Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I have been paying my loans for years now and its only getting worse. I was paying XXXX which is almost all of my paycheck for two weeks. They call from unfamiliar numbers at all hours of the day. On XX/XX/XXXX they called me at XXXX in the XXXX. I picked up and the person on the line was rude and demanded that I give them money. I felt cornered, but I wasnt even sure if it was them because they call from a new number every time. Today I looked into a loan because they said I need to pay, and they told me that I had to pay XXXX dollars to go into forbearance. I feel hopeless when I call, like Im not really going to be helped, I feel like Im being coerced into paying more money than I have. They refuse to go below XXXX but thats still half of one paycheck. I felt like I was in a standoff.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I have student loans from XXXX XXXX College ( XXXX, MD ), I last attended in XX/XX/XXXX. I didn't return the Spring semester due to I was told the school was not doing the XXXX program in XXXX only in XXXX. I never withdrew from the school being that I was told the school was working on its problems to stay open. The XXXX XXXX XXXX was in the process of withdrawing their accreditation, They were made aware that the student needed to be in a Teach out. Well I live in XXXX and the Teach out was for only students in the XXXX area, XXXX was a XXXX school. The school closed in XX/XX/XXXX. I am not left with over XXXX worth of student loans and I am not able to have them discharged. I was not able to transfer credits, so I took classes that did not benefit me. I want to know what can I do to get the loans discharged. I have applied for a loan discharge 2 times. I also had contacted the State of Maryland Consumer Protection Division about the issue and the rep told me to contact Navient again. But what was the use and I had already tried twice. I can't transfer the classes, so I took out loans for absolutely nothing.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I have been unemployed for over two years, first and primarily because of a sick parent who required full-time caregiving after XXXX XXXX XXXX. I continued to pay the debt monthly as possible with savings because, though the bulk of my student loans were granted an unemployment deferment with ease. I attempted on several occasions to get those deferred as well, but they refused and said private loans are not eligible for the same deferments. Moreover, any application of temporary deferment would only be for 60 days and required a per-loan charge of {$50.00}. These two loans thus charged me {$100.00} for a deferment of two months, which while helpful given that the two loans would be over {$800.00} for the two months, it seems usurious and wrong that this charge is only for an application and is applied to neither principal nor balance. Interest continues to accure. So I waited until absolutely necessary to do so. Since my mother died and I have lost stable housing and support, as well as exhausted savings, while having not earned an income for over two years and living with what little money I gain through odd jobs and help from friends, I ultimately did apply for and was granted a deferment of two months in XXXX because they were filing derogatory remarks on my credit. Mind you, this is all while they allow the bulk of my loans to be deferred. It is untenable as a position when it's the same lender and they have everything in front of them to see that I have been in a prolonged period of financial hardship due to family matters and now prolonged unemployment. I have gone on dozens of interviews and worked with two staffing agencies, but continue to lose out on opportunities because my professional experience is freelance creative work and while I supplemented my income for years with personal administrative support that experience is years ago and does not translate easily to the city in which I now live. It's a wildly unfortunate position to be in considering I have years of work and a master 's degree from a highly reputable institution. But they are now demanding payment again, aggressively calling to collect past due balances and I don't have {$100.00} to get another deferment. What am I supposed to do? I just applied for Income Based Repayment to put my loans onto that plan wherein, for the time being, I won't have to make payments but will be considered current. It's unfortunate as the interest will accrue and I have several hundred thousand dollars in debt, but I can't let my credit rating go down any further, at risk of precluding me from stable housing, banking, credit lines and employment. Many employers run such checks and I don't want to be in default. But why is a lender allowed to do this? Why can they not keep the payments across the board. Why is there no federal oversight of these private loans that protect me in the same way that the vast majority of my other loans do? I did not know this was the case when I took the loans. Servicing these two was for many years all I could do financially and as a result let interest accrue continually on deferment/forbearance. The lender is uncooperative despite many many calls and I have no choice right now but to let them go unpaid while I continue to look for work, and while the process of putting the bulk of my loans on IBR works its way through the system.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Navient Removed me from the Income Driven Repayment Program ( " IDR '' ), Without notice or full disclosure as to why, While I am disable. Then reported that I was delinquent on repayment 120 days. I contacted Navient, they said It was reporting that way because I failed to renew or re-certify for the IDR program. I provided all the Emails and facts proven that I was never given notice or full disclosure as to any failed payments or that the IDR had expired nor that it was time to re-certify. I was placed on hold, then a representative named XXXX returned to my call admitting that she couldn't find anything explaining why the contact status was changed ; and that she didn't see where I had ever requested that my previous means of contact that I provided, be changed. Then she went on to inform me '' but it was changed from email and phone to contact by mail ( Letter in the Mail ) ; and I don't know how. '' I sent numerous written request as directed to the credit reporting division, at Navient, for the information on my credit report be corrected and that the false, incorrect and inaccurate misinformation be removed. Still over 1 year later the information is showing on my credit report making me financially indigent. Moreover, the loan is paid off.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My provider is Navient. They have been ridiculous to deal with over the years. I despise having them service my loans. Their website is unfair and deceptive and I believe purposely set up to make it difficult to figure out how to apply for a payment repayment program, forbearance, or deferment. I have been struggling to make my payments, but am single so my income artificially inflates my ability to make payments. I finally figured out how to contact Navient in XX/XX/XXXX of this year and was told the round about and difficult way to submit a forbearance request. They approved my request through XX/XX/XXXX. It is now XX/XX/XXXX and they are reporting me past due to the credit bureaus. When I log into my account, they show I have a payment due in XX/XX/XXXX. Not only do I have no payments due because of the forbearance, they never sent me a statement via mail or email to advise me of an upcoming payment in XX/XX/XXXX. Had I received such a statement, i would have contacted them immediately regarding their mistake. Now my credit has suffered a hit. They are in violation of Regulation Z for not providing a statement, FCRA for inaccurately reporting on my credit, and UDAAP for their terrible website as well as causing harm by incorrectly reporting my credit and not providing me the ability to prevent that harm due to their FCRA violations. This servicer of loans is absolutely terrible and I can not stand doing business with them. I hope that the CFPB will take a look into their unfair practices, but, as of right now, I want my credit fixed ASAP.
