Issue: Problem caused by your funds being low
Subissue: Non-sufficient funds and associated fees
Consumer Complaint: To Whom It May Concern, I am writing to file a formal complaint against Navy Federal Credit Union for their practice of imposing excessive return item fees. Recently, I have been subjected to a series of fees that collectively amounted to the entirety of my paycheck. This action has not only been unethical, but it has also caused significant financial hardship for my family and me. The imposition of such heavy fees in one instance seems to demonstrate a lack of consideration for the financial well-being of members. It is distressing that an institution, which should have the best interest of its members at heart, adopts such practices that appear to be predatory and indifferent to the consequences faced by its customers. I urge the Consumer Financial Protection Bureau to take my complaint into serious consideration and to investigate the fee structures and policies applied by Navy Federal Credit Union. It is crucial to ensure that consumers are protected from unreasonable and burdensome financial practices. Thank you for your attention to this matter. Sincerely, XXXX XXXX XXXX XXXX

Issue: Managing an account
Subissue: Deposits and withdrawals
Consumer Complaint: For a couple of weeks I have been making deposits. Often Navy Federal moves the deductions and takes money from my account for purchases twice. For example I made a payment for {$410.00} on XX/XX/24. the payment was taken from my available balance. Today I made two deposits totaling {$890.00}. The payment has been moved to posted XX/XX/24 and has been deducted from my balance again. I have gone into the branch, called and emailed. I have asked that an account specialists audit my account. I have asked for a detailed break down of each transaction with balances, not received. I went to an ATM and it did not disburse funds, but the money was deducted from my account. Navy Federal removed the whole transaction once the ATM company completed the return, but they never replaced the funds. No one will listen and as well I have been hung up on by the supervisor.

Consumer Complaint: I am reaching out and seeking counsel to file a lawsuit against Navy Federal for improper debt collection and the illegal freezing of my and my husband 's accounts. Upon thorough examination, it has come to our attention that there are substantial irregularities in the legal procedures followed, and we believe that the actions taken by Navy Federal may constitute a violation of the Fair Debt Collection Practices Act ( FDCPA ). This is in direct contradiction to the provisions outlined in the FDCPA, specifically, Section 807 ( 11 ), which expressly prohibits the false representation or implication that a debt collector has the authority to seize, garnish, attach, or sell any property or wages without a valid court order or proper legal process. Additionally, our due diligence has uncovered disturbing information about XXXX XXXX XXXX, who is not a law firm, but a debt collector. We have contacted the Supreme Court of XXXX XXXX, where it appears that a judgment was filed without proper presentation and assignment to a judge. Furthermore, we have received an email from an individual named XXXX, inquiring about the total amount frozenthis is the same individual associated with the initiation of the request. Moreover, attempts to contact XXXX and XXXX through provided numbers have been futile, as they are either disconnected or redirected to personal cell phones. It is noteworthy that XXXX and XXXX are not accredited through the XXXX XXXX XXXX, and multiple complaints have been registered against your agency. Additionally, I never signed an agreement with XXXX XXXX XXXX, and the response from Navy Federal that we have received, was because my husband has access to my accounts, they have to place a freeze on all of my personal accounts. Currently, we have $ XXXX that is being held up and no access to these accounts.

Consumer Complaint: On or around XXXX XX/XX/2023, Navy Fed allowed an unauthorized party to deposit a fraudulent check into my account without my consent. Unknown to me, my credentials were already obtained by this person. Either this was well planned or just a coincidence. The check went through and some of the funds were stolen from my account totalling around {$5500.00}. A couple days after this, the check showed up as returned. This is accurate to the best of my knowledge as I didn't notice It until the day of XX/XX/XXXX I believe it was when I checked to see if my military pay came yet. I reported it asap once I noticed the charges on my account. I've been waiting for word on this case since my rebuttal I sent in early XXXX I've reached out to the bank directly and all I'm told is it's still getting looked at, my other case on this submitted with CFPB states my bank won't reimburse me or cover it but I've yet to recieve anything in writing & actual notification from my bank with their decision. NFCU has a 0 fraud tolerance policy which I believe I 100 % fall under due to this being unauthorized and fraud, it seems Reg E is black and white as far as consumer protection. This is a severe injustice for them to tell me it's my fault and I'm now responsible for it eventhough I did nothing wrong to be in this position. My credit is destroyed along with the huge financial burden caused by this since the bank won't reimburse the funds that were stolen from. I've submitted claims and cases everywhere I can without a resolution from the bank, CFPB, XXXX and a couple others I can not remember. I have also submitted a fraud affidavit I believe it's called and sent it to the credit reporting companies. ( I can attach if needed but its a few pages ) Every time ive called and spoken to a fraud investigator, its taken a few hours of getting transferred just for them to finally say it looks good to go and I shouldn't have an issue getting refunded but NFCU will work my case in the order it was recieved, it was Recieved in XXXX. Please help, this has been a huge headache dealing with this since XXXX and being denied a refund for unauthorized charges that were reported asap. My XXXX XXXX is tracking the issue and is willing to step in and vouch if it would make a difference.

Issue: Opening an account
Subissue: Unable to open an account
Consumer Complaint: Had a credit account that was assigned in my divorce. Unfortunately, Navy Federal Credit Union charged the account off as a bad debt. I contacted Navy Fed and inquired about this debt and ability to open a checking account once this was paid off. The rep on the phone said yes, once paid off you will become eligible. XX/XX/XXXX, account was paid off with letter in hand stating balance was XXXX and now Navy Fed has changed their position and said I am now permanently banned from opening an account. They decietfully lied to me in order to get this account paid off. I have been informed that there is no way I will be allowed to open any accounts because Navy Fed lost money even though the account is paid off. This is their problem not mine and I am being punished for it. I was intentionally misinformed and now they don't want to make good on their promise to allow me back as a member now that the debt is paid off.

Issue: Managing an account
Subissue: Deposits and withdrawals
Consumer Complaint: I have a Navy Federal account that was opened back in XXXX. I called multiple times and was told that my account was stuck in pending closure. On or around XX/XX/2023. I walked into the bank submitted proper documents and was able to withdraw {$100.00} something I had in my account. I was told that if I wanted to get money from my account, this would be the procedure from now on. My account status was in a pending closure since XXXX when it was open. I asked them if I was able to deposit a check I received and they said yes, your account is able to take credits but if I wanted to withdraw then the same procedure I just went through earlier would be done. I said, okay I am fine with that. I deposited the check, they said it would be on hold for an additional 5 days. I was fine with that. Fast forward to XX/XX/2023, the hold has passed and I walked into the same branch, asking to withdrawal. They declined my request and told me to wait for a banker. The same banker who helped me last time didnt help me out this time. He called navy federal security and told them about what I was trying to do and also told them that they should put a restriction on my account. Since than I have not been able to withdrawal from my account. I also submitted and appeal and theyve requested additional documents. My account has been stuck in this closure status for a long time because they could not verify my identity. Since I submitted an appeal and all documents theyve requested from me theyve declined and did not overturn their decision. I felt like I was being mistreated. I felt like I was robbed. I depended on this check so I could pay my rent but now, Im stuck in an eviction battle with my current landlord. This frustration and anger that Navy Federal Credit Union has caused me, I dont think I will ever recover from it. I am facing so many financial hardships. Im about to be homeless. I needed to pay rent and they just held onto my money. Why is there such thing as a credit only for an account thats in a pending closure? I consider this fraud.
