Consumer Complaint: On XXXX Select Portfolio Servicing received a check from me for approximately {$95.00} to move my payment date from the XXXX of the month to the XXXX of the month. I get paid in the XXXX and the XXXX of every month. If the XXXX falls on a Saturday I do not get paid until the following Monday. I was told the transaction would take thirteen business days to complete. The next few months I would call in to make my payment on their automated service. If I made the payment on the second or third of the month the automated service would say the payment was past due. I called in to ask why the automated service was saying the payment was past due when the payment date was moved to the XXXX of the month. I was informed then the payment date was not moved to the XXXX. But the payment was not really past due until the XXXX. And that they would contact the appropriate department to get the payment date changed to the XXXX. Again I thought the problem was CORRECTED. FOR THE LAST THREE MONTHS when I call in to make my payment I have spent an hour on the telephone asking why the payment date was not moved. While making my XXXX payment I was told I would have to send in another interest payment to get the payment date moved. I BLEW UP AND REQUESTED HER SUPERVISOR! He assured me the problem would be cured! I just made the XXXX payment AND NOT TO MY SUPRISE THE PAYMENT DATE WAS STILL THE XXXX OF THE MONTH! I again spent an hour on the phone getting to another supervisor just to have him XXXX XXXX XXXX XXXX XXXX telling me the same lies I had been told tge last 4 months! I told him we were 59 days from THE FIRST year anniversary of the day THEY RECEIVED MY CHECK TO TAKE 13 BUSINESS DAYS TO MOVE MY PAYMENT DATE! SPS has hurt MINE AND HOW MANY OTHERS credit rating BY THEIR FRAUDULENT ACTIONS! I want my payment date changed and I WANT SPS TO CONTACT ALL CREDIT RATING COMPANIES AND MAKE SURE I DO NOT SHOW A LATE PAYMENT TO SPS SINCE XXXX TO XXXX. I ALSO AM REQUESTING AND AND ALL LATE FEES BE REIMBURSED TO ME BY CHECK IN A TIMELY MANNER! I AM ALSO REQUESTING SPS BE AUDITED TO SEE HOW DEEP THIS SCAM THEY HAVE BEEN PULLING ON ME REALLY GOES! I WANT SPS TO RESPOND TO ME IN WRITING FROM TODAY FORWARD. BECAUSE THEIR TELEPHONE SERVICE AND EMPLOYEES LIE THRU THEIR TEETH! SPS DOES NOT DISPUTE THEY RECIEVED MY CHECK ON XXXX TO CHANGE THE DATE. THEY JUST WONT CHANGE IT!

Efforts to receive my funds back have gone ignored for years upon years now. I would like these funds returned now please.

Consumer Complaint: On XX/XX/XXXX I was placed on forbearance with Select Portfolio Servicing , Inc due to the XXXX pandemic. My forbearance period ended on XX/XX/XXXX. I applied for additional assistance in which I was denied on XX/XX/XXXX because the finance company Select Portfolio Servicing , Inc said I didnt qualify. I was and is currently on unemployment and I qualified for the additional forbearance extension. On XX/XX/XXXX I received a letter in the mail that Select Portfolio Servicing , Inc wanted me to participate in a modification in which I explained I couldnt afford to feed my family, pay light bill, and pay the high modification mortgage they wanted me to pay. They threaten to foreclose my home if I didnt pay. On XX/XX/XXXX I launched an investigation with Select Portfolio Servicing , Inc with their ombudsman department and they did not resolve my account. I had to borrow money to pay XXXX and XX/XX/XXXX modification payments. I called on XX/XX/XXXX regarding the forbearance extension which is on XXXX XXXX website and Consumer Finance.gov which state the extensions is 18 months if the mortgage account was in forbearance on XX/XX/XXXX. I was in forbearance at that time frame. Every conversation is recorded please request conversation records from XXXX XXXX XXXX. They have lied and stole money.

