Consumer Complaint: I am submitting this complaint because I sternly disagree with the way my mortgage lender has addressed my recent request for assistance. In XXXX I was forced to tale early retirement, for lack of a better term. In that position was had to use virtually all of my 401K to get through the year. I actively job searched for nearly 10mths. Being XXXX yrs old did not make me a sought-after talent at that time. At the end of XXXX I was able to become employed. Unfortunately, my salary dropped by more than {$20000.00}. In XXXX and much of XXXX I had a severe financial struggle. I requested to modify the terms of my mortgage to no avail. Each time a requested assistance I was denied without taking my loss of income into consideration. Within days of requesting to modify the mortgage I would receive a denial letter in the mail stating that they were unable to assist me and that they did not take my income into consideration. I would then appeal the denial with no success. I continued making the payment as funds became available, but the payments were not on time, but they were made nonetheless! In XX/XX/XXXX I again requested assistance and this time I was offered the ability to repay the balance by paying a few hundred dollars more than the current payment. I agreed to that all in an effort save my home. I had made arrangements for the mortgage company to take the proceeds from my checking account for the first payment in XX/XX/XXXX. However, at this same time, XXXX Florida was threatened with a direct hit from a hurricane at the highest category. I called the mortgage company and spoke with a young lady and I asked if they could not take the money from my account because I needed to now use that money to prepare for the hurricane. I recall telling the young lady that I did not want it to appear that I was trying not to pay the mortgage as promised, otherwise, I would be defaulting on the agreement. The young lady told me that she could not stop the payment, that I was too late, and she further noted that the mortgage company was in XXXX Fla and they were aware of the hurricane. Needless to say, by me not making the initial payment the records indicate that I did not keep the agreement. All subsequent attempts to modify or get mortgage assistance was simply denied verbally as each time I would call, the representative would tell me that they do not have any assistance to give me. Complaint : 1. Mortgage company deliberately placed ne in a no-win situation. I have received several pieces of correspondences all which tell me that they may be able to assist me and for me to call the representative yet when I call, I am verbally told they can not assist me. 2. Mortgage company sends out several correspondences overlapping each other with no real way of understanding the process of what comes next. I have called the mortgage company as recently as XX/XX/XXXX with a representative from XXXX on the line and specifically asked about a correspondence that referenced 37 days. I then asked what that meant or want was I supposed to do as I did not understand the correspondence and the representative could not give me any guidance. Subsequently I could only understand that my home would be placed in foreclosure and that I had 37 days to do something. 3. I was verbally told that I did not have any more appeal rights. Yet, correspondence dated XX/XX/XXXX specifically speaks to appealing an earlier denial of modification. The appeal must be received by XX/XX/XXXX. This same letter speaks about foreclosure alternatives. Although I have been told verbally time and time again, even as recently as today after speaking with XXXX that there are no alternatives for me. There is far too much internal conflict, yet I, as the mortgagee am supposed to be able to navigate all of this by myself. 4. I requested a Reinstatement Letter so that I could get what remaining monies from my 401K to put towards the delinquency. I spoke with a representative Friday evening on XX/XX/XXXX. The letter was mailed on XX/XX/XXXX and I received the letter on XX/XX/XXXX. You can readily see that this letter only gives me until XX/XX/XXXX to pay the delinquent amount. So, in essence I was given 6 days to cure the debt in the amount approximately {$4.00}, XXXX. 5. Letter dated XX/XX/XXXX stated that I must completed necessary paperwork for loss mitigation ; however, each time I called the lender I am told that there are no programs to assist me. 6. I called my lender on XX/XX/XXXX to discuss the short amount of time to cure the debt based on the Reinstatement letter noted in # 4. The representative then generated another reinstatement letter on XX/XX/XXXX and told me that the new amount to reinstate is approx. {$5500.00}. I asked how the reinstatement amount exceed {$1000.00} in 3 days. The representative could not give me a response other than to say maybe it is attorney fees. As you can see, it is not reasonable to expect a customer to navigate this process when the representatives are not sure what they should do and more importantly, their system charges excessive amounts within 3 days with no explanation.

Consumer Complaint: XXXX XXXX XXXX is listed on a Alleged deed of trust, a company named XXXX filed suit in XXXX in a XXXX foreclosure and was denied for lack of standing, and according to the Texas secretary of state records XXXX 's name became inactive as of XX/XX/XXXX, then in XXXX of XXXX a Civil Debt collection suit was filed using XXXX ( inactive ) as plaintiff in asking for both a judicial and non judicial foreclosure, which was granted to inactive XXXX. a foreclosure sale commenced on XX/XX/XXXX R.E.O 'd to XXXX XXXX, a company according to a certified copy of record from the Texas secretary of state is and was terminated as a foreign entity in XXXX and had no rights to bring suit against me, along with the attorneys working on behalf of XXXX, XXXX, XXXX, XXXX and XXXX XXXX. sending me letters stating " this is a debt collector attempting to collect a debt '' but are not bonded in texas as debt collectors according to the Texas secretary of state office, a fraudulent deed was filed in the real property records of XXXX county texas, and Legal Injury was caused by the illegal practices of fraud which resulted in a REO of my property by means of a constables deed and a recent eviction attempting to be served on me currently the sheriff was at my house this morning to kick me out, also fraud deed encumbered property of empty lots for equity on a homestead

