Consumer Complaint: I believe that XX/XX/XXXX my mortgage was bought by Select Portfolio Services Inc. from XXXX. I did not receive notification from anyone that this had happened. I had automatic bank transfer for our mortgage with XXXX. SPS received payment for XX/XX/XXXX-XX/XX/XXXX, then they stopped collecting the mortgage payment. XX/XX/XXXX I had a XXXX XXXX, this laid me up for awhile. XX/XX/XXXX we found out that Select Portfolio Services had acquired our loan. The way we found out was that they ( SPS ) were starting foreclosure proceedings. After multiple times of trying to repay what we owe ( SPS refusing our payment every time, even though it was their mistake ). We are now in the world of loan modification and repayment. I have sent them all the information that they have asked for, 3-4 times. Every time I get a answer from them that they did not receive the fax or the fax broke down, transmission problems, etc. These people have no class, instead of working with us they would rather ruin you. I had no problems with XXXX or XXXX our previous loan agencies. We have lived in our home for 12 yrs and now we are being forced out. I know now that I have been SCAMMED by SPS. Something should be done about these people. Decent homeowners are being forced out of their homes for no reason. I will be contacting the FBI and the Attorney General of Florida.

Consumer Complaint: I attempted to get a modification from XXXX when my husband was XXXX and our income reduced to XXXX person working. XXXX XXXX XXXX could not figure out who our investor was. They claimed we had XXXX investors ; XXXX XXXX and XXXX XXXX XXXX, then changed it to XXXX on behalf of XXXX XXXX XXXX. They filed foreclosure proceeding with the XXXX XXXX court, and it was denied. After 4/12 years of sending in the same documents our mortgage was sold to Select Portfolio Servicing. The document requests started all over. Another foreclosure was filed with the court ; I appeared and presented evidence of deceptive lending by XXXX Mortgage my original lender, and XXXX XXXX XXXX inability to resolve the issue in 4/12 years. The judge instructed Select XXXX Protofolio 's lawyer speak with me get copies of the evidence I entered and make a decision within 30 days before she make XXXX for both parties. We received a trial payment period from XXXX XXXX 2016. All XXXX payments were made on time as agreed. My XXXX concerns are the modification payment is not reflecting on my credit report. Any type of payment a creditor receives from a consumer must be reported. Select Portfolio Servicing is telling me because the payments were trial payments they do not have to report it as payments, and I strongly dislike that policy and need your advice. The second concern I have is with the balloon payment we got for our modification and had less than 30 days to have a lawyer read it and advise us on it. This is how we got in trouble with XXXX Mortgage in the first place harassing us to refinance two years after we had just refinance our home with them. I do not trust the entire process and would like for someone to please review our case. Consumer Complaint: I am a XXXX XXXX, on Social Security & XXXX.My mortgage rate is a high 6 1/2, because mortgage lenders consider me a high risk because I was out of work for more than a year, and I ca n't get it refinanced.I obtained the mortgage in XX/XX/XXXX. My mortgage has been transferred several times to different service companies. The current holder of servicing is Select Portfolio Servicing , Inc., XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, Ut XXXX, referred to as SPS. They advertised a modification proposal to lower my monthly payment, sent me a package to fill out & supply supportive documentation. I complied, even providing additional information about my medical history, a seasonal job I have ( I sent a Social Security statement review showing my physical capacity ), etc. The company SPS rejected my request by letter without itemizing what was 'incomplete'.A telephone call ( they said was recorded ) with representative XXXX XXXX on XX/XX/XXXX at XXXX CST produced a litany of things they need that include just a check mark on a IRS Form XXXX, a fancy financial statement for my part time mowing job, a more complete copy of all my bank statement that I gave them redacted pages, two months of my XXXX wife who is on Unemployment Compensation till XX/XX/XXXX and received a stipend from laid off company of {$36.00} per month she just cashes & gives me, but SPS wo n't accept that as proof, etc. THey want me to deposit the {$36.00} to my checking account this month and next, so as to see the proof of it, even though I sent them the entire payroll stipend form with tax withholding information, year to date {$4000.00} of XX/XX/XXXX. I feel discriminated against, that they do n't want to help. I gave them proof of Social Security, my season jobs income verification, my wife 's info, taxes, bank statements, property tax info, medical specifics from XXXX with diagnoses. XXXX. It 's not right what they are doing!

Consumer Complaint: The servicer is asking for canceled Social Security checks from the Borrower because he cashes his checks instead of depositing. The award letter was provided for both him and his wife. THe servicer will not move forward with the modification until they get canceled checks from the social security office which will take some time. The borrower and co borrower are a XXXX XXXX. It is very difficult to get back and forth to the bank and other places when the servicer keeps asking for docs. So it takes time to get the docs and send to them. The home is in danger of foreclosure.

