Consumer Complaint: Agreement Per Our Recorded Conversation onXX/XX/2020 Tonight I spoke with XXXX in the Loss Mitigation department. Prior to speaking with her I did write a letter to my relationship manager and as of today 's date I have not gotten a response this was almost a week ago. She advised me of my current status PRE FORECLOSURE which I NEVER got any documentation to this effect. I only knew until she had given me a call which was an attempt to fix the error. Prior to speaking to her I called and spoke to a rep and advised of the upcoming payments which they had agreed and had already accepted the bank bill pay system. During the last few months this account was in more than 2 status at one time. I the consumer was not fairly given the opportunity nor advised what or where the account status was due to payments missing and no one actually knowing what or where this account was. I had made numerous calls. Never ever was I told I was in pre foreclosure nor was I given a specific date due to being in a pending status due to waiting on a decision on a modification on two failed attempts. I as the consumer/borrower I have made numerous attempts to fix this account with no assistance nor attempt by Select Portfolio other than this one call today from a rep that was very helpful and patient. I sincerely appreciate at least after many attempts today someone is helping me I hope cause I am still uncertain due to their track record. I did try to schedule a payment and she advised that she did see it in the system where I made several attempts to get current. She was very nice and advised she would wait for the payments to come in before going forward to another level I am still uncertain due to them saying one thing and always doing another. I advised her that all payments would be in by XX/XX/XXXX and that I would be giving her a call on that day to see if she had gotten all payments as agreed a total {$7900.00}. The money she advised is needed regarding account to stop any and all collection activity. I advised her my intentions to keep the property and she was willing to assist me with assuring all payments are credited to account as she agreed. My only problem is that they would tell me one thing on the phone and do another thing later. I would never get things done as they said they would. I only would like documentation stating the agreement because when you hang up the phone the company does whatever they see fit. Putting my account further into FORECLOSURE would only cost me more money when something is agreed already unfortunately, for me as the consumer/borrower can not believe nothing they say because they continue to do the opposite after hanging up the phone. Not sure if it is because they may be short of staff or because it may be too many accounts that they can not keep track of. Or their reps are not keeping notes to any agreement that they make and the extensions. It is always something not correct or rectified causing constant delay and misunderstanding in communication with the borrower. I sincerely request that all accounts with this firm are reviewed for if this is happening to me it is definitely happening to other consumers/borrowers. Unfortunately, the reps do not understand or do not care that they are actually affecting many lives without any care nor concern to work with the consumer

Consumer Complaint: I received a letter from Select Portfolio Servicing saying effective XX/XX/2019 they would be taking over servicing my mortgage. I was in the process of re-financing, which closed on XX/XX/XXXX. The closing payment was sent to my previous mortgage servicer on XX/XX/XXXX, and they had to wire the amount over to SPS. SPS didn't acknowledge the payoff amount until XX/XX/XXXX, and charged me for the 9 extra days of interest. This seems like a clear violation of RESPA, and in the transfer letter sent to me by SPS says : " During the 60-day period following the effective date of the transfer of the mortgage account servicing, an account payment received by your old servicer before its due date may not be treated by the new mortgage account servicer as late, and a late fee may not be imposed on you. '' Although this is not explicitly a " late fee '', they are charging me for extra interest because of the situation of my account being transferred which RESPA is supposed to protect me from.

Consumer Complaint: Good Afternoon, We XXXX and XXXX XXXX have tried unsuccessfully to come to a resolution in order not to lose our home. We have been in close communication with SPS explaining why our mortgage fell behind but we are still receiving letters indicating there are no available options to assist us. XXXX XXXX has been gravely ill over the past few years and I have attached his medical records showing the dates of all of his medical conditions. ( XXXX XXXX XXXX/XXXX XXXX XXXX ) I have also attached a letter of hardship to this complaint which explains more in detail. We were placed on a forbearance agreement in which I XXXX XXXX XXXX worked very hard to make all of the required payments up until XX/XX/2019 which is when my mother passed and I had to utilize all available funds including my mortgage payment in XXXX to attend my Mother 's funeral. I have also attached a copy of my Mother 's Obituary that includes the date of her passing.

Consumer Complaint: I lost my job a few months ago I started to get unemployment so I call the mortgage company to let them know the situation and that at this moment only income that I have coming in is my unemployment to see if they will work with me but that did not happen so because of that I fallen more behind on my mortgage now it's been 7 months since I mad a payment on my mortgage I called the company every chance that I got to see can I work out something and they refuse all they talk about is me paying all the seven months and all the fees that call mes with it over {$7000.00} money that I don't have at one point they put me on a payment plan that I could not afford because only thing I was getting what's the {$510.00} from unemployment they had me on a repayment plan off almost {$1300.00} a month something that I could not afford and now I am pending foreclosure now I am working full-time 40 hours a week and they still refuse to assist me no matter what I do no matter how much documents I show them about the job they just want to foreclose on my home to a point now that I am going to file for bankruptcy to keep my home. They receive all this bailout money and still refuse to help homeowners that is struggling to keep their home and make their monthly payment

