Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: On XX/XX/2023 I was notified by XXXX that Navient reported my private student loans as 60 days late. I was in disbelief. I was never late on my payments. Actually Navient takes payment from me every month of the 3rd. I check my bank statement and sure enough the XXXX was removed. I never received any statement in the mail from Navient. I never received any invoices from Navient prior to this issue because I found out Navient was sending my information to my co-signers house. My father, who does not live with me or will not open my mail. When I called Navient even the supervisor filed a report for me stating I did infact make my payments monthly. When I called them back to ask what my status was because they never returned my call, they stated the reason why I was late was because the federal interest rates went up and making my payment higher. How is this possible when I am clearly on a payment plan and I was never notified of these changes needing to be made. They were the ones taking this out monthly for me out of my bank account. There was no follow up and no one wants to help me at this point. I have filed to dispute this with Navient at which they ensured me on a recorded line an ombudsman would contact me, and never did. I have also tried disputing these accounts with all 3 credit bureaus. I was in the process of buying my first home when they reported these frivolous findings.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: Navient, Formerly Sallie Mae, has continuously been an incredible source of frustration for myself and other borrowers. My complaint is this : When an " overpayment '' is made, the loan interest rate rises. The associates I speak to have stated categorically that overpayment does not affect interest rates, and yet, when I view the Prime Interest Rate trend history, the rises in my Navient loan interest rates do not match. In other words, I am being punished for overpaying which was not in my MPN. Additionally, I have on multiple occasions email the company requesting a copy of my ORIGINAL Master Promissory Note and the have outright ignored my requests, simply choosing not to respond. I utilized their emailing system for these requests. Furthermore, multiple times I have submitted ALL required paperwork to release my cosigner and again I have been completely ignored. When I call, the customer service representatives act as if they are ignorant of the way they could view the submitted material. Navient has been sued in recent years for it's predatory tactics and lending practices and I am a victim of this, though I have been paying faithfully for 15 yrs I am still treated like trash from this institution. In Summary : 1 ) Loan interest rates rise dramatically when any overpayment is applied - this is not associated with Prime Rate trends 2 ) Company feigns ignorance of my multiple request for original MPN ( under Sallie Mae ) 3 ) Company feigns ignorance of my submittal of all required materials for releasing co-signer 4 ) Company overall is predatory in its tactics and mistreats its clients because, basically, it knows it can because no one stands up to them.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: I am writing to file a complaint against Navient regarding their unfair practices and harassing behavior towards me and my late mother. Despite multiple attempts to come into a fair payment arrangement with them, I have been repeatedly charged for payment arrangements, and my principal balance never seems to go down. Furthermore, during the pandemic, when I was in financial difficulty and asked for deferment, they refused to help and instead called me and my late mother every day. I politely requested them to not call me and my late mother, but they continued to do so. The situation has now escalated to the point where they are calling my job and being rude to my coworkers. They even disclosed my account details to my coworker, which is a blatant violation of privacy. I feel extremely uncomfortable and harassed by their actions. I am frustrated and deeply concerned about Navient 's unfair practices and unethical behavior towards their customers. I have tried to resolve the issue with Navient directly, but to no avail. Therefore, I am requesting your assistance in resolving this matter. I urge you to take appropriate action against Navient and ensure that they comply with the relevant consumer protection laws and regulations. Thank you for your attention to this matter