Consumer Complaint: I am writing to complain about questionable business practices currently being employed by Select Portfolio Servicing. I hope your office as assist me in resolving this matter without the need for further action. Therefore, I am requesting that your office launch a full inquiry into this matter. The issues are as follows : On or about XX/XX/XXXX, I attempted to pay my mortgage payment ( for XXXX ) with Specialized Loan Servicing. However, the representative informed me that as of XX/XX/XXXX, my mortgage account was transferred to Select Portfolio Servicing and that I should contact them to make all future mortgage payments. I immediately contacted Select Portfolio Serving and the representative confirmed that my account was indeed transferred to their company. The representative also told me that my account hasn't been inputted into the system and that I should wait a few days to make my payment and that I had 60 days to make any past due payments without any adverse effect to my credit profile. On XX/XX/XXXX, I received a letter from Select Portfolio Servicing confirming that my mortgage account is being transferred from Specialized Loan Servicing to Select Portfolio Servicing. On XX/XX/XXXX, I called Select Portfolio to make a mortgage payment ( while still under the impression that I am still protected by the 60 grace period to make my payments. I made a payment of {$1800.00}, which was applied to my XXXX payment. During that conversation the representative stated that Select Portfolio has several payment options that could assist me in catching up on my XXXX payment if necessary. I initially rejected the offer, since I still believe until XX/XX/XXXX to bring my account current. On or around XX/XX/XXXX, I contacted Select Portfolio Servicing and told the representative that I wish to enroll in their 6 month deferment program. The Representative told me that my first payment is due on XX/XX/XXXX in the amount of {$2400.00}. I was still under the impression that since I made this arrangement before my grace period ended, this enrollment would not have any adverse effect on my credit profile. Plus the representative did not mention that signing up for this program would have an adverse effect on my credit profile. On XX/XX/XXXX, I made my first payment in the amount of {$2400.00}. However, shortly thereafter I receive an alert from my credit monitoring account that my credit score was decreased by 55 points due to a late payment! My wife 's credit score was also reduced by 48 points! On XX/XX/XXXX I contacted Select Portfolio to inquire about the late payment. I spoke to a representative at the main office ( XXXX ) who stated that while I am on this program for the next 6 months they will continue to report a past due late payment to the credit agencies. I stated that if I knew this from the beginning I would not have signed up for this program. This program does not benefit me in the least. I told her to remove me immediately from this program and I will make my arrangement to make my mortgage payments for XXXX and XXXX shortly. I made my XXXX payment on XX/XX/XXXX and plan to make my XXXX payment within the next two weeks. If the representative was transparent and honest during our conversation, I would never signed for such a ridiculous and unscrupulous program. This is a questionable business by this company aimed to ruin the average consumers credit. I asked the representative to explain the benefits of such a program. She said was that you could avoid late and attorneys fees! How does late fees and attorneys fees compare to a ruined credit profile? I thought that as long as a signed up for this program with the 60 days grace period it would have no adverse effect of my credit. I think that this very important point should have been mentioned when joining this program to give the person an opportunity to see if joining this program is worthwhile. However, the representative failed to mention this! I am a XXXX XXXX and currently hold a XXXX XXXX XXXX and having good credit is one of the conditions of employment. Having derogatory and adverse information on my credit could cost me my job! Plus I will have to explain this issue during my next re-investigation. The representative said that she understood that there was a misunderstanding and told me that she would contact her Legal department to see if they can reverse the points on my credit profile. However, I have little faith that they will do anything. This company does not have a good reputation based on the complaints that I have read on the XXXX XXXX XXXX and the Consumer Protection Agency websites. I intent to file similar complaint with the Office of Consumer Affairs and the Maryland Office of Financial Regulations. This program should be offered to folks who are months behind on their mortgage, in bankruptcy or foreclosure. They should be more explicit when offering these payment options to their customers. I have only been late once on my mortgage payment which that was due to a time different ( the company was located in a different time zone. Consumer Complaint: On XX/XX/XXXX, our loan was transfer from XXXX XXXX to SPS for servicing. Due to my bankruptcy, there was an issue with my statements as the address on file was my attorneys address, once we rectified this, I got my first statement and I noticed an entry for Deferred Principal in the amount of {$7800.00}. On XX/XX/XXXX I called SPS and talked to XXXX asking for an explanation on the {$7800.00} deferred principal that was showing on my statement. She was unable to locate the reason for the extra principal but explained that this was something that was received from the prior servicer. She said she was sending a request to research and that I should receive something in the mail. I received the documents showing an adjustment for the same amount on XX/XX/XXXX but no other explanation. On XX/XX/XXXX I sent a letter with all the documents below asking SPS to for an audit on my Mortgage Loan and for a clear explanation with supporting documentation proving the reason of the addition. Attached the following documents : XXXX Form 1098 showing and outstanding mortgage principal as of XX/XX/XXXX of {$210000.00} XXXX XXXX # XXXX Statement dated XX/XX/XXXX with an outstanding balance of {$200000.00}. SPS Loan # XXXX Statement dated XX/XX/XXXX with an the following amounts : o Interest Bearing Principal of {$190000.00} o Deferred Principal of {$7800.00} o Outstanding Principal of {$200000.00} I did receive a letter stating they received my letter and documents but I have not received any information from them. Once again, My latest statement is till showing a Deferred Principal in the amount of {$7800.00}.

