Consumer Complaint: I have been dealing with a foreclosure action on my residential home in New Jersey for over two years. I have lost my job, am on XXXX and in long term care due to XXXX. Despite my XXXX, over the past 12 months my family and I have worked with my Servicer, Select Portfolio Servicing XXXX Inc., ( SPS ) to try to complete a short sale workout. My goal is to resolve this negative litigation in a more favorable end result for myself and my wife that will mitigate the negative credit on our consumer records due to this litigation. In XXXX and XXXX of 2023, the Ocean County Sheriff in NJ, set a sale at the same time my Realtor and Short Sale negotiator, XXXX XXXX XXXX, had a short sale offer in place. SPS representatives advised my negotiator that they needed 37 calendar days ( prior to the sale date ) to review the short sale offer. I requested two sheriff sale adjournments and attained an adjournment totaling XXXX days before the sale, to allow SPS to review the package ( see the attached Sheriff Sale adjournment verification letter ). Despite being provided over 37 days to review the offer, SPS has refused our efforts and advised in a rejection letter that they would not review the package because " there is a sheriff sale scheduled '' ( see the attached denila letter from SPS ). Given that they advised that they would make a good faith effort to review the package and that they too are allowed up to 60 days of adjournments in New Jersey, it is my position that the rejection was not adequately supported by the facts nor their promises to fairly review the offer ; they have acted in bad faith, and that by doing so, their actions will have a negative impact on my family 's credit. I would like to have this reviewed with them as soon as possible in order to allow my family a chance to resolve this issue through a short sale loss mitigation option, to benefit my family 's future credit.

I have been making my mortgage payment fine for years on time, This company Select Portfolio servicing out of no where took my monthly payment to {$4500.00}, in XXXX of this year, they did not give me any warning, I would call this mismanaging of my mortgage on their behalf on my mortgage. I feel like I'm being preyed upon they tried to do this same thing in XX/XX/XXXX. Like in XXXX they had me feel out a ton of paper for financial assistance. Which I did not need until they increased my mortgage I was doing fine I have worked with my company XXXX XXXX XXXX now for over 10 years. I make {$80000.00} a year sometimes more or less. My loan number with SPS is XXXX they say their are no financial options for me. they are a evil l company they have done the same thing to other people I know. my Payment is now increased by {$790.00} a month. Where is a woman at the age of XXXX to come up with this extra money. I need your help, they are trying to take away my house that I have lived in for 27 years

Consumer Complaint: This company was processing payments of {$4800.00} dollars each month, paid directly out of my bank account for 9 months. ( I have bank statements to support this ) lead my family to believe they were working on a modification, or repayment plan. When in fact they were processing a foreclosure all the time. There is no reason financial or other wise myself and my wife can not me a fair financial payment. But we were not offered a reasonable chance. We are law abiding taxpayer Americans, and I believe we diserve a chance to protect the future of our children. Thank you for listening

Consumer Complaint: On XX/XX/XXXX I signed on to my mortgage lenders site to make a payment. At that time the payment was accurate and as expected based on what I owed. When I logged in the very next day they were showing an amount due to that was over {$200.00} more than what my normal payment is. The payment went from approximately {$1800.00} to {$2100.00}. At first I thought it was a glitch, so I logged on again today and saw again that the payment indeed was showing as {$2100.00}. My taxes and homeowners insurance didn't increase by over {$2400.00} for the year, so I couldn't understand why the payment would have gone up so much. So I called them today ( Monday XX/XX/XXXX ). They said that they put a new requirement in place where they wanted all of the escrow upfront to pay taxes and insurance. And that since I didn't have it all upfront the extra monthly amount was to catch up to that amount. I was never given notice of this change, nor time to adjust and figure this out in my budget. I just received a new bill. I've been with them for over 5 years and I've never had this happen before and it appears to be unfair to just raise someone's mortgage payment without even giving any kind of notice or options.

Consumer Complaint: I completed a trial plan after my struggles with XXXX. I was told all arrearage including escrow shortage would be put to the end of the loan. My payments at that time was {$1600.00}. After making 6 payments and keeping the account current I received a communication that after a recent escrow analysis my payment would be going up to {$3800.00}. After being blindsided by this I immediately called SPS. The young lady said she could extend the escrow out 36 months versus the current 12 months. After " I '' helped her with the calculations she submitted it to her supervisor and was immediately turned down. She advised me to fill out an RMA online for additional help. I then filled out the application stating my issue and submitted. The next day I received a denial. I signed up for paperless that is why the denial came so quickly. I then called back, bagging for help. The new agents advised they sometimes extend escrow 24 month, but not for me. Yes, " but not for me ''! She also stated the first agent just wasted my time as they would not look at an RMA for escrow. The new agent asked to take a payment knowing i couldn't afford it. No sympathy, no empathy!!!!!!

