Consumer Complaint: We have been working and trying our hardest to modify our mortgage with SPS, it 's been nothing more than stress for us. We do n't talk with the same person, no one knows the same answer. You can call one minute and talk with someone get an answer, call back and get a completely different answer. We 've been trying since XX/XX/XXXX to modify our mortgage our interest rate is 7.5 %. Also the paperwork we need to fax, one person says it 's all complete then we get a letter saying missing information we fax, then they need another paper. So we have a customer rep that we ca n't get a hold of. It 's been exhausting we do n't want to lose our home we are trying but they just delay in reviewing our case. Why our mortgage was given to them, it 's been XXXX. Our mortgage is {$1100.00} we live in a twin home and have bad credit we are trying to work with them but they do n't seem to really care. I know the answer they will give as I 've seen the automatic response so all complains. Then we 're getting act XXXX letters, why are we getting them and foreclosure when we are in middle of modification, is n't it dual tracking. We just want results and save our home we 've had for 32 years.

Consumer Complaint: I have been trying to modify my mortgage sine XX/XX/2016 with Select Portfolio. Its now XX/XX/2016 and still nothing has been done. I followed there instructions of going on to there website and checking on my status loan and the website does not work If I do NOT call them I have NO idea if they need additional information.I have cooperated by sending them any documents that are missing by uploading them because its quicker and they receive it in 24 hours. I call them faithfully every week and they tell me the same thing that every thing is fine your in review and it takes time. Yesterday I was served with foreclosure complaint for the FIRST time and its not even the intent they went right to the complaint and when you call SPS they have no idea whats going on. Im upset because I want to save my house and I have followed there direction followed there rules and they never wanted to help me at all. They lead me to believe that they were going to help me and they had NO intentions ever to help me.When I called SPS and questioned the foreclosure complaint they told me to call a certain number and extension and when I called it turned out it was there attorneys office that represents them. The attorney was rude and basically spoke down to me and he proceeded to say that they were n't going to HELP me and that they were ACCELERATING my foreclosure and with in a few weeks I would have a sheriff sale so I should start looking for a new home. Why would SPS do all that and lie to me this whole time. I trusted and believed that SPS wanted to truly help me.

They called back to confirm the counter offer was received, here is the timeline of calls to SPS : XX/XX/XXXX sent update offer {$310000.00} XX/XX/XXXX New offer in review. sale date postponed XX/XX/XXXX in review XX/XX/XXXX in review XX/XX/XXXX in review XX/XX/XXXX in review XX/XX/XXXX in review XX/XX/XXXX in review XX/XX/XXXX SPS states counter offer LOST NOT IN REVIEW! The real estate company confirmed SPS had the XXXX short sale counter offer on XX/XX/2016 which helped postpone a sale date. And then XXXX weeks later SPS lost my XXXX short sale. My major concern is because SPS has refused to stop the sale date of XX/XX/2016. So for the past XXXX weeks while I ca n't sleep at night because I have a sale date hanging over my head, SPS has been doing nothing to help me avoid a foreclosure or receive a HAFA short sale. I am furious! This is complete fraud, and/or dysfunction! And I am the one who may pay for the SPS incompetence.

SPS sent to my PERSON previously private and confidential loan documents of another customer to include a Promissory Note. I still have these items in my possession. Promissory Notes are negotiable instruments and subject to all applicable federal laws. There is a high probability that Select Portfolio Servicing, Inc.has also illegally violated my financial privacy and distributed my private and confidential information to other entities. We already know that they sold my monetary instrument and committed mortgage and securities fraud.

Consumer Complaint: After being neglected by my servicer SPS ( Select portfolio servicing Inc ) and lender ( XXXX ) for soo long, I recently got reviewed for a home retention /loan modification program. First of all, the loan modification underwriting review took longer than 45 days from the day SPS comfirmed receipt of a complete file. I kept wondering what was taking them so long. Prior to submitting my application, SPS 's XXXX reps assured me, that they have an Inhouse Proprietary Modification Program based on theloan amount I owed, which exceeds both the Hamp program {$720000.00} loan limits. My loan file went through a thorough underwriting review, from which I given a proposed modification program with explanations based on the input data analysed. Ridiculously to my suprise, SPS is unable to offer me the proposed modification, because, " XXXX has not given them the contractual authority to do so. '' My servicer has proved that, this is my Primary Residence which is 100 % underwater with an appraised value of {>= $XXXX}. My servicer also proved that I have a stable sufficient monthly income of approximately {$20000.00}. The point I 'm trying to make here is, all along my Servicer and Lender continue to cause me much more financial harm due to negligence in their loss mitigation proceedures. With all that said, On XX/XX/2016, SPS 's XXXX rep told that the only option I have for my home is deed inlieu. On the same day, SPS 's attorney ( XXXX ) removed the sale period HOLD and placed a foreclosure date of XX/XX/2016. There is n't any opportunity for me to appeal SPS 's assistance review decision. Neither the Servicer nor the Lender is following the legal guidelines in their loss mitigation/foreclosure review processes, to the extent that my title company has informed me that, there is n't an assignment recorded for either one of them. This is malpractice for both.

