Consumer Complaint: Our loan docs state that PMI may be removed from our loan when the LTV reaches 78 % and allow an appraisal to be ordered in order to obtain a more current valuation for the LTV calculation. However, after the appraisal was completed, Nationstar is refusing to honor that document citing XXXX investor guidelines that state that for the first 2 to 5 years of the life of the loan, PMI may only be removed from loan when the LTV reaches 75 % if a new appraisal is required to obtain a more current valuation for the LTV calculation. We never signed anything agreeing to this particular XXXX guideline. Further, the appraisal came in much lower than we had anticipated. We purchased our home in XXXX of XXXX and at that time the appraisal came in at {$430000.00}. The appraisal that was ordered in XXXX of XXXX came in at {$470000.00}. This indicates that during the 2.5 years of rapid appreciation of real estate in our area following the bottom of the housing market the value of our home only appreciated a little over 7 %, a claim which we find to be borderline insulting particularly given the comps in our area. Since XXXX XXXX, we have been trying to resolve these XXXX issues with Nationstar, but they refuse to cooperate.

Consumer Complaint: I purchased my home at in XXXX XXXX. The Loan was through XXXX Bank who then sold the mortgage to a company called Nationstar Mortgage. This occured in XXXX and my XXXX property taxes were due to be paid out of escrow. Nationstar Mortgage never paid the property taxes and I was never given an escrow check or compensation for this failure. I only discovered this fact as I went through the process of refinancing. Nationstar Mortgage 's failure to pay property taxes when they were due, out of my escrow account caused hundreds of dollars in fees to accumulate on the account. Since I am ultimately responsible for my property taxes I paid the property taxes due from XXXX on XXXX XXXX, XXXX to include the accumulated fees and charges. To attempt to resolve this issue with Nationstar has been a nightmare. I have since received part of what is due to me out of escrow and am waiting to receive the final balance on my escrow account as my loan has been paid and closed due to my refinance. The part Nationstar will not assume responsibility for or offer payment for is the late fees and charges that built from their failure to pay XXXX taxes. My intended resolution for this conflict is for Nationstar, at a minimum, to pay the difference of {$490.00} in additional fees that were accumulated due to their error in not paying my taxes. I have attached a spreadsheet summarizing the cost analysis and included is a link to the city of XXXX property tax records to verify the information. I am thankful I caught this issue when I did because if it continued to go unnoticed it could have resulted in a tax lien on my property and potential for my own home to be sold out from under me. I had to pay out of pocket to resolve this issue initially and am now waiting to be compensated by Nationstar.

Consumer Complaint: NationStar Mortgage acting as the Servicer of this mortgage has failed to meet all of its requirements under XXXX and is attempting to illegally foreclosing on our personal home by selling it at auction on XXXX XXXX, 2015 with the assistance of a Foreclosure Trustee named XXXX. The direct violation of XXXX law is based on NationStar Mortgage improperly and unfairly reviewing our loan modification request for relief which was never processed by them because they lost the file and all documents. I submitted a complete loan modification direct via fax and have been forced to resubmit the same package several times at no avail. In addition, NationStar Mortgage has repeatedly denied us help several times and we never get a single person or SPOC to answer our questions honestly or directly. They always have several of their reps pass off our file amongst each other just to create delays. They have mishandled our documents and file several times and failed to properly communicate with us throughout the process. We intended to keep our home and we meet all eligibility criteria. They have never offered any help or relief and continue to threaten to take our home. NationStar Mortgage Mortgage illegally commenced and is conducting a foreclosure while reviewing attempting to find workout relief options for us. They simply wish to foreclose and kick us out onto the streets. They have clearly violated XXXX specifically under the " dual tracking '' clause.. Now NationStar Mortgage instructed and allowed the Foreclosure Trustee named XXXX to illegally start foreclosure on my property. NationStar Mortgage. So there no valid or justifiable reason why NationStar should have denied our request or started foreclosure on our home. As a foreclosure avoidance option, we hired a RE Agent Named XXXX XXXX at XXXX XXXX to handle and start a short sale. We accepted an offer and now NationStar refuses to accept the offer that she submitted in early XXXX of 2015 and said they will continue with the foreclosure sale. The sale is still set and they wont stop it to process the short sale which is wrong and illegal.

