Consumer Complaint: In XX/XX/2018, my wife and I fell behind on our mortgage payments after she became ill. The majority of our income went to her treatment and medical expenses which made it impossible for us to keep up with the payments since we were on a fixed income. Paying our bills literally became a life and death decision. She recently passed away this past XXXX and I am just trying to get the default rectified so that the home does not foreclose. I do not have the funds to reinstate the loan so I am in the process of applying for a short sale to sell the home. I need more time to get my wife 's belongings out. I haven't had any time to clean out and sell the home because I've been in such a whirlwind since XXXX XXXX death, I could barely afford to cover her funeral expenses. Please have someone help me in getting the foreclosure auction stopped so that I can sell the home, I just need at least 60 extra days.

Consumer Complaint: In XXXX of XXXX, I was granted a COVID hardship forbearance. Shortly after it was granted, we were informed that our payment would be doubled, from ( roughly ) {$1200.00} per month to {$2700.00} per month and that a lump sum payment would be due upon the completion of the forbearance period, which was 6 months. During the forbearance period, I continued to get billed at the new doubled rate. At the end of the 6 months, the indicated I needed to pay them close to {$17000.00} or face foreclosure. I balked. I requested a review and also that my payments be reduced to the amount I was paying pre-COVID. We exchanged several letters and they ultimately indicated they had, Granted me relief! Their idea of relief was to double the double and want me to pay them {$5500.00} per month ( more or less ). They indicated if I did this for one year, I, d be good and could keep my house. I am keenly aware of the Cares Act and its prohibition of lump sum payments if one has been granted a hardship during COVID. I am confused as to why they are doing this! I am now some {$37000.00} ( more or less ) in arrearsaccording to them. And, I have most recently received a letter indicating I must pay the loan off by XX/XX/XXXX or face foreclosure! The company I get billed by is Select Portfolio Serviicing, Inc. You should note this company touts themselves as a Mortgage Sevicing Company . The reality being, its a fancy title for a collection agency. They harass my wife and I relentlessly! They even send an individual to our house, monthly, to drop a flyer on our front doorAND THEY CHARGE ME TO DO THIS!!!!! Their address is SPS, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, UT XXXX. They will avoid answering directly and be vague. They will further tell you they simply service the account. SPS will indicate the current owner of the mortgage is XXXX Mortgage XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX New York, NY XXXX. They DID NOT PROVIDE me with an account number. Nor did they provide me with any documentation indication when this company acquired the mortgage and they certainly didnt provide proof they were acting on behalf of this company! In addition, at the time of the COVID forbearance, and according to SPS, the mortgage was owned by XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, DE XXXX. They provided the following numbers, CSMC XXXX. I do not know if this is an account number or not. Im not even sure when this bank acquired the mortgage. Please help. I feel as if I have tried to get help/relief from SPS numerous times and that they have ignored our requests or made it virtually impossible to solve the problems. Ultimately we believe they are simply trying to steal our property, a property we have lived on for over 23 years. You should also note, our loan HAS NEVER GONE DOWN..it has increased every single year!!! How does one defeat that?

Consumer Complaint: Escrows are being over-projected by approximately {$1400.00} extra a year from actual assessment and yearly XXXX to XXXX tax of {$3300.00} to {$4800.00} inflating monthly mortgage payments. Rather than fix problem, Mortgage servicer XXXX XXXX loan servicing did transfer loan servicing to Select Portfolio Servicing in XX/XX/XXXX. Called SPS on XX/XX/XXXX was treated very badly and again on XXXX and XX/XX/XXXX while providing useful city hall data from the Tax collectors/assessors office to prove that real estate tax on XXXX XXXX XXXX XXXX, MA XXXX is being ove-rprojected. To date there has been no effort to correct matter. Please assist as this now shows an intent to defraud consumer.

Consumer Complaint: I filed bankruptcy in XXXX. My house was not included and I have never missed a payment. My mortgage was sold to Select Portfolio Services in XXXX. In XXXX I noticed my mortgage payments were not being reported to the credit bureau. I contacted Select Portfolio Services and advised them of the situation and that my bankruptcy paper work shows the house was retained. I was told by the representative that since my social security was associated with a bankruptcy, the information must remain on my file for the life of the loan, because it is a Select Portfolio Service policy. I have copies of my payments to Select Portfolio Service that date back to XX/XX/XXXX.

