Consumer Complaint: MY lender does not want to remove the differed principal as per the principal forgiveness program as of XXXX after the court settlement to reinstate the loan. They purposefully forced by not accepting payments under hardship and took me to court demanding full payment and then a foreclosure and sheriff sale date, which ended in the court by me providing the proof of funds to the judge and he asked then to reinstate the loan as per the agreement. Which puts both the parties at the original point. They include in the statement all late fees and legal fees and interest and every possible way of making more money from me, I paid every single dollar and they still do not honor the original agreement as of XXXX. I have emailed the servicing company multiple times and they fail to understand and the Lenders are unreachable. The original loan was in XXXX. The Loan was modified in XXXX. Court settlement in XXXX. If you investigate into this loan you will see the Loan origination fraud and the unethical Practices of the lenders. Please refer to section 3.C of the loan modification and compare with my current month statement and you will notice that in the current month you still see {$140000.00} of the {$210000.00} still showing up on my statement till date.

Original loan amount was {$140000.00} and now they claim we still owe {$150000.00}!!!. That was the only period we were late on payments and it was due to a hardship. This loan/company is unethical and doesn't add up. We've been paying on this loan for 14 years and still owe more than purchase price? I'm at a loss and they can't explain and have hung up on me.

Consumer Complaint: On XX/XX/XXXX we submitted our latest Notice of Error and Qualified Written Request to our mortgage loan servicer, Select Portfolio Services , Inc. ( SPS , Inc. ) detailing an ongoing dispute with the company regarding the company 's incorrectly reported unpaid principal balance on our mortgage loan with them. We have disputed the unpaid principal balance amount with them since our first inquiry to them in XX/XX/XXXX, when we first identified the error in the company 's reported principal balance. Since then, we have submitted 8 notices detailing our dispute, along with extensive and irrefutable evidence to back up our claim. In each case, except our most recent submission, SPS , Inc. has replied to our notices, including our next most recent submission on XX/XX/XXXX where they replied on XX/XX/XXXX. However, they have not corrected their error under 12 C.F.R. 1024.35 nor have they correctly explained their unpaid principal balance with a legally supported explanation under the Loan Agreement and Deed of Trust that governs their fiduciary obligations when they serviced our loan. Furthermore, they have not provided any direct and irrefutable evidence to support their unpaid principal balance claims, or that refutes our error notice or the evidence that we provided them and that we used in our dispute with them. On XX/XX/XXXX we submitted to SPS, Inc. our latest Notice of Error where we explained - using the Loan Agreement and Deed of Trust, the loan amortization table ( that SPS provided us ), the XXXX Forbearance Agreement ( that we successfully completed and that did not include an agreement to defer any installment payments or accrued interest ), our payment history, past periodic statements and other supporting evidence - that the correct principal balance was exactly or almost {$110000.00} and that the loan will be fully paid off on the loan maturity date on XXXX, XXXX. As of XX/XX/XXXX SPS , Inc. has incorrectly reported the unpaid principal balance as {$200000.00}, even though they report the identical repayment terms, loan maturity date, Loan Agreement, Deed of Trust, payment history and loan amortization data that we used to determine the correct unpaid principal balance of {$110000.00}. In their past 8 responses to our repeated inquiries and Notices of Error, SPS , Inc. has attempted to explain that their reported principal balance was correct because the " prior loan servicer '' ( XXXX XXXX XXXX XXXX XXXX XXXX ), '' deferred accrued interest to the end of the loan '' or " added deferred interest to the principal balance '' or similar nonsensical explanations that were not legally supported under the Loan Agreement and Deed of Trust between us. In our XX/XX/XXXX and XX/XX/XXXX Notices of Error, we explained to SPS, Inc. how their explanations for their reported principal balance were nonsensical and not legally supported under the Loan Agreement and Deed of Trust. We also further explained, using over 100 pages of extensive and irrefutable evidence, how XXXX XXXX XXXX XXXX, XXXX misappropriated almost {$72000.00} of delinquent installments that we paid to them, instead of applying them to the loan as they were solely obligated under the Loan Agreement and Deed of Trust. We also explained how the {$72000.00} that we forwarded to XXXX XXXX XXXX XXXX XXXX has never been accounted for by any of the 3 loan servicers of our mortgage ( XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX and SPS , Inc. ), and has been missing and unapplied to our loan since XX/XX/XXXX. We also explained how XXXX XXXX XXXX, XXXX fraudulently reported the almost {$72000.00} that they misappropriated as " Deferred Interest ''. Lastly, we explained how the almost {$72000.00} of misappropriated and unapplied funds accounts for the difference between the correct principal balance of {$110000.00} and SPS , Inc. 's incorrectly reported principal balance of {$200000.00} on XX/XX/XXXX and how SPS, Inc. 's " deferred interest '' explanations for their reported principal balance were incorrect and not legally supported under the Loan Agreement and Deed of Trust.