I am - disputing a false middle initial placed on my name through the Select portfolio servicing which created another person on my mortgage with the account. # XXXX. The company has continue to use the same name and account number. as of XX/XX/2020 which is an illegal name and account number. However I can no longer excess my mortgage account though their online services. Although the select portfolio servicing were faxed and send the correct information by the owner of the property, over ( 60 ) sixty days ago. The Select portfolio servicing Inc has continue to use an illegal middle initial to create an illegal account number through a conventional mortgage foreclosure at XXXX XXXX XXXX Mi XXXX. However, as of XX/XX/2020 the select portfolio servicing Inc requested for the Owner/complainer to sign a document : which will not hold : Select portfolio servicing, accountable for their illegal errors. Therefore I ' XXXX XXXX is filling a [ second ] complaint against : Select portfolio servicing Inc. I am requesting for the select portfolio servicing to accept all responsibility for their illegal name error, and to change all account numbers to the mortgage account to reflect the correct changes ; belonging to the Owner. XXXX XXXX. financial mortgage loan. As of XXXX XXXX Select Portfolio servicing " has not " used the correct name, Nor a new account number to reflect the changes of the errors and the errors still exist. Consumer Complaint: The reason I am filing this complaint is because I believe that my loan has not be given proper consideration for a home retention workout that would allow me to retain my home. I originally re-applied for a loan modification back in XX/XX/XXXX/XX/XX/XXXXbecause I was not longer able to adhere to the repayment plan that was established by SPS due to a hardship we encountered. My husband injured his XXXX which has prevented him from working. This hardship created in reduction of income in the household which preventing being able to continue with the repayment plan previously established. My husband is now receiving XX/XX/XXXX and we just need to be given a fair opportunity to keep our home. In speaking with SPS and correspondences received, we were denied without considering our monthly household income because they were unable to reduce our monthly payment. In review of the NPV Test, it appears the reason they were unable to reduce the payment is due to the fact that they included a deferment ( non-interest bearing principal balance ) in the amount of {$310000.00} into the interest bearing principal of {$280000.00} totaling {$620000.00} into the proposed modification which obviously would increase my proposed payment significantly. Because they will not consider leaving the deferment balance in place, it's causing my loan modification to be denied. We are unsure if this is part of the Pool and Servicing agreement nor do we know if leaving the deferment in place was ever considered however ; we want and have the financial means to afford our mortgage.

Consumer Complaint: FYI-I have the money to pay to get out of foreclosure so this is not about me trying to get something for free just because. I have had to quite a few things to get almost $ 10k and I shouldn't have to. This shouldn't be allowed. My mortgage was sold to SPS in XXXX of 2019. My house payment is automatically taken from my bank for the mortgage every month. In XXXX, I called my house insurance to get a monthly price of what I was paying and found out that my insurance had not been paid ( It's escrowed ) for so long that they dropped me and I didn't have house insurance. I called XXXX XXXX XXXX XXXX and they informed me that they didn't have my mortgage and SPS had it. So first off, no one paid the the insurance. Secondly, my payments were still being sent to XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX sent my payments from XXXX to XXXX to SPS but discontinued after that. I spoke to SPS and asked them if they could help me get the money from XXXX XXXX XXXX XXXX and they said that they could not because it wasn't a situation where the payment was just " lost ''. Upon further investigation the funds started coming back into my account at the bank around XXXX without any notification. I have alerts on my phone for anything taken out and deposit but it was a reversal so it didn't alert me. I offered to show proof to SPS that I never stopped making payments and they were made every month on time ahead of schedule ... just to XXXX XXXX XXXX. They wouldn't tell me what to do other than they needed all of the payments. In the meantime, I had to search around for more house insurance so we were covered. They wouldn't accept payments from me unless it was the full amount from XXXX, XXXX, XXXX and so forth. I have not received any calls from SPS but have kept in contact with them. In XXXX I went online to see if I had a case manager yet ( I didn't ) and started playing on the website where I found a document giving me the option to pay XXXX, XXXX and XXXX and then regular payments after that for a modified mortgage. I tried to pay at the end of XXXX and was told I couldn't because It started in XXXX. No one told me this modified offer. No one called me and no one emailed it to me. So now we are up to XXXX. They still won't accept my money because it is not paying it off. I finally spoke to someone who helped me. The amount due was {$6600.00} at that point although my monthly payments missed added up totaled around {$2400.00} give or take since my insurance wasn't paid. I explained that I work full time 50 hours a week with a commute of no less than 2 1/2 hours a day every day. I am a single mother of a XXXX year old and XXXX XXXX XXXX year old who is considered XXXX currently. She spent 6months in the hospital at which time, I still made sure that every bill was paid for by depleting my 401k since I couldn't work due to having XXXX while XXXX. She was born at 25 weeks XXXX. The woman was understanding and put me on hold. She came back and said she spoke to someone and was told if I could pay {$4200.00} that would stop the XXXX Foreclosure sale of my home, my children 's home. The rest could be paid monthly in extra payments with my normal monthly payment. I specifically asked her by when and her response was, " Well I mean I'd get it as soon as possible since it sale is XX/XX/XXXX. '' I thanked her and told her I'd get it. At the end of XXXX, I called in to get the wire information to send the money and was told they wouldn't accept it because it was not the full amount. I explained to her the conversation that I had prior and she just kept telling me that they would never have said that. XX/XX/XXXX. I called once again to get it paid and was told again that there is nothing that I can do unless it is in full. In fact, NOW they want {$8600.00} from me to save my home, my babies only home they know. I can't refinance anywhere because of medical bills and also now it shows on my credit report that I haven't paid my house payment in months. Me and my children are going to be living in my car because they DOUBLED the amount owed within weeks. Even with all the wrong doings between XXXX XXXX XXXX XXXX and SPS, I still wouldn't have sent complaints in but they are strong arming me out of my home and giving me unrealistic pay offs. All I want is for them to accept my {$4200.00} and let me pay the rest off by paying extra with my monthly payments as agreed upon 2 phone calls ago. Let me save my home. Give me a chance that they won't take off of me last second like they have. I have never been told so many times that someone wouldn't accept my payments. To whom it may concern, I spoke to the company again on Friday the XXXX to find out they jacked the price again. I havent received anything. I called today and they dont see where they mailed a letter or where they were supposed to. She offered to give me the quote and low and behold the amount was jacked up again to {$9000.00} XXXX. How am I suppose to ever save my home if they jack it up {$500.00} every 3 business days????? XXXX XXXX XXXX

