Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I am filing an official complaint against the following business : XXXX XXXX XXXX ( XXXX ), Portfolio Recovery Associates, XXXX XXXX ( XXXX XXXX XXXX ) The reason for the complaint is : continued attempts to collect an alleged debt, and reported this alleged debt to credit bureaus, while having failed to honor my written request for validation of said debt. Most notably, they have failed to produce any documentation that I owed this debt at any point, such as a contract signed by me for a service previously rendered for a specified period. For the record, I assert that this claim of debt is entirely fraudulent, as such a document with my legitimate signature on it does not exist. I have attached the following pages for your review : on which I indicated my wish to dispute the debt. This was mailed back to XXXX and Portfolio via certified mail in the same envelope as my debt verification request letter on XXXX. -Copy of the debt verification letter I mailed to XXXX/ and Portfolio via certified mail on XXXX XXXXCopy of certified mail return receipt, proving that XXXX and Portfolio received my debt verification letter on XXXX

Consumer Complaint: I am urgently reaching out as a mother of a family of XXXX, deeply concerned and demanding immediate action. The issue at hand involves a company reporting fraudulent and inaccurate information on my credit report, a situation that gravely impacts my ability to acquire a much-needed vehicle for my family. This company 's actions are in violation of both the Uniform Commercial Code ( UCC ) and the United States Code ( USC ). Specifically, under UCC Article 9, which governs secured transactions, any party claiming a security interest in an account must provide concrete proof of their legal claim their failure to provide the Purchase Agreement as evidence of their claim to the account is a breach of the transparency required in such dealings. Furthermore, under USC Title 15, Section 1681s-2, responsibilities of furnishers of information to credit reporting agencies are clearly outlined, and their actions contravene these regulations. Additionally, their refusal to provide pertinent documents for review is a direct infringement of my rights under USC Title 15, Section 1681a, which details permissible purposes of consumer reports. This unauthorized use of my identity without my consent is adversely impacting my credit rating, creating a significant barrier to my financial stability and progress. Given these violations, I insist that the CFPB, in alignment with its mandate under USC Title 12, Section 5511, which involves regulating the provision of consumer financial products or services, takes swift and thorough action. The ongoing reporting of this unverified and potentially false information must be stopped immediately to prevent further damage to my credit rating and the overall financial well-being of my family. I expect your prompt and decisive intervention in this critical matter. Thank you,

Consumer Complaint: I received a letter from Portfolio Recovery Associates LLC on XX/XX/XXXX for an account from XXXX XXXX XXXX that they said I owed from XX/XX/XXXX and I do NOT even owe. It is not my debt.y debt. Then, I received a a different letter from XXXX XXXX on XX/XX/XXXX stating that " We are trying to collect a debt that you owe to Portfolio Recovery Associates , LLC ''. I believe that Portfolio Recovery Associates has been under scrutiny for trying to collect debts that have expired under the Statue of Limitations. On XX/XX/XXXX CFPB filed a complaint against Portfolio Recovery Associates for violating the 2015 Order, the CFPA, the FDCPA, and the FCRA.. They stated that Portfolio familed to timely resolve disputes submitted by consumers, properly respond to disputes they deemed frivolous, conduct reasonable investigations of consumers disputes, etc. They also were suing to collect time barred debt. The order required Portfolio Recovery Associatiates to pay a {$12.00} million in redress to harmed consumers and a {$12.00} million civil money penalty. It also imposes broad injunctive relief designed to prevent Portfolio from violating the law in the future. This letter to me from Portfolio and now it appears they sold the account to XXXX XXXX is way past the stature of limitations. XXXX says they " are trying to collect this debt for Portfolio Recovery Associates LLC ''. I am not sure if they are working for Portfolio or if they purchased the debt from Portfolio Recovery. Either way, Portfolio is still doing illegal collecting practices along with XXXX XXXX.

Consumer Complaint: Back in 2016 an account was opened up in my name unbeknownst to me I seen it on my credit report and I tried to dispute it with XXXX XXXX XXXX times. I keep getting an unchanged result. So I paid it off late 2016 I recently pulled a credit report to figure out why my credit was so low when I make all my payments on time. It is showing XXXX late payments on this account how does that even happen without being malicious in intent. I have reached out to XXXX XXXX several times. And I refuse to pay something again that was fraudulent to begin with. I don't know where else to turn.

Consumer Complaint: The three credit bureaus do not speak to one another. My data on each credit report is incorrect. I have on several occasions requested the credit bureaus to update their records. The accounts that are listed as open/reporting negatively, are either paid-in-full closed, paid in full no balance, or should not be appearing at all.

Consumer Complaint: The debt collector failed to send communication regarding the debt, introduction of who they are, what the debt is for, and my right to dispute. They just appeared on my credit report without notice. They must abide by the regulations and validate the debt. This has not been done. How did this debt collector, even have access to my credit report without the proper protocols and regulations?
