Consumer Complaint: As of XXXX XXXX, 2017, there is fraudulent activity being reported on all three credit bureaus with an additional money being taken out, without my consent, and reported fraudulently by Nationstar Mortgage that literally has been added onto my current mortgage loan. I am attaching both copies of XXXX and XXXX credit reports showing the date, increase of over {$140000.00}. I am also in contact with all three credit bureaus to place a freeze on my credit reporting until this urgent and serious matter gets resolved ASAP. I am also attaching where you clearly see the payment history and that my loan was not signed for $ XXXX. Clearly ... this appears to be another retaliation from Nationstar due to several complaints that I have filed with the Consumer Finance Protection Agency and the state of Indiana. This is a very serious matter and I will be taking as well additional steps to make sure this never happens again to another consumer. I have as well sent a second complaint to the state attorney generals office in Indiana. I am asking this to be handled ASAP. Sincerely, XXXX XXXX

Consumer Complaint: I was notified of a deficiency with my property taxes of over {$450.00}. I paid the deficiency and yet it is being added on a monthly basis. When I called the Mr. Cooper representative told me I lacked funds in my account, yet when I checked the city tax office I am all paid for the year. I also spoke with the city assessor who told me my tax liability increased only $ XXXX/year yet somehow Mr. Cooper is charging me $ XXXX/month additional. The Mr. Cooper representative informed me that this is because of a doubling of my tax base and refuse tax. Unfortunately, I pay my refuse tax through the HOA, not direct. I feel as though I have been defrauded of funds and request an immediate investigation into Mr. Cooper 's business practices. My account number is XXXX

Consumer Complaint: Parents filed a bankruptcy and the bankruptcy court went after my husband 's job and garnished his pay. We were in this process for years. They took money from his salary and the debt was paid and they still took money from my husband 's salary. They put our home in bankruptcy, my parents did not own a home. Now they have discharged the bankruptcy and our home has a sale date. NationStar/Mr. Cooper refuse to work or speak to us about our own home. They will only say we have a sale date and their is nothing we can do about it. They had an inquest and received a judgment of foreclosure and we were never notified.

Consumer Complaint: Mr. Cooper was my mortgage company for a property I purchased. A couple months prior to expiration date of my property mortgage insurance, my insurance agent and I faxed and emailed reinstated proof of insurance for the property covering XXXX XXXX, XXXX through XXXX XXXX, XXXX. After receiving non-renewal from Mr. Cooper, I called. Emailed and faxed over the proof of insurance. My agent also emailed the proof of insurance. Mr. Cooper sent me non-renewal letters after that to which I called and asked how many times do I and my agent need to forward the proof of insurance before Mr. Cooper updates their file. On XXXX XXXX, XXXX, after receiving another non-renewal letter from Mr. Cooper, I called them. ( As of XXXX XXXX, XXXX, Mr. Cooper mortgage transferred my loan to XXXX XXXX XXXX ) I found out on XXXX XXXX, XXXX that Mr. Cooper has been billing me for home insurance policy and that Mr. Cooper paid out {$1100.00} on my behalf for this insurance. I was told my loan account showed having two policies. Mr. Cooper actually got an insurance for me and has been billing me. I have been paying this without knowing!. A lady named XXXX at Mr. Cooper told me I will be receiving a refund check within 5-10 days. I still have not received it. When I call Mr. Cooper, I was put on hold and after few minutes, I would get cut off.

Issue: Closing on a mortgage

Subissue:

Consumer Complaint: I sold my home on XX/XX/XXXX. The mortgage company, Mr. Cooper, provided inaccurate payoff information. The payoff was not provided to the legal team until the day of closing and they were unwilling to correct the problem with any urgency. The company and the website are not providing me with any information about whether they 're going to correct the error and have failed to do anything except make a note on my account that I 've complained. The escrow balance on my account on XX/XX/XXXX ( my latest mortgage loan statment ) was {$890.00}. The escrow quoted at the time of closing was {$670.00}. Both the XXXX and XXXX Mortgage Insurance Premiums were deducted from the escrow prior to closing, at a monthly rate of {$100.00} for a total ( difference ) of {$210.00}. The Mortgage Insurance Premium I was quoted on the XXXX payoff was {$210.00} instead of {$0.00}. I was also charged interest on the loan through the end of the month in which I closed. I closed on XX/XX/XXXX, which is when the payment is reflected on my account. The interest charged amounts to 23 days of interest on money I no longer owe. All FHA closings which occur after XX/XX/XXXX prohibit FHA lenders from collecting interest through the end of the month by classifying it as a pre-payment penalty. The total interest I was charged is {$950.00} for 61 days. I only actually owed 38 days of interest, or {$590.00}. Mr. Cooper overcharged me at closing ( full payment amount not available on their website, legal documents filed at closing are in my possession ) by a total of {$570.00}. I had to bring money to closing with absolutely no warning due to this error.

