Consumer Complaint: HELLO, MY NAME IS XXXX XXXX AND I AM A VICTIM OF IDENTITY THEFT. SOMEONE OPENED UP A STUDENT LOAN IN MY NAME FROM SALLIE MAE, NAVIENT IS COLLECTING FOR THEM. I PRESENTED THEM WITH A NOTARIZED IDENTITY THEFT AFFIDAVIT, ID THEFT REPORT, ALSO A POLICE REPORT IN WHICH I HAVE INCLUDED ( THROUGH UPLOAD ). XXXX HAS REFUSED TO CORRECT THE MISTAKE, WHICH IS HURTING ME FINANCIALLY. XXXX AND XXXX HAS ALREADY REMOVED THE FRAUDULENT ACCOUNT. I KNOW OTHERS THAT HAS HAD THE SAME PROBLEM WITH XXXX, UNQUALIFIED WORKERS ARE HARMING CONSUMERS CREDIT. I BELIEVE ITS A SCHEME, AND THEYRE DOING IT ON PURPOSE. FCRA 605B EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, A CONSUMER REPORTING AGENCY SHALL BLOCK THE REPORTING OF ANY INFORMATION IN THE FILE OF A CONSUMER THAT THE CONSUMER IDENTIFIES AS INFORMATION THAT RESULTED FROM AN ALLEGED IDENTITY THEFT, NOT LATER THAN 4 BUSINESS DAYS AFTER THE DATE OF RECEIPT BY SUCH AGE NCY.OF : 1. Consumer Complaint: I started XXXX XXXX at XXXX College on XX/XX/2019. I applied for an in-school deferment before classes even started. It took over 2 months and 15 phone calls to Navient, my student loan servicer, in order to finally get them to apply it to my account. I had to pay 2 months of my student loans while in school and also paying tuition out of pocket because of their negligence. Since XXXX, they have inexplicably removed my in-school deferment 3 times. The first 2 times, whomever put my loans on hold put them on a temporary hold instead of an in-school deferment. This caused late payments to appear on my credit report, and effected my credit score, which I have worked diligently to improve over the last 3 years. The last time I spoke to them, they promised I would be put on an in-school deferment. This morning I received a letter from them that my income based repayment plan was approved and my new amount due would be {$490.00}, due on XX/XX/2019. This is the 3rd time they have made this mistake in the span of 7 months. I called them yet again, and they are trying to tell me they never sent anything to me, even though I literally have the email in front of me. When I asked to speak to a manager, I was put on hold and left there. No one ever came back to speak to me. At this point, I am unsure what is going to happen, and will probably have to call back yet again to make sure they are not going to start charging me. This is unnecessarily stressful, as I have done everything they asked, I have submitted every paperwork needed, and I should be able to be in XXXX XXXX concentrating on my degree, not worrying that suddenly my bank is going to be auto-debited {$500.00} that is set aside for rent, or that Navient is going to wreck my credit again. They are a fraudulent company, and it is unconscionable that they are allowed to do business.

Consumer Complaint: First, we had many phone conversations with people from Navient to tell us what payments had been paid with Salle Mae before they took over the student loan. They never could tell us the payments. It was a loan for {$36000.00}. XXXX. But when Navient took it over, it was {$5000.00} more. We asked Navient to send a record of the payments that had been made from the beginning of the loan which was with Salle Mae in XXXX before Navient took it over in XXXX. We received a payoff adjustment form which makes no sense with no dates. This form came from XXXX XXXX XXXX XXXX in XXXX, AZ. Another issue we have is the balance on this loan seems astronomically high after paying on it for so many years. The way they figure the payments makes it difficult for one to see if the figures are correct.

