Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: In XXXX my mother XXXX and I had spoken many times to Navient regarding all 5 of my private student loans and how we want the payments applied. After many attempts on the phone and multiple emails, we wanted Navient to apply our payments correctly, and in addition, we wanted to put the extra payments towards the principal. After all these attempts, they finally implemented payment posting as we requested. Please know that this took many hours both on the phone and in emails, as well as constantly monitoring and tracking all 5 private loans on the Navient website. I recently noticed that Navient has been sending me emails requesting " Overpayment Directions ''. My mother called in to Navient on XX/XX/XXXX at XXXX PST and spoke to XXXX, ID # XXXX to better understand the letter and our next steps. My mother explained to XXXX that back in XXXX we gave instructions to Navient during many phone calls and outlined in emails on how to apply payments. She explained to XXXX that we make payments based on loan number. In other words, I have 5 loans, and make 5 payments. I pay extra money on every loan, every month. All 5 loans should have all extra money paid applied to the principal. My mother then explained to XXXX that this letter does not provide an option to " put the extra payment to the principal '' so we was unsure how to respond. XXXX said this is a standard letter and is system generated. XXXX informed my mother that her system notes already have XXXX set up to place the " extra payment to the principal ''. XXXX said " I know this is confusing '', and then she began to read about my payments being an accrual or something of that nature. What she was saying did not appear to have anything to do with the nature of my call so my mother told her to not read from a script. XXXX then said, yes, we already have XXXX XXXX instructions. Navient makes these phone calls so difficult, and it is so frustrating that they talk about things that don't even appear to make sense with the issue we are talking about. Is she trying to intentionally confuse us further?? XXXX and my mother walked through a payment that I recently made and she confirmed that the extra money being sent is going to the principal. So, now I'm really unclear why this letter is being generated, other than to try and confuse me. XXXX provided no viable reason as to why we are receiving this letter since they already have instructions on what to do with extra money I pay. I have no faith in Navient and any information they provide us. I also have no faith in how they apply my payments. Only one loan number is being input for this complaint, but please note that I have 5 loans.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: On XX/XX/XXXX I filed complaint against Navient for they did my payments and called my job. Filed another on XX/XX/XXXX for their new hidden fees etc. For the current problem I filed for U.S. Small Business Administration disaster assistance loan in XX/XX/XXXX due to Hurricane Michael in XX/XX/XXXX got my reply letter back XX/XX/XXXX said ( denied ) due to my Unsatisfactory history on a federal obligation on line number 4 it say include documentation showing Navient Student loans have been paid in full or proof of satisfactory repayment agreement. I was so angry, Navient know I dont have no federal loans with them. All my federal loans were always current. I reported this to the XXXX there ( Navient ) responded? Thank you for reaching out to the XXXX with your concerns regarding your private loans. We never report your private loans as federal loans but if you want to settle your debt for a payment in amount of {$11000.00}. If you are interested in learning more about this option, please contact XXXX XXXX directly at XXXX. They do hard credit inquires when can do a soft. This the third time a loan just for one thing can't explain because I can't my credit report and I don't see it only if you are doing a home loan when that underwriter pull it. Right now, XX/XX/XXXX I did VA refinance loan that information came up it still been report by Navient to the credit agencies on me that I owed Navient federal student loans. Navient need to be fined they know I dont have none them. Just to destroy her credit and she pay us. It must be nice to be in partnership with the federal government to collect money for them and investors really thats a lot of power for one company privilege- Navient. Other servicing company don't have authority to do these things.