Consumer Complaint: In XX/XX/2023, I contacted my mortgage company because I had several life events making it impossible to make my payment. ( I was a victim of a XXXX XXXX XXXX and spent 5 days in XXXX with medical bills exceeding $ XXXX. I am a designated XXXX XXXX victim as this XXXX is being XXXX by the FDA. Prior to that, my husband moved out/we separated and then he lost his job ) During that call in XX/XX/2023, PHH Mortgage stated my account was in excellent standing and I could defer 3 months payments ( XXXX, XXXX, XXXX ) and then defer that unpaid amount until the end of the loan or until I sold the house. I asked multiple times if there was a penalty and confirmed that when I resumed payments I would not owe for these 3 payments all at once. The PHH representative assured me the amount would be deferred until the end of the loan. She stated PHH would suspend XXXX withdrawals and then I would just need to call in at the beginning of XX/XX/2023 to get XXXX set up again. PHH THEN SUSPENDED XXXX PAYMENTS. When I called PHH at the beginning of XXXX, I was told my account was in default and they could not set up XXXX. They would also not accept my regular loan payment amount and said I had to pay $ XXXX. Which of course I didnt have. Since then, I have called PHH more than 10 times asking for a supervisor regarding the original XXXX agreement. No one ever calls me back. I have been promised on 3 occasions that my issue has been escalated and a supervisor will call back within 24 to 48 hours. I have not received a single call back. Then, PHH sent me a notice advising they would modify my loan if I agreed to do so by XX/XX/2023. But the agreement doesnt include the amount of the new loan, doesnt outline the fees, doesnt have an amortization schedule and doesnt state whether or not there is a penalty for paying off early. I have called multiple times asking for this information. No one can provide it. I have emailed the relationship manager but have not received a response. I called and scheduled a meeting with the relationship manager. Her earliest availability is XX/XX/2023, which of course is after this offer expires. I called 3 times today because today is the deadline and no one called me back as promised. My calls go through but then the outgoing message states PHH is experiencing high call volume and the call disconnects on me. I need assistance because I am getting no where with this company and am terrified I am going to lose my house.

This firm is subject to the FDCPA and according to their website they offer these services. The attorney who responded blatantly made several misrepresentations, failed to provide the facts and was extremely dishonest. Consumer Complaint: I was divorced in XXXX and filing for a release of liability through phh mortgage to get the ex removed from the mortgage. XXXX - they received the release of liability package XXXX - the release of liability goes to underwriting XXXX- they cash the check for the release of liability processing fee XXXX - the do a hard credit inquiry call repeatedly between XXXX and XX/XX/XXXX. Told that it take 40-60 business days for the underwriting department to process the request. It is now day 62 and they again checked my credit XX/XX/26. I call again and the escalation manager tells me someone is going to call me today but he has no information. I am under court order to complete this process in 120 days, 120 days was XX/XX/XXXX. I am waiting for the release of liability to complete so I can close on a home equity line so I can buy my wife out of the house, but can not complete this until she is off the primary mortgage. I have XXXX in equity in my home and only owe XXXX and have been with them 15 yrs. They can see from the tax returns in the release of liability package I have been making the payments on my own as my wife hasnt worked in 10 yrs. I make XXXX a year and have a credit score of XXXX. There is no reason this process should take this long.

Consumer Complaint: On XX/XX/XXXX, I called PHH Mortgage Services and told them that I wanted to pay a year rent. They refused that I could only paid for 6 months, which I did. They payment covered XX/XX/XXXX to XX/XX/XXXX. I sent the payment for XX/XX/XXXX ahead of time. Instead of PHH applying the payment, PHH put my payment in my escrow account which the admitted to. Instead of marking my payment from XX/XX/XXXX to XX/XX/XXXX, PHH Mortgage sent my name to credit bureaus that damaged my credit. Moreover, PHH Mortgage decided to modify my loan unknown to me, which I refused because I have been payment my rent. I have called the company on several occasions to have the settled. I have to deal with different crisis intervention team that realized that their errors and promised to take care of it but never did. My name was sent to a law firm that harassed me with so many calls. I got back on the phone and told them that their lawyer was calling constantly. Again, after going through another lengthy discussion with an apology and promise to sent in a letter of an apology, it never materialized. PHH is deliberately trying to foreclose on my home. Have so many people calling to buy my home. This is a criminal behavior and predatory lender.

Upon my husbands death I had to file bankrupty once it was discharged the mortgage company refused to report it to the credit bureau stating it was bankrupty policy not to report accounts even though they had been discharged and have been in good standing for years. I tried calling and was told even though this was 15 years ago it was their policy and there was no remedy for this. PHH terminated my ACH agreement on XX/XX/2023, didn't notify me via with proper notification, and subsequently violated Reg E when they didn't complete the agreed upon ACH draft on XX/XX/2023. As a result of this violation, I was assessed a late fee of {$160.00}. Their notification was completed in electronic form only and uploaded to their internal portal. I did not receive a physical notice or any e-mail notifying me of a message in my portal that would indicate that my draft was cancelled. Upon realizing in late XXXX that my payment had not been drafted, I promptly made the payment, rescheduled Autopay, and requested a waiver of the late fee. They declined.

Consumer Complaint: My home is financed with PHH Mortgage. In XXXX, I inquired about having the PMI removed. The current financed amount on the home is $ XXXX. The house if conservatively valued at $ XXXX, well over the 80 % threshold. In response to my inquiry, PHH instructed me to fill out a form along with a check for {$100.00}. I responded shortly afterwards with both by mail. After 6 weeks or so, I called PHH to get an update on the process. I was then told that the fee had changed from {$100.00} to {$150.00}, and I needed to send an additional {$45.00} to get the appraisal. My specific complaint is that when a bank discloses a fee, they can not change their mind midway though the process. This feels like a predatory lending practice, or possible a TILA or UDAAP violation. Please review my complaint and contact me with any questions or comments. Thank you, XXXX XXXX