Consumer Complaint: On XX/XX/XXXX, Select Portfolio Servicing , Inc received requested documents such as death certificate of XXXX XXXX via email. The email dated XX/XX/XXXX to Select Portfolio Servicing , Inc included XXXX XXXX Death Certificate which is also filed with the Recorder of Deeds at the LT. Governors Office in XXXX XXXX XXXX, Adjudication ( Probate ), Order of Default of cosigner and executor of the estate and the Order vacating Default of XXXX XXXX. A letter XX/XX/XXXX was sent to my address requesting the same documents ( death certificate ) that I uploaded to Select Portfolio Servicing via email ( see attachment ). I am requesting Select Portfolio Servicing to include my mothers death certificate on file. I XXXX XXXX the sole heir that can assume and be further responsible for this loan. In addition, I would like to clarify Consumer Financial Protection Bureau ( CFPB ) rules adopted under the Garn-St. Germain Act which list the transfers of real property is excluded from enforcement of a contractual due on sale clause. The protected transfers include a transfer to a relative ( heir of XXXX XXXX ) resulting from the death of a borrower, since the cosigner and executor defaulted. Acquired property by this kind of transactions, I XXXXXXXX XXXX have the full complement of rights under RESPA and TILA. Since, I XXXX XXXX complied within specified time frames, and you have in your possession all relevant documents that are needed to confirm that I am the person making the request, I am a protected successor. I am hereby invoking my rights to get information, request transfer the loan, dispute errors and have payments properly credited. I am requesting Select Portfolio, Inc certified me through the documents received on XX/XX/XXXX as the homeowner of the property. Since the requested documents were provided, I should be entitled to protections relating to assuming the mortgage or other loss mitigation disputing rights, monthly statements, escrow accounts, servicing transfers, and other rights afforded by TILA and RESPA as a home mortgage borrowers. Please note, under the new rules expand the definition of a borrower for purposes of RESPA, and consumer for purposes of TILA, to include a confirmed successor in interest. 12 C.F.R. 1024.31 ( eff. XX/XX/XXXX ). Successor in interest is defined as coextensive with transfers listed in the Garn-St. Germain Act after which a due-on-sale clause may not be exercised Select Portfolio Servicing , Inc has erred by not filing the death certificate, placing XXXX XXXX as successor of interest, not proving the requested documents to review the account of my deceased mother XXXX XXXX and provide loss mitigation options such as a loan modification or assuming the mortgage under the Garn-St. Germain Act. By copy of this notice of error, I am once again requesting that Select Portfolio Servicing, Inc provide the above listed documents and/or information and correct all errors.

Consumer Complaint: On XX/XX/21 I received a letter from my insurance co, that my policy had lapsed for non payment.I immediately called my mortgage co Select Portfolio Servicing, bc my escrow covers my mortgage .I spoke with manager XXXX XXXX XXXX he told me he fix the issue, as the mortgage had been transferred to SPS in XXXX of XXXX never received a welcome letter or any correspondence that my loan had been transferred, only bc I called my previous servicer Shellpoint Mortgage, which also paid my insurance from my escrow acct, regarding Covid, was i made aware of the changes.The new servicer apparently hadnt realized the ball had been dropped concerning my escrows.Mr XXXX XXXX assured me this matter was resolved.1 week later I called back, to double check behind Mr XXXX, bc my spirit didnt rest with his explanations, only to find out, everything he said was a lie, and nothing had been done.I tried to get things moving, bc a storm was brewing in the Gulf, and heading to La.Unfortunately the matter was not taken care of promptly, and my home suffered significant damage, and Im displaced but my insurance co, denied coverage , as they never received payment.My insurance was included in my note, my mortgage co.collected my payments, and never paid my insurance, although theres an escrow acct for that purpose.They have stolen my money.This co has paid millions in fines for deceptive practices and they continue to deceive and fraud the public.Please Help

Consumer Complaint: During COVID both my husband and myself were not working. Under the government protection mortgages were allowed to be deferred and placed on the back end without interest. Sps servicing contacted us continually and informed us there was no problem and we were on the deferrement. Recently yesterday we received a phone call stating we needed to sign modification papers. I questioned why a modification this is supposed to be a defferment. They stated that it took a year to qualify for deferment all the time their company we were fine. Now they are trying to force us to sign a modification which is not the protection the government put in place. We requested phone conversations to be pulled if their associates and they stated it doesnt matter they were behind in their decisions. Seriously. They sstqte one thing and then try to force people into extra interest etc. any assistance with this horrible company would be greatly appreciated as this company has down nothing but lie and scam