Consumer Complaint: I am filing a complaint regarding a lack of proof of service, lack of due process, lack of publication with regards to a foreclosure which took place on XX/XX/XXXX without my knowledge. This company, Select Portfolio Servicing , Inc. appears to have executed a foreclosure in violation of XXXX Civil Code 2924b. Although I currently reside in XXXX, I am a co-owner of a property located in XXXX. I did not receive any notice nor did I see any publication about the sale ; and thus I did not have any opportunity to defend my interest in my property. I can not even find a newspaper publication which announces about the sale nor did I see any proof of publication. I was told that my former partner, who is the co-owner of the property, is in Bankruptcy, and tendered payment in full to Select Portfolio Servicing , Inc. Further, according to an auction company of public record, XXXX, they confirmed that the auction of the property did NOT take place on XX/XX/XXXX. Despite these, when I check a public record, Select Portfolio Servicing , Inc. DID record a Trustee 's Deed Upon Sale on XX/XX/XXXX, indicating that an auction took place on XX/XX/XXXX and it was sold to the foreclosing beneficiary, being the highest bidder at such sale, became the purchaser of said property and paid therefore to said trustee the amount being {$700000.00} in lawful money of the United States , at the auction sale which did NOT take place on that day according to the auctioneer of record.

Consumer Complaint: I fell behind in my mortgage due to the natural disaster of hurricane Irma then Michael then Dorian all FEMA disasters one after the other. I was previously with a different mortgage servicer then my loan transferred to Select Portfolio servicing and I had to start the modification process all over. They have been very difficult to work with and they declined me but then I had a change in circumstance and my income increased by a substantial amount to where I could qualify for retention options. I submitted my update information and application on or about XX/XX/2020 but they claimed they didn't have time to review me due to the XX/XX/2020 sale date. This is not true and I was well beyond the 37 days before the sale guideline.

Consumer Complaint: I purchased this home in XX/XX/XXXX when I was working. I became ill and was put on a medical leave by my doctor in XXXX. I have struggled to pay my mortgage since my XXXX went from XXXX to XXXX XXXX and my XXXX payments went from 90 % of my pay to 60 % of my pay. I got married with the hope of some assistance but my husband moved out and refused to help. He has never made a mortgage payment. Every payment has been paid by me. I believe that SPS has looked at his income rather than mine to make the decision to refuse a modification but we never shared a bank account of money. He passed away in XX/XX/XXXX. I did not inherit anything from this man. I am not the executor, administrator or trustee of his estate. My only income is {$2400.00} a month from Social Security and my mortgage payment is {$1100.00}. Despite their refusal to modify my mortgage, I must struggle to keep my mortgage paid as I have no other place to go. I have been in my home 25 years and I am paying a mortgage on a home in a neighborhood where all of the homes are under water. Our property taxes are some of the highest in XXXX county. There are many vacancies on my block alone and many others are rented out under Section 8. People are abandoning their properties and leaving the area. I am trying to keep my home. I am XXXX years old and buying another home is out of the question because I can't afford to. Right now, I live close to XXXX of my children if I should need help.. There are properties on my block that has been vacant for 3 years or more. It seems as if Mortgagers and Servicers want these properties to be abandoned and vacant. It actually feels as if they want you to be homeless. I need relief from this struggle and a short sale is not an option.
