Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I was told by my college XXXX XXXX XXXX that I did not have any government money left to use to pay my tuition and fees and therefore I would need to take out private loans in order to pay. The financial aid department at XXXX certified my loans for amounts exceeding the cost of tuition and then kept the extra money. I later found out after leaving this school that I did have federal funds available to pay for tuition. As a result I now have several large private student loans with Sallie Mae. Now Navient the collections branch of Sallie Mae is constantly harassing me and my co-signer for extremely high monthly payments that I am not able to make because they exceed my monthly income and my co-signer can not make because they are XXXX ill and currently in the hospital. I have spoke with different agents in the past, most recently in XX/XX/2018 regarding options to lower my payment amounts to feasible amounts. I have offered to provide my pay stubs, monthly bills, and statements from credit card companies to show how these large payments would create undue hardship for me. They have never requested any document from me to prove my undue hardship. The agent I spoke with only asked me questions about certain expenses over the phone. Navient only offers me a forbearance option of paying {$150.00} which doesn't lower my monthly payments it only makes the account current and thus makes no difference. The last time I spoke to an agent regarding lowering my monthly payment amounts I suggested an amount that was reasonable for me. I was told it wasn't going to happen and was mocked for not being able to make the suggested monthly amount Navient wanted. Currently I only send Navient what ever money I am able to come up with when I can. I have told them repeatedly that I can not make these large payments and that I can only pay what I can afford, but the call repeatedly everyday.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: Since XX/XX/XXXX, I have made a payment every single month. I have spoken with a representative and they advised me to call in the next month to make another payment as a payment plan was not available. Even though that is the conditions they set with me, they call and harass me and my family every single month. Last night, they ( a guy named XXXX ) left a message at my work that everyone heard. This is ridiculous and needs to stop. I don't have a lot of money, but I make payments every month. This kind of harassment should be illegal and make me beyond angry. I will try find another option this year for my student loan repayment. This company crushes your soul and isn't satisfied until you're destitute, and your family has nothing. I am convinced they would take the clothes off your back if given the chance. Stop the harassment.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: The cosigner on my private loans was paying one of my loans from Sallie Mae through Navient. He was assisting me with this loan because I have already been struggling with other student loan payments. After my cosigners death, the automatic debit from his bank account stopped and now the loan is a few months passed due. With an already extreme interest rate, the principle is now even larger. Only after contacting Navient did they inform me that there was nothing they could do and the loan would be completely on me to pay. Even with my other loans from Navient and XXXX being on an income-based repayment plan, if I were to start paying this outstanding loan by myself, I would be paying over {$1000.00} per month just in loan repayments. I am starting to believe that Navient is not giving me the lowest possible payment on an income based plan. People who I know that are in similar situations pay much less. I have over {$200000.00} in student loan debt, with a job that requires a XXXX XXXX and only pays {$55000.00} per year. This student loan debt is near crippling to someone who lives in an expensive metropolitan area for work, is newly engaged and wants to start a family. There is no end or relief in site for me or others in my situation. Please help.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I contacted Navient in XX/XX/XXXX to discuss repayment options and they recommended I apply even though I stated I could make small payments and decided to make some of them anyway ( {$50.00} per month ). XX/XX/XXXX I was contacted by Navient to and told : " You're eligible to resolve your past due payments through forbearance and you may qualify for a new repayment plan. '' XX/XX/XXXX I was again contacted with the same email pushing me toward forbearance There have been many times over the past years that I have contacted Navient to talk about repayment options due to limited income and life situations. More recently, on XX/XX/XXXX I was put on forbearance when I contacted to inquire about what to do since my College has closed. I was put on forbearance and told to submit paperwork which I sent in but I never heard back and my payments reinstated XX/XX/XXXX.