Consumer Complaint: Attached is a listing of payments that I have made since start up to now. As shown in that list, the last disbursement was on XX/XX/XXXX, but basically it seems that I started really making payments after CAPITALIZATION on XX/XX/XXXX. So the original principal was {$8700.00}. I have 10 years of paying an average amount of $ XXXX/mo, and, incredible enough, the unpaid principal balance is still ( see listing ) up to XX/XX/XXXX about {$3800.00}. I'm no expert in accounting, but it seems to me too much time for the balance to still be that amount previously said. I'm planning to pay more every month to advance faster, but I don't have a good job and therefore I'm not getting a good income, so I would like somebody with legal authority to check and see whether there is something that can be done. I feel I have already paid that loan. 10 years x 12 = 120 months x XXXX = {$17000.00}

Consumer Complaint: In accordance with the XXXX Loan Forgiveness program I submitted a request to Navient. They've denied my request under the auspices of reason 3 : " As of XX/XX/1998, you had an outstanding balance on a Federal Family Education Loan Program loan or Federal Direct Program loan. This loan ( s ) is either still outstanding or had an outstandign balance prior to new loans being disbursed. This loan ( s ) may also be included in a consolidation loan making your loan ( s ) ineligible for the XXXX Loan Forgiveness Program. '' I am objecting to and challenging this determination in that Navient has been charged with systematically misdirected borrowers into student loan repayment programs and types of forbearance, which do not qualify for Public Service Loan Forgiveness, which enables public servants to have their federal student loans forgiven after meeting certain requirements, and that Navient ignored borrowers best interests in violation of its government contract to prevent borrowers from moving to XXXX ( the student loan servicer that administers the Public Service Loan Forgiveness program ), so that Navient could continue to earn fees. As a result, XXXX, nurses, first responders, social workers and other public servants are paying millions of dollars more than they otherwise should in student loan payments.

I HAVE ASKED NOW I AM DEMANDING THESE ACCOUNTS BE REMOVED FROM MY CREDIT FILE. I WANT THE LATE PAYMENTS REMOVED AS WELL AS I WANT THE ENTIRE ACCOUNTS DELETED FROM MY CREDIT FILES.

I feel they lured students in to profit off individuals looking to better them self. I have filed for the Borrowers Defense application process to have my loans discharged. The negative impact that it is having on my credit report is major and I continue to get no answers as to when a decision will be made from the Department of Education. Navient the lender is impossible to get in contact with to follow up with the process. As well as the Department of Education. I do not feel I am responsible for said loans as I was lied to and preyed upon as many other were.

Consumer Complaint: In XX/XX/2016, my already stressed and impressionable XXXX year old daughter received a high pressure sales call from XXXX University. They quickly brainwashed her and convinced her this was the best option for her to receive a college education. We as her parents were then high pressured into signing loan documents for a loan that is now upwards of $ 17K. My daughter only went to XXXX online university for 1 year. She has since transferred to a local XXXX college. The tuition I have paid for 2 years there does not begin to equal the balance of this Parent PLUS Loan. I feel my daughter as well as my husband and I were pressured into this loan with really not education from anyone on what the true costs of the loan really are when all is said and done. The loan is deferred right now until next year. I will need to try and defer again as my daughter nor myself have the money to repay this debt.

Consumer Complaint: So this issue started in XX/XX/XXXX. I woke up one morning and had some late payments that were reporting on my credit. I had called my loan servicer previously to update my payment information and was assured that my auto payments were set up. Well I guess someone at the Dept of Ed/Navient made a mistake and the payment did not draft. When I called Dept of Ed/Navient to figure out what had happened they told my there was an error in my autopay set up. I tried to make a payment then, however, the Dept of Ed/Navient would not accept a payment from me. Eventually they fixed the auto payment so that it drafted from my account, but they never fixed the reporting on my credit. I have requested Dept of Ed/Navient to do so like 3 times already. A similar issue occurred in XXXX when my loans transferred to another loan servicer. I never received statements or any information about whom I was supposed to make payments to so I ended up making payments to the wrong company and got reported late by the other servicer of my loans. My credit is extremely important to me and really these late payments are not my fault. This most recent late is making my score very low and is preventing me from moving forward with my goals of buying a new home.