Consumer Complaint: Select Portfolio has avoided answering my questions in QWRs and DVLs. They state that their authority comes from XXXX XXXX as XXXX. XXXXXXXX XXXX states they have no such authority and are nominal. .SPS refers back to reports and labels used by themselves, which is not an answer to my questions. They have yet to provide evidence of, ownership or authority over the alleged debt. I have never received a notice signed by an officer of XXXX XXXX stating that it is the XXXX that owns any obligation owed by me to the trust. Nor have i received a notice signed by an officer of XXXX XXXX that states that SPS is appointed servicer of my account receivable, as owned by XXXX XXXX XXXX for the trust, there is no direct assertion that either SPS or XXXXXXXX XXXX is involved. They have also refused to directly address accounting defects, while at the same time attempting to coerce me to accept a trial modification with threats of legal proceedings.

Consumer Complaint: I have recently opened my monthly statement to see that there is deferred principal in the amount of {$7800.00}. I have always paid my monthly payment even during the pandemic. There is absolutely no reason why I should have deferred principal. This company continues to plays games with my mortgage and my monthly payments. This is a negative amortization mortgage, which is illegal in some states, and the company is literally stealing from me. Now they come up with this nonsense! I have made several complains in the past and the CFPB has done nothing!

Consumer Complaint: A lender 's failure to pay the requisite taxes rendered the note and mortgage unenforceable, making the instrument unenforceable when the final judgment was entered. For clarity see Fla. Stat. Florida Statutes 201.08 ( 1 ) ( b ) & 199.282 ( 4 ). Florida statute 201.08 ( 1 ) ( b ) - " The mortgage, trust deed, or any other instrument shall not be enforceable in any court of this state as to any such advance unless and until the tax due thereon upon each advance that may have been made thereunder has been paid. '' 199.282 ( 4 ) - '' No Mortgage, deed of trust, or other lien upon real property situated in this state shall be enforceable in any Florida Court until the nonrecurring tax imposed by this chapter, including any taxes due on future advances, has been paid and the clerk of circuit court collecting the tax has noted its payments on the instrument or given other receptor it ''. See original terms of the note attached herein. The loan amount on the original note was {$240000.00}, the allege loan modification from XXXX reflects that the loan increased to {$350000.00}, on which XXXX never paid XXXX dollar for it. Because the loan amount increased, XXXX were supposed to record and pay the taxes due on the instrument before the judgment was entered in order to have enforceability. As of today XXXX has still not paid one dollar over the loan increase nor record the instrument. The judgment was void at the time it was issue by the court and therefore the judgment can be reversed due to the fact that as per Florida statute mentioned, a lender does not have ANY ENFORCEABILITY IN ANY COURT ROOM WITHIN THE ENTIRE STATE OF FLORIDA. READ THIS AGAIN AND AGAIN SO YOU CAN GET IT. SEE FLA. STAT. 201.08 ( 1 ) ( B ) ,199.282 ( 4 ). NO ENFORCEABILITY, READ IT AGAIN

Consumer Complaint: They basically contacted me in XXXX because I had missed XXXX payment and I had never been late or missed a payment before offer me a forbearance type of deal so I can get caught up. The next thing you know theyre telling me that I have to make a past due payments in order for this to start which I made XXXX and then I got no answers as to what exactly was going to happen after that I called several time. Each time I got a different person and a different answer say no we dont do that no you cant do that you have to pay there she had to pay more money asking me for additional payments and my question to them as well what good is the forbearance if youre if Im paying now even more payments then I was behind. I cant get a straight answer from them and then I get a letter saying that if I dont pay over {$4000.00} by XX/XX/XXXX if theyre going to take my house they say that Ive made no payments whatsoever I went to my bank and I have transaction history posted on XX/XX/XXXX this year on XX/XX/XXXX of this year and XX/XX/XXXX this year and XX/XX/XXXX all mortgage payments made to them but not the extra payment I had to pay them last month of {$1100.00}.
