Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: I am writing to file a formal complaint against Navy Federal Credit Union for egregious violations of the Fair Credit Reporting Act ( FCRA ) and the Privacy Act of 1974. My concern revolves around Navy Federal 's inaccurate reporting of negative transactions on my consumer report, a clear infringement of the rights protected under 15 USC 1681a ( d ) ( 2 ) ( A ) ( i ). In addition to the FCRA violations, Navy Federal has failed to provide the appropriate mechanisms for me to exercise my legal right to opt-out of the sharing of my nonpublic financial information with third-party non-affiliates, as mandated by 16 CFR 313.7 and 15 USC 6802. This blatant disregard for consumer rights is unacceptable. Despite providing Navy Federal Credit Union with formal notice of my decision to opt-out, the institution persists in violating the Fair Credit Reporting Act and the Privacy Act of 1974. This not only represents a fundamental breach of my privacy but also undermines the integrity of the regulatory framework established to safeguard consumers. I am urging the Consumer Financial Protection Bureau to conduct a thorough investigation into Navy Federal Credit Union 's practices and take immediate action to rectify these flagrant violations. As a regulatory body empowered by 15 USC 3805, I expect the CFPB to enforce the laws designed to protect consumers like myself from such reprehensible conduct. Navy Federal Credit Union must be held accountable for their actions, and I request that the CFPB intervenes swiftly to address these violations and ensure compliance with all pertinent federal statutes. I appreciate your prompt attention to this matter and look forward to a decisive resolution that upholds the rights and protections afforded to consumers.

Issue: Applying for a mortgage or refinancing an existing mortgage
Subissue: Application denials
Consumer Complaint: I was told that my mortgage was denied because I missed a few months payments on a loan of about {$2000.00} because I was unemployed at that time 7 years prior. The loan was paid in full and my credtit was great across the board. They also denied my appeal when I stated the reason and provided documentation that all of my student loans were in good standing. I also applied for a credit limit increase months prior but was told I reached the credit limit Navy federal was able to provide account holders at {$2000.00}. Yes, only XXXX XXXXXXXX XXXX. This flat out LIE on top of my mortgage denial feels racially motivated and discriminatory. See email sent to XXXX on XX/XX/XXXX regarding denial below : Per our conversation, you informed me that the principal reason for denial was because of the history on a micro-loans I had with another lender probably a good 7 years prior. At the time of those loans defaulting, I was no more than XXXX XXXX XXXX and had lost my job so I was unable to make on time payments. Fortunately, I was able to find the means to pay ALL of the balances in full within the same year. Since then I have had 100 % payment history across my entire credit profile with the exception of my student loans which hadn't been updated at the time I submitted this application, but as of today they are all in forbearance until XX/XX/XXXX ( See attached document from loan servicer ). Any inquiries on my credit profile are a clear indication of my ongoing effort to ask you, or any other lender for higher limits and credit lines in general just to reflect that I am a responsible and have vision for my future with that particular financial institution. I have low if not a XXXX balance on my credit cards including the one I hold at NFCU. With all of this in mind, I feel it is unfair to deny me the opportunity to purchase a home when I have done nothing but try to build a solid, long standing relationship with Navy Federal. Also, I ask that the underwriting department keeps in mind that I am a licensed agent making me very familiar with the bouts home ownership in general, fair housing laws, and of course the closing process in general. I say that to say you can rest assured this will be a smooth transaction.

The representative even laughed at me when I told them this is not right, over XXXX years. I am now hearing and reading that the color of my skin my be the reason NFCU has denied me. Consumer Complaint: I, XXXX XXXX XXXX received a bill in my mail at address located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX on XX/XX/23 from XXXX XXXX XXXX for a loan that was allegedly taken out via cashing of a mail check in the amount of XXXX on XX/XX/23. Upon reviewing this bill, I realized that I have never and would never cash a check from said company. The following day I went down in person to the local branch of said company located at XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX and spoke with two employees regarding the fraudulent charge. An employee there provided me with a copy of the check that was cashed in my name on XX/XX/23 in an account with Navy Federal Credit Union via mobile deposit. I have never had an account with said bank. The number on said check was XXXX. The signature on the back of the check was forged, and an XXXX readable signature was written beside my name. The phone number on file both on the check and in XXXX XXXX XXXX system as provided by both employees was that of XXXX matching neither my personal or work phone number or any associates or relatives of myself. Also included on the back of the fraudulent check was the first three of a Social Security Number of XXXX, again not matching myself or any known associates or relatives. After gathering this information I then proceeded directly to the XXXX XXXX XXXX XXXX XXXX XXXX a police report for fraud and forgery. I spoke with XXXX XXXX ( XXXX XXXX XXXX ) and filed a complete police report under forgery and fraud. The case number provided was XXXX. XXXX XXXX advised me that I cold pick up an official copy of the full report within XXXX to XXXX business days from the date the report was filed on XX/XX/23. I then returned to the XXXX XXXX XXXX XXXX XXXX XXXX at the address mentioned previously, and spoke with the same employee and provided a copy of drivers license and the pamphlet with the officers name and case number provided to me by the XXXX. XXXX took copies of information. I was then advised that once the official police report was made available to bring it back along with a copy of signature to be provided to the fraud department XXXX XXXX XXXX XXXX. I agreed and will return with information as soon as available. I then reached out to the fraud hotline of Navy Federal Credit Union at XXXX. I spoke with the agent over the phone who located that check and opened a fraud claim. The agent advised me that I would receive mail correspondence in 3 to 5 business days. I have also filed a report of suspected mail theft/ fraud with the United States Postal Service Inspection Service XXXX From there I was advised to file with the CFPB as was done on XX/XX/23.

