Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: I have reason to believe, and do so believe, that this Navient Solutions did not loan me anything and I do not have any alleged debt with Navient Solutions. Pursuant to 15 USC 1602 ( f ), ( g ), ( l ). I have reason to believe, and do so believe, that this is a consumer credit transaction where I as the original creditor used my credit card, which is my social security card, to assign myself to the creditor by granting the right on the existing credit plan. Navient Solutions then at some point, purchased this alleged debt and is now attempting to collect on it fraudulently. I have reason to believe pursuant to 15 USC 1692j ( a ) Navient Solutions created and furnished a deceptive form in the attempt to make me the consumer think I got a loan and they are entitled to payment. I've sent a debt validation and cease and desist letter via certified mail, as well as a notarized affidavit via certified mail, and I have not received any response by mail. Navient Solutions has continued to report on my consumer credit report during this time, as well as attempt to communicate with me via telephone or email to collect upon the alleged debt with no regard for federal law nor my rights as a consumer.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I contacted Navient last XX/XX/XXXX to request to lower my student loan payments because I had cut my hours at work due to Covid-19 and homeschooling my son but I was denied. This was actually my XXXX request to do so. XX/XX/XXXX, I was diagnosed with XXXX and a month later admitted into the hospital for in patient XXXX for a blood XXXX and a XXXX XXXX that was found unexpected. The next several months were a whirlwind. Covid peaks, no family allowed in the hospital, XXXX XXXX, XXXX, XXXX XXXX, I was going through quite a bit. XX/XX/XXXX, I started receiving phone calls every other day, emails, voicemails, etc threatening student loan default and next step I would be sued. I explained to Navient that I was in the hospital undergoing treatment and out of work. I could barely walk and requested a forberance, hardship or something to push payments until I could go back to work. I was advised these were private loans and nothing could be done. XX/XX/XXXX I started receiving threatening calls from an insensitive gentleman that asked me why did I take a loan if I couldn't pay it back. He said my loans had defaulted and it was his job to collect payment or send my file to an attorney to sue me. I advised him of my health condition and was told his dad had XXXX and that was no excuse. He asked if I had received any taxes and asked did I want a settlement for I believe 70 % of the amount or he stated I could give him $ XXXX {$8000.00} down and make payments of $ XXXX. I tried to explain to him that due to treatment ( unexpected diagnosis ), not working, I had fallen behind unfortunately on almost all of my bills but when I submitted paperwork from my doctor, everyone worked with me including my housing. He proceeded to tell me I needed to borrow the money from someone or talk to my parents. I advised him my dad was deceased. I was so stressed out after he called 3 times in one week, I called Navient and asked for a supervisor to take over my account and I was told there was nothing they could do. I asked if they were aware of the lawsuits pending from XXXX XXXX ( who made the loans ) and they said there was nothing that could be done. I inquired if they had any XXXX relief options, they said I did not qualify for anything. I asked why was I receiving emails to call about options to lower my payments but when I call there are no options.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: My husband and I co-signed on a private student loan with then ( Sallie Mae ), now Navient. I have tried numerous times to contact them to have them change incorrect information our credit report. Navient posted that the loan was written off at {$7200.00}. However, my son actually is working with a loan consolidation agency, and Navient agreed to a {$5500.00}. Therefore the loan was not defaulted for {$7200.00}, it was deducted and paid for {$5500.00}. When I try to contact Navient to have our credit reports corrected, they repeatedly state that we are not even in their system. I also have tried to access our account through their online system, and a message there also states that our account can not be found. This is extremely frustrating because our report will never be corrected if according to Navient we don't even exist, nor ever had an account with them. How can this issue be corrected. This derogatory note has directly affected our credit. Please advise on hour to resolve this issue. Thank you.