Consumer Complaint: ( XXXX ) This is the third complaint against this company who changed their name from Nation Star to Mr. Cooper, but the complaints are the same. CFPB closed the last complaint because the company responded, that seems to be a common result ... as long as they respond the complaint will be closed. This company has not offered any other help after we have made it clear these payments are not acceptable. We were told that once we made three trial payment our payment would be much lower. The trial payment were made but this resulted in higher payments and the company responding my XXXX exemption was not 100 % and XXXX XXXX sent tax payments out, although the tax were sent back several times. It seems that contacting this agency for help is not working as it once did and mortgage company like this one will continue to play games, hire unqualified people write garbage explanations back to homeowners. I will take this to another agency for help

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: This complaint is against XXXX XXXX XXXX, XXXX ( XXXX ) for misrepresentation, fraudulent and forgery relevant to illegal collection activity on behalf of XXXX XXXX XXXX ( Nationstar ) a/k/a Mr. Cooper ). This form did not have the specific category of complaint for me to select, therefore I selected debt collection for debt that I do not owe. In actuality, I do not owe this debt to XXXX XXXX XXXX XXXX ( XXXX XXXX ) as Trustee for XXXX XXXX XXXX XXXX XXXX as falsely stated by XXXX XXXX XXXX XXXX XXXX on behalf of Nationstar. In XX/XX/XXXX XXXX wrote me attempting to collection on an alleged outstanding mortgage debt. They claimed that the debt belongs to XXXX XXXX XXXX. I disputed the debt as I had disputed it over the years with the alleged servicer, Nationstar. I provided XXXX evidence showing that the mortgage note and loan application were fabricated and forged, but XXXX continued with illegal collection activity against me for the alleged debt. On XX/XX/XXXX, I went to see what XXXX alleged was the original mortgage note and at that time met with XXXX XXXX ( Loss Mitigation Supervisor ). I informed XXXX XXXX that the signature on that note was not mine and was forged. Again on XX/XX/XXXX, I went to review the note with my husband and daughter. We met with XXXX XXXX and XXXX XXXX ( Partner ) and while reviewing the signature the ink of the signature smudged/smeared. I told XXXX XXXX and XXXX XXXX that this note was obviously forged because the signature written with a ballpoint pen almost 12 years ago would not smudge. Neither XXXX XXXX nor XXXX XXXX responded to my accusation. I therefore believe that the note was forged/created just before our arrival to review it by XXXX XXXX and XXXX XXXX. I immediately filed a forgery complaint against XXXX and Nationstar with the XXXX XXXX Police Department ( XXXX ) stating that XXXX forged the document to facilitate collection on behalf of Nationstar and XXXX XXXX. Despite my repeated communications alerting them to the smudging of the forged note and the criminal complaint I filed against them, XXXX moved forward with foreclosure on XX/XX/XXXX through their counterpart XXXX XXXX, XXXX. In addition to disregarding my letters disputing the legitimacy of the debt and mortgage documents, I had also rescinded the loan on XX/XX/XXXX and XXXX XXXX al still ignored the rescission, which violated the law. In order to save my home, I was forced to file bankruptcy and this has had a detrimental impact on my credit and financial status. I again filed a 2nd rescission ( reminder ) on XX/XX/XXXX and once again XXXX and its clients/agents ignored the rescission. After my debts were discharged in bankruptcy, XXXX again persisted in its misrepresentation and illegal collection activities by scheduling another foreclosure on XX/XX/XXXX. I therefore filed a complaint with CFPB around this time period and filed a civil complaint XXXX ( attached ) with the Circuit Court of XXXX XXXX County. XXXX did cancel that foreclosure but its illegal activity with Nationstar and XXXX XXXX has damaged my credit, violated my rights and defamed my property and reputation. XXXX ( and their lawyer XXXX XXXX XXXX and XXXX XXXX ) misrepresentation and fraudulent activities violates forgery law, Consumer Fraud and Deceptive Business Practices Act, Fair Debt Collection Practices Act, Fraudulent Misrepresentation and Defamation. The attached copy of civil complaint has specific details related to the violations committed by XXXX et al. XXXX ( and others ) deliberately and fraudulent fabricated false mortgage documents to facilitate illegal debt collection on behalf of Nationstar despite all the valid evidence I gave them disputing the debt. I therefore ask that CFPB refer this complaint to the Virginia State Bar and any other regulatory/disciplinary entity responsible for handling complaints against law firms and attorneys practicing law.

Issue: Trouble during payment process

Subissue:

Consumer Complaint: I have my mortgage through Mr. Cooper, previously Nationstar since XX/XX/XXXX. All payments have been made in full since the start. In the most recent escrow Annual Escrow Account Disclosure Statement, my monthly escrow payment increased from {$330.00} to {$480.00}. I called and spoke with a representative today ( XX/XX/XXXX ) in the escrow department who identified that there were two payments made in XXXX and XXXX of this year to PMI. {$410.00} was paid in XXXX and {$1400.00} in XXXX. I was transferred to the PMI department and spoke with a representative and a supervisor. I was told that the reason for these two payments was due to my PMI having not been paid. Based on the total ( {$410.00} + {$1400.00} = {$1800.00} ) and the amount of my PMI ( {$58.00} ), 32 payments were missed which indicates that payments have not been made for my PMI since the loan originated. The statements that I have received from Nationstar and Mr. Cooper indicate that payments were being made for PMI. On the attached statements there is a section called Prior Escrow Analysis Account History, which has the wording " This is a statement of the actual activity in your escrow account from xx/xx through xx/xx. '' I was under the impression that my PMI payments were up to date based on this information. I have received two refund checks from Nationstar/Mr. Cooper since the loan originated - {$750.00} on XX/XX/XXXX and {$220.00} on XX/XX/XXXX. The supervisor at the PMI department advised that I would not have received these refunds had the PMI payments been made. I, however, did not know that the payments were not being made and therefore thought that the surplus checks were indeed surplus after having all escrow liabilities paid. At this time, I am now expected to pay an additional {$140.00} per month due to this error that went unnoticed for 32 months. The error was noticed, according to Mr. Cooper, due to an audit performed by the PMI company and not by Mr. Cooper themselves. I had never received any notice of payments not having been made or that the error was found. This new monthly payment amount is outside of my budget due to Nationstar/Mr. Cooper 's error.
