Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been making overpayments on my Navient student loans, and as a result, I am overpaid by several months. However, Navient is saying that I'm currently behind on my payments by XXXX {$500.00}. I called customer service on XX/XX/XXXX to see what was going on, but they were of no help. I had to correct the rep many times because he did not accurately read my account and often mistook my account for another one. The customer rep was also providing the wrong information on the payments that I was making and what my actual monthly payment amount was. I asked the rep why I was delinquent, given that I made extra payments on all of my loans, and he couldn't give me an answer, but he said that he " escalated it '' and that someone will get back to me. No one ever got back to me, I've reached out to Navient two more times to no avail. Furthermore, Navient has increased my monthly payments from XXXX {$230.00} to XXXX without any information or prior notice. They have done this to show that I was not making any overpayments in my account. This change was reflected in my account after I called Navient on XX/XX/XXXX to question why my account was delinquent. Navient has also proceeded to change my graduation date from XX/XX/XXXX to XX/XX/XXXX and have added on capitalized interest to my loans. They have added on three more months of capitalized interest to my loans by falsely claiming that I graduated three months earlier than I did. Currently, Navient is emailing me to make payments on my overdue account ; I will be reported to consumer reporting agencies otherwise. They have already reported me once since our last conversation. I am overpaid by several months and, yet, I was still reported because of my " delinquent account '' and my credit score took a hit due to Navient 's dishonest and predatory behaviors.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I have an extensive timeline of records. I've tried to reach out, well in advance, to Navient about my IN SCHOOL status and my inability to repay while I'm in school. Prior to my loans becoming due, I contact them by email and by phone. I told them about my IN SCHOOL status and that I should be completing my XXXX at XXXX sometime towards the end of 2020. Worst case, I told them I could pay like {$170.00} a month or less. Just something to pay towards the Private Loans to show good intent. To date, I keep getting refusals to help when I call. However, days later I get emails from Navient employees saying they can help me. When I call, they refuse to help me. It's slightly abusive. Moreover, It's absolutely idiotic. Why a company wouldn't try to help someone earn more money so they can repay their debts is outrageous. I've filed complaints to the XXXX. I've filed complaints here. I'm also seeking at Attorney shortly. Even though I've voluntarily paid small amounts per month from XX/XX/2020 forward, they still reported my Private Loans as delinquent to the credit bureaus. I was told specifically by Navient employees this would not happen. I'm angry and fed up with Navient.

Issue: Communication tactics

Subissue: Used obscene, profane, or other abusive language

Consumer Complaint: Requested a letter via mail, they refused and will only send via email which i do not feel comfortable using. I have told both associates and their supervisior that i need a letter first, also i am currently unemployed and can not pay. I have said i would love to settle but i have no income and have moved home with my family. They then told me to borrow from my family or borrow against my parents house. This is unprofessional and will not stop calling. They use very unprofessional and abusive language and will not stop! They say i am incompetent and i don't want to settle this matter which is untrue.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have been, and continue to be, adversely impacted by Navient misreporting and inappropriate billing practices. Forbearance was encouraged on multiple occasions having been applied to original loans with Salle Mae without my authorization. I have been enrolled in an income-based repayment plan since XXXX. I re-submitted paperwork for this plan prompting me to investigate the status of my application. According to the Federal student aid website, my loans show forbearance status for XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX. My servicing institution shows now as XXXX no longer Navient. The change to my loan was never reported to me by Navient, repayment months status shows as N/A and months in repayment N/A. I have not been able to clarify what the status is nor was I notified of any change. My original loans incurred with Salle Mae for medical school. During my medical residency training, immediately following my medical school education, I was not able to begin repayment on my loans due to financial hardship. Initially, my loans were incurred with Salle Mae and eventually acquired by Navient. I was never provided Income based repayment as an option when with Salle Mae and was encouraged to accept forbearance with Navient when my loans were acquired. My original loans were consolidated into a FFELP loan which has grown from XXXX to over XXXX while with Navient. I have made multiple attempts to deifier the fees and changes applied to no avail. When my Salle Mae loans were acquired by Navient ( XXXX ), a Navient private loan representative informed me that my private loans would be handled differently with Navient. I was told it would be in my best interest to make the one time only lump sum payment to take care of my private loans. I made the requested payment, just under {$30000.00}, to have the private loans discharged. I made this payment and requested documentation and was never provided supporting documentation for that transaction. In XX/XX/XXXX I received an email stating I had a message in my Navient inbox. I was sent the 1099 forms related to my private loan dischargeable amounts required for IRS reporting purposes. But no other documentation. Days later, I contacted Navient requesting private loan discharge supporting documentation specific to the 1099 forms received and was told I would be sent that documentation. To date, I have not received the paperwork related to the private loan discharge.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I have had my student loans for over 10 years. In that time period, I have never had a late payment on any of my loans. During the 2019 year I placed a loan with Dep of Ed/Navient in forbearance. Unbeknownst to me, this loan came out of forbearance and I was never contacted regarding its status. Every account that I have with Navient is on automatic payment however somehow this account was not.It appears that Navient had made a mistake with a double charge in my past and in order to prevent that in the future perhaps autopay was turned off on this account. Navient allowed this to continue for 3 months without my knowledge and then reported a 90 day delinquency on my credit report during the time I was trying to purchase a home and completely destroyed my credit. All I have asked Navient to do is take a payment for this loan and repair the report so that it is not showing on my credit as a late/delinquent charge. Navient will happily take my money but refuses to give me any information regarding the status of their reporting to me and are forcing me to go directly to the credit bureaus to file a complaint. How can a company be so brazen in their handling of a student just trying to get by.