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: Before I began XXXX school, I contacted Navient and was told that my loan was eligible for in-school deferment. I chose this option, submitted the request, and budgeted my very limited assets assuming the deferment was legitimate and I would not be paying this bill for the time being. I began XXXX school and found out through collection attempts from Navient that I was not, in fact, in deferment status. On or around XX/XX/XXXX I was advised by the company that I was not eligible for deferment, and I paid {$100.00} to forbear my loan to bring it to current, in panic that my credit was being affected. I contacted Navient twice in XX/XX/XXXX. I believe the dates of these calls were on or around XX/XX/XXXX and XX/XX/XXXX. In XX/XX/XXXX I was given information indicating I did have options to lower my payment, then later those statements were retracted, apparently in alignment with the contract I signed with XXXX XXXX XXXX. Since that day I have been in contact at least twice more with Navient ( I can not recall the next call after XX/XX/XXXX, and I spoke with a supervisor today ). I also made a monthly payment on XX/XX/XXXX in good faith to show I am not a person who is avoiding their bills, but rather someone looking for a realistic option to repay my loan until I am done with XXXX school and back to work. During the process since XX/XX/XXXX I asked Navient to send me a copy of my contract, which I did review. The contract verbiage did not align with what I had been told by a Navient representative. I was told specifically that my contract prohibited deferment since the loan was disbursed ( I believe a term of 60 months ) in the past, however the contract did not expressly or implicitly contain this provision. I was then told that I had no options to adjust or delay my payments according to the terms of my original contract with XXXX XXXX XXXX. Today ( XX/XX/XXXX ) I spoke with a representative, then supervisor XXXX XXXX, who advised I did have an option ( one not previously communicated to me ) of making interest-only payments, however the discount was insignificant ( a {$30.00} difference, from a monthly payment of around {$170.00} ) and therefore did not help my situation. XXXX also advised I could place my loan in forbearance to bring it back to current, seemingly the exact option I took advantage of in XX/XX/XXXX. I had previously filed a complaint to the Navient office of the Ombudsman, however the results of the request were not communicated to me until I asked the representative on today 's telephone call. The results indicated there was no representative error, which is logically impossible since I was previously given options by the company that were mutually exclusive. XXXX was very understanding and submitted another Ombudsman research request within Navient, as well as an internal research request. She anticipated that I would receive a telephone reply ( and voicemail if no answer ) within the next couple weeks. I did advise XXXX that I would proceed with a CFPB complaint as well. My desire is not to get out of paying my loans. If I can find a way to make a reasonable payment, or to defer temporarily, that would be the best result until I receive income and can go back to making normal payments. Additionally, my contract did mention a minimum monthly payment of {$30.00}, which may or may not be relevant to my issue, but if this provision is implying that I could reduce my monthly payments to this amount, I would certainly be able to budget my loan payments. I have two loans total that were originally borrowed from XXXX XXXX XXXX and are now serviced by Navient. If there is any additional information I can provide please do not hesitate to contact me via telephone or mail.

Consumer Complaint: On XX/XX/2018, I filed income-driven repayment plan request. I received an email from Navient stating that my request was approved. My payments were showing to be lowered to {$32.00} for the following month of XXXX. However, as of today it has changed back to the amount {$150.00} without any notification from Navient. I would like clarity and guidance as to why this is happening and for it to be resolved.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: Hi, I had previously submitted a complaint in XXXX of XX/XX/XXXXwith Sallie Mae - who has since sold my loan to Navient. The previous complaint case number was : XXXX. The complaint was centered around raising my payments after doing an interest only repayment. I settled on an agreement with Sallie Mae - which was to an extension of 3.5 years to help keep the payment at the original payment amount of XXXX per month. Upon checking on the status of these loans - it looks like they have extended my loan to XX/XX/XXXX. I graduated in XX/XX/XXXXand was told that my Master Promissory Note shows a 10 year repayment. This means that I should be done paying these loans in XX/XX/XXXXor XX/XX/XXXX at the absolute latest. My monthly payments have also steadily increased from {$620.00} a month to {$670.00} a month currently ( and to be clear the total interest being paid a month is actually less than it was in XX/XX/XXXX). I tried calling Navient and asking for the agreement and original master promissory note. I was told they would get them to me by Friday of last week ( XX/XX/XXXX ) and they have still not been sent. I have been paying these loans for over 11 years at this point. I took a short period of time where I paid interest only and I'm aware that this extended my payment - but I did not agree to have this extend to a 19 year repayment. This is unacceptable and I'm hoping you will be able to assist me.
