Consumer Complaint: My primary residence is in XXXX, and I have a mortgage loan with XXXX XXXX XXXX ( originally XXXX ) which is now serviced by Nationstar Mortgage. It is with Nationstar that I have problems with. I am a XXXX in XXXX, but I had a substantial drop of income as I lost a significant providers at the time. This caused me to be in delinquent with my mortgage loan. However, throughout the last year, I repeatedly contacted Nationstar to set up a payment plan. I even offered to pay $ XXXX per month until the loan was current. THEY REFUSED TO ACCEPT UNLESS THE ENTIRE $ XXXX WAS TENDERED. I had also offered them $ XXXX cash now and the rest on a 6 months payment plan, which they also refused. They filed a Notice of Default on XXXX XXXX, 2015, and the XXXX day is around the corner. They had me applied for a loan modification, but I still have no idea with the status is at the present. The reality is if this continues I will be forced to file a Chapter XXXX bankruptcy to prevent my house from being foreclosed. And once that is in place, Nationstar will get much less than what I am offer. This will also ruin my records and business. Therefore, I solicit the help from your office to see if there is anything your office can assist to get Nationstar to act rationally to all. Thank you.

Consumer Complaint: Nationstar has sent statements dated with variances that range between XXXX weeks so customers do not receive them in a timely manner and sometimes very close to the actual due date. Multiple times when I have called I have simply been hung-up on, this is almost half of the time I call. It happened XXXX today alone when I called to inquire about my escrow check since I refinanced - in part because this mortgage company is the worst.

Consumer Complaint: In XX/XX/XXXX my client, the buyer, had entered into a real estate contract, with a seller, that was a short sale transaction with Nationstar mortgage. The deadline to complete the transaction was XX/XX/XXXX. We were not able to reach the deadline but, the agent, that represented the seller, later informed me that the short sale negotiator was extending the date in order to complete the transaction. This resulted in the need of a new payoff because we were now entering a new month by XXXX. So we set a settlement date to close on XX/XX/XXXX. But, on Friday, XX/XX/XXXX, all parties were notified that the seller 's house a been sold to an investor on the auction block. This left my buyer XXXX with no explanation. The seller 's agent talked to the trustee for Nationstar to see if they would rescind the offer with the investor, but they refused. Prior to this foreclosure sale, no parties were notified. ( Seller, HOA, Title company or Seller 's agent ). My client and I are seeking assistance to receive a clear explanation on how something of this nature could occur. Please help. Thank you

Consumer Complaint: Nationstar Mortgage requested information that was unnecessary ( confirmation of SSN for tax purposes, even though the institution had already sent a tax form and clearly had this information. They also did not include a postage-paid business reply envelope, as is good practice for business mail. I responded to this and paid postage myself to get this to them reliably. After being told the notice was in error, I have requested that they refund postage. They have refused and additionally, sent me someone else 's information (!! ) in a response. They keep insisting they sent a response envelope that was paid, while a quick glance on XXXX for this joke of a lender would tell you that no-one got such a paid return envelope. Bad practices and privacy violations are just the tip of the iceberg with these guys, but it 's a place to start.

Consumer Complaint: I, XXXX XXXX residing at XXXX XXXX XXXX, XXXX, New York XXXX hereby states for the record with the Consumer Financial Protection Bureau that Nationstar Mortgage LLC and any predecessor as servicer to a mortgage attached to XXXX XXXX XXXX, XXXX, New York was handled abusively during a numerous modification processes. Nationstar Mortgage LLC has assigned a foreclosure process pertaining to a note and mortgage originally procured with XXXX XXXX Mortgage in XXXX with XXXX XXXX XXXX as master servicer to a New York XXXX law firm for foreclosure. There are several criteria established that proves that the entire transfer of the note and mortgage were fraudulent, along with an original foreclosure filing in XXXX where I was never personally served. The fact that it took nearly five ( 5 ) years after this initial filing for the legal entity to re-file the original complaint is highly suspect that the note and mortgage are not in any legitimate position to foreclose. I was approached by the mortgage servicer on at least XXXX XXXX XXXX XXXX occasions with a modification pre-trial arrangement, all of which resulted in a declination by the servicer. There was never a legitimate reason given for the modifications being declined. The collection processes were abusive at all levels against all Fair Debt Collection Practices Act guidelines to remedy a debt. The real estate meltdown highly affected my property valuation in XXXX through XXXX, all of which should have been taken into consideration during the modification process, mostly due to the fact that the ultimate responsibility to make the debt whole to investors would fall upon the taxpayers of the United States. Real estate securitizations have become an area that is under attack for using fraudulent means to an end for the American banking institutions. The original note was fractionalized whereas there are multiple owners located in several securitization trances. The note and mortgage were split on a level XXXX forensic on public record by MERS, and once again by XXXX XXXX XXXX Corporation as the note was positioned into XXXX XXXX XXXX XXXX several years after the securitization trust was closed in XXXX. I will take this matter to an administrative court to offset the foreclosure action in New York XXXX if deemed necessary. However, the letter attached to my submitted modification state on record that I am willing to re-modify the existing mortgage or sign a new mortgage if there is a considerably reduction in principal and interest rate. I also request that the Consumer Financial Protection Bureau to monitor the entire modification process that I have submitted to evaluate if Nationstar Mortgage LLC is operating within the amended FDCPA guidelines on modification/foreclosure workouts as of XXXX XXXX, XXXX. ( GUIDELINES ATTACHED )

