Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I graduated in XXXX. At the time I had no business in college, I graduated XXXX XXXX with a XXXX GPA and XXXX with a XXXX GPA. I had 0 concept of finances and did not fully understand what I was agreeing to. I only wanted to wrestle. As an adult I am better with money and recognize the consequences of my actions from over 11 years ago. Unfortunately Navient is very hard to work with. You student loans are in 3 different departments, Government, Governement back, and Private student loans. Each department has it own programs and don't talk to each other, so when you have 20 student loans it is easy for Navient people to make mistakes. They signed me up for 18 % interest rate. I have basically been on a rate reduction plan for the private loans for the last 10 years and have never paid the government loans. Every six months they want to call and discuss my income situation over again. I also get harrassed by employees for making life decisions like buying a car or house. They tell me I should be calling them before taking out new debt. It is very draining considering the yoyo ride my income has gone on over the last 10 years. It should not be legal for them to hold an 18 % debt over my head and not consider locking in a rate longer than 6 months. They are the only negative reporting information on my credit. So I can not refinance the loans, they keep increasing the monthly payment so paying back federal also becomes impossible. Not sure what this email will do but I though someone should know. The purpose of Student loans and Navient was to improve my life. I now feel like a slave to the debt and I keep getting harassed by the company every 6 months because they want me to pay 18 % interest. Navient needs to do a better job of servicing their long term customers and helping them enrich their lives through a pay plan that is profitable but affordable for consumers. Student loans should not be hurting me this badly after 11 YEARS!

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I had a student loan with Sallie Mae for many years and it eventually became Navient. I have had intermittent issues with them over the years regarding not posting payments. They can't seem to process money orders. I have no choice but to send money orders each month. I have a consolidated loan with my ex-husband and he is court ordered to send me money orders once a year ( 12 of them ) and I have to send them monthly to satisfy his portion of our loan. ( I actually pay my half online ). Every month for the last ( probably 6 ) months, I get harassing calls from Navient about my payment not being made. They tell me they never received the money orders. Then I have to call the money order company and confirm they were cashed-which they always are. Then Navient will argue with me and tell me I have to send them proof from the company ( which the company charges {$30.00} for. An automated system will give you the cleared date for free but charge for official copies ), and it's a written mailed request I have to send in, wait for it to be sent back, and then I would have to send it to Navient. The whole process is very time consuming all the while they are showing me past due. Every month I have to explain to a different Navient employee what is going on and that it happens every month. Today is the 2nd time this week they have called me-while I'm working. My payment is due the 11th. I mailed it 2 weeks ago, they cashed it on the XXXX of this month. Yet, they have no record of it in their system. THIS IS THE MOST FRUSTERING THING I HAVE EVER HAD TO DO REPETITIVELY regarding a billing issue and i do not wish ( or feel like I should have to ) do this for the remaining 15 years (? ) of my loan. There have been times they called XXXX weeks after they cashed it to tell me I am past due. The money order is mailed with a printout of my account ( I don't get a monthly statement ). The printout has the money order number on it, the amount of the payment, my loan number, name, address, and i put a note on it that says " any questions call XXXX ''. The money order has the loan number on it. A few months ago a Navient employee said " put a XXXX after the account number on the money order. It will help it get processed. '' So I did that. The following month when they called and I explained, the employee said " Since you are sending in 2 money orders, put them in different envelopes ( still with -9 ). So I do that, both will the printouts and all the information. ( I take a picture with my phone every month of the paperwork and the money order so I have documentation ) It's like a big game to them. They have called me 2 times today already. My anxiety and stress about this is through the roof and they don't care and they have no answers, and they don't care to make any process improvements. Why wouldn't a money order get posted when it is received like a check does? A money order is more reliable, its been prepaid. A check could bounce? I know Sallie Mae has had lawsuits for mishandling payments and other issues. I don't want a law suit. All I want from them is to process my payments and stop harassing me and acting like I don't pay my debts. I don't want to have to spend an hour on the phone with them once or twice a month every month explaining their incompetence. I think they should be forced into a process improvement, or fined if a payment is received but not posted within ( 3 days seems plenty reasonable ). The employee today told me it takes 3 days, yet it is the XXXX and it was cashed on the XXXX? He didn't really have any explanation, they never do. 15 minutes after I got off the phone with Navient, I got another call from them about my payment being late?! I have ask them to stop calling me about payments and told them why but they said no, they can't do that. I'm pretty sure you can ask a creditor to stop calling?? Please, for the sake of my sanity and all of the student borrowers-please do something to correct this.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My student loan payments have started on XX/XX/05. I was " counseled '' by XXXX back then to put my loans into deferment/forbearance for years until I could find a job. Not only find a job, but one where I could afford the hefty monthly payments. After my initial deferment expired I was forced to go into forbearance. Unknown to me then was that the capitalized interest was running the entire time, which was not explained to me clearly over the phone. Then came the switch to sallie mae, which also did not explain the situation clearly. Then, with the switch to Navient I finally signed up with an Income Based Repayment Plan ( IBR ). Given my low paying jobs I was forced to either send my loan back into forbearance and rack up interest or my loan payment was calculated as {$0.00} given my low wages, which also incurred interest. So, in essence my IBR and a normal forbearance are one and the same, as far as interest goes. The final straw was when I was recently reviewing my loans. I wanted to see the progress I had made with the no interest the past 18 months. Only to find out my FEDERAL LOANS are not owned by the dept of education, thus I was charged interest through the covid-19 pandemic. This company, Navient, is criminal. They explain nothing. I made major decisions, including signing with XXXX at XXXX years old, without any information or explanation. I wish to receive some relief with all this interest i've paid since 2005. On a {$21000.00} loan and 15.5 years later i'm just at {$14000.00}. And that is with my company paying {$100.00} extra a month for student loan relief. Absurd!

