I certified mailed a letter of intent to sell the house, and a request for a six-month extension, along with a death certificate, to : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX XXXX Monday, XX/XX/2023, ( yesterday ) when I called customer assist, XXXX to find out why I had not received back the green stub proving certified mail was received, I spoke to " XXXX, '' and she said that they " did not '' receive certified mail with my letter of intent and death certificate. She gave me the fax number for XXXXXXXX XXXX XXXX, XXXX, and the email address, XXXX. On Monday, XX/XX/2023, I went to postal annex and faxed a copy of my letter of intent, using the fax number XXXX gave me. I also emailed multiple photos of my letter of intent and death certificate. I also went to the post office and mailed two copies of the entire Trust and Last Will, letter of intent, death certificate, and signed authorization by me, to contact my attorney. One of them I sent Certified Mail, and the other copy I sent Priority Mail. The email came back to me, stating that they refused to receive it! I contacted CFPB today because I know that they can get through to XXXX XXXX

Consumer Complaint: On XX/XX/, I became aware that my mortgage company, PHH, had failed to pay my property taxes from my escrow account when I received a delinquent tax notice from my town, with a penalty and interest assessment, and warning of a tax sale if the issue is not resolved. PHH had previously assured me on XXXX XXXX XXXX that it was " preparing the payment '' for my property taxes, and that " [ t ] here [ wa ] s no need to forward a regular tax bill to '' them. I was under the impression my taxes had been paid until I received the notice from my town on XX/XX/XXXX. On XX/XX/XXXX I immediately reached out to PHH by phone and email, providing the documentation and requesting payment of my taxes. I have since then continually followed up with PHH, by both phone and email, to no avail. The money continues to sit in my PHH escrow account, my property taxes remain unpaid, interest and penalties continue to accrue, and my home remains slated for a tax sale if the issue is not resolved. Today, XX/XX/, I received notification that the servicing of my mortgage account is transferring from PHH to XXXX XXXX XXXX XXXX XXXX XXXX.

What Owen/PHH Mortgage Service was wrong and unlawful. Our principal balance of this account should be - {$93000.00} - I have contacted PHH Mortgage Services about these unfair practices but their representatives were unhelpful and had no knowledge.

Consumer Complaint: PHH mortgage company has repeatedly stated they would expedite sending me a partial payment from my insurance companys settlement check. Each time I follow up with them they state that there is no record of them receiving a request for a release of funds. My home was seriously damaged from hurricane Ian and I can not make the repairs without receding the funds. The repairs are needed to replace shattered windows. They also have not scheduled an adjuster to review the completion of their 90 % repair requirement. In essence, they are holding my insurance proceeds for no reason. This seems unethical and fraudulent. I am a XXXX citizen and the stress is killing me. Please help!

Consumer Complaint: We became in default when layed off during covid, then again when hospitalized with covid. Then had a car wreck and out for a long time due to injury. Contacted PHH Mortgage Servicing & tried to apply for mortgage help programs but was rejected for all. All the while PHH ( proven crooks ) kept adding fees ( not late fees ) to mortgage. XXXX XXXX XXXX said they could get better interest rate and use govt programs and help us renegotiate payment amts and get back in control. Sent ALL home files to them ( they even paid shipping, made copies and sent us copies back ), they kept in touch and we made payment to them ( just like when had to file bankruptcy for same added fees and job loss ), we sent them pmts for 6 months or more, then they tried for quite a while to get in touch with them. Never heard ANYTHING WHATSOEVER from Mortgage servicing so figured all was still on track or else we would have received statements of pmts due, but never received one statement from PHH, never received notice of being behind in pmts, then went straight to foreclosure. Completely unfair. They refused to help when behind, even though govt programs existed. Have lived in this home for 25 years. They don't send notices or statements but just right to foreclosure. And tried to get help, company seemed completely legit. PLEASE HELP ME KEEP FAMILY HOME AND MAKE PHH/OCWEN QUIT STEALING AND FRAUDING PEOPLE. Also filing with Tx Attorney General XXXX case XXXX

