Consumer Complaint: Dear sir or madam to whom it may concern. I filled for Chapter XXXX bankruptcy and received my court ordered discharge on XX/XX/2019 I have told NAVIENT many times to please stop harassing me and calling to collect. I filled for Chapter XXXX bankruptcy because I have no money to pay them, by law I am not to be contacted for debt collection for a period of 5 years to my understanding as told by my attorney. I have IRS tax debt also in part because of my Student Debt and I can not handle any more financial hardship. I can not get them to stop calling me every day.

Consumer Complaint: I have three remaining student loans with Navient. About once every other month I have to call to inquire about why the minimum payment has been allocated in a way that is inconsistent or incorrect. Each time I call I am told it will be fixed and they are not sure why it was allocated in this way. These misallocations result in a higher percentage of my payment going towards interest and allows the interest to accumulate ultimately making my final payment further away and costing me more money. Today I spoke to a representative who told me that the way I see my account ledgers online is not consistent with the way she sees the same on her end. She also conveyed that " the system '' was allocating money towards loans I have already paid in full ( one a full year ago and another three full years ago ). She could not explain how or why either of these things were occurring but told me she would " submit a ticket '' and that the problem should " probably be resolved within two weeks ''. Each time this happens, particularly before I understood what was happening, Navient collects more money from me, my interest goes up and my credit is negatively effected based on the total borrowed balance compared with the total paid balance. This also keeps me in debt even longer.

Issue: Struggling to repay your loan
Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: I graduated from school in XX/XX/XXXX and began payments on my loans with Sallie mae that turned into Navient. There were times I had trouble paying my loans and I had to try different payment options of forbearance. I have since re consolidated my loans with XXXX however my complaint is SallieMae/Navient never gave me the option to refinace my loan so I could possibly get loan forgiveness in the future. I am a XXXX and paid on that loan for 13 years with my balance always going up and never down. After looking at my paperwork I realize they added some XXXX dollars shortly after I graduated calling it an " adjustment ''. I do not even know what this is. I started with a balance in XXXX of XXXX and ended with a balance of XXXX. Mind you paying on it the entire time. If they told me my options I could have refinanced to a loan that allowed me to apply for forgiveness after paying on it for 10 years since I am a XXXX that works in a XXXX XXXX. Since moving my loan to XXXX in XX/XX/XXXX I have paid more in 3 years then I ever paid in 13 years with SallieMae/Navient. This is bad business and I feel like something shady had happened. I shouldn't be graduated from school for 16 years still paying on a large student loan debt. And now finally making a dent in my debt with another lender.

Subissue: Keep getting calls about your loan
Consumer Complaint: On XX/XX/2019, they called at XXXX XXXX, XXXX XXXX, XXXX XXXX, and XXXX XXXX. I finally answered at XXXX XXXX. They were calling because my loan payment of {$XXXX} is late by 9 days. My loan payment was due on XX/XX/19 and they are already calling me this frequently, including on the weekends. This is typical daily call frequency if the loan becomes more than 2 days late

Consumer Complaint: I have 2 loans that navient sent into default. I am trying to get the defaulted loans into rehab so they will stop garnishing my social security. Navient changed my name on my account and I did not request it. I spoke to navient and they said it was changed in error and they had no request from me to change my name. I can not sign the docs until they submit the correct name. XXXX XXXX has the defaulted loans. when I spoke with Navient Post Claims they said hey would submit the right name and not to sign the documents. they are already taking payments from me for the defaulted loans. They are taking my social security, my part time job and the monthly payment that was set up for the rehab program. XXXX XXXX told me to sign the documents and worry about the name change later. I need my checks to not be garnished as I am having multiple surgerys and I dont have insurance to cover these and I need the garnishments to stop but Navinet has not sent the info to XXXX XXXX.