Consumer Complaint: Select Portfolio Serving, Inc., ( SPS ) approved a Short Payoff of {$270000.00} with a closing date of XXXX XXXX, XXXX and funding date of XXXX XX/XX/XXXX which accounted for the mandated rescission period for refinance loans in NJ. The closing occurred on the XXXX, the closing documents were emailed to SPS immediately on that day and the funds were wired on the XXXX. However, SPS on XXXX XX/XX/XXXX, returned the wire and now refuses to accept the XXXX XXXX. Even though the closing occurred within the time frame that SPS requested, it would have occurred earlier but SPS disobeyed the judge 's order to remove the lien on a second mortgage that had previously been dismissed. Instead, stating that they would take 30 - 60 days to release the lien which would have causd my refinancing to not occur within their set time frame. This caused my attorney to file a clarifying order from the judge, incurring time and cost. On a conference call with SPS, the Title Agent and myself, SPS confirmed they would accept the funding wire towards the Short Payoff on that date, XX/XX/XXXX. They promised to send a fax confirmation but never did send it. On XXXX XX/XX/XXXX, asked us to send new signed Payoff, XXXX and they then would accept the wire.I did this immediately but despite this, they would still not accept the wire transfer. SPS has used negligent serving practices, misrepresentation and fraud.

Consumer Complaint: I took out what I believed was a Line of Credit Loan with XXXX XXXX in XX/XX/XXXX. The loan amount was {$39000.00}. The interest given me was 9.125 %. I began in XX/XX/XXXX paying {$320.00} monthly. I don't know exactly when, however SPS, Select Portfolio Servicing acquired this loan, I'm thinking. around XXXX but could have been sooner or later. I have 2 complaints reference this loan. 1. Somehow, someway this became a 2nd mortgage with XXXX. I have owned 3 houses and have never agreed to or had a 2nd mortgage. I don't believe in them. I recently got the original paperwork from SPS and can see what appears to be a stamp or a statement added stating 2nd mortgage. 2. As stated above the monthly payment is {$320.00}. However, for as long as I can remember, for many years I have been paying {$320.00}. By my math I estimate to have already paid nearly {$60000.00} on this {$39000.00} loan. How much interest is enough? I've long ago paid back what I borrowed. Yet, after 16 years of making these monthly payments, SPS shows a balance due of {$23000.00}, which is also the payoff. So paying nearly {$60000.00} on this {$39000.00} loan over a 16 year period has resulted in only {$16000.00} off the loan amount. Almost {$45000.00} in interest. I believe this to fall in the category of " predatory loan. '' As a XXXX customer and a XXXX male I was included in the modest payoff ordered by the Justice Department against XXXX. At the very least it is a bad loan, not fully explained or understood. And again, as stated above, I did not, and never would have agreed to a 2nd mortgage.

Consumer Complaint: On XX/XX/23 Select Portfolio Servicing drafted a false document. The document is identified as a Escrow Closing Letter. They indicated on the letter that I requested to close my escrow account and ask that I respond, to the letter, before XX/XX/23. SPS action are in retaliation to my claim filed with the Consumer Financial Protection Bureau. On XX/XX/23, I drafted an email to SPS at XXXX indicating that I never request the removal of my escrow account and the claim is false. I made a follow up call on XX/XX/23 at XXXX. On this call, I spoke with XXXX ( XXXX ). I informed her that I NEVER requested to remove the escrow account and and I did NOT desire for it to be removed. My request was for my account to be noted and reflected as such. She advised that the escrow is scheduled to be included for the Month of XXXX. On XX/XX/23, SPS issued my monthly statement that reflected a balance due of {$3800.00}. The current balance for the Month of XXXX was {$1900.00}. The statement also reflected a special account contribution in the amount of {$670.00} for the Month of XXXX, but there was still no reporting of my escrow payment for the Month of XXXX. On XX/XX/23, I submitted my payment online in the amount of {$1900.00}, for the Month of XXXX. This payment posted to my account applying {$1000.00} towards principal and interest and {$740.00} towards the escrow account. Based on my calculations there is {$170.00} unaccounted for and misallocated. On XX/XX/23, I accessed my SPS account to see that they had removed the escrow for the Month of XXXX. The account reflects a balance due for XXXX in the amount of {$1000.00}. Because my account has not been updated to reflect the escrow payment for the Month of XXXX. ( {$670.00} ) Also, because my transaction were made electronically, I am requesting that SPS be reported to the FTC for an internal investigation. Due to the falsification of a legal document, and the removal of my escrow account, by SPS on XX/XX/23, I am request DOJ perform an internal investigation into all legal transactions. The actions of SPS have caused me mental and physical injury. I have lost time from work to seek out mental and physical support to deal with my XXXX XXXX and XXXX XXXX XXXX I am requesting that SPS issue pain and suffering compensation to me in the amount of {$2500.00}.