Consumer Complaint: Gentleman, This is a follow up on several complaints I have concerning XXXX XXXX. On two occasions XXXX XXXX responded that it was not the appropriate company at issue. On its third response it finally acknowledged the case is in litigation as I claimed. XXXX XXXX is Wrongfully pursuing foreclosure action against me and has been doing so since XXXX. I have provided corroboration documents of the truth of the matters asserted. XXXX XXXX refuses to respond to my concerns regarding its Wrongful foreclosure action against me. In XXXX XXXX 's latest response, it purports that it is unable to respond to me directly and has requested I contact the third-party servicer, PHH Mortgage who has nothing to do with this " loan account ''. As evidenced in the attached XXXX XXXX Ruling XX/XX/XXXX, XXXX XXXX is the appropriate company that needs to address this issue. I am attaching XXXX XXXX 's response to my complaint. I am attaching the Pooling and Servicing Agreement again which clearly states on page XXXX of the Prospectus " THE TRUSTEE XXXX NOT ENFORCE THE MORTGAGE NOTE AGAINST THE RELATED BORROWER ''. I am attaching the APPELATE COURT RULING dated XX/XX/XXXX which clearly states " XXXX XXXX HAS FAILED TO SUBMIT EVIDENCE PROVING IT IS A PARTY TO ENFORCE THE PROMMISSORY NOTE AT ISSUE ''. XXXX XXXX XXXX TRANSFERRED THE " NOTE AND MORTGAGE '' TO XXXX BANK EVEN THOUGH THE APPELLATE COURT RULED IT IS NOT A PARTY TO ENFORCE THE PROMISSORY NOTE AT ISSUE. XXXX XXXX HAD NO AUTHORITY OR RIGHTS TO TRANFER OWNERSHIP OF THE " NOTE AND MORTGAGE " AT ISSUE. THIS IS FRAUD AN ILLEGALITY. PHH Mortgage refuses to address the issues at hand as well. PHH Mortgage is now passing this complaint off to another third party servicer who has nothing to do with the " loan account ''. PHH Mortgage has provided a payment history but not the loan account. PHH MORTGAGE has provided two FALSE, FORGED, FRAUDULENT AND FABRICATED AFFIDAVITS OF AMOUNTS OWED. I am asking PHH Mortgage to respond accordingly to the issues I have addressed and am attaching the corroboration documents again for them to respond accordingly. THIS COMPLAINT IS FOR PHH MORTGAGE. Consumer Complaint: I am filing this complaint to the CFPB in hopes you can help investigate the illegal foreclosure proceedings and Dual Tracking of foreclosure that occurred on my family home on XX/XX/XXXX. Our Mortgage with PHH has been foreclosed upon while we were working with PHH on Home Retention options for Loan Assumption/ Loan Modification. Prior to the foreclosure we had been submitting all the required documents they asked and had assured us the foreclosure on our home was all Postponed and that foreclosure would not continue but in XX/XX/XXXX PHH went ahead and still foreclosed on our home while under review. Prior to XX/XX/XXXX we had made multiple payments to PHH and brought the loan current leaving no balance owed ( I have attached the Proof of payments Paid to PHH ) but PHH refused to apply the funds to the account and failed to stop the foreclosure. After the foreclosure we have been in communication with PHH, XXXX XXXX and their Attorneys XXXX Trustee- The Trustee XXXX has not been helpful and they have stated there job has been completed and for all future communication to reach out to PHH , when we call PHH there is no SPOC assigned and are not able to give us any information, we have tried numerous time to talk with the REO department, Loss Mitigation and have even escalated the issue to a Supervisor with no luck. This loan is a 6 Month redemption period, and the time frame expires XX/XX/XXXX. PHH is in violations of Dual Tracking laws of Foreclosure, Negligence and Failure to perform while an account is in active Loss Mitigation review and while they have been accepting payments to the account. We hope to have the foreclosure rescinded back to our name so we can continue to work with PHH to resolve this issue. As well if we can get a SPOC assigned to this case, the problem when dealing with PHH we where only able to talk with agents in XXXX that are not licensed and do not understand my problem.

Consumer Complaint: my mortgage just increased by @ {$500.00}. When I contacted the mortgage company they said it was because my homeowners insurance went from {$3500.00} to {$7200.00}. So I contacted my insurance provider XXXX XXXX, XXXX confirmed that that was correct, but they also stated that the payment has not been made and that the policy has been canceled. So, If they have not paid my homeowners insurance where is that money that they are now charging me for going? And, now I have no homeowners insurance. My mortgage company is PHH Mortgage. Also dealing with them on the phone is a nightmare as I am transferred from one person to another and no one is able to answer my questions as to where that {$7200.00} is going. Did they find another insurance company and if so I have not received a declaration page or any other confirmation that I even have insurance.

Consumer Complaint: Our Mortgage started XX/XX/XXXX with XXXX XXXX and was later sold to PHH Mortgage who holds our mortgage now. Somehow, the tax bill belonging to the two properties adjacent to ours has been paid out of our escrow account in both year XXXX and XXXX. XX/XX/XXXX- {$1900.00} and {$1900.00} was paid to the county tax office out of our escrow, along with our correct parcel tax bill of {$2800.00}. XX/XX/XXXX- {$1900.00} and {$2000.00} was paid again to our county tax office out of our escrow account, along with the correct parcel tax bill of {$2900.00}. I reached out to PHH Mortgage in XXXX to start the process of solving and rectifying the issue. First, with no help to PHH, we figured out that it was the adjacent properties tax bills we had been paying and made PHH aware of exactly the error they had made with our funds. After talking with our counties tax office we learned that PHH had to work with the homeowner who owns both adjacent properties and get the tax monies back from their mortgage company. This homeowner was made aware of the situation and was very willing to make right the tax monies that she had not paid because of PHH 's paying them first. The Tax Office is not allowed to pay out any monies it has correctly or incorrectly taken in- which is why PHH needed to go to the properties mortgage company to get their refund. As of XX/XX/XXXX, PHH was able to get funds back from the incorrect paying of said properties taxes for ONLY the year XXXX - and even so did not notify me or has yet to explain where that refund was credited to - as I have not seen any monies in either check or credit. I could be missing it somewhere, but have been reaching out to try and get an explanation and have not been able to talk to someone who knows anything whatsoever about exactly what is happening. I have reached out multiple times since XX/XX/XXXX trying to let them know that XXXX errors have not been rectified. I end up explaining thing, or trying my best to sort this out, and have yet to have anyone show any expertise or really care at all for the case. Communication has been terrible since the beginning of this problem. If I do get a call and they leave a voicemail, I am given a general call center number and can hardly ever get back to anyone in particular.