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: Over several years, Navient has used harassing tactics in attempt to collect a student loan debt. Last XX/XX/XXXX, they called several times before XXXX asking for a payment I had already submitted. I preemptively called and informed them that due to personal circumstances, I nor my guarantor was able to make XX/XX/XXXX 's payment by the due date ( XX/XX/XXXX ). I stated that I would be able to pay it by the first week of XX/XX/XXXX and the representative stated that there was nothing they could do. I asked that they at least notate the payment would be late and they refused. I received a call XX/XX/XXXX at XXXX requesting payment, during which I informed the representative that I would be remitting payment shortly. I completed the payment XX/XX/XXXX, receiving a confirmation number and seeing the deduction from my bank account. Today, XX/XX/XXXX I received 3 separate phone calls from the number XXXX. One at XXXX, one at XXXX, and one at XXXX. I answered the third to discover that it was a Navient representative calling to say they were trying to collect the XX/XX/XXXX payment - the one I had already submitted. I explained that to the representative, who used the computer system to verify it. She said she would make a note that the payment was there and to stop the calls. I asked her to please check for payments before calling - especially 3 times back to back. She became argumentative, stating there was nothing she could do about it and that I should just make my payments on time. I explained to her that this has happened even when I made my payments on time and she became more argumentative, talking over me, and unwilling to hear my position or take responsibility for repeatedly calling me under false pretences.

Consumer Complaint: On XX/XX/XXXX, I submitted an online payment to Navient to pay off in full the remainder of my student loans. The same day, I also cancelled auto-pay because I was afraid that Navient would continue to process the auto-pay, even though the loan was paid off. On XX/XX/XXXX, the payment in full was removed from my bank account AND the auto-pay was also removed. The in-full payment was on the Navient site listed as " processing '' but the auto-pay was not listed at all. I called and spoke with Navient and they told me that the auto-pay would *probably* post in a couple of days, but that a refund would be 3-4 weeks. They further said that auto-pay often takes 5 days to cancel, but no where on the website did it give me any such warning at all. I paid it off in full, INTENTIONALLY cancelled auto-pay, and they STILL charged me and won't return my money for 3-4 weeks. Money that they STOLE.

Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: I first report on XX/XX/2019 XXXX # XXXX. I asked for a Master promissory Note Proving the Loans that they had under my name for there company. The CFPB dismissed my complaint because XXXX/Navient sent a Promissory Note that had nothing to do with the Loans they Claim they have on file for me. I have Attached to THIS complaint is the Promissory Note that XXXX/Navient attached with my first complaint ( # XXXX ). I have also attached what XXXX/Navient reporting to the creditors. Why are the Original Grantors not the same? Isnt the information suppose to match? I also asked my private loan carrier for A Master Promissory Note and I was shocked to find out that they have the same Promissory Note for my private loans that XXXX/Navient have for Federal loans for different schools. How is that possible? XXXX has told me on multiple occasions and by multiple employees when I have asked XXXX/Navient who my Original Grantor is ; there answer has changed atleast Twice, and now that I see that there reporting that XXXX is the Original Grantor. That's the third misinformation about this loan that they have given not just to me but multiple other companies. I have asked an employee and one of XXXX/Navient Managers for contact information to there legal Department. I was told that XXXX/Navient does not have a legal department. How do they handle lawsuits without a legal department? All conversations were recorded, I have had problems attaching them in the past, but if an email is provided I can submit those recordings Promptly. I hope someone really looks into this!!

Consumer Complaint: I have help to write this letter for help. I am currently on XXXX I started drawing this in 2010. I was referred by XXXX worker to Legal aid to assist me with getting XXXX because I was struggling in the program tanf. I tested in the program with XXXX program and my results were very low and under testing requirements low math scores and cognitive scores showing I had scored low intellect scores in many areas. I struggled all through school I graduated but I'm sure they just passed me through. so I eventually tried the 2 year college I scored low but financial aid obviously pushed loans that I never understood the whole process of even where to get my books. so I never completed to gain credits. How could they allow me to enroll and receive fincial aid knowing i couldnt complete. when I clearly struggled to even find the classes. even in school I was not offered special classes when I showed failing always. XXXX sent me to test in many areas and I was shocked when an advisor give me my results basically I had many learning problems. I started Adult ATTN ( ADD ) medication as an adult it helped but I developed insecurities over the years from losing employment I still feel humiliated from so many comments on my ATTN issues math XXXX and on how it takes too long for me to learn tasks. I'm now responsible for these loans that I never gained a degree for with so many attempts to try again to fail ..I wish someone could have not allowed this financial hardship and prevented such a waist of funding with out special placement of some kind.