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: My complaint is about a student loan servicer, Navient, that has attempted to steal, cheat, lie and admit to their wrongdoing, but will not offer to fix their mistakes. Navient has violated several State consumer protection laws and several Federal laws. The only relief I am expecting Navient to provide is to reverse the charge off since they admitted to that mistake ( with no cost to me ), make corrections to the credit bureau ( mine and my my cosigner ), place my account back in good standing with $ 300-350 monthly payments. Below is a brief timeline of the important events. I currently have all records and documentation to prove all events. ( not every event is listed here, I will attach a full timeline event ) 1. They illegally tried to debit more money out of my checking account 2 months earlier than what their emails said ( I currently have those emails ) 2. After several attempts of trying to reinstate my original payment amount ( I currently have that documentation ), no one at Navient reinstated my request. 3. I was told the exact date when my loans would Default ( I currently have those records and Navient admitted to their mistake ) 4. Navient charged off my private student loans 30 days sooner than they were supposed to ( I currently have those records ) 5. After Navient admitted to their mistake, they would only reverse the charge off if I payed {$580.00} ( I currently have those records ) 6. When I told them I just started working while being unemployed for 4 months, I couldn't afford the {$580.00}. And that I could pay $ 50-75 that day and {$300.00} monthly payments, they said no, I would have to pay the {$580.00} that day. ( I currently have those records ) 7. When I offered to pay {$50.00} that day, they told me they couldn't accept my payment ( I currently have those records ) 8. When I mailed a {$300.00} check to Navient in XX/XX/XXXX, they returned it stating that it was an " invalid bank account number '' ( I currently have those records ), my bank account number has been the same for 24 years 9. When I contacted my bank, they verified for me that no one had attempted to cash the {$300.00} check ( I currently have those records ) 10. When I mailed a replacement check for {$300.00}, that check has never been cashed nor returned to me.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I was initially set up for a payment plan even though I notified Navient that I was unemployed and still attending XXXX school full-time. My husband has paid the payments on the payment plan going on for two years. The plan they have me on increases amounts each time the program ends, and I have to reapply for the plan. It was conveyed that my payments were due on the XXXX, even though I was told I could make the payments by the XXXX of each month. I submitted a new application for the payment arrangement, and when I called to make sure my request been received, I was told yes. However, the problem hasn't been offered now and to call back XX/XX/2020 to see if there are any payment programs I'm eligible for. Navient has reported late pay 's to my account that was in good standing, and I have had to file a report with my credit bureau to get their mistakes removed from my credit report. I'm not trying to pay for my loans, however, I'm not working at the moment, and I can't seem to get any help with an income reduction plan where the payments aren't continually increasing on a payment plan. When I applied for the private loans, I was told that I couldn't get the loan in one lump sum. It had to be two separate loans. But that once I started paying the loans, they could be consolidated into one loan. However, SallyMae was fraudulent with this information, and my credit was sold to Navient. The school that the loans were taken out for was XXXX XXXX College in XXXX, Ohio, which has been shut down. I'm seeking a resolution to this nightmare and getting this resolved. Every time I contact Navient, I get different information from their loan operators, and I'm not trying to go into default with my student loans.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: I had a private student loan with the company Navient, formerly Sallie Mae. I was in college and my loan was in deferment. On the DAY I graduated, they sent my loan to collections. I had NO correspondence. I had called them and mailed them my change of address SEVERAL times in addition to them having my family members contact info as well. My loan was originally for {$15000.00} and now they are claiming that I owe {$41000.00} and they sent the loan to collections. I was paying the collection agency {$200.00} a month starting in XX/XX/2017, after paying on it for over 6 months, I realized that EACH MONTH Navient was still reporting on me for missing payments even though my account had been charged off from them and was supposedly closed. This has hurt my credit, tarnished my record and I am at my wits end. I have reached out to them several times, I've filed complaints, disputed the account, and each time I've been given the run around.

