Consumer Complaint: I have filed QWRs with both of my mortgage holders. I believe that the response I received from both companies does not meet the legally required guidelines that have been set forth. They seem rather condescending and unwilling to provide the requested information. I do n't believe that said information is proprietary or restricted in any way, after all it is my loans that we are discussing. I would greatly appreciate any assistance in obtaining my requested information from these XXXX companies. I would like to know the legal status of my loansl I have attached my initial correspondence with both companies. Thank you for any assistance you may be able to provide.

Consumer Complaint: I am concerned that my loan servicing company SPS ( Select Portfolio Servicing, inc. ) is purposely delaying my loan modification process in order to prevent me from qualifying for the program before it ends in XX/XX/XXXX. I have repeatedly been told that my application is incomplete and asked to provide information that was already provided. They do not notify me that documentations are needed at the time, I have to follow up regarding status only to find that it is on hold because they are awaiting information ( generally that they already received. ) They are also now requesting that I produce a " new '' rental agreement for a XXXX property I own to prove income. I showed them the original lease that clearly shows a switch to month-to-month tenancy after it expires. The same tenant has occupied the residence for years and it is not reasonable to ask him and HUD to execute a new agreement since we already have an implied month-to-month per the original lease. HUD ( which is a government agency ) accepts this as an agreement and pays us based on it. In addition, the servicer has my tax returns and bank statements that clearly show the rental income ( which is at a loss so has no bearing on the loan modification. ) In addition to documentation from HUD with the breakdown of what they pay and what the tenant pays which can be verified by tax returns and bank statements. This is a clear and sufficient paper trail but they are staying it is not because the lease eludes to a new written agreement. Reverting to month-to-month tenancy after lease expiration is standard practice in the industry and the document is worded accordingly. In addition, this is a legal real estate document provided by XXXX so we can concur that it is worded to be enforceable by law. This modification was started over 4 months ago and is being held up for frivolous reasons. I have also only just learned that the program shuts off in XX/XX/XXXX so if my application is not complete by this date that I will not be eligible.

Consumer Complaint: I contacted Select Portfolio Services several times over the last 2 years to find out if we would qualify for a loan modification, due to financial hardship from house repairs and other unexpected expenses. I was unable to make a full payment every month, yet they would not take partial payments. I provided all the documentation ( so I thought ) to them, over a year and a half ago. We then filed a personal bankruptcy in XXXX XXXX to help get us back on track, which did help, but we were still unable to pay the mortgage. We did not include the mortgage in the bankruptcy because we were still waiting to hear regarding the modification. In that 6 months prior to the bankruptcy, SPS asked for additional information ( some of which I had already provided ). After the bankruptcy, they continued to say they needed updated information, new signed docs, new hardship letters, etc. This continued for all of XXXX. While they still had n't approved or disapproved me, they referred my account to a legal team to move forward with a foreclosure. Luckily there is no sale date yet, however, they did finally get back to me stating that I was not approved. While they base it on your gross income, they decided we made enough money to be able to pay the loan. Well, we do n't with all the expenses and still trying to pay off loans for house repairs. Then they said I did n't make enough money, however, to qualify for the repayment option. So, it took them almost 2 years to tell me that. Now, I am in complete default, so no one will lend me any money, and if I want to keep my house, I will have to file Chapter XXXX so that means legal fees that I do n't have and they will put me on a repayment plan that I ca n't really afford. Oh, but if I can come up with at least $ XXXX, they will reinstate my mortgage. What a bunch of XXXX! After letters, upon letters, upon letters, stating how much they want to be able to help you. " There may still be something you can do. '' Yeah, you can put me off for almost 2 years so that you can just move ahead with the foreclosure you knew you were going to move forward with anyway! Thanks!

