Consumer Complaint: We have contacted SPS and tried to work out something on out loan and they are not willing to help us. We feel that that they are using predatory lending practices to try to force us out of our home. On XX/XX/XXXX, I was laid off and reached out to them to get help under their unemployment plan that they offer. They denied us and sent us a repayment plan instead. It was for {$3100.00}. Also, they sent us a foreclosure notice and referred us to an attorney. I thought under the new stimulus package that President5 Biden signed, that all foreclosures were stopped until XX/XX/XXXX. They are violating this that was enacted by our president. I called them about this and they offered no answer or even discussed this. I had also asked about a forbearance plan and they denied this as well. We also asked about a new loan modification and they denied this as well. We sent them a payment on XX/XX/XXXX and they sent it back to us. We are trying to get this settled. We have not contacted an attorney yet. I wanted to see if there was one that was recommended. No matter what we do, they are denying everything and we feel we need some help as well as maybe an attorney.

Consumer Complaint: I am once again writing to CFPB about ongoing changes to my account. First, let me say that I have been paying this account from the beginning and more recently, although we are in a financially destructive pandemic, I have not missed one payment. I have still paid the full amount of my monthly bill, and at times paying over the required amount. With this said I am still incredibly inundated with added fees. Second, I have always paid my own property taxes and home owners insurance. I have written and provided Select Portfolio Servicing, inc. with the required documents requested. Although this document is on file at Select Portfolio Servicing , inc, I am still being charged a monthly fee to pay property taxes. I have also not lapsed in my homeowners insurance even when switching to a better insurance servicer. When the residential taxes and insurance are paid by me, the fees are not taken off. This has been happening for years. Third, a Select Portfolio Servicing, inc. representative went so far as to divisively pay my property taxes even though Select Portfolio Servicing , inc. has on file that I pay them myself. When Select Portfolio Servicing, inc. found that the XXXX XXXX department would not return their duplicate payment, Select Portfolio Servicing, inc. charged me the unreturned payment. Fourth, I am consistently charged other fees that are not explained on any billing invoice. Fifth, I am being charged a fee that fluctuates each month I make a payment and appears as a late fee. This fluctuating fee is posted although I have paid and continuously paid from the beginning, on the last day of the month. I GET THIS FEE EVEN AFTER CONSISTENLY PAYING DURING THIS PANDEMIC AND HAVE NOT MISSED ANY PAYMENT. Sixth, when I pay extra on the monthly payment it seems to vanish and I do not see any of the extra payment listed. But Select Portfolio Servicing, inc. fees are always posted and clear without explanation. Please see all previously attached documents as this is an ongoing issue. Consumer Complaint: I am reaching out seeking assistance in dealing with our mortgage provider. We are XXXX XXXX XXXX XXXX XXXX providing XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. We were severely impact by the pandemic shutdown last year and were unable to make our mortgage payment. The provider agreed to a forbearance plan. Now they sent us a repayment plan with a monthly payment that is more than double of what it used to be prior to the pandemic. I reached out to them and they said there is no other option. There is no way we can pay the amount of the plan since it is more than our monthly income and more than double of what it used to be before our business was impacted by the pandemic. We need help to get them to agree to a reasonable payment amount so we can keep our home. Please advise on how you may be able to help us or what else we can do? Thank you.

