX XXXX XXXX, as XXXX XXXX XXXX XXXX the holders of the XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. So the information in this foreclosure notice sent to me is incorrect and must be changed before a lawful foreclosure can be carried out. The foreclosure sale scheduled for XX/XX/XXXX, must be cancelled. XXXX. Substitution of another trustee by creditors says The substitute trustee shall reside in the county or city in which the property that is conveyed in the deed of assignment or the greater portion thereof in value is located. According to the Foreclosure notice sent from the Substitute Trustee : XXXX XXXX has a shell office in XXXX, VA and its actual address is the same as the foreclosing attorney XXXX XXXX XXXX in XXXX, MD. So this does not meet the Virginia Code requirements : In Virginia, foreclosure trustees must be state residents, or if the trustee is a corporation, its principal offices must be located within the state. ( XXXX XXXX XXXX XXXX XXXX ). Again, XXXX XXXX does NOT have their principal or main office located in the state of Virginia. When researching the address on the Substitute Trustee assignment recorded in XXXX XXXX, the information for shows XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, VA XXXX. Maryland XXXX. XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX. Phone : XXXX, with only a Maryland phone number. This is not a principal office in Virgnia as stipulated in the Virginia Code.