Consumer Complaint: I have spent months providing Select Portfolio Servicing with requested documentation pertaining to my deed of lieu we agreed upon. Today I have received a letter stating that my loan is to be restarted. They are requesting information I have already provided to them. Instead given me the answer to their decision regarding my deed of lieu. The process abruptly restarted all while I am communicating with them asking for more time to contact my daughter to get the new unexpected documentation. In the intervening period of time, I send the new requested documents on my behalf. This whole conversation has been recorded my both SPS and myself. XXXX XXXX, 2016, I received the first Mortgage Statement in a year, shortly I received another letter dated XXXX XXXX, 2016, stating " the mortgage servicer on the above- referenced account, received your inquiry regarding a possible mortgage workout plan. '' The whole statement above is a lie. I allowed Select Portfolio Servicing each time they requested to record our conversation so that I could put on my speaker phone on to record them as well. I have recorded our communication for the last year. I have dates, times, what was said according to our stated agreements XXXX XXXX, 2016, at XXXX I requested the status of my deed of lieu, I was told that my request was still being investigated for a ruling. Consumer Complaint: Dear Sirs, I need your help with SPS Company located in XXXX XXXX XXXX. In XXXX, I was assigned the relationship manager named XXXX XXXX, I spoke to him on the phone and asked questioned about an issue that SPS had not addressed issues with our home mortgage and was told he would send the corresponding paperwork for loss mitigation. No paperwork came to me. In XXXX a new relationship manager was assigned my case XXXX XXXX. Now the paperwork sent to me only includes relocation assistance. Can you help, I have been diligent in asking for SPS to solve problems with my loan : Problems with escrow, another party on my loan, problems with accounting of payments made that were above the amount due and unable to abtain paperwork for loss mitigation since XXXX. Only two weeks ago was I asked to send in paperwork but it was for relocation assistance - the sale has n't even occurred, and forms were omitted. I have asked for loss mitigation but at this point this company does not keep it word to send paperwork and forms where not sent that they require in the packet this past month. Also the paper work that they sent to you did not include the most recent loan papers for the only mortgage on this property from XXXX Bank, only paperwork from XXXX XXXX that is invalid. Thank you so much for looking into these issues and can you please help me so that a sale of the property does not happen on XXXX XXXX, 2016. My property has still not been listed this month by the Sheriffs Sales site as other properties in my area and XXXX and XXXX states the property is not available for sale, and I have received no response from SPS in terms of where it is listed. I did receive a letter from XXXX loans that they might be able to help with this, but I need SPS to start helping and sending all paperwork when requesting it and not sending letters without the proper forms included for loss mitigtion and making sure that my loan has been updated with the proper amount due and all charges to this loan are itemized and explained, and that they are sure that I have a clear title after XXXX made the mistake of listing another person on my loan. I do not have any other loans on this property!!

Consumer Complaint: In an effort to confirm who owns the mortgage and has lien on my home I sent correspondence to Select Portfolio Servicing ( SPS ). On XX/XX/XXXX I sent a letter to requesting the following items : Provide the identity of the mortgage loan note on my home. Provide the owner of my mortgage for the property located at XXXX., XXXX, New Mexico XXXX. I received a letter dated XX/XX/XXXX from SPS stating that they had received a letter from my authorized agent. I received a letter dated XX/XX/XXXX from SPS stating that they have received my inquiry letter and to give them 30 days. I received a letter dated XX/XX/XXXX that they had completed their investigation into my inquiry and since they had not serviced my account in over a year they would not provide a response. In XX/XX/XXXX I ran into financial troubles and requested a foreclosure letter from SPS so I could withdraw money from my XXXX ( k ) to pay them. SPS informed that since the loan was a XXXX mortgage they could not foreclose on my property so they could no provide a letter. in XX/XX/XXXX SPS placed my account in a XXXX status. I have not paid SPS or any other entity for this mortgage since. SPS is not providing me with my requested information and are not being cooperative in my effort to clear the title on home.

Consumer Complaint: Dear Officer of Consumer financial Protection Bureau : I am writing you this letter regarding my current Mortgage Service provider Select Portfolio Servicing , Inc. For past few months, I have tried resolving the repayment plan with Select Portfolio Servicing , Inc. , however they are unable to resolve the issue and they are not giving me any reason at all. I asked for loan modification and I was informed by my case manager that Select Portfolio Servicing , Inc. does not participate in any government program. Recently, one of their operators accidently told me that they are in process of selling Select Portfolio Servicing , Inc. to a company called XXXX XXXX XXXX and they are working with anyone on any plan. I was informed that, it will extremely hard to get a correct answer from anyone as employee are looking for jobs elsewhere. This is totally unethical that they do not follow government based load modification program and resist to provide any assistance to consumer. Select Portfolio Servicing is totally out of compliance with government.

Consumer Complaint: My Case number : XXXX. I submitted a complaint by in XXXX of this year. Since then we have been trying to do a loan Modification with Select Portfolio Services. We continue to submit documents and resubmitting. On 6 different times I have request the SPS send us the transfer of the Trust Deed for every time my loan has been sold. Twice in writing and 4 times on the phone. I have also request my complete payment history from the origination of the loan. Finally this week they sent me the payment history dating back about 3 years ( the loan was originated in 2007 with XXXX XXXX ). I have never received the Trust Deed or the complete payment history. Yesterday we were sent a notice that they were filing a notice of default and setting a sale date, and we thought we were negotiating for a loan modification. We ca n't understand how they can file a notice of default if they refuse to supply us with the required documentation.
