Consumer Complaint: I have a loan with DEPT OF EDUCATION/NELNET . I have always made my payments on time. For some reason, I realized that there were 90 days late ( XX/XX/2018 ) payments on my credit report. I tried contacting the XXXX and XXXX Credit Bureaus with no successful resolution. There was definitely an error on their part. Investigate thoroughly and please update for 100 % accuracy. Below are the following accounts with erroneous information. Consumer Complaint: Firstmark student loan servicer has taken over for XXXX XXXX as the servicer for my private student loans. Under XXXX XXXX I had one monthly payment I paid early, more than the amount due and never had an issue. Since Firstmark has taken over in XX/XX/2021 they have misapplied my payment EVERY month requiring MULTIPLE PHONE CALLS AND EMAILS to have a payment paid in full and usually 2 weeks early. They show part of my account as past due and apply my payment only to partial sections of the total loan balance. This month XXXX the LOST my payment. When I called with my bank information giving proof of dates and proof that the transfer had been received by firstmark their representative told me that First mark " lost multiple XXXX XXXX customer payments this month '' the payments were misapplied. I have looked to refinance this loan however the only other available lenders all uses this awful servicer as well

Consumer Complaint: My student loan was in deferment and they reported the loan as late payments. I also never attended XXXX XXXX XXXX and they charged me any way for the loan. I consolidated my loan with nelnet and they STILL garnished my taxes and the remaining balance of {$61.00} they allowed Nelnet to consolidate on a plan to repay. They were supposed to consolidate the entire amount for the student loan. That was the agreement. They illegally garnished my taxes while in consolidation. I paid the {$61.00} in XX/XX/2020. My account with Nelnet is in good standing and paid. US Department of Education and XXXX XXXX are reporting that my account is delinquent. This is not accurate. The account was consolidated with Nelnet and is in good standing. I have called the US Department of Education and they tell me to call Nelnet. Nelnet tells me to call US Department of education. This inaccuracy is bringing my scores down over 100 points on XXXX.

Consumer Complaint: I am a victim of identity theft. Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX Data breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I am doing. I appreciate your effort in getting this matter resolved. Thank you. Please let me know if you need any other information from me to block this information from my credit report. Thank you.

Consumer Complaint: On XX/XX/XXXX, I sent a letter to Nelnet regarding three accounts that are reporting on my credit report from them. I was requesting for them to show me proof that their reporting of the accounts were 100 % accurate. The reason why I asked this was because there were major inconsistencies and inaccurate information on their accounts from all three major credit bureaus. However, on XX/XX/XXXX, they sent me a letter stating that they are not complying with the investigation. They must cooperate because these accounts are inaccurate, inconsistent and non metro 2 compliant!

'' Pursuant to 15 USC 1691a ( f ), " The term person means a natural person, a corporation, government or governmental subdivision or agency, trust, estate, partnership, cooperative, or association. '' Pursuant to the federally protected consumer laws listed above, I, XXXX XXXX XXXX, natural person and consumer, is the ORIGINAL CREDITOR for all extensions of credit created against my UNITED STATES trust account. This is also proven pursuant to 15 USC 1602 ( l ), " The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. Notice congress stated " ANY CARD '' and as such, Nelnet used my social security card, a credit card as defined by congress, to extend my credit to me, the ORIGINAL CREDITOR. This violation is identity theft and fraud. Pursuant to 15 USC 1681a ( 2 ) ( B ), " any authorization or approval of a specific extension of credit directly or indirectly by the issuer of the credit card or similar device ;, should be excluded from a consumer report '' and as such, Nelnet is in violation of this code as the extension of credit originated from my social security card/credit card is being furnished to all of the consumer reporting agencies. This is also identity theft. In addition, Pursuant to 15 USC 1681b ( 2 ), " In accordance with the written instructions of the consumer to whom it relates. '' I DID NOT give Nelnet written instructions to furnish my information to anyone. This is also identity theft.

Consumer Complaint: I had this loan with XXXX XXXX and it was transferred to First Mark Services in XXXX. Since then, I've had several issues with FMS doing whatever they felt was needed without asking permission. They've changed the terms of my repayment without notification or asking. I submitted a prior CFPB complaint when this happened. I also noted in that complaint that FMS 's actions violated my contractual agreement with XXXX XXXX and potentially nullified the contract itself. On XXXX I called in and spoke with XXXX about my monthly payment suddenly changing from {$170.00} to {$120.00}. XXXX told me that every XXXX the loan was reamortized which resulted in ~ $ XXXX/month reduction. She also claimed this is something that happened with all servicers in XXXX, but is not something I dealt with previously. Once my loan was set at a fixed interest rate and term - there should be no reason for my monthly payment to fluctuate. This is not the first time FMS has stepped outside the original terms of my contract, therefore I am reserving my right to declare this contract null and void. I had to call back and read this over a recorded line to XXXX for accuracy.