Subissue: Problem with customer service

Consumer Complaint: To Whom It May Concern : My wife has a loan serviced by Navient. It is past due and they sent a generic email, on XX/XX/2020, offering to put the loan in to deferment/forbearance. They requested a simple reply of " yes '' to make this happen. I replied to this email requesting information about loan forgiveness options available to her as she has been a XXXX in a XXXX XXXX XXXX XXXX in the State of Texas for more than 10 years. My understanding is that some or all of her loan balance should be eligible for forgiveness. I received the following response on XX/XX/2020 : " Thanks for replying! Unfortunately, we're unable to discuss specific account information via email. We're able to assist you via phone, just call XXXX. '' I responded to this requesting correspondence via email or certified mail only. I want a paper trail to keep a record of correspondence as I have been lied to about payments and options available to her in the past. They responded to this request with : " Thanks for replying. Unfortunately, we're unable to process a forbearance until you specifically reply " yes '' to this email. '' They can't discuss payment options and programs that my wife may be eligible for via email or certified mail, but they can put her loan into forbearance with a simple reply of " yes '' to an email? I attached a copy of the email correspondence. Please note that I have permission to represent my wife with Navient and any written or verbal statement by her can be provided to support this.

Consumer Complaint: I made a XXXX payment for XX/XX/2020 which is due the XXXX of the month. I made it on XX/XX/2020. Navient did not give me credit for it ... they said their other department had it..i have a private student loan the other loan department of navient has it . They withdrew it from my savings debit card and i can not get the money back or have it applied to my student loan. I called and they are looking at sending it back to bank in 3 or 4 weeks ; it has not been applied to anything they just have it. They want me to get a copy of my bank statement and send them so they can see i was the one that sent it instead of just putting it back into the bank so i can make the XXXX payment ... if i am late then more trouble as they charge more interest although they have the money sitting in their pockets This bunch is driving me crazy ; even when i make payments early to get the balance down they XXXX me and i end up paying late charges and still dont know if i will ever get back the XXXX they have in limbo of mine not applied to anything. this is my second letter to consumer financial protection, but these schemers have went on with too many lies to list here ... this is just the latest how can our government condone a company like this that takes advantage of college students!! disgruntled and nearing the end of my patience!! Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I have private and student federal loans with navient. During XX/XX/2019, I was advised that I needed to make a payment because the payments they recieved wasn't going to the accounted with the due dates. I was not provided clear instructions on which accounts to pay and as to how much. In XX/XX/2019, I spoke with a lady who verbally advised that if I scheduled an payment my account would not report late as I would have met the deadline before the reporting to the three major credit bureaus. A few months ago, I called back and spoke to another lady and asked that an investigation be completed because I was provided incorrect information. As a result, the second time I called was advised that a manger would listen to the phone records to hear what her staff advised and assist with getting the late payment removed as I was following her direction. To present, nobody has called and when I call I get the run-around. I have tried to handle this on my own and if someone replays the phone record ( as all calls are monitored XXXX will clearly hear the lady advising that if I schedule a payment, my account would not report as late.
