Issue: Getting a loan
Subissue: Confusing or misleading advertising
Consumer Complaint: I received an advertising in the mail regarding a XXXX XXXX XXXX in XX/XX/XXXX. I called the phone number listed on the advertising and after answering a few questions, I was told I needed to enroll in school as quickly as possible. A few days later, I received call advising me that I was pre-approved for {$20000.00} and since I have a son in school that qualifies me for the loan and they could have proceeded without me been matriculated in school. I was also told that I would need a co-signer. I was excited to go back to school. With no knowledge at the time, I immediately called my dad who agreed to co-sign for the loan. The loan was approved and I started school XX/XX/XXXX. In XX/XX/XXXX, my father was diagnosed with XXXX and I fell behind on my loan. I started to receive phone calls regarding past due balances as so was my dad and son. After a bit of research, I realized that what the representative failed to disclose was that my son was actually listed as the student and not me. I was listed as the borrower, my son as a student borrower and my dad as the co-borrower. I notified the lender that was incorrect that my son was not the student and should have never been on the loan, but they ignored me. I tried several times to get this corrected but to no avail. I struggled throughout the years to maintain the loan, but with my dad 's serious health condition it was difficult. In XX/XX/XXXX my dad passed away and I became unemployed. After his passing, I received documents requesting full payment for the loan from my father 's estate. When I questioned the demand for full payment, I was advised that was one of the condition of the loan and this was included in the promissory note. Sadly, I had never receive a promissory note and no one had told me that either. The phone calls continued and both my son and I have been consistently reported to the credit bureau. Recently, I was connected with the Office of Customer Advocate and I was provided with my payment history and an ineligible/fainted copy of signed documents. Along with a few pages of what is supposed to be the promissory note that I should have had. I am in communication with a third party agent who is requesting full payment from my father 's estate and my son and I are receiving several calls daily from the lender.

Consumer Complaint: In XXXX of 2018 I entered into a payment modification program and set up auto pay with Navient. {$150.00} was supposed to be taken out of my account each month. Navient never set the payments up with the correct information, causing my payments to be late. Was told that a payment was needed by XX/XX/2018 or delinquency would be reported to the credit bureaus. Navient reported to the bureaus prior to the date they specified. When payment was attempted they refused to accept my payment of the past due of {$150.00}. Said that I had to pay {$200.00} and that was the minimum amount that would be accepted. Otherwise they would continue to report to the bureaus for non payment.

Consumer Complaint: I work at a XXXX XXXX and have been planning my life, essentially, around being able to discharge my loans after 10 years of consecutive repayments to NAVIENT. I have only Federal Direct Loans. My loan payment is enormous -- {$530.00} a month for a single mother of XXXX. However they only calculate the loan based on income. When I went to apply for public service loan forgiveness, I was told -- for the first time -- that I did not qualify because I wasn't doing " income-based repayment, '' a form of repayment that would nearly double my monthly payments. I can barely make my monthly payments as it is. No one said ANYTHING about having to be on income-based repayment when I was told I could get loan forgiveness for working at a XXXX XXXX 11 years ago. I believe I have been a victim of fraud.

Consumer Complaint: Navient has harassed me and my co-signer over XXXX situations over and over for years and every time I figure out its an issue from their end and call them out on it they stop harassing for a bit. Now most recently they havent even been reaching out to me, the borrower, instead they just reach out to my co-signer without any attempts of reaching out to me, claiming that my account is past due but in reality it is not and when I call and give them payment confirmation numbers they claim that their system takes a long time to update. Yet they have already taken the money out of my account! This is harassment and they tack on unnecessary fees that dont have any explanation. They need to investigated bc they truly have nothing but Horrible intentions towards their borrowers and all they do is lie and try to steal more money! How does it make sense to never contact the borrower yet harass the co-signer? They have all of my contact information! My account is always up to date but bc of their slow system they claim its past due until I give them confirmation numbers. They have also marked my credit report and Ive attempted to dispute it several times