Consumer Complaint: To whom it may concern : I have been making my monthly mortgage payments up until XX/XX/XXXX. Upon this date I fell on financial hardship do to having to pay spousal support in the amount of XXXX dollars per week for six months as I was in the middle of a divorce. My marriage was to some one else other than the other name on my loan for this property. The other person on the loan had not re affirmed the note due to chapter XXXX bankruptcy back in XXXX. And in XXXX the other person had signed a quit claim deed freeing them totally from the mortgage. In XX/XX/XXXX my employer had cut our hours back do to Covid 19 which impacted me financially tremendously. Meaning that I was the only one paying all the bills in the household. Upon this I had reached out to the mortgage company around the end of XX/XX/XXXX to XX/XX/XXXX and they had put me in a forbearence do to the Covid epidemic. So I thought that i was covered under this plan. I kept receiving letters from the mortgage company for months that my Covid plan was about to end. So I had contacted them months later after missing more payments do to my hours being cut and paying the spousal support as well. I explained to them my situation and would make payments when I could. I contacted them again in XX/XX/XXXX and asked them for a loan modification and filled out there form. The mortgage company had kept asking me for a divorce decree and or the quit claim deed. I called in several times telling them that they had this information in my documents that they had received from my prior mortgage company. But they would not look for it. Kept asking me for one that was less than 90 days old. I told them that it is impossible for that. This document was done back in XXXX and they kept insisting that I send it to them. Note this mortgage company did not aqiure my loan until XXXX. I finally had one of there workers had went into my file and found the quit claim deed and had submitted it for the completion of my application for loan modification. A few weeks had gone by so I contacted them to find out how the modification was going. The worker had told me that they were waiting for this document again. I was frustrated again and said that I had talked to some weeks earlier and they had submitted it for me and everything was good. So he had went in my file and found it and submitted it again for the completion of my application. Please note that they gave me an relationship manager for my loan but you would call it with there ext. and someone else would pick up every time. I would request that I speak with my assigned manager but refused to connect. Telling me that they are a manager as well and they could help me. So I would go over everything with them and they said call back at a later day to see the progress. So I called back a few days later in which it would be the later part of XX/XX/XXXX and they informed me that I was denied. I had questioned them on why because they had never asked for my monthly bills, loans, etc. There response was that if they needed them they would ask for them. I was under the assumption that when you request asittance that they would ask for them. So when talking with another manager he encouraged me to appeal the decision and to apply for assitence again because of my significant change in wages causing me to fall behind. So I appealed there decision and submitted a new form. I Had then finally got with my relationship manager that was assigned to me and spent over a hour on the phone with her explaining my hardship and that I need a plan to get me current. She had informed me that I was standing better chance since they were not asking for finances. So I thought everything may work out. But I was wrong again, they denied my application again.I had forgot to mention that in XX/XX/XXXX they had hired an attorney for my loan. Nowhere in this attorneys letter said that my home was in foreclosure. On XX/XX/XXXX the mortgage company had sent my homeowners insurance company a letter that they had initiated a foreclosure action on my property. In return my insurance company had sent me a letter wanting to cancel my policy as of XX/XX/XXXX. I had requested that the mortgage company produce me a letter that my house is in foreclosure and they have yet provided me with one. I contacted my insurance company and told them that my loan was under review for a modification. They had told me to get a letter from them to say that its under review. I had contacted them and they sent me the letter and I had forwarded it to my insurance company for them not to cancel my policy. My insurance company had reviewed it and was going to cancel my policy. A few days later I received a letter from the lender demanding that I contact my insurance company for payment of my home owners policy to be paid .I had forwarded this to my agent and he had said how is your property in foreclosure if they are demanding coverage on the property. My insurance company had reviewed it and had re instated my policy on my home. Since then I have contacted the lawyer firm and left a voicemail to the lawyer handling the cas onXX/XX/XXXX at XXXX ; XXXX XXXX. I have yet to get a response from them.Please note that through this whole request of asking for help they have never offered a repayment plan nor asked for any financial documents to show why I had fell behind on my payments. All they told me to do is write a hardship letter and that's it. I have been in this home since XX/XX/XXXX and I am doing everything I can to save my home. But in the end I feel as that they are false advertising that there are programs for you to keep your home. In the meantime they are putting me further behind because they are dragging things out. To add to my hardship I became unemployed on XX/XX/XXXX from my job of 6 years. I have regained fulltime employment shortly after that. I have explained to them that I can resume making the payments if they could defer them to the back loan. I plan on appealing there denial again. I hope that your firm can get to the bottom of this.

Consumer Complaint: I was forced out of my forbearance in XX/XX/2021 after losing my job due to COVID. I was given until XX/XX/2021 to resume payments. I called to make a payment XX/XX/2021 and was told that it was too late. Since XX/XX/2021 I completed the application for mortgage assistance. Since XXXX, I have submitted every document requested and the mortgage company refuses to process my modification and I have been threatened with foreclosure even though I have been compliant with forwarding the requested documents. I have submitted paystubs, bank accounts, tax documents, utility bills and everything else requested to no avail. This is causing me undo stress in a matter that is already stressful. I feel that the mortgage company is trying to foreclose on my home because of the equity.

Consumer Complaint: I was granted forbearance during covid due to job loss. I was sent a letter stating i did not have to make a balloon payment because I had a XXXX XXXX loan and the care act options would be available to me. When the period ended I contacted the loan servicer and they made me jump through hoops and go through loss mitigation only to deny me any help. I have plenty of equity in my home and I feel like they are just trying to take my home to make a large profit. The only option I was given was to pay in full or foreclosure.