Consumer Complaint: This is my second complaint against Select Portfolio Servicing. Complaint : Since XXXX we have been applying for a loan modification from SPS. We have submitted hundreds of requested documents, answered numerous phone calls, and paid for legal representation XXXX times, but to date we have not received any loan modification offer. We submitted requested documents as late as XXXX XXXX, XXXX, only to be told by the SPS representative that our loan will be transferred to XXXX on XXXX XXXX, XXXX. This whole situation has been nothing but excruciating for us. We have seen this change of servicer as a pattern that began with XXXX XXXX XXXX, XXXX XXXX XXXX, and SPS with no resolution in sight. What is most frustrating is that we know that we fully qualify and meet the requirements for the government 's loan modification programs and yet we have been denied by SPS and prior servicers. Therefore, our conclusion is that our loan is being subjected to additional requirements other than those of the government 's by SPS and prior servicers We believe that : 1. The continuing practice of servicers repeatedly requesting documents from homeowners are doing so to purposefully increase our indebtedness for the company 's financial gain and this should be investigated for illegal actions. 2. SPS is using their in-house policies and requirements for our loan modification, and not those of the government 's programs for financial gain.. 3. Discrimination could be a factor in repeatedly denying us a loan modification. This is based on our ethnicity ( XXXX ), age ( XXXX ), and our family structure ( not husband and wife, but parents and adult children ). 3. SPS is continuing to purposefully use delay tactics to deny us a loan modification so that our delinquency indebtedness continues to increase. This conclusion is based on their evaluation policies, repeated requests for the same documents, and general threats about legal action against us. We also believe that information about our mortgage loan status is shared with investors who routinely stop in front of our home and either look until we come out front or come to our door with questions. Recently, we had a visit from a private investigator that was sent to verify who is residing in our home. Background : XXXX XXXX ( son ) is principal on the loan XXXX XXXX ( mother ) is secondary of the loan We have proven we can pay for a reasonable loan modification. In XXXX my son, who is principal on the loan, filed for bankruptcy in accordance with a Florida program for obtaining a loan modification. Through bankruptcy court we paid SPS {$30000.00} @ {$1400.00} per month until XXXX XXXX when the application was denied on the grounds of insufficient income. This was a wrongful denial because SPS disregarded our attorney 's repeated submission of collective income from our family. SPS chose to use XXXX income only for evaluation. Our attorney filed a dispute for the denial but was unsuccessful in getting it overturned. Our financial hardship began in XXXX, XXXX when we refinanced our loan with XXXX XXXX. Six months later we were sued because XXXX XXXX fraudulently forged the signatures of the prior owners to process our loan. Due to this we incurred significant expenses for attorney 's fees. Making home repairs and maintenance on our home then and now continues to be on a cash basis. Our mortgage is an upside down loan - {$330000.00} according to SPS billing, and the latest actual value is {$260000.00}. Even obtaining home owners insurance has been unsuccessful due to the status of our loan.

Consumer Complaint: Because they failed to validate the debt in the timeframe allotted according to the FDCRA and other applicable laws this item was legally deleted from my file. After my wife filed a claim against them with CFPB stating that had failed to validate her debt and therefore should remove it from her credit report, they in turn RE-INSERTED the erroneous information on my credit report on XX/XX/2016. Select Portfolio Servicing has worked overtime to ruin our life with their fraudulent reporting. They have further sought to even comply with the law in reporting to the credit bureaus and have cause me irreversible harm.

Consumer Complaint: We applied for a loan modification. After years we were denied. We have appealed the decision and submitted an entirely new package and we are currently under review for a loan modification. We live in the State of California and are protected under the Homeowner Bill of Rights from dual tracking. The HBOR restrictions on dual tracking foreclosure and loan mods prohibits mortgage servicers from advancing the foreclosure process if the homeowner is working on securing a loan modification. When a homeowner completes an application for a loan modification, the foreclosure process is essentially paused until the complete application has been fully reviewed. In spite of this they have no placed in in foreclosure.

Consumer Complaint: I requested a loan modification in XX/XX/XXXX due to an operation my wife had to undergo which has prevented her from continuing her XXXX. I was asking to skip one month 's payment, and was told that there may be a slight reduction in our total payments due to the modification. I have submitted the same paperwork numerous times, answered the same questions over the telephone numerous times ( several times the same question was asked, then asked two weeks later by another individual in a different way ). We have been late, 30 days, since about XX/XX/XXXX and have been occurring the late payments as well as having the late payments being reported to the credit bureaus. We have over a dozen requests for information by letter, some saying they have all the information they need, with another letter coming the following week asking for information or documentation we have already provided. Had I known that there would be this much red tape and time taken ( I honestly believe they are purposely stinging us along, perhaps to force us into foreclosure ) I would have looked into a new loan with another bank. At this point, I have been late, which precludes me from any HARP loan options and pretty much reduces any other options I may have had. What I would like is that SPS give us an answer ( I never get to speak with the same person and they shield the " decision-makers '' from their clients ), one way or another and to reverse any late payments and clear our credit with the credit bureaus. Thank you

Consumer Complaint: We just paid {$100000.00} to a {$290000.00} loan modification. {$49000.00} field adjustment was the amount paid to XXXX and {$32000.00} was the amount we paid to midland. I guess they gave us partial credit for the {$55000.00} we paid to XXXX XXXX XXXX. XXXX collected the money paid to commerce bank and XXXX. This means that NONE of the {$670000.00} I have paid to my house has been applied to principal. Which means I have paid {$640000.00} to interest. Which again I will point out is OVER 18 % interest on a 15 year loan disclosed at 4.34 %. When are they going to release this lien that XXXX bought for {$90000.00} XXXX reported {$80000.00} extinguished but it was never removed from the balance. We were not given credit for the {$5000.00} HAMP incentives. We did not get credit for the {$17000.00} paid from XXXX other properties. We paid it again.