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have been in constant contact with Navient and have been making good progress with one loan that I can afford to make payments on. I have tried to make a payment arrangement, but the amount is way out of my budget. I received multiple email about the account and that if I did not do anything by the end of XXXX, they would report me 120 days late. I called and explained I can not pay full back payments due and need new payment arrangement. I was told if I paid XXXX it would stop the 120 days late reporting. I said I would try to come up with the money and agreed on the money coming out of my account on the XXXX of XXXX 2023. which it did. They still reported me 120 days late and when I called, I was told well I should have made the payment on the XXXX. Why would I call and be on the phone for 41 minutes and agree to a payment that " would stop it from progressing '' If the date I paid it in was one day to late??? I called Navient and got the " we will review the call '' XXXX I am a grad student that now because of Navient can not het Finacial Aid due to their inaccurate information and their inadequate staff that fails to give the customer the correct information, It is not fair we can not have some type of retribution for their unfair and inadequate business practices. Again, why would I make a payment a day too late to stop the account from progressing to 120 days late?? This is a scam Navient only cares about their bottom line and has unfair and inadequate business practices. They should be stopped before they ruin more lives. I have had many problems with their accounting practices, I will pay an account according to the amount due only to be tagged with late fee even when the payment was made on time, and I was told I paid the wrong amount. I paid what their site said was due.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Over the past few years, I have made several requests for accurate account information directly from Sallie Mae/Navient and submitted numerous disputes with the different credit reporting agencies. On XX/XX/XXXX, I requested a copy of my entire Tuition Answer loan files. On XX/XX/XXXX, I received a canned response that " copies of your loan agreements will be delivered to your address of record via U.S. Mail. '' On XX/XX/XXXX, I received a letter that only enclosed copies of the loan applications and promissory notes. I followed up with another request for the payment history and charges on my private Tuition Answer loans from XXXX. I made several disputes with the credit bureaus in the past and have received form responses that the disputed items were verified. However, I was never provided the information that Sallie Mae/Navient provided to " verify '' those disputes with the CRAs. On XX/XX/XXXX, I renewed my request for the entire loan files. To avoid any confusion, I requested to see all assignment ( s ), notice ( s ), servicing agreements, servicer transfer letters, notes regarding any modifications of the loan terms, and full payment history from XXXX to the present. None of that information was ever provided. On XX/XX/XXXX, I received the following email response : " XXXX, " Thank you for your inquiry and for your business with Navient. Please be aware that a transfer of services is unable to be provided as no transfer was taken. In XX/XX/XXXX, Sallie Mae split into two separate companies, Sallie Mae and Navient. When this split occurred, your loans did not move, just the name of the servicer changed, the payment address and all terms and conditions of the loans remained the same. A letter was sent to you as well as notification was provided on your monthly billing statements as well as your online account of company split. " Your loans were in In-School Deferment for Voluntary Forbearance from XX/XX/XXXX to XX/XX/XXXX then again from XX/XX/XXXX to XX/XX/XXXX. Payments were not required or made during this time which is why there is a gap in payments for these months. The declining balance history provided to you is an accurate record of all balances and payments made to your loans since origination, either addressed to Sallie Mae or Navient. We do not indicate a payment made in XXXX of XXXX. This could be an inaccurate report on your consumer report. " Your loan ending in XXXX was disbursed for XXXX on XX/XX/XXXX. There were several cannibalizations of the interest on your loan from the disbursement date to XX/XX/XXXX. From disbursement until XX/XX/XXXX, no payments were made on your loans. Because no payments were made, the principal balance would not have decreased from origination as interest accrues daily on the unpaid principal balance from the date of disbursement until the loans are paid in full. Unpaid interest after a period of postponement is capitalized if it is not satisfied. The balance of {$37000.00} as of XX/XX/XXXX is accurate and is as close of a transaction on your account we can provide to the balance as of XX/XX/XXXX. " The balance on your loan ending in XXXX was {$29000.00} as of XX/XX/XXXX. The balance on the loan as of XX/XX/XXXX was {$34000.00}. '' I received and reviewed the " Declining Balance Histories '' for my Tuition Answer Loans and noted discrepancies between the amounts Navient showed versus the amounts Sallie Mae previously reported prior to Navient 's alleged acquisition of the loans. First, both loans have a gap from XX/XX/XXXX through XX/XX/XXXX for which there is no history whatsoever. On Loan XXXX, Sallie Mae last reported to the credit reporting agencies that a payment was made on XX/XX/XXXX ( which is not reflected on their " declining balance history '' ) and that the account balance was {$12000.00} as of XX/XX/XXXX. However, where the new servicer 's ( Navient 's ) account history picks up on XX/XX/XXXX, they show a balance of {$42000.00} - almost 3.5 times greater than what Sallie Mae reported, in less than 2 years ' time. Likewise, with Loan XXXX, Sallie Mae last reported to the credit reporting agencies that a payment was made on XX/XX/XXXX ( which, again, is not reflected on their " declining balance history '' ) and that the account balance was {$9000.00} as of XX/XX/XXXX. However, where the new servicer 's ( Navient 's ) account history picks up on XX/XX/XXXX, they show a balance of {$34000.00} - almost 3.75 times greater than what Sallie Mae reported, in less than 2 years ' time. Navient 's starting balances should properly reflect the last balances reported by Sallie Mae. The fact that Navient asserts that the Sallie Mae-Navient transition was simply a " name change '' makes the account discrepancies all the more troubling. Also, the fact that Navient admitted that its XX/XX/XXXX reporting to the CRAs was " an inaccurate report on your consumer report '' is disheartening when I kept getting responses to my disputes that the information furnished by Navient/SallieMae was " verified ''. I have repeatedly requested explanations of these discrepancies, to no avail. I have been making program payments for several years yet it seems my loan balances barely decreased. If Navient can not produce the backup documentation to support its claims for these loan balances, it should not be permitted to collect them. At this juncture, the Consumer Financial Protection Bureau appears to be my last resort to finally obtain a clear, complete, and accurate compilation of the loan transfer/servicer transfer documents for these private loans. I would also like to see the original loan payment histories from Sallie Mae at the time of the company 's split in XX/XX/XXXX. Thank you, XXXX XXXX

Issue: Getting a loan

Subissue: Fraudulent loan

Consumer Complaint: I attended XXXX XXXX XXXX in XXXX Ohio from XXXX to XXXX where I was receiving federal student loans. Midway through the program, the financial aid department stated the college was under a letter of review for the respiratory therapy program and they lost their accreditation. Sallie Mae was the student loan provider at the time and my account was sold to Navient after Sallie Mae was closed down. All my federal loans were placed into a private loan by Sallie Mae without my knowledge and sold to Navient. I was an undergrad in XXXX when Navient started harassing me for payments even though my loans were placed in deferment. During the Navient lawsuit process, I attempt on several occasions to rectify this situation with no prevail. I filed a borrower 's defense application and was notified on XX/XX/XXXX my loans by XXXX XXXX XXXX will be discharged through the lawsuit " Sweet v. Cardona. Every month Navient has increased the loans to over XXXX dollars and I requested a copy of the signed agreement they claim I agreed to and never received it. Why would I transferer my federal loans to private loans? I have spoken to an attorney and will move forward with a class action lawsuit about this fraudulent matter.