" Loan Servicing Representative Select Portfolio Servicing , Inc . XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX XXXX : XXXX XXXX XXXX XXXX Account number : XXXX. Contact number : XXXX Dear Loan Servicing Specialist : As part of my introduction to this hardship letter I want to clarify the fact that I am submitting a loan modification request package to you for the fifth or six time. This letter is to support our application for a loan modification that will help us to get our mortgage payments back on track with an affordable mortgage. We have lived in our home for over 20 years. Although we have been working hard to produce the necessary income and keep it, Covid-19 was and is an exceedingly difficult to overcome. I have my XXXX XXXX Business at home. If we lose the home, we will probably have to move out of the City of XXXX and lose all our clientele as well. Even though right now our clientele is not much due to the circumstances we all live on it, we hope the future bring us a better outcome. We fell behind on our mortgage due to the loss of income because of Covid-19. We had an extremely hard time dealing with our debts because we never had financial problems like this before. There are so many expenses and managing a home, family and a business is hard. Since the time we purchased our house in XX/XX/XXXX until XX/XX/XXXX we never missed a single payment on our mortgage. We ( My wife and I ) have been self-employed in the XXXX XXXX business for more than 24 years as XXXX XXXX. We lost our clientele back in XX/XX/XXXX due to Covid-19 and our unemployment compensation was only around 45 % of our prior income. I was able to increase our income as XXXX XXXX XXXX as of XX/XX/XXXX to make up part of the difference, but we were unable to make full payments for XXXX through now. However, your Company did not accept my requests to lower the loan interest and instead of helping me out you just ignored my requests. Furthermore, you just keep sending me letters with my accumulated balance which include mostly interest since XX/XX/XXXX. This is unfair because since XX/XX/XXXX I have been trying to get a low interest Modification Loan and you again ignored all my online applications. As a result, most of my balance is just interest due, again because you keep ignoring and/or rejecting my online applications to avoid interest from going up. With a Loan Modification Low Interest, we will be able to start making payments again soon. I am tried to get of my clientele back as well some of my XXXX accounts to run their XXXX XXXX. We are also receiving {$390.00} per week on Unemployment. This will be less than my prior income, but with this increase of work our income will be approximately 65 % of what it was before Covid-19. Enclosed please find our Income/Expense Comparison report for the XXXX first quarter. It is crucial to mention that our current 4.875 loan interest we have is just too high. We need a lower rate, one that accommodates the financial hardship we currently have under Covid-19. I have been trying to refinance with other lenders, but no one wants to refinance due to Covid-19 pandemic. I need your cooperation on this matter. I am in need that you modify my loan at a marketable affordable rate. Please put yourself in our position and try to help. We thank you very much for any effort you can make. '' This is the problem we are having with SPS XXXX XXXX, they are not even considering our Loan Modification requests, they just choose to ignored them. Consumer Complaint: On or about XX/XX/XXXX requested mortgage modification of the terms and conditions my mortgage interest rates due to lack of affordability with the changing interest rate terms from of 2 % to 3 % due to financial hardship. On or about XX/XX/XXXX I was grant forbearance on past due amount of approximately {$3500.00}. On or XX/XX/XXXX was granted or approved for trial modification in the amount of approx. {$1100.00} for three months. On XX/XX/XXXX I rec 'd the new mortgage modifications with new terms and conditions with the same terms and condition of the original mortgage with step rates which is designed to increase my interests on first 12 month 3 % to 3.5 %, and on the 13 month and 3.875 % on the 25 month with a balloon payment of XXXX at the end of the new maturity date of XXXX. The new terms and conditions drawn up and provided by SPS Servicing Inc are not reasonable affordable and thus not sustainable terms and conditions. A more affordable terms would be to maintain my mortgage interest rates to remain at 2 % for the terms of the loan to the maturity date of XX/XX/XXXX which will make the mortgage payment more affordable. I am requesting the agency review the matter in more details.

Consumer Complaint: On or about XX/XX/XXXX I submitted a complaint to this agency as well as inquired to my mortgage servicer SPS as to why they filed paperwork to start foreclosure procedures and added that to my mortgage balance on XX/XX/XXXX even though they had given me a letter stating I had until XX/XX/XXXX to make a payment. I also submitted a QRW to them in XXXX inquiring as to why they were sending my payment of {$410.00} back, but did not send my {$4000.00} plus of payment I made all of XXXX even in a forbearance period and during a pandemic. I have yet to receive a response from them regarding either matter. My attorney has attempted to reach out to them with no response as well. We have started bankruptcy procedures. I am a single mother of 3 children and will be homeless. Even though I have been making payments and those payments were accepted and applied even during a nationwide pandemic in which I was impacted. I was impacted during COVID-19 and have attempted to reach out to them. They have yet to respond in writing. When my " relationship manager '' called me I asked her to respond in writing she hung up on me. I have that recording of that call as well and can provide it in a court of law if needed. I have also asked them who was the owner of my loan and they insist it is XXXX XXXX, but when asking XXXX XXXX, they say they are not. When I inquire about the mortgage assignment that is attached to my note of a handwritten document that finally attached after they attempt two times before to foreclose without an assignment. They have yet to provide an answer. The notary and the " manager '' who signed that assignment has given testimony and willing to testify in court about that document. The " manager '' says she was never a manager with the company of XXXX who was the original owner of my mortgage. That company went out of business in XXXX but the assignment was filed in XXXX with the XXXX XXXX XXXX XXXX XXXX in XXXX after the company had already closed. And after the date of the proposed assignment. I also sent SPS a letter stating that another company sent me a letter saying they had bought my mortgage and I made payments to them. I am not sure if that is accurate as I can not reach them and I am out that money. SPS and their parent company XXXX XXXX have been preying on borrowers and the American people for years. Court filing after court filing even with the the Department of Justice can prove that. They are not honoring a forbearance and relief period granted by the United States government.