Consumer Complaint: I have had a mobile home mortgage with XXXX XXXX for nearly 10 years. I was never late with a payment and always sent more than the minimum due. My principal and interest were nearly the same as you can see from these past few statements enclosed. XXXX of 2020 I made my last payment to XXXX XXXX as they transferred my account to Select Portfolio Services ( SPS ). I made my first payment early to SPS in XXXX which they received XX/XX/XXXX being 7 days early of the due date. Upon receiving my first actual statement from SPS showing my first payment to them, I was mortified to find they put 80 % of my payment toward the interest, 17 % toward the principal and .26 % for fees and other charges. These last 2 resulted in a 27 day billing cycle from my XXXX payment to XXXX XXXX and the XXXX payment received by SPS. I immediately called SPS and questioned this, and several people at SPS kept telling me these figures were correct. Also, no one can tell me what the fees and charges are for or for how many days they used in the billing cycle to calculate these interest charges. Finally, after requesting several times, I was able to talk to management, and they had me send in my statements from XXXX XXXX and SPS, and it is now under review. My regular payment is XXXX, and I have been sending XXXX XXXX {$700.00} for many months. I am including some of my last payment statements from XXXX XXXX and my current statement from SPS. I just made another {$700.00} payment so as not to be late. On my current statement from SPS, the figures I wrote in by the principal and interest is what I believe these figures should be, or at least very close. There is a lot of recordings of my calls to SPS, or so I opted for when making these calls.

Consumer Complaint: I have had a very difficult time with SPS. I have tried to submit for a loan modification several times. I was never able to communicate to the same person which always caused confusion. SPS always seemed to lose my paperwork, which I constantly had to re-fax. When I finally was approved I unfortunately was unable to make trial payments because I got furloughed. When I reapplied SPS said I was not longer eligible for a loan modification. When I called them and asked to fo a short sale they told me I was not allowed to apply for a short sale. Then SPS placed a foreclosure sale date on my property. I simply want to avoid a foreclosure and move on. A foreclosure will destroy my credit for 7 years, and will cause me another major hardship.

Consumer Complaint: To whom it may concern, this will be the 3rd complaint submitted on this file. The client recently filed a chapter XXXX bankruptcy and since the bankruptcy has been filed, we received information that is concerning to not only the client but the bankruptcy court as well. Complaints were filed with the CFPB on XX/XX/2019 and XX/XX/2019 regarding a discrepancy of the number of modifications the client has already received. The lender was claiming three modifications were received by the client but could not produce any documentation confirming these modifications even existed. A complaint was filed to ensure the CFPB would step in demanding copies of the three modifications the lender stated she received however that was never done. The reason the amount of modifications received was in dispute is because per the client she only received 1 for the life of this loan and in the pooling and service agreement she is entitled to more than one. Per CFPB guidelines the lender needs to exhaust any and all loss mitigation options that would allow the client to keep her home if there is a valid hardship in which there was and still is. Instead of the lender helping her they wanted to increase her monthly mortgage payments to over 51 % of her net income which is clearly not affordable and would cause her to lose her home. That is not a modification by any means. Also, by stating she has had multiple modifications it created a bias with the investors as they were under the impression, she had three already. Per the answers from the complaint filed on XX/XX/2019 and XX/XX/2019 the lender admitted to providing incorrect information and stated the client has only had two modifications. That letter will be attached for your review. The concern at this time is after speaking with the bankruptcy attorney for XXXX XXXX XXXX XXXX XXXX about this issue she requested copies of any and all modifications on the file and the lender confirmed with their attorneys that there has only been one modification given to the client XXXX XXXX since the loan was taken out which again contradicts what the lender is stating and it seems as though the lender has given nothing but false statements to not only the client but the CFPB as well. This is not only outrageous but extremely unfair and against the guidelines of the investor who should be required to assist us with this matter as the lender is solely their responsibility. The investor and the lender should be held fully liable and accountable for the false statements and false information given which not only could cost this client her home but also effected the bankruptcy proceeding as well.

SPS has filed an Erroneous Notice of Trustee Sale for XX/XX/XXXX. XXXX XXXX XXXX Kicked the can down the road but never resolved original dispute. SPS is attempting to sale home under a Trustee foreclosure sale but I feel is violating CA foreclosure laws and does not have a valid debt and /or has not gone though proper steps.