Consumer Complaint: Hello, I am requesting a futher review of complaint number XXXX. The case was closed and the issue still has not been resolved. The issue still has not been resolved, SPS has requested more documents after the complaint and still has not issued a response in the matter. They have had all required documents this time since XX/XX/XXXX. Please keep in mind this process has been going on for 2 years and due to delays on their end we continually need to send updated documents. This of course restarts the review process and starts the vicious cycle over again. For the life of me I cant believe a company is allowed act like this, how are they in compliance? Here is my original complaint filed XX/XX/XXXX Two years ago a applied for a mortgage modification with my original mortgage companies which were XXXX ( 1st mortgage ) and XXXX ( 2nd Mortgage ) and with in a month or so both loan were transfered to Select Portfolio Servicing after being with my old lenders for more than 10 years never missing a payment. Since being transfered to SPS I applied for a modification and was turned down twice. In XXXX of XXXX I applied for a short sale and went under contract and they dragged out the process for more than a year and the buyer walked leaving me to relist the home and start the process all over again. I have not been back under for more than a year and I see no end in sight. They request documents which I provide then they say they need 7 days to review and then something else will expire and the circle just continiues. I am trying to move on with my life and I moved out of the home a year ago thinking the short sale would take place and as of today they are requesting more documents. What options do I have if any? We also have been working with an agent that can supply addional information if needed XXXX XXXX XXXX

How can Select Portfolio Servicing Flagg a loan modification on XXXX XXXX with XXXX? This is crazy, Im not sure if they changed or added a new account number because I had no knowledge of the above. Please, please investigate on what going on. Follow the money, I can guarantee those missing checks and funds was used for investments accounts funds for profit. I wanted to know who is holding the mortgage note? I really think you all need to check for yourself because they lied and said it was with some insurance and when I call they had no knowledge of what SPS stated on one of the documents they sent to CFPB

Consumer Complaint: Select Portfolio Servicing ( SPS ) keeps adding unjustified " Fees and Other Charges '' to my mortgage account. When I ask what the fees are SPS say that they are for attorney fees, and things. I have paid said attorney fees over and over again. We were in court months and months ago and all fees were paid. The account was up to date. Suddenly " Fees and Other Charges '' in the amount {$900.00} showed up on my XX/XX/2020 statement. When I logged into the Select Portfolio Servicing web portal the " Fees and Other Charges '' shows as " Fees and Advances '' and the amount is now {$930.00} and not {$900.00}. Now the total due is {$930.00} ... the EXACT same amount as my monthly payments. When I called and asked about the {$930.00} charge ... .I was again told that it was for attorney fees, inspection ( no inspection was ever done. ), and " stuff ''. As a minority I feel that this is a further attempt to keep my account in a less than favorable standing so that " Fees and Other Changes '' can be added at will.

Consumer Complaint: The first time select portfolio servicing miss appropriated the principle funds on my Account was The First Payment in XXXX. They did not pay on the Principle. They held the payment for more than 5 Days. Posted it late. Then they sent me a letter about setting up an Escrow Account as an Excuse. This theft pays out for the life of the loan. SPS is still stealing from me on this one. The second time sps miss appropriated the Funds on My Account was/is 6 months later. They modified the payout without notice or permission. Sent Me a Statement for 2 months only one payment and did not make the correct payment on the principle. Basically, It says. Don't worry about paying the XXXX payment. Pay XXXX and We'll only charge XXXX $ plus Your regular payment. I called them XXXX. I was told to call back in a couple of weeks to see if it's fixed. Two Times in 6 Months. They ASSUME EveryBody has a Computer. Sps has sent me several demand letters for asking for Proof of Insurance Coverage and threatened to charge my Account XXXX $ for Insurance. My Home was/is Insured. I called the Insurance Company for Them. Told them to Fax Them the Policy had been Changed to sps on XX/XX/XXXX. On XX/XX/XXXX I get another Demand Letter Demanding written authorization signed by all signers of the original mortgage documents which states that you would like to set up and Escrow Account And Copies of current property tax and hazard insurance billing statements showing that these Items have been paid in full for the next ( 12 ) months. Evidence may be in the form of A. A paid in full receipt or B Front and back copies of your checks used to pay the Item in full. That's Verbatum to the Demand Letter. My Account had an Escrow Account when They took It over. They can't get the statements out in a reasonable amount of time and are trying to force me to pay late penalties. I've had to call sps more than 10 Times in 6 Months spending a lot of My Time dealing with their Demands. I've also E-mailed Them a couple of Times. I sent a Written Notice of Error on XXXX sps has Pressured Me EXTREMELY HARD for Online Payments. My Account. The Account sps acquired from XXXX XXXX Manufactured Housing has/had an Escrow Account Set Up. I did not borrow money from sps. It's XXXX around XXXX XXXX Central USA Time and I'm Posting This. sps has not called me back or e-mailed me back with news that My Account has been corrected. sps has done this and other things to people on many other acquired Loans. They have not stopped stealing from People.