Consumer Complaint: My original student loan was with Navient ; which was incurred in XX/XX/XXXX ; I was current on my loans until I filed for bankruptcy ( which was filed in the bankruptcy courts in Arizona on XX/XX/XXXX ), listing Navient in my bankruptcy petition. On XX/XX/XXXX, the Judge entered an Order of Discharge ( which Navient was part of that discharge order ). After the order, I received phone calls and letters from XXXX ; and now on my credit report I have a company stating I owe them student loans to this company : XXXX XXXX XXXX XXXX XXXX XXXX ( Educational ). I have never had any loans with this company ; nor do I owe any loans as I filed for bankruptcy and owe nothing to anyone.

Consumer Complaint: I have been making payments on private student loans since XX/XX/XXXX on private student loans. The amount of payment has varied over the years. I was setup for auto payments that were taken right out of my bank account and each month for years I would get phone calls saying my loans were late. I would explain the same situation month after month ... .they are on auto pay..they are not late. Navient was not applying the payments correctly so late fees and interest were being applied. This went on for years. My mother is a co-signer on my privates. I applied this year ( XX/XX/XXXX ) to have her released and was denied. She is XXXX and on social security. Navient calls her because of my loans. This stresses her and I've asked them to stop. But of course she is a co-signer which is why I filled out paperwork to have her released. It was denied. My income has changed in XX/XX/XXXX and now I can no longer make the huge amount of monthly payments. I am starting to fall behind and the phone calls are starting. I have called ( XXXX, XXXX & XXXX ) several times to get the payments lowered. I'm told they can go any lower than the {$400.00}. I can not afford this amount. Navient said they is nothing I can do to lower my monthly payment. I have read about the lawsuits with Navient. I have had the same experiences with Navient dealing with my private student loans. I filed bankruptcy in XXXX and was told I could not discharge my private student loans. I am now reading that sometimes they can be discharged if I go before a judge. I was not told this and was not aware this was an option. I just need help to reduce my monthly payment.

Consumer Complaint: Navient has encouraged me quite often in the past to get " Forbearance '' and then " Consolidation '' when I had personal setbacks like divorce and paying for my children 's college loans and mine which I took to get relief. I inquired and completed forms for " Public Loan Forgiveness '' and Teacher Forgiveness '' to no avail. I have spent countless hours on the telephone with Sallie Mae and Navient employees. I have now retired and inquired again about forgiveness programs after 50 years of working in XXXX, specifically with XXXX XXXX XXXX XXXX, XXXX XXXX children and adults and XXXX populations. I was told that I did not qualify for either program because I followed through with their advisement that I consolidate my loans with my children 's loans. I did not have a viable option at the time because my children 's colleges/universities did not allow students to apply for student loans. I have been put in a " no-win '' situation by both Sallie Mae and Navient with their forbearance schemes and false encouragement to consolidate and their determining my payment options without my consent. ( I am asking for forgiveness of this extremely large debt, although I have maintained these payments by " robbing Paul to pay Peter '' analogy. ) I have just received an increase notice which competes with my mortgage payments. In fifty years, my student loan debt has not shown any decrease due to their machinations, captialized interests, and poor advisement. Thank you.

Consumer Complaint: I have tried on numerous occasions to lower my monthly payment due to a decrease in my families income ( my wife and I just had a child and therefore she is not currently working ). Navient was not able to reduce my monthly payments or even put my loans on temporary forbearance. I am either forced to continue to pay this amount we can not afford or default on payments and have my credit affected.

Consumer Complaint: I was told I wasn't eligible for any type of loan forgiveness in any manner after having XXXX in XXXX XXXX and a XXXX XXXX school district for over 25 years. I was offered loan consolidation, which did nothing. I am currently retired and on a fixed income with an upcoming loan payment of over {$1400.00} in XX/XX/2019. This denial occurred approximately 5-6 years ago, after the superintendent of human resources from my school district completed verification of employment, etc., I was denied and told the only program I was eligible for was loan consolidation, which I have done