Consumer Complaint: In XXXX I was approved for a XXXX through XXXX. Prior to closing, my Loan Officer went over final numbers which included a $ XXXX/mth XXXX option, and a $ XXXX/mth XXXX option. Just to my surprise, I notice after receiving my first bill that the XXXX option, which was the interest only payment, was not the numbers that the Loan Officer quoted me. I contacted the Loan Officer who went back over closing numbers and he again agreed that the numbers he quoted were correct according to his mortgage calculator. The Loan Officer later contacted a representative from XXXX who had already sold the loan to XXXX to see why the numbers had adjusted. According to XXXX, the rates had adjusted prior to closing and was never locked. Prior to closing, my Loan Officer said that I had the option of refinancing out of the loan with no additional closing cost or fees at anytime. Within the XXXX 6 months after closing on the Pay Option Arm, I decided that this mortgage product was very costly and decided to refinance out of the loan only to find out that pre-payment penalties were attached to the loan ( Pay Option Arm ). Negative Amortization was never explained to me prior to excepting the Pay Option Arm nor the pre-payment penalties. In XX/XX/XXXX, my loan was sold to XXXX XXXX XXXX. Due to the negative amortization, my loan was no longer affordable. I had exhausted the minimum payment option and became financially crippled. Not only was I not able to pay my mortgage, I also felled behind on my other household and financial obligations. This caused a major distraction in my marriage. In XX/XX/XXXX, my wife and I decided to separate. In XXXX XXXX, I decided to file a chapter XXXX bankruptcy because of the financial obligations that were left behind after my separation and I could no longer afford to pay my mortgage. In XXXX XXXX, my wife and I were granted an XXXX divorce by the state of Maryland. Many attempts were made to refinance or modify loan through XXXX XXXX XXXX but never could come to a mutual agreement on the terms. In XX/XX/XXXX, XXXX XXXX XXXX sold the loan to Nation Star who is now the current note holder. I have been approved for XXXX different modifications but I am not willing to accept any of the terms because of the delinquent payments that they want to attach to the loan. I have all of the original loan docs and they are available upon request. I was clearly a victim of predatory lending an unfair practices. Currently, I have an interest in the property and would like to continue living in the XXXX XXXX community so that I can raise my daughter in the community that has embraced her and has contributed to her well being.

Consumer Complaint: My mortgage was bought by Nationstar Mortgage on XXXX XXXX 2015. I was notified by the previous Mortgage holder ( XXXX ) that it was sold and to make the next scheduled payment to them as I was to be receiving a welcome packet from them " any day ''. I never received the packet and it took hrs on the phone with Nationstar to attempt the payment with negative results. I had to go back to XXXX to make the payment. Through XXXX my new acct number for Nationstar was obtained. Since that payment, I have received over XXXX phone calls to my residence from Nationstar. The person calling identifies him or herself as a rep from their Company and asks for my SSN, DOB and other sensitive information. They advised me it was for their debt collection bureau. I told them I pay my bills on time and asked to speak to their supervisor and they wouldnt put one on the phone. I have received at least 3 calls a week from private numbers, different XXXX and XXXX numbers all stating the same. They stated they will not be stopping until they update the information for debt collection regardless of the fact that I have made each and every payment for both this current mortgage and my previous home 's mortgage on time. I finally received the welcome packet from Nationstar this week..It has been about 4 weeks since they have held my mortgage. I never asked for their service and I dont like their company. I am being harassed now by a Company in their efforts to update their debt collection records and I have no issues paying my debt with them even though I have never asked for their service. They are rude. They are violating Penal Law section 240.30-1 in the NY State Penal Law where as their calls are both unwanted and annoying, repeated and alarming. They need to be stopped as they are effecting the quality of life in our home. Making us shut our phone off and ignoring phone calls. WHY and HOW do they get away with this.

Consumer Complaint: My original note was owned by XXXX Bank and I was given a loan modification, at the same time I was offered the Loan Modification my loan was sold To Nation Star Bank and subsequently my loan modification offer was not honored and I was forced to resubmit for a new loan modification. All of the income and documentation was the same and I was turned down for a loan modification. I have resubmitted several times at the request of Nation Star and have been turned down each time.
