I don't want my home to be sold on the courthouse steps with do process of law. I demand a jury of my peers to make the decision. I want a judicial foreclosure because of all of the fraudulent assignments and other deceptive practices

Consumer Complaint: In XX/XX/2017 my payments increase after a 24 month repayment agreement. Unaware of my increase in monthly payments I attempted to make a payment and was told they were not going to accept the payment. I seek housing counseling from a HUD counseling agency and submitted a financial packet to be considered for a modification to make my payments more affordable. I was approved for a 2nd time for a 12 month repayment plan which is double the amount of my original mortgage. I disagreed with the decision and sent proof of my income and expressed that the rate is over 9 % and I was unable to afford this payment agreement. They insist on telling this is all they can offer.

Consumer Complaint: SPS Select Portfolio Servicing , Inc. over charged my account in excess of {$5300.00} for attorney fees for services or work not provided by their attorneys, XXXX. They could not explain them, but said that's what the attorney XXXX XXXX ( XXXX ) charged them, so they charged my account. I paid off the loan in it's entirety and they forced me to pay these fees, and stated they would reconcile afterwards. I've requested a refund from the lender and for the attorney to provide a prove up of attorney 's fees. The attorneys only sent a letter and confirmed that no foreclosure took place or was even processed. This is like robbery and I need help from the CFPB to get my money back and resolved.

Consumer Complaint: We executed a modification in XX/XX/XXXX with XXXX XXXX and signed and notarized modification documents and sent them back on XX/XX/XXXX when they were due. Later we received a call from XXXX XXXX saying they never received the documents and that they were sending us a new set of documents. We were required to send a cashier 's check for {$3000.00} with the new set of documents which had to be returned by XX/XX/XXXX. The prior documents dated XX/XX/XXXX and notarized and returned by us to XXXX XXXX did not require a {$3000.00} cashier 's check to be sent with the documents. According to our records, the payments were made to XXXX XXXX to XX/XX/XXXX. The XX/XX/XXXX payment was returned from my XXXX XXXX account. We replaced that check for {$6400.00} with a cashier 's check. In addition, XXXX XXXX charged my mortgage account the amount of {$3400.00} for late charges, administrative and corporate fees, and interest which amounted to {$9500.00}. My mortgage account was capitalized in the amount of {$27000.00} in the new modification documents rather than {$18.00}, XXXX according to the XX/XX/XXXX modification documents. This was an increase of {$9500.00}. In addition there were two payments as notated on the XXXX Transaction Payment History that were not credited to my mortgage account which amounted to {$6200.00}. We paid all insurance policy payments prior to XX/XX/XXXX when our mortgage was impounded for tax and insurance payments. However in reviewing the escrow charges for that time period, we were charged {$7400.00} by XXXX XXXX for insurance premiums prior to XX/XX/XXXX when we were making our insurance payments. Therefore I am disputing this charge that was made on my mortgage account prior to XX/XX/XXXX as well as other excessive escrow charges. There is a payment for {$7300.00} made on XX/XX/XXXX, which was credited to the XX/XX/XXXX payment when in fact we made two more payments to the account as indicated by checks received, the documents of which are enclosed with this letter. Therefore my mortgage account is owed {$12000.00} for two payments not credited to the payment history plus applicable interest and penalties. My account is also owed {$7300.00} made on XX/XX/XXXX. Please note cf # XXXX on the payment history In addition my account was capitalized {$86000.00} on XX/XX/XXXX for loan maintenance/ modification expenses. Of this amount {$48000.00} was for accrued interest changes and late charges and $ XXXXOf the amount of {$43000.00} charged to my mortgage account, I am disputing the amount of {$27000.00} which was capitalized into my mortgage balance. Of the amount of {$48000.00} for accrued interest and penalties, I am disputing the amount of {$26000.00} which is owed to my mortgage account. I have been disputing this issue with XXXX XXXX, XXXX and now SPS since XX/XX/XXXX when the original bank errors were made. I am including documents to substantiate my claim. SPS is maintaining that I signed a modification agreement dated XX/XX/XXXX which brought the account current and therefore any payments I made prior to that date would not be considered or could not be credited toward any missing payments. I am disputing this fact because bank errors were made on my mortgage account which were not corrected despite my addressing this issue since XX/XX/XXXX. On the XXXX Payment Transaction History, there is a history of misapplied payments and " suspense '' accounts. I understand it is illegal for banks to hold " suspense '' payments past the specified payment history. XXXX XXXX, XXXX and SPS have capitalized my mortgage account in the amount of {$170000.00} since the inception of the mortgage in XX/XX/XXXX. Of this amount, {$59000.00} was added to my loan for escrow and tax expenses and {$110000.00} was added to the principal loan balance since XX/XX/XXXX for accrued interest and penalties, Of this amount I am disputing as per accounts stated per the XXXX Payment Transaction History {$100000.00} as being excessive capitalization to my mortgage account.

