Consumer Complaint: Navient is transferring my loan to a new service provider, which I was only informed about over the news. This week, I received an email about setting up auto-payments through Navient when loan repayments are supposed to start, with no mention about transferring my account or why they would need to re-start auto-pay. I tried to call their offices to answer my questions directly, which are not found on their website, emails or mailings. I was given an automated caller run-around, and never given access to a human to talk about the changes coming to my account in the next 4 months. Navient will not communicate with the borrowers it is servicing.

Consumer Complaint: The nature of this correspondence is to inform you an error and greivance that has caused me severe hardship on my credit report, i'm speaking of the charge-off ( s ) on my XXXX and XXXX credit file. On XX/XX/XXXX I made a payment to Navient I have attached my bank statement to this message as proof. I had made a payment but the loans were still charged-off on XX/XX/XXXX. According to the Cares Act their was a Covered Period that started XX/XX/XXXX which goes 120 days after XX/XX/XXXX. Under those terms I should've been covered without the derrogatory marks and late payments on my credit file. Furthermore I was informed by a Navient Supervisor that there was a program that I could've qualified for that could have saved me, but Navient did not disclose this information to me. Lastly I have made a several of payments in XXXX I have attached bank statements to this message. And I bring that up because as you know Navient is in a Lawsuite with the CFPB ( Article attached to this Message ) where they ( Navient ) forced borrowers into high payments which had a negative affect on borrowers credit file and I was notified that I was a victim as well.

Consumer Complaint: I tried to dispute some delinquencies that Navient placed on my credit report viewable on all major Credit Bureaus and they refused to honor my well-grounded dispute. Just to provide a brief description of the disputed delinquencies, I have 3 late payments listed on all 9 accounts I have with Navient and some show up as 150 days past due. The repayment process was scheduled to begin on or around XXXX of XXXX, around the time the 6-month grace period was to expire, with the first monthly payment scheduled for XX/XX/XXXX. However, during the summer of XXXX I was enrolled at XXXX XXXX XXXX XXXX as a student particularly on the dates of XX/XX/XXXX through XX/XX/XXXX. Per the FSA, a 6-month grace period is granted to students who borrow both subsidized and unsubsidized loans before they begin repayment although interest can accrue. This would mean that my grace period would have begun on or around XX/XX/XXXX instead of XXXX of XXXX. During the time I was under the impression the grace period expired, I was in the process in the process of applying for the Income Driven Repayment program which I was later approved for and my it extended my repayment to XXXX or XXXX of XXXX. I have attached my student ID, my account activity summary, my student profile, and my transcript all of which will corroborate the Student ID number. Also, the profile and account activity summary corroborate my address. Most importantly, the account activity summary and transcript will corroborate and confirm that I was attending classes as a student at XXXX XXXX XXXX XXXX from XXXX of XXXX through XXXX of XXXX.

I submitted multiple disputes through the credit reporting documents with the forbearance letter, and it still reporting late because Navient keeps saying all records are correct. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 120 days late on this account in XX/XX/XXXX and XX/XX/XXXX I immediately disputed this information with DPT ED/NAVI and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). Consumer Complaint: I am writing on my own behalf without the help of any outside person. The laws referenced are available to the general public. I am aware that my rights were violated and are continuing to be violated in bad faith. NAVIENT is engaging in deceptive and abusive debt collection practices from the inception of the alleged business relationship, violating my consumer right to privacy, and undermining my confidence in the banking system. Since the consummation of the credit sale occurred after XX/XX/1977, NAVIENT is subject to consumers ' claims and defenses pursuant to 16 CFR 433.3. As defined in 16 CFR 433.1, NAVIENT is a seller subject to consumers ' claims and defenses. When the original credit sale was consummated, I, the consumer, was unaware of the seller 's business arrangement with the creditor, nor given disclosure about the determination of the finance charge along with my right of rescission. Upon review of the master promissory note, I have reason to believe and do so believe that my obligation was settled, leaving me with controlling security interest. I am aware that I am entitled to twice the finance charge for the violation of 15 U.S. Code 1635 due to my right of rescission never being simply and clearly disclosed to me. I have reason to believe and do so believe that NAVIENT is a debt collector engaged in communication in violation of multiple cease and desist notices from me, and is in violation of 15 U.S. Code 1692c ( a ) ( 1 ) and 15 U.S. Code 1692c ( a ) ( 3 ). As the consumer, I am aware of the definition in 15 U.S. Code 1692a ( 6 ) that " the term 'debt collector ' means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts. '' NAVIENT has never received my express consent to communicate with me for the purpose of debt collection, thereby violating 15 U.S. Code 1692c, generally. NAVIENT has violated my cease and desist orders and communicated with relatives without their consent on multiple occasions. NAVIENT has violated 15 U.S. Code 1692e ( 7 ) by making the false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer. NAVIENT has furnished deceptive forms to instill in the consumer the belief in the consumer that a debt is owed, in violation of 15 U.S. Code 1692j. I consider every word that NAVIENT has uttered in connection with debt collection to be obscene and profane language in violation of 15 U.S. Code 1692d ( 2 ).