Consumer Complaint: " I recently applied for a mortgage loan and initially received pre-approval, followed by formal approval. I proceeded with the necessary steps, including the payment of earnest money. However, during the final stages of securing the loan, unforeseen complications arose. Despite my substantial down payment of over {$200000.00}, a XXXX XXXX exceeding XXXX, and the property 's value being {$360000.00}, my application was unexpectedly rejected. The reason provided was related to my debt-to-income ( DTI ) ratio. It's important to note that my student loans were not only in deferment but also subject to an income-driven repayment plan, with a nominal required monthly payment of {$130.00}. Given my annual income in the six-figure range, this denial was both surprising and disappointing. Regrettably, this turn of events resulted in a significant financial loss of nearly {$6000.00}. ''

Consumer Complaint: On XX/XX/2023, I, the consumer, sent to Navy Federal a billing error notice under 12 CFR 1026.13 disputing the entire amount of alleged credit card debt and to request all documentary evidence related to my account. They responded on XX/XX/2023 stating that they can assure that the debt is valid without conducting any reasonable investigation nor producing any documents they are required to provide following a billing error dispute along with three of my most recent statements, credit card agreement, and my initial billing notice error attached via USPS mail. I responded on XX/XX/2023 stating that I further dispute any alleged debt that has been deemed valid without any proper investigations done. They then responded on XX/XX/2023 stating that there are unable to identify an open Credit Card Dispute. It has not been 90 days since notice has been sent and by Navy Federal completely disregarding the consumer 's wishes and concerns is in direct violation of TILA and Regulation Z by failing to comply with requirements for creditors during billing error resolutions. Navy Federal also continues to collect on at least the minimum payment due even though the entire amount is in dispute, which means they are prohibited from collection.

Issue: Managing an account
Subissue: Problem accessing account
Consumer Complaint: I have been going back and fourth with Navy Federal Credit Union since XX/XX/23 regarding my seized account. I was scammed and I also was facing felony charges for theft by receiving and forgery. The charges were dismissed and I still have no access to my account. Below is the email I sent to Navy Federal on XX/XX/23 XXXX XXXX, I am reaching out to you all in reference to my account that has been restricted with no access and my available funds taken since XX/XX/23. As I stated in a previous email, I was arrested for felony theft by receiving and forgery. I have attached a copy of the certified certificate of disposition from XXXX XXXX Government XXXX XXXX XXXX XXXX XXXX. Ive also attached the initial police report. The charges have been dismissed. As I stated to you all, I was scammed and had no knowledge of this check. My car was stolen, my account passwords were changed, I provided evidence that I genuinely thought I was moving money for a friend. XXXX at the last minute said he could not come and sent another guy that I did not know. The closet Navy Federal brach from my location was the XXXX in XXXX TN. I never knew a check was deposited. I have lost my job and all of my bills are past due. This Navy Federal Account is my main account. I have credit cards and loans past due. I am an authorized user on my parents XXXX cards and I am paying on those cards from an external account. You all have locked down their accounts as well I guess under the assumption that I scammed them too. My mother has been on the phone with a representative daily. The last time she was on the phone with XXXX was today XX/XX/23. I have never in my life broken the law or ever been arrested until now. Ive tried to get government assistance but could not because you all refused to even email me check stubs that I asked for in previous emails. My rent is 3 months behind and I am facing eviction. I had a direct deposit from my employer that came to that account while I was in jail. You all are refusing to give me that. The Assistant Branch XXXX XXXX XXXX at XXXX Navy Federal Credit Union had malicious intent went she had me arrested and falsely accused. I was literally in the bank like a normal customer. She didn't question me or anything. She called me into a loan office and XXXX officers appeared directly behind me. Immediately she started cursing me, calling me stupid, asking how much my cut was, saying that she finally got XXXX. I was bewildered and fully cooperative. She was extremely rude and refused to hear anything I said. She had me write my signature down and then she got really quiet. The police stated that it sounded like I was scammed, she insisted on me going to jail. I had to file a police report for a stolen fire arm that was in my car that was stolen. The police asked me if money laundering was going on at this bank because its always stuff like this happening. This allowed me to infer that this is a reoccurring pattern of theft/scamming at this credit union and XXXX XXXX was XXXX of it and she prejudged me. I was falsely accused and there was malicious intent in that. There is no way that I was this ignorant as to deposit a check for XXXX into my account knowingly or willingly that was not mine. There is proof that the man who scammed me has a history of this as well and he has outstanding warrants. All of this evidence was provided to the prosecutor. The officers body cam footage will also confirm XXXX behavior. I have no history of being a check user. I wish that the bank caught it the first time because this possibly would not have happened. I told the teller that Id be back later because I knew my account had a limit. If XXXX had just spoken to me, my car would not have been stolen and we could have got the other money. The only reason the car was even left running is because I went through XXXX XXXX through and was told to come inside. If I knew this was a scam, I would have drove off. I left my car running because I thought I was just going in and coming back out like a normal person as the previous time. I just want to understand that if the court of law decided that they would not pursue this against me, why is my account still seized and XXXX, the Navy Federal XXXX XXXX XXXX was the complainant that wished to prosecute? XXXX trying to get my job back, XXXX trying to get out of debt. This has ruined my life and I just really need someone to do the right thing reviewing the facts instead of personal feelings and emotions. The files are attached at the bottom of this email thread.
