Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: This account was placed in default on XX/XX/2018. It just came off of a Derferment in XX/XX/2018. I stopped getting any kind of mail from my loan servicer in XX/XX/2018. I received no calls or any correspondence from my servicer, XXXX. They put the loan in default without corresponding with me. I received 1 phone call from XXXX XXXX 3 weeks ago. I was told to contact XXXX. I contacted my servicer, XXXX. I was told to contact XXXX. I was getting the run around from all parties involved. I worked a little part time job last year. I was able to receive an income tax return, but it was taken, by Navient without notification. With Navient taking my income tax, it has put me in a major bind financially. Examples : Electricity due to be cut off any day, Phone is due to be disconnected any day, Car is due to be repossessed, etc. I didn't know who my servicer was until I called several different places. I did a review of the company, Navient. They have 4 lawsuits against them currently for Student Loans. The customer service representatives with this company is extremely rude. I couldn't get a word in at all with the several representatives I did come in contact with. I need some serious help with this situation.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I have three school loans taken out one that happens to be in XXXX ( XXXX paid and XXXX balance ) before I was even born. Then the other two on my credit report were in XX/XX/XXXX ( 1= {$3000.00}, the 2nd= {$3100.00}, both closed. But was told that they're the same one. But on my credit report it states that there different. ) I also tried to dispute those two that I never did those that I fully believe my ex-husband XXXX XXXX whom I divorced in XXXX and have a five-year XXXX XXXX against until XXXX that he committed fraud against me. I sent in document stating my case. Nothing was done and now I was garnished my XXXX taxes ( {$3.00}, XXXX ) which I was trying to use to support my XXXX kids and move out of California with and now I can no longer do. Can you please help? Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I assumed this loan for my daughter. When she graduated she never found employment in her degree/field. I had to support her while she tried for several years to find work in her degree. I have paid on this loan as best I could having to move from place to place 6-12 months consecutively with another move due to a sale of current household in XX/XX/2019. She finally took a XXXX job but still needed support due to low wages. I am retired with a Federal Retirement benefit and social security. Due to losing my house, my age XXXX and not driving I have had to move regularly incurring expenses and defaulted for a time during these moves. I would like to work with someone for a normal monthly payment yet have been put on hold for more than an hour and now having my social security and federal retirement garnished and told conflicting information on my retirement and payment plans. Relief would be desirable yet with no judgement against me my retirement will be garnished leaving me with barely a livable wage. My daughter graduated almost 10 years ago and still doesn't work in her selected field and still works for a bit more than minimum wage. I would still be helping pay her rent has she not found a low income apartment.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have on two occasions now contacted Navient to take me off Income-Driven Repayment ( IDR ) as the loans are accruing around $ 1k of interest a month ( I owe almost 270k, go XXXX XXXX ). The first incident was in XX/XX/XXXX, where I received verbal confirmation from their customer service rep that I was to be taken off IDR. This never happened. When I looked at my student loans again this XXXX ( XXXX ), I had not been taken off IDR, and had accrued additional interest. I called Navient again, again received verbal confirmation. The representative indicated that I would see changes to my account after payment was drawn for XXXX. Payment was drawn for XXXX, and I am still not off IDR. I plan to follow up daily until they hopefully take me off this plan, but each month these people hold my loans hostage and make ~ {$1000.00} in interest, I am unable to get off IDR, and I am unable to refinance them or move them to a different lender. It honestly feels like I am being held as a financial hostage by this organization and don't know where to turn to.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: This is my second complaint. They have the wrong person. I have spoken to them four times, and they admit they have the wrong person. They say they will stop calling my number, but they do not. The phone calls started again today, and I have received three calls on XX/XX/2019.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I noticed that my XXXX payment had not posted to my checking account, and called Navient. I have been on a payment plan for a while, and it was time to review my financial statement. I was proposed an increase of over 15 % on my monthly payment, I asked to speak to a supervisor as I am struggling to make payments as it is. I was denied an option for a lower payment - my monthly payment was increasing from XXXX {$540.00} to XXXX {$630.00}. This incident prompted me to research a little further to see how much I had already paid on my student loans, and what I found out was mind blowing : I have borrowed from Sallie Mae a total of {$86000.00}, already paid {$50000.00}, but still owe {$96000.00}. Loan 1 - {$24000.00} on XX/XX/XXXX, Loan 2 - {$30000.00}, on XX/XX/XXXX, and Loan 3 - {$31000.00}, on XX/XX/XXXX. I would like to know what are my options, as this looks like predatory lending. Any help would be greatly appreciated. Thank you, XXXX

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have been paying back my student loans held by Navient for about 5 years now with a fixed payment plan ( the same amount is withdrawn every month on autopay ). On XX/XX/XXXX I directed an overpayment to a loan. Today ( XX/XX/XXXX ) I did a deep dive into my loans to check how repayment was going. I noticed that, though I was charged the same monthly amount, no money from my monthly payments had been going to the loan that I overpaid for the months of XX/XX/XXXX-XX/XX/XXXX. I also noticed that the next time that that particular loan was scheduled to be paid was XX/XX/XXXX, a full year after I had directed the overpayment. Obviously, my intent in overpaying a loan was to pay it off quicker, not defer payments and have the loan accrue interest while it was deferred. I had overpaid before and had never had this issue before. To my knowledge, I had not received any correspondence from Navient that would indicate that loan overpayments would defer future auto payments, nor was I given an option at the time of overpayment to choose whether or not I would like to defer future payments. I called Navient and they said that they would fix the issue. They would reset the payment calendar on that loan to reflect when I would begin payments ( in XX/XX/XXXX instead of XX/XX/XXXX ) and they would return interest that had been compounding on my overpaid loan. They also said that they would reallocate my previous payments retroactively to reflect my original intention, which was to have my regular monthly payments continue after an overpayment. I am filing this complaint for two reasons. 1 ) I am worried that Navient may not resolve this issue in a timely manner and in the way that they described to me on the phone. 2 ) The practice of defaulting to loan deferment after an overpayment is deceitful. The intent of most overpayments is to pay a loan down more quickly. By defaulting to a deferment, Navient is ensuring that they are collecting interest on loans that have been overpaid. They are hoping that those in debt do not notice that certain loans are not in repayment because of an overpayment and are therefore collecting interest. I caught this problem, but I do not want others to have the same issue that I had.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: On XX/XX/19 my work received a letter from XXXX XXXX to garnish my wages on my federal student loans for XXXX! This is the same company who over two years ago had my loans and did a qualification program where I paid them for 12 months then I would qualify to go to a lender who would consolidate my loans and base my payment on my income! After 9 months they sold me and had no info on me including who the new lender was! Now they are trying to do the same thing! I do not want to deal with them

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: In XX/XX/2012, I started my own business and I was not able to pay on my student loan so I started to deferred them. Between running my business and a major car accident, paying back my student loan has been difficult. Over the last 6 years Sallie Mae/ Navient have added over {$10000.00} in interested and late fees. My loan amount total was around {$21000.00} in XX/XX/2012and now it is over {$33000.00}. Navient harassed me about my payments when the forebearance would end and call me all hours of the day. Then once I would do another fore-bearance they would add on more fees, interest and late payments. Navient made me believe that deferring my payment was a good/okay thing to do but what it really was, this company is just getting richer off of poor women like me. Now I am trying to dig myself out of this financial hole and I wrote them a letter asking them if they could go back to the {$21000.00} as my outstanding balance, if I would agree to pay this off in a couple yes and they said no. They manipulated me for their financial gain. Any help would be greatly appreciated. Thank you, XXXX XXXX