Consumer Complaint: SPS LN XXXX XXXX XXXX XXXX, XXXX XXXX CA XXXX XXXX XXXX We have an approval from SPS for the previous buyer ( issued on XX/XX/XXXX and good through XX/XX/XXXX ). This buyer backed out at the last minute and we submitted a new offer on XX/XX/XXXX to SPS. SPS had acknowledged receipt and has been telling us for the last TWO WEEKS that the offer is under review. Now, all of the sudden, they are refusing to work on the new offer claiming the auction date is too close. In previous conversations with SPS they stated the full package and offer must be submitted more than 37 days of the auction date ( XX/XX/XXXX ) so that there is time to review for the approval. Instead of reviewing the offer that was submitted more than 37 days prior to the auction date SPS is now making up new numbers and claiming the offer has to be in within 47 days. -- -- -- -- Our new offer was submitted WELL before the 37 days prior to this auction date and SPS is STILL REFUSING to review the new offer. Its not as if we were asking SPS to re-view completely new terms - the buyer can close very quickly as it is an all-cash offer AND the terms for the new buyer were exactly the same as the old buyer. -- -- -- -- When pressed on the date discrepancy between the 37-day rule and the new 38-day rule, SPS came up with a flimsy excuse, saying they wont review the new buyer because they were working on an extension for a previous buyer and were unaware that that buyer had walked during the extension review. I find this to be disingenuous at best because as soon as we knew about the new offer, we told SPS and provided them with another offer the same day. There was no hiding of any facts or deception by us in regards to the status of the buyer. -- -- -- -- ****Additionally it is important to note that the ONLY reason the extension was requested in the first place was due to the other THREE LIENS with the FTB and the IRS , on the property, which we have already started work on getting removed so that we can close as quickly as possible. In fact, the IRS has already issued their release, and the FTB is only days away from issuing their release letter. Both releases are at NO COST to SPS nor the homeowner. -- -- -- -- Normally, SPS approval letters allow 45 days to close. SPS only gave 30 days on this one. WHY???? Is it because he's XXXX? -- -- -- -- I want the new offer to be reviewed. There should be no issues or further delays, as the terms of the offer are the exact same as the ones SPS already approved. We may need a small extension to the approval letter itself, in order to obtain the THREE Lien Releases from the FTB and IRS there is nothing we can do about this-we cant make them disappear. ************* HOWEVER, we will close prior to the auction date of XX/XX/XXXX we just need an approval for this new buyer.

Consumer Complaint: About 8 months ago, I called my mortgage company because I was behind on some mortgage payments. I spoke to customer service from the mortgage company and that person stated that my account was on process of an assumption agreement and to hold making payments. After 3 months, I receive a letter from attorneys, hired by the mortgage company stating that my property was on foreclosure for lack of payments. I then called the mortgage company again and they stated that I needed to send more documents for the process of the assumption. They sent a form ( RMA ) which I submitted back to them over and over again because it kept getting rejected. Finally I spoke to a relationship manager, who then stated that they had been sending the wrong form and that was the reason the RMA form kept getting rejected. I replied that it wasn't my fault and because of that, everything was taking longer. I was told that I needed to download the form and fill out and send it to them. It took me awhile to submit since I have been sick and diagnosed with XXXX, I did not have the ability to fill out the form by myself and was just struggling completely to get this done with. Finally a friend helped me and the form was sent. To the day this has not been resolved and just one month ago I still had to send over the whole package again. I do not want my family or I to lose my home and this situation has caused me a lot of anguish and stress.

