Issue: Closing on a mortgage

Consumer Complaint: I sent cashier 's check XX/XX/21 to pay off mortgage. I included my pay off quote from the company also. It was cashed XX/XX/21, misapplied as a payment and not as a payoff. I wrote the company advising them of the misapplied payment and telling them the CFPB says they have 20 days to properly apply the payment and return any escrow. They acknowledged my letter online XXXX in the matter of a form letter saying they have 30 days to make it right. Online the account is still showing with an outstanding principle, no letter in writing has been received and no escrow returned. Please help.

Consumer Complaint: My dad passed away in XXXX 2021. SPS sent someone to my dads house on XXXX/XXXX/21, then XXXX/XXXX/21 to winterize it without approval or notice to me. While they were there they stole approximately {$4000.00} worth of my dads ( now mine and my brothers ) property. I called to let the company know, they simply told me to file a police report. There was no forced entry on the house so the only people who had access to the house is the mortgage company, which Im also not sure how they entered.

Consumer Complaint: Divorce XX/XX/2016. XX/XX/2016 ex wife took out a modification loan, used forgery with my signature and the bank never verfied information. The documents where sent to a XXXX XXXX XXXX had no access to retrieve mail as the XXXX XXXX XXXX to her daughter from another marriage. The bank never check full documents and now the bank refuses to help me with this matter. The end results I would like is the bank remove me from the account and to report the removal to the credit bureaus.

Consumer Complaint: Homeowner Assistance - Unfair Mortgage Practices Im reaching out for some guidance on where I can get assistance with Unfair Mortgage Practices and my search led me to the CFPB I have a second mortgage from XXXX of XXXX ( 11.5 % ) that was needed at the time but ultimately forgotten about while it was on autopay ( horrible decision ) until I lost my job in XX/XX/XXXX. - The loan was for {$60000.00} which we paid $ XXXX/month diligently for 15 years. The balance is still {$51000.00} ... 84 % of the payment went to interest only. We have paid over {$100000.00} on this {$60000.00} loan already. - The maturity date is scheduled for this XXXX at {$51000.00}. I wrote Mr. XXXX XXXX, President and Chief Executive Officer of XXXX XXXX XXXX XXXX XXXX, Select Portfolio Servicing, and the XXXX XXXX XXXX asking or better yet pleading for them to please reconsider my Short Pay Offer that was submitted to Select Portfolio Servicing. Asking them to Please consider the consistency in our payment history and commitment for over 14.5 years of managing and paying this completely unfair, deceitful, and borderline unethical/predatory loan arrangement. I was given forbearance in XXXX, XXXX, and XXXX then only offered an opportunity for a modification on the matured balance for $ XXXX/month for another 30 years at 6.34 %. That would still leave a maturity balance of {$31000.00} due on XXXX/XXXX/XXXX. I couldnt begin to wrap my arms around the pain of reading that offer. Short summary : A {$60000.00} loan at 11.5 % that has been paid for 15 years at {$590.00} a month with {$490.00} ( 84 % ) going towards interest and only {$98.00} going towards the principal. Totaling over $ XXXX+ already paid on a {$60000.00} loan. o With a Total Balance including the Modification is now {$52000.00} After a very difficult two years, I outlined the financial and mental distress that my family and I continue to face during the pandemic. This year has been even more challenging with the inability to gain employment and my wife continuing her XXXX XXXX with mounting Hospital Bills

They fail to include how many months can be deferred with me being less than 12 months behind. They are not considering a global pandemic is the main reason for my hardship. We failed our Chapter XXXX bankruptcy Case # XXXX scheduled on XXXX XX/XX/2019 and was denied an " Opposition of Hearing '' by XXXX XXXX XXXX lawyer , XXXX XXXX XXXX retained by SPS by mail on the day of our court hearing, not certified mail. XXXX XXXX XXXX lawyer presented falsified documents to the court such as robo-signed by XXXX XXXX XXXX XXXX XXXX XXXX of MERS on behalf of XXXX XXXX the Trustee . We learned after the fact that this is common practice of XXXX XXXX XXXX XXXX XXXX, violating the Penal Code 115-PC. We are hoping to reopen our case to recover damages. We are both are seniors XXXX and XXXX years of age.

Consumer Complaint: Our mortgage is very delinquent. My husband got even further behind during my incarceration. I began incarceration on XX/XX/XXXX and just returned home on XX/XX/XXXX. I am now working two jobs and we will be able to comply with the mortgage payments going forward. The loan modification that my husband applied for while I was incarcerated was recently denied. I advised that my income was not included in the evaluation. I submitted an appeal and provided proof of income for both of my jobs. I seek to obtain a loan modification and not loose our home.

Consumer Complaint: On XX/XX/XXXX I made payment of {$1000.00} to previous servicer ( XXXX XXXX XXXX ). The payment was not transferred initially with the loan to new servicer ( Select Portfolio Servicing ) on XX/XX/XXXX. On XX/XX/XXXX I received evidence that payment was received by new servicer in the form of a check. To this date SPS is denying receiving such payment and claims previous servicer did not send it despites the evidence : copy of the XXXX check sent to SPS, the XXXX tracking number and XXXX tracking system showing mail was delivered on XX/XX/XXXX at XXXX XXXX. On XX/XX/XXXX I called SPS again regarding this issue. Since the associate was not able to address my request I asked to talk to a supervisor. The associate denied my request advising me I will be contacted once they update my case. As far as I am concerned payment was received and the only update that must happen is SPS applying this {$1000.00} payment to my loan as of XX/XX/XXXX. This is obstructing my right to payoff this loan early since payoff quote can't be generated given that all previous payments have not been applied.

Consumer Complaint: In XXXX of this year, I started an assistance application with Select Portfolio Servicing in regards to my mortgage as fell behind due to lack of rent. Im currently in forbearance until XXXX and Ive been making payments. After almost months and doing everything they asked of me many times, I received a letter I qualified for nothing and my only options are foreclose or sell. I dont think this is fair because Ive done everything asked of me, including working with HUD . During these times where jobs and rents came with much uncertainty ; one would think they would be more acceptable to working with a person who has lived here 20 years.