In XXXX I filed a RMA Modification with them, they 've been making constant claims that they have not receive the XXXX pages needed almost deterring progress, they 've been giving me the run around after receiving the XXXX pages and then proceeding to ask for all pages, the first set of forms were faxed and mailed. I uploaded the form on XXXX/XXXX/2016 waiting to hear from them.

Consumer Complaint: Our home of 12 years is in foreclosure. We were part of the sub-prime lending back in the early XXXX 's. I 've managed to keep the home and payments going all these years. In XXXX, the new servicing company, Select Portfolio Servicing ( SPS ), imposed an escrow account without my prior knowledge -- which was perfectly fine with me -- except that they had to 'fill the gap ' and placed the prior year ( that I had n't yet paid on my own ) and the current year of escrow on my account all at once. This left me in arrears by over {$8000.00}, so they raised my monthly payment. My monthly payment went from {$550.00} to {$960.00} with the correct escrow amount, but because of the prior and current year 'gap ' they tacked that on and raised my payment to {$1400.00}. Just like that. In XXXX, I was laid off from my job. I was unable to find new employment for 11 months. I was a single mom and could n't find a new job to support my family. I kept the mortgage stable, albeit a month behind every month, but I was able to catch it back up when taxes came in. I did my best to keep up with that payment, but, I was trying to get caught back up from almost a year of unemployment, so, I did what I thought was best -- I called to ask for an assumption modification on the mortgage. I began this process in XXXX of XXXX. I followed all of their instructions, rules, uploaded every single document they required, called in every few weeks and made the single 'good faith payment ' they required to 'show I was willing to make payments with whatever modification comes through '. I was instructed to not make my regular monthly payments because 'once the modification goes through, my payments would be applied differently '. By XXXX XXXX, I was getting nervous, frustrated, and impatient! I finally got XXXX representative to advise me that all that was left before the modification could go through was the need for a quitclaim deed to be signed between my ex and I which would sign the property over to me. I complied with their request and paid the {$190.00} to file the quitclaim and sent the mortgage processor the copies required. I was informed it would take 30 days for the review to be completed. By the middle of XXXX, after weekly calls requesting updates ( with no communication from them at all ), I was verbally informed that the modification was denied and I was now to pay back all those months of payments they had me not make because they would have been applied incorrectly. I tried to work with them. I tried to get a repayment plan -- they requested a {$10000.00} 'security deposit ' which I did not have. They had me upload all of the same documents I had submitted for the modification, and this time, kept rejecting them for XXXX reason or another. I kept trying to get written notification of the denial, copies of the mortgage documents, and more. All requests went unanswered. I attempted to retain a lawyer, who, XXXX turned me away because without that hard copy denial of modification, he could do nothing to assist me. Fast forward to XXXX/XXXX/XXXX : I was served with foreclosure papers. Now, they refuse to work with me stating that the Pooling Service Agreement prohibits modification. I have jumped through hoops for them to save my home of 12 years. Had they been willing to work with me back in XXXX, my home would not be in foreclosure at this time. They have forced delays failed to provide documents and now there is no way I can clear the exorbitant arrears of payments, miscellaneous fees, and legal fees. It is my belief that this has been done with unclean hands on their behalf. My goal is not to cheat them out of money or default on this debt. My intention has always been to retain our home. The mortgage is in my ex husbands name, but the house and responsibility have been decreed to me via divorce.

Consumer Complaint: I fell behind on my mortgage after having to send all of my money to my family in XXXX in order to save their life after the war reached their city in XXXX. My servicer SPS ( Select Portfolio Services ) is only considering my loan for assistance based on affordability and not an actual hardship which caused a gap in income. I hired an attorney to assist me in submitting my request for assistance to SPS. My loan apparently was also recently sold from XXXX to XXXX of Nevada. According to my attorney, XXXX was part of an Attorney General Settlement and this loan is required to be modified as part of that settlement. The fact that it was recently sold should not be an excuse to block me from assistance. My hardship is real and SPS and the new owner of my loan do not care about anyone or actual hardships. They are evading reviewing me for an assistance program that actually looks at gaps in employment. My attorney states SPS does this to everyone. They only review for affordability hardships and ignore actual gaps in income or real hardship cases. My home is only worth about 60 % of what I owe. I truly want to pay the entire amount of my balance, however it appears the new owner of my loan only wants to steal my home.