Issue: Threatened to contact someone or share information improperly

Subissue: Contacted you after you asked them to stop

Consumer Complaint: After many weeks of receiving hourly phone calls from Navient, I sent them a letter instructing them only to contact me by mail, per the Fair Debt Collection Practices Act, and the calls stopped, although they have emailed me a couple of times. Today, XX/XX/19, the mother of a friend from middle school let me know that Navient had called HER and left a message for me. She is not listed as an emergency or secondary contact in any of my paperwork ; Navient should not have her number unless they dig it up themselves. This is a huge breach of privacy and a clear violation of the FDCPA, given that I had instructed them to only contact me by phone and that they contacted someone completely unrelated to me and told them they were looking for me regarding student loan debt. Per the FDCPA : " a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. '' Navient clearly violated this. The person who contacted her was named XXXX XXXX, and she gave the reference number XXXX and the phone number XXXX extension XXXX.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: Hello my name is XXXX XXXX I went to the university XXXX XXXX back in XXXX exact date XX/XX/XXXX I only stayed at this school until XX/XX/XXXX according to the university XXXX XXXX they were dispersed XXXX dollars from Sallie Mae 's now navient. They refunded navient back on XX/XX/XXXX in the amount of XXXX navient is stating that they have no record of that while I emailed the proof the ledger of what was refunded back to them. They are stating that I have to pay navient back over XXXX the total amount dispersed for the two months that I attended that school was in the amount of XXXX. They are trying to make me pay and extra XXXX and some change for something I never used. XXXX XXXX response to the matter was well why are you looking into it now 11 years later. While I was in school and still in school I thought my loans was deferred but according to them which I did not know at the time that a private loan you have to pay back while still in school and they are trying to make me pay for something that I never used as well as not will to work at a reasonable price for repayment to what I can financially afford. They were rude, nasty and not made statements to me that you should not say to a customer such as " why am I looking into the matter now '' " you should have did this 11 years ago it's to late '' " it's a debt that has to be paid '' I'm willing to pay what i used and that is the XXXX not over XXXX dollars. Inhave documents to prove what was issued to university XXXX XXXX and what was refunded back to navient. THERE IS NO WAY THAT FOR 2 MONTHS OF SCHOOLING THAT IT COST XXXX DOLLARS. They are disguising student and not explaining what a private loan is and when it comes time to pay they are not flexible with the students and what they can afford. I would like to take this higher to a class action lawsuit if possible.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient is my loan servicer for all of my federal student loans. I have a mixture of un-subsidized and subsidized federal student loans. ( 6 in total ) I have been enrolled in auto-pay for all loans since the time I started paying on the loans ( 6 months after graduation ). Dated : XX/XX/XXXX Auto-pay has always withdrawn the minimum payment due on the loan. For one of these loans, the loan with the highest interest rate, I have paid ahead each month to pay this loan off faster. With no notice or any change to the autopay agreement, Navient has decided to push all auto-payments back to start on XX/XX/XXXX since I am ahead on my payments. This is completely against the auto-payment enrollment agreement that I originally signed.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I attended XXXX College in XXXX, and graduated in XXXX doing a 9 month program. My school was closed down a few months after I graduated for negligent activities and fraud. When I signed up for the program I had to take out a private loan. The process wasn't clearly explained to me and I acquired a very high interest rate through Sallie Mae. After graduating I deferred my student loan after going back to school. No one from Sallie Mae said anything about interest incruing, and the forbearance process was explained to me as if everything freezes until I'm finished with school. That was a lie. So this loan keeps growing and anytime I asked Sallie Mae about refinancing it they said I couldn't do that. I don't have very good credit because of countless health issues and prior medical bills so I can't refinance it through a bank. I'm also now XXXX and not working. When they switched my loan over to navient I had the same problems. They were calling me nonstop for years and every bit I did pay didn't go to the principal of the loan. I was paying the loan back through one of their payment assistance programs that was for a year period and would need to be renewed after a year. I had to authorize debit card transactions. Navient has been trying to take money out of a bank account that is no longer open, that I had over three years ago, that they do not have access to, and was not agreed to based on last payment program I was on. This was a bank account that I haven't had since XXXX and have tried to delete from their website. They do not, and have not had my permission to charge that card since at the very latest, XXXX. How is this legal? I have also tried to get a XXXX loan forgiveness and they say they do not do that for private loans.
