Consumer Complaint: SPS is in violation of RESPA and acting in bad faith regarding a real estate transaction. At issue is a short sale request that was submitted on XX/XX/. SPS then countered based on a drive by property analysis which is NOT valid with lived in homes. We then supplied written documentation stating this property was improperly valued as a 3 bedroom and their value was inflated. We advised them to act in accordance with RESPA and contract guidelines they are required to do an interior and to take into consideration the illegal additions which must be removed. SPS is refusing to do an interior and they laughably put in the notes they only consider what they can see in the photos which is literally the outside of the home. This is gross negligence and incompetence regarding a financial matter. SPS should be significantly fined just like XXXX XXXX as they are harming homeowners.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: We are currently in the process of Refinancing our primary mortgage to get a lower interest rate and get rid of PMI. Our secondary insurance has not completed the subordination in a timely manner. every time we call, which has been weekly and sometimes twice a week, we get the same story that the underwriting team is having difficulty obtaining documentation of ownership of our loan. We refinanced our primary mortgage 2.5 years ago to get out of a very high ARM, SPS subordinated their loan in less than 45 days without any issues. This time we are pushing towards almost 90 days since the request and have 21 days left on our third lock rate. If they do not subordinate, we can not extend our lock rate and will lose our lower rate. Every time I call I get the same story from every employee at SPS, they are waiting on underwriting to get ownership of the loan. I have been told that it takes time and gets held up in the courts, I asked why the last time it was done so quickly and now they don't have the proper documentation this time, they say they can't speak on behalf of things that happened in the past. ON XX/XX/20 I was finally able to get XXXX at the " XXXX XXXX XXXX '' office that looked into the account, saw that the old subordination was complete in less than 45 days and did not understand why this time was different. she gave me her direct extension of XXXX which come to find out is not an extension to her, it just goes to the call center. I do not appreciate being pushed aside and lied to. XXXX stated that she was going to send some emails out and further research it on Monday and call me back. XX/XX/20, I have not received a call from any one at SPS about the subordination of the loan. If we are unable to finish the refinance of our primary mortgage we are going to lose the {$570.00} for the appraisal on our home and a {$250.00} lower a month mortgage payment. when I ask to talk with some on in the underwriting department, I am told there is no phone number all the customer service reps can do is document the account and escalate the issue. I have called so many times that at this point the amount of escalations should be on the presidents desk. I asked who the mortgage owner was on the loan as SPS is just a servicer, I was told they could not give me that information. I am tired of being given the run around and not getting any where. I pay SPS every month, on time and this is not fair! I have had enough and would like to consider taking further action, but I am unsure who to contact to do so. thank you for your help with this complaint.

Consumer Complaint: I tried to do a loan modification with SPS. SPS is stating to me that because I had other reviews in the past the investor says I am not eligible. I next submitted a short sale and SPS approved this short sale. I had several judgments and liens to get cleared up in order to make the closing on time. We got 2 extensions from SPS and when were ready to close we asked for a 1 day extension and SPS declined this extension. SPS then closed the short sale review. The very next day we resent the entire short sale file to SPS and they stated the investor which is the XXXX XXXX XXXX XXXX XXXX would not open a second short sale review per their guidelines. I spoke to XXXX XXXX XXXX XXXX XXXX and they stated I am eligible for a short sale because there is no sale date within 37 days of the review and they told me to resend the file to SPS. It seems SPS is making up rules on their own rules as I spoke to some of their other clients who have SPS but a different investor and SPS is telling all clients they are not able to do a second short sale review because the investor only allows one review, no matter who the investor is. SPS should open my short sale review. I am eligible and they refuse to confirm this with XXXX XXXX XXXX XXXX XXXX. They should also open the review because these short sale documents were submitted 37+ days prior to any scheduled foreclosure sale date. This is unfair to me, the buyer, and all parties involved in this short sale.

Consumer Complaint: Previously I filed a complaint against SP Servicing that they did not apply my funds appropriately. They responded back that I accrue daily interest. I demand my monthly interest amount when I paid my mortgage on XX/XX/2020 and they failed to respond to my request. They also said there was an error that had to be corrected and my previous interest was miscalculated. There was no error. They did not provide proof of the error or any documentation addressing that there was indeed an error. I demand proof of error. All they provided was a copy of my mortgage which I already have. These idiots truly believe that they can keep saying that my mortgage accrues daily interest and that justifies what they did. As stated my payment was {$930.00} dollars, but for one month they charged me over {$1100.00} interest. Interest was roughly {$500.00}. They must show how this interest was calculated or I will continue to file complaints until they do. In fact will be filing a complaint in the state of Texas where my home is located. Send me the proof I have demanded. They will refund my money.

SPS has been continuing to send me mail, harassing me about a contract that does not exist and now SPS just sent a letter that SPS is assigning this contract to a law firm for potential foreclosure. Homeowner has sent XXXX, SPS and Investor by certified mail return receipt : 1. Rescission Notice : 1st, 2nd, and Final Notice 2. Notice of Default and Dishonor 3. Notice of Injury 4. Conditional Acceptance Notice 5. RESPA Letter Respondent failed within the days allotted to Respondent after the initial communication with Claimant in the collection of the assumed debt the following : a. The true amount of the debt b. To whom the creditor the amount is owed c. a statement that the Respondent obtained verification of the debt or a copy of a judgment against the Claimant and a copy of such verification or judgment will be mailed to the consumer by the Claimant d. They responded to me on XX/XX/XXXX, stating that they were going to reduce my rate down since I am protected by the SCRA. I am still on XXXX XXXX and they increased my rate back up to 11.200 %. Also, my balance was {$39000.00} at that time. I have been making my payments and sending in extra, and my balance is {$39000.00}. They are not using the extra money that I send in to pay on my principal balance. My principle has barely lowerd since XXXX. SPS is charging higher interest twice. Once for not keeping my protected SCRA rate and again for not using the extra payment amount towards my principle.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: On the past month of XXXX, I applied to buy a home. I was surprised when the loan officer denied me due a negative account on my credit report from XXXX. I disputed the account with XXXX via certified mail XXXX. Back on XXXX, your institution was notified to relieved me of all responsibility regarding this account. This account belongs to my ex-spouse and as you can see in the court documents attached, I was supposed to be removed. I sent as a supporting document the Court Order including the translation. ( See attached ) I received the dispute results ad came as verified as accurate. Its funny that mentioned the report was updated. I sent the letter on XX/XX/XXXX and was received on XX/XX/XXXX. But the new report generated today XX/XX/XXXX said the account was updated on XX/XX/XXXX Does they really investigate the account? If so, why the dates showed they didnt. ( See attached ) I Also disputed the account with Select Portfolio Servicing via certified mail # XXXX. The letter was received by the mentioned company on XX/XX/XXXX ( See attached ) As today, XX/XX/XXXX the company didnt respond. Under Fair Credit Reporting Act ( FCRA ), companies generally have 30 days to investigate the dispute. Failed to respond is a violation under the law. When I sent the dispute, they supposed to cease and desist any collection activities until they send me the results of the investigation. They didnt response my dispute, but they went ahead to verify the account with XXXX which under the law is considered a collection activity which is another violation under the law. As you can see, there is a lot of violations involved here. Im demanding to remove the account # XXXX reported by Select Portfolio Servicing from my credit report due the mentioned violations and because the account is not belong to me. See attached the letter copies of the letter sent to XXXX and to Select Portfolio Servicing and the Court Order.