Consumer Complaint: ( 1 ) When the predatory lending and fraud that occurred in connection with the mortgage transaction that took place between XXXX and XXXX XXXX XXXX XXXX there has been nothing but total CHAOS for most every signed mortgage holder who had a mortgage ( including myself ), with XXXX XXXX XXXX. After this predatory lending and fraud occurred somewhere between XX/XX/XXXX and XX/XX/XXXXevery signed mortgage holder who had a mortgage with XXXX XXXX XXXX was left in limbo not knowing which way or direction to turn to submit future payments. Not until I took personal action to find out where and who payments were to be submitted did I learn that most XXXX XXXX were Sent to the XXXX XXXX XXXX XXXX somewhere in Texas. I was never contacted nor received any Notices from the XXXX XXXX XXXX XXXX. I has to request a Search to the XXXX XXXX XXXX XXXX to learn had they took over the mortgage rights, or not and this Search took over a year to be located. While this Search was in process, I hired XXXX XXXX XXXX XXXX, ( XXXX XXXX. XXXX XXXX, XXXX, NJ ) to perform an audit of his mortgage, and the results found the mortgage to be factitious with many errors included to increase and enhance getting the mortgage approved. ( Income was increased and changed fictitious initialing. ) After I was informed that his mortgage, ( account No : XXXX ) had been located by the XXXX XXXX XXXX XXXX, and received an address where the mortgage payments should be directed to and where to submit the audit report. I was informed by XXXX XXXX XXXX XXXX that payments could not be accepted, because the mortgage was in default I was, willing and ready to submit payments, but was denied of making any payments. My audit report was received at the address given but ignored. XXXX XXXX XXXX XXXX had took an height deposing of all XXXX XXXX In late XX/XX/XXXX all signed mortgage holder who had a mortgage ( including myself the defendant ), with XXXX XXXX XXXX was summoned by XXXX XXXX XXXX XXXX law firm located in XXXX, PA in an attempt to institute a suit against XXXX and XXXX XXXX XXXX, charging {$650.00} per month to be included in the suit proceeding. I refuse to be included because its was a risk that this law firm would be able accomplish their feat at the expense of XXXX signed mortgage holders. Though who also refuse to get involved were warned to be aware of other claiming to be Consultants, Servicing companies, on behalf of, banks and mortgage companies scan schemes as all signed mortgage holder who had a mortgage ( including myself ), with XXXX XXXX XXXX were open market to be had. I received only one inquiry from a servicing company, known as ( SPS ) Select Portfolio Servicing, my first knowledge of SPS Select Profolio Servicing a debt collectors outfit came to me by mail at the property address on XX/XX/XXXX, with an loan account number that did not comply with being loan account number ( XXXX ) from XXXX XXXX XXXX. I considered at the XXXX XXXX XXXX XXXX was just another modification, ( making home affordable advertising ) company seeking to get pervious XXXX XXXX holders. I had no knowledge of any connection between SPS Select Profolio Servicing and XXXX XXXX XXXX until I received written notice at a much later date. The notice dated XX/XX/XXXX. XXXX from XXXX XXXX XXXX indicating the account No : XXXX is being transferred to another mortgage servicer, without specifying the name of this servicer. SPS Select Profolio Servicing continue to send me payments notices, not having any knowledge of the legitimacy of SPS Select Profolio Servicing, I proceeded and contacted the Independent Foreclosure Review Administrator to enlist into the HAMP modification program seeking guidence and direction to go. On XX/XX/XXXX. I received a check in the amount of {$2000.00} from the Independent Foreclosure Review Administrator as compensation of this predatory mortgage issue to me. I also contacted XXXX XXXX XXXX XXXX, XXXX XXXX XXXX or Principle Reduction that will bring the remaining balance Current due to the errors and deficiencies the initial mortgage ) SPS Select Profolio Servicing continue their assault and aggravation on me to send payments to them, stating they where obtained by XXXX XXXX XXXX, XXXX. as trustee on behalf of the XXXX XXXX Trust Fund. an XXXX investors group and advise the were taking the matter to court, At this point, I choose XXXX XXXX XXXX to be represented by and has obtained their services in this matter filed XX/XX/XXXX in the Superior Court of New Jersey, XXXX Division of Union County Complaint for Foreclosure, Civil Action, Docket # XXXX by XXXX, XXXX XXXX XXXX, XXXX, attorney for the Plaintiff known as XXXX XXXX XXXX XXXX XXXX. as trustee on behalf of the XXXX XXXX Trust Fund. this fist court case was thrown out and dismissed. SPS Select Profolio Servicing, somehow got the court reverse the dismissal decision using another law firm, know as XXXX, XXXX, XXXX XXXX XXXX, XXXX. entering themselves in this foreclosure proceeding complaint as the " mortgage '' company and the XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX. as trustee on behalf of the XXXX XXXX Trust Fund. as the Plaintiff. and has an open proceeding of a Sheriff Sale of the property that they have fraudulent advise the court set for XX/XX/XXXX.
