Issue: Struggling to repay your loan
Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: So this is more about the interest I accrued during my first XXXX XXXX bankruptcy roughly over 14-15 years ago when i contacted my lender they just said I'm in forbearance and dont have to make payments. Well my XXXX XXXX was 5 years making payments of XXXX dollars a month Navient never told me interest would continue to add up so my XXXX loan went well over XXXX. Now I'm going to pay about XXXX just in interest over the life of the loan till XXXX/XXXX/2030. This seems so unfair and I don't know what to do and feel helpless. Paying almost 3 times the original amount seems so unfair.

Consumer Complaint: This is in response to complaint XXXX. The true nature of my creditworthiness is not being reflected because there are inaccuracies being reported within the account NAVIENT. They are reporting that I was 90 days past due, but XXXX and XXXX are only reporting 2 negative dates while XXXX reports 1. How is this accurate when all data furnished should be the same? Also, if I was late 90 days there would be another date listed where I was late. Lastly, you are reporting different account numbers for the same account. How does this meet FCRA regulations? The account numbers being reported are XXXX, XXXX, XXXX. I am demanding that this account is deleted from my credit report immediately for incorrect information.

Subissue: Keep getting calls about your loan
Consumer Complaint: Navient has been calling me multiple times a day and also attempting to contact third parties about a debt. They've been emailing and calling me at work. They've been calling my children 's cell phones, they've been calling my mother. On XX/XX/2023 I sent a certified letter requesting that they only contact me in writing at my mailing address. I also requested a copy of the signed promissory note on the loan. A representative from Navient received my written request on XX/XX/2023. Since that date, they have continued to call various phone numbers associated with my name and sent various emails to email addresses associated with my name. This is in clear violation of The Fair Debt Collection Practices Act. I do not acknowledge this debt and dispute it.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I have numerous court records showing Navient has sent out old loans to XXXX XXXX who sent them to a collector named XXXX and XXXX who are now collecting on accounts Sallie Mae determined were not mine! This took place over 10 years ago and now they are re opened. Navient has passed this off as a court record yet THEY own the contracts. I have told them over and over and over these were closed by Sallie Mae and they even contacted me about not collecting on them again. Navient is hiding behind the debt collectors ( XXXX and XXXX and XXXX ) who illegally filed records without serving me. I have asked over and over to have this re opened at the courts and they have not done so. XXXX responded to my complaint claiming I said it was fraud and I never said such a thing. I said I was never served and Navient is responsible for this. Sallie mae passes me to Navient who passes me to XXXX who passes me to XXXX and NOBODY is doing a thing! I want this case re opened and the garnishment stopped!

Consumer Complaint: Navient claims that my student loans are Department of Education loans serviced by Navient. Navient claims that as Department of Education loans, my loans are federally guaranteed loans ( e.g., can not be discharged through bankruptcy ), but since they are serviced by Navient I have none of the benefits and protections of of other Department of Education loans ( e.g., no interest accrual on loans during Covid non payment periods ). I accrued thousands of dollars in student loan interest during Covid. I have complained to a Navient about this, that it does not make sense that Navient gets all the federal benefits and protections on my loans and I get none. I do not think this is fair. I have attached communications with Navient regarding this issue.

Consumer Complaint: I am submitting to your attention a complaint that involves alleged private student loans that Sallie Mae/Navient and XXXX XXXX claim existed. Both SallieMae/Navient and XXXX XXXX are claiming these alleged private loans existed and have been collecting on these loans since allegations began. XXXX now holds the alleged private loans formerly held by SallieMae/Navient XXXX I have included attachments that reflect supportive documentation that such alleged private student loans may have been fraudulently created and/or misclassified. These alleged private loans were initially classified as federal student loans and were re-classified as private loans with different ID and account numbers. Numerous phone calls were made to SallieMae/Navient and XXXX XXXX with requests to justify the existence of the alleged two private student loans to no avail. XXXX XXXX attempted to justify collecting on a duplicate set of these alleged private loans. I requested specific documents from both Navient and XXXX XXXX that would help support the allegations of private student loans/disbursement. A review of the information received did not support the allegations that there were private student loans nor actual proof of disbursement. Contesting repeatedly to SallieMae/Navient and XXXX XXXX that I felt the alleged private loans were not valid loans and that these alleged loans may have been intentionally/unintentionally misclassified, I thoroughly searched my own records, made several telephone calls to the University, Department of Education, and Federal Student Aid Office seeking proof . The University confirmed there were never any private loans disbursements- only federal loans supported by information submitted and that they would have to approve any private loan requests/disbursements. There are no records of any alleged private student loans with supportive documentation in my files nor the files of those queried. SallieMae/Navient and XXXX are the only ones alleging such loans existed and information submitted is both questionable and does not support their allegations. The following attachments were based on information derived from the Department of Education and from SallieMae 's records.Reflected in attachment # 1 is documentation which shows similar dates/amounts of " federal student loans '' that SallieMae/Navient and XXXX XXXX claimed were private student loans. Attachment # 2 shows federal loans, not disbursed, around timeframe reflected in their document submissions to me. Finally, from SallieMae 's records, attachments # 3 & 4 clearly reflect that the alleged private loans were originally classified as " Federal Plus Loans. ''

Consumer Complaint: To Whom It May Concern : I am writing to lodge a formal complaint against Navient, my student loan provider, for their refusal to grant me the full 48 months of in-school deferment eligibility as outlined in the terms of my loan. Despite multiple attempts to resolve this issue, Navient has consistently attempted to gaslight me by suggesting that I have already utilized some months of eligibility with my prior loan servicer. I am absolutely certain that I have never used in-school deferment with my previous servicer, and Navient is well-aware of this fact. Navient has sent me documents from my previous servicer ( please see the attached files ) which they seem to have used to arbitrarily determine the number of months I have already spent in in-school deferment. However, nowhere in these documents is there any indication that in-school deferment was ever applied. In a poor attempt to resolve the issue, Navient has arbitrarily applied additional months of in-school deferment to my account, but this solution is neither satisfactory nor accurate. As it stands, one loan has in-school deferment expiring in XX/XX/XXXX, and another in XX/XX/XXXX. According to Navient 's own documents, in-school deferment was first applied in XX/XX/XXXX. With 48 months of eligibility, this would mean that my in-school deferment should not expire until XX/XX/XXXX. This issue has been inadequately resolved and poorly managed. Every attempt I have made to contact Navient has resulted in copied and pasted responses suggesting that the issue is being " researched. '' I am disappointed and frustrated with Navient 's lack of transparency and failure to fulfill the terms of my loan agreement. I kindly request the Consumer Financial Protection Bureau 's assistance in resolving this issue and ensuring that I receive the full 48 months of in-school deferment to which I am entitled. I have attached all relevant documents for your review and consideration. I appreciate your time and attention to this matter and look forward to a prompt and fair resolution.