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I graduated from XXXX XXXX in XXXX. XXXX of my XXXX student loans was assigned to Navient, and the rest to a different organization. I attended graduate school at the XXXX XXXX XXXX from XXXX to XXXX. Apparently, in XXXX of XXXX Navient attempted to start collecting on my XXXX student loan. However, they never informed us of such. The only method Navient used to attempt to reach me was, according to them, through my XXXX XXXX email that I have not used since XXXX. In fact I do not believe I even have access to that email anymore. Navient did not send any bills to my permanent address, which has been my permanent address since XXXX, nor did they use any other method to reach us. In XX/XX/XXXX I attempted to refinance my student loans with XXXX. I've had good credit my entire life. My loan was denied. The reason for my loan was because apparently Navient put a massive hit out on my credit when we had no notification of bills being due. We moved quickly to address this, challenging the hit on my credit with all 3 reporting agencies. However, it is now the end of XX/XX/XXXX and I was just denied refinancing again because of Navient. Navient has updated the report to indicate that we have paid back what is owed and up to date on payments, but they are refusing to remove the hit on my credit report with XXXX stemming from 4 months of bills that we never received XX/XX/XXXX through XX/XX/XXXX. When I spoke with XXXX for an hour on the phone they opened another challenge to this hit on my credit, but indicated that the only factors they will consider are whether or not the payments were late, which they were which leaves the decision to remove the damage to my credit entirely up to Navient which has thus far refused to undo the damage they caused, or to file a fraud report with the police or the FTC.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I entered a consumer credit transaction with this organization and extended them my credit and as a result they used my credit card ( as described in 15 USC 1602 ) and was extended credit in a consumer credit sale. they are now claiming that they originated the credit I extended to them, in which constitutes fraud, the alleged interest not included in the finance charge ( sum of all charges ) Pursuant to federal law They have committed fraud and several violations of the FDCPA and TILA. They are now threatening me for an alleged debt that they claim I owe. I never received a Material Disclosure of any of the information that was supposed to be provided to me. they have taken an unfair advantage of me as a consumer, and they should be held accountable for deceiving me and not validating the debt. They have not validated anything ; they have ruined my character and general reputation by reporting erroneous information on my consumer report and included a symbol on the contents of the envelope for the mail carrier or any person affiliated with the mail service or comes in contact with the envelope thats alleging I owe a debt. Theyve act as if they are unaware of what I am requesting or that the law does not apply to them and I've included evidence and proof, pursuant to federal law with facts that prove that the law does apply to them and that they must adhere to them. They have not provided me with any original documents, and they have disregarded the law by saying, they do not have to provide me with anything except billing statements or applications, which is not proof of validation or proof that I owe anything. They are also claiming that they must report information to the credit bureaus, however cfpb handbook 3.1.1 furnishers incentives and decentives states- reporting to credit bureaus and other consumer agencies by creditors is voluntary and historically has been. Furnishers have multiple incentives to contribute data to XXXX one of which is for borrowers to make timely repayments. Their willful non-compliance has damaged my reputation as well as my credit file.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: NAVIENT is reporting incorrect information on my credit report. I went to school on a full-ride scholarship and someone obtained financial aid in my name. This issue is pending SUPREME court. NAVIENT is very well aware of this situation and you need to stop them from reporting fraudulent information on my credit profile. Under The Fair Credit Reporting Act ( FCRA ) there are procedures for correcting fraudulent information on your credit report and requires that your report be made available only for certain legitimate business needs. Under the FCRA, both the consumer reporting company and the information provider ( the business that sent the information to the consumer reporting company ), such as a bank or credit card company, are responsible for correcting fraudulent information in your report. To protect your rights under the law, contact both the consumer reporting company and the information provider. PLEASE STOP REPORTING

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I had a little over {$23000.00} in student loans when I graduated in 2017. Upon entering the workforce as a temp, my repayment plan was still paused until 6 months after graduation. When the bill started coming due, I was working 40 hours a week at {$8.00} an hour, which comes out to about {$1000.00} dollars a month. My rent was {$750.00}, my car insurance was {$200.00}, and any other costs of life added to more per month than I was making. When I requested an income based repayment plan in XX/XX/2017, all I could pay was interest. I was making no headway on my actual student loan bill, instead my hard earned money was going into the pockets of a company that had zero desire to offer me other solutions. They make money off people who can't pay their bills, it's predatory lending at its finest. This is absurd. I am officially down to {$18000.00} in total after consistently paying on them for 4 years. All I've managed to pay is a total of XXXX dollars because the majority of my bill went to paying interest on a loan I didn't know would be making money to wealthy CEOs. Fix this broken system.