Consumer Complaint: DEPT OF ED/NAVIENT continues to report to credit bureaux a 90 days past due payment for XX/XX/XXXX. I was in active Chapter XXXX bankruptcy from XX/XX/XXXX to XX/XX/XXXX, and in active forbearance on my student loans. No payments were required during that time, so no payments could be deemed " late. '' I was making payments when possible to reduce balance during that time and post bankruptcy discharge, all payments were made on time, in full, and ultimately completely paid off.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I've been unemployed since spring of XXXX because of the pandemic. I still have student loans from attending college in the late XXXX. Student loan borrowers were supposed to be given automatic deferral during the pandemic. Navient continued demanding payment as usual and unexpectedly withdrew my monthly payment in XX/XX/XXXX per autopay, causing me significant financial distress at the worst possible time. They later agreed to reverse the payment and put me in some kind of forbearance, but never clearly explained how long it would last or when I would have to start paying again. They claimed they weren't bound by rules made to help student loan borrowers during the pandemic. Navient suddenly began demanding payment again in XXXX of XXXX even though the pandemic was still raging and I was still unemployed. I found out about their demand when I was charged a late fee. I asked for additional relief because of the pandemic and they refused. My only options were 1 ) use up my few remaining months of regular forbearance and then begin making payments again somehow despite having hardly any income, or 2 ) pursue a consolidation loan so I could have additional forbearance opportunities, which they encouraged me to do. After some research I learned consolidating would cause me tremendous financial harm because, while my current loan 's remaining balance can be forgiven under XXXX after a couple more years of public service, consolidating would wipe out all my past payments qualifying for XXXX. Navient totally ignored their obligation to address the unprecedented hardship the pandemic caused student loan borrowers like me. They kept putting the squeeze on me demanding payment and charging late fees while my family faced some of the scariest times in our lives. Believe me we already had plenty to worry about! If I had less savings and family support Navient 's opprobrious behavior could easily have caused me to go hungry and/or lose my home. Navient also tried to steer me into wiping out my ability to soon qualify for XXXX.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I have been experiencing a reduction in work hours since the pandemic started. Navient has worked with me up until this time, but now Im receiving conflicting information and issues moving forward. I received and email stating that as of XX/XX/31 short term coronavirus relief was no longer available for private student loans. I went to their website under covid-19 assistance and it states the program is available until at least XXXX with a note that you cant use it for more than 12 months. I called to speak to someone yesterday and they told me I have no other options that to make the repayment because Ive used all other options. The reality is I am still working a reduced number of hours and need assistance in postponing payments. I have been very proactive in reaching out before payments have been due to keep Navient informed about my situation. Unfortunately all of the sudden Im getting conflicting information from their sources and no real help.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I was enrolled at XXXX XXXX in XXXX and they filed for bankruptcy and closed before I was able to complete my degree. In XXXX, Navient contracted XXXX to collect my defaulted student loan. XXXX reached out to me and offered to allow me to settle for less then the full amount. I did not have money at the time and asked if I was able to pay, if they would remove it off my report. They said Once Navient receives the money, they will take care of that. They told me I would have to make the payment by XX/XX/XXXX. I called around the middle of XXXX to ask for an extension, which they said an extension would mean they couldnt honor the settlement. I even called back the next week and told them I did not have the full {$2000.00} and if I could settle for XXXX and they again said no. On XX/XX/XXXX I called in and when I couldnt I paid the XXXX. They told me they would take the {$2000.00} and hold it for a month and then update my account accordingly. I have been calling at least 4 times a week begging for them to fix my report correctly so I can get approved for a home. Every time I call they give me attitude and tell me that I have to wait 30-60 days but its not XXXX. I kept telling them you guys are reporting it incorrectly and Navient did nothing but send me to a fake voicemail which I have left so many messages on and havent received not one call back. I decided to create an account with them and when I did it said that my account was still in default and I owed a past due balance. I have complained so much and Navient had not helped me at all.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: In 2020 I negotiated to pay off my daughters student loan with NAVIENT. I was the designated cosigner, and my daughter was behind in her payments. I wanted to put an end to the issue and so reached out to NAVIENT to negotiate a settlement for loan close out. We talked about loan close out options, I explained that I wanted to settle the loan in full and did not want to simply drop the cosigner. Eventually we agreed on a final closure price. NAVENT would not send written documentation and refused to send contract negotiation info, they said they needed to be paid first. I said I would not move forward unless I got a letter from them stating the terms and that they agreed to close out the account, as loan to be settled and marked Paid in Full, for the agreed to settlement value. On XX/XX/2020, I received a letter from NAVIENT agreeing to these terms that said they agreed to settle for 66 % of loan value. This amount would be {$17000.00}. It said that after I completed the full payments they would consider the loan settled in full and would stop all further collection actions. '' They verbally explained that payment could be done over a 6 month period of time. I completed all payment in 4 months. They agreed I had met my obligation and said they would process the loan for closure. It is now 7 months later and they have not processed the loan for closure, in fact they have changed the rules and assigned the full loan value minus the settlement, to my daughters responsibility and they still have me listed as cosigner for remaining balance too? I realized this situation just very recently when checking my other daughters student loans. So I called them on these tactics and they first claimed the settlement was not for loan payoff, but was to remove cosigner. I protested. Both my daughters and I had separate verbal discussions which are completely opposite to their claims. The letter they sent is opposite of their claims of a cosigner settlement. They are not returning my phone calls, now ; I want to pursue formal complaint and lawsuit.

Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: The Department of Education/Navient stating I owe {$29000.00}. This information is not correct as I do not owe them anything and they have violated my rights by publishing this info on my credit report. 15 USC 1681 ( a ) under the investigative consumer report, the consumer report should not include factual information, also they are supposed to interview my neighbors, friends and associates. None of this took place so it is a violation of my rights.
