Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I began my student loan repayment journey being {$46000.00} in debt ( XXXX approx ). NAVIENT was handling the forbearance's/deferments. Every single time I called them, I was given different information ( this was prior to XXXX ) and there were many days that I called multiple times, spoke with different people and received completely different answers ( in regards to how much to pay, how long, and they honestly never really answered some questions and were very dismissive ). I lost my job and struggled to find a new one for some time but when I finally did NAVIENT informed me my payment would be well over what I took home in an entire month. They told me that if I didn't agree to the terms then I would be in default. I was so angry that I hung up. I called back again and was able to have some sort of extension until my pay was regular and I thought that I could trust them. Before I knew it, my loan had ballooned from the original amount to OVER {$120000.00}!!! There is no way that I will be able to repay that at what they expect me to. Every single time that I would call they would tell me that my loans had been sold/transferred and that there was another fee and more interest. I am now very much at risk of having a very good job offer rescinded because of my student loans on my credit report as I had to contest my report and explain what happened. I believe that NAVIENT has acted predatory towards borrowers and it affects our livelihood.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: Navient Solutions , LLC . has contacted several of my family members about my student loan debt. They have contacted people that I do not speak with just because they have the same last name as me. I spoke with Navient and informed them that I lost my job and was denied unemployment and as a result would not be able to make my payments. As a result of this, I was asked if by one of their representatives if " a family member would lend me money to pay it? '' My family has nothing to do with my loans as they are not cosigners, and were not listed as references on my application. The Fair Debt Collection Practices Act states that " A debt collector is not allowed to contact a third-party more than once unless requested to do so by the third party ''. My family has received multiple calls from Navient and never requested to be called again. If this continues, I will tell them to pursue a claim against Navient for abuse or harassment.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Have been dealing with XXXX XXXX for 15 years!! We have had NUMEROUS problems with getting incorrect information, Improper distribution of loan payments, Unauthorized payments taken out of bank, Harassing and threatening phone calls ( sometimes as many as 7-8 times a day!! ), Changing terms/payment amounts without notice just to name a few. When we call or speak to someone from Navient, we will set up payment agreement, but then the next time we speak to someone, there is no record of any agreements. They have multiple call centers across the US and there is either no centralized records or improper documentation of the call. Most recently my wife set up payment arrangements on XX/XX/2019 however they claim this was only monthly payments and did not work to bring the account current, from what the claim were missed payments!! Often when we do make a payment ( There are 3 loans ), they would only distribute payment to 1 or 2 of the loans, causing the third to become late/delinquent. In XXXX I was deployed with military and due to issues with pay ( Not paid ) we were unable to make the payment. We called to make them aware and set up something and are just now being told that no payment was made in XXXX!!

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Student loan servicer, NAVIENT, is misapplying student loan payments and failed to conduct an investigation. 1 ) Auto-payments are not being properly distributed among the loans. I have 3 Direct loans and 2 Direct Grad Plus loans serviced by Navient. I am on the regular repayment program using auto-pay to automatically deduct my fixed monthly payment from my bank account. My auto-payment is {$1400.00} per month. Of this amount, {$400.00} is a fixed amount that should be applied to the highest interest rate loan. On at least two occasions ( the XXXX and XX/XX/2019 autopayments ) Navient applied less than the fixed amount to the highest interest rate loan and shifted payment to the lower interest rate loans. In XX/XX/2019, no principle whatsoever was paid on the highest interest rate loan by the auto-payment. 2 ) Navient failed to conduct an investigation or respond to my concerns. On XX/XX/2019, I called Navient and spoke to a representative regarding payments. I was told that an investigation would be opened and I would be emailed written report detailing how auto-payments and overpayments to the highest interest rate loan were applied. I was told that the report would be emailed within two to three business days. I did not receive any emailed or written report. On XX/XX/2019, I called Navient and spoke to a different representative. I was told that the first investigation was concluded, no report was emailed or mailed to me, and that no changes had been made to my account. Again, I requested Navient investigate why the auto-pay was not applying the correct amounts to the highest interest rate loan and instead paying principle on lower interest rate loans. I again requested Navient investigate that all payments were properly applied over the life of the loan. I was told there would be an investigation and that I can expect a written report delivered by XX/XX/2019. Because Navient 1 ) failed to properly apply payments, and 2 ) failed to investigate and report on misapplied payments, I am filing this complaint. As a consequence of this failure by Navient I may be forced to overpay by thousands of dollars over the life of the loan.