Consumer Complaint: ***Nationstar is now guilty of additional fraud and intentionally misleading a government official by filing false information in a Government report. *** FIRST LIE ~ " Please note that we are unable to attest to any actions of the prior servicer. '' ~ They have a full accounting of every action that happened, every date, signature and payment. They are FULLY aware the first loan was generated with dishonesty and a fraudulent HUD/Truth in Lending Statement because they told us. SECOND LIE XXXX " Overall, no errors were identified during the course of our investigation. '' This is a flat out lie. They KNOW we have a false HUD. They KNOW this loan was obtained using fraud and they also know it is not valid and needs to be written off. This is simply a desperate attempt to escape the inevitable. THIRD LIE ~ " Escrow shortage '' ~ Every payment has been made and most of them were substantially higher than we were told in the loan disclosure process. This has been a criminal scam from day XXXX. I am amazed at the lying, fraud and intentional cover-up I am witnessing now. FOURTH LIE XXXX " They provided evidence of a crime and presented it as evidence of innocence. ... See XXXX prior service EA '' The attached form clearly shows a monthly payment of XXXX {$500.00} less then the XXXX XXXX payment of {$1300.00}. It is amazing that they have the ability to lie while presenting proof of guilt. That shows how far out of control this company is. No fear of anyone, especially the CFPB. FIFTH LIE ~ " Please reference the enclosed Escrow Analysis dated XXXX XXXX, XXXX, which reflected an Escrow Shortage in the amount of XXXX " Every payment was made on this loan yet, somehow, we were over 1 year behind in escrow? They know why and this is more evidence of the crime. SIXTH LIE XXXX " Our records indicate that you also spoke with a representative on XXXX XXXX, XXXX, who confirmed the aforementioned to you. '' ~ Their customer service is intentionally unhelpful and they were dishonest and breaking several laws when I spoke with them. Once they identified the fraud and the crime it was their LEGAL OBLIGATION to correct it by writing it off and apologizing. Since that date all we have seen is crime and cover-up and, obviously, lies, lies, and more lies. They have harassed me, abused me, and sent people by to embarrass me by hanging notices on my door, with no legal right to collect. Summary ~ IT IS 100 % ILLEGAL to profit from a criminal act. These companies have broken so many laws it 's tough to keep track of all of them. ADDITIONAL FACTS ~ IT APPEARS TO BE A CRIMINAL ENTERPRISE I believe all of these other fraudulent activities are part of their long term business plans. They are too consistent and too well organized to be accidents. Huge escrow errors send the consumers scrambling and make them unable to pay the payment. Next, the servicer fails to help intentionally. These organizations are full of people with XXXX Degrees. We have to believe that A ) None of them can do any math, even the most basic or B ) It 's intelligent people perpetuating a criminal fraud on helpless, unsuspecting consumers. IF they are simply inept, excuse " XXXX '' does not exempt them from legal compliance nor does it protect them from prosecution and fines.

Consumer Complaint: To Whom It May Concern : Re : NationStar Mortgage Co. Loan # XXXX I am requesting that someone investigate this matter. I feel that NationStar Mortgage Company have discriminated against me concerning a Loan modification and a Short Sale. I owned a rental property at XXXX XXXX XXXX, XXXX, NC XXXX. It took them three months to make a decision about the loan modification because they would n't accept my information because I did n't have a mortgage statement on my primary resident. However, NationStar did n't want to accept the documentation I provided to them because they wanted a mortgage statement on my current resident. I sent NationStar all necessary documents showing them that I owned my primary resident. But, the underwriting in that department still requested that I send them a mortgage statement. At this point, XXXX XXXX XXXX my loan Specialist had to contact her boss regarding this matter before the underwriter would receive my documentation concerning the Loan Modification. The things this mortgage company put me through was truly uncalled for. Nevertheless, when it comes to the Short Sale they waited almost another 70 days before making any decisions about the Short Sale. They only gave the Real Estate Agent XXXX XXXX XXXX not even 30 days to sale the property. I was n't given due process in selling my property or receiving a Loan Modification on a home I owned for nearly 13 years. I stated in the beginning of this letter this company has discriminated against me as a US citizen. I know they do n't do all of their customers this way. I explained to NationStar that I had developed a number of health issues which has put me in position where I 'm not currently able to work. I tried to give them a partial payment and they would n't accept no payment unless it was the full balance. I tried everything I possibly could to get this company to work with me. But, they constantly discriminated against me in every way that was possible. Please investigate this matter for me. It not right for them to discriminate against me I 'm a US citizen and I have rights. If nothing else I do n't want this to happen to anyone else. Thanking you in Advance XXXX XXXX XXXX

Got a HEL from local credit union and they valued home at {$240000.00}. XXXX values at {$210000.00}. Nationstar says my home is worth {$140000.00}. I asked if I can get and was willing to pay for an appraisal from a company of their choosing and they ignored that request just saying my LTV was at 97 %.

Consumer Complaint: Please assist, my husband and I are over XXXX years old and feel that we 've done all we can do fix this issue with no results with Nation Star MY house loan was sold from XXXX XXXX XXXX ( XXXX ) Account # XXXX to Nation Star ( NS ) XXXX in XXXX XXXX. From the beginning there was an issue with an unpaid fee of {$120.00} for missing days on the property without insurance with XXXX we were disputing. When I heard the loan was been sold to Nation Star I decided to pay this amount in full with the last payment made in XXXX to XXXX to avoid any further problems. In XXXX we started making payments to NS as specified on the monthly bank statement. Then the first month we started getting calls and letters that we owe additional escrow balance to NS. They claimed the amount of {$120.00} had not been paid and we needed to pay this amount and late fees right away. I spent many hours on phone calls in XXXX, XXXX, and XXXX XXXX trying to fix this issues. XXXX months down the road, Nation Star was not finding the money, they kept arguing that the money had been paid. At the end of XXXX I called NS again and a gal by the name of XXXX was able to help out. We spend about XXXX - XXXX hours on the phone in which we call XXXX and they told us that all the funds had transferred to Nation Star. XXXX searched this money and found out that the funds had transferred to Nation Star and that our account needed to be fixed and credited all the extra fees NS had charged to my account. This gal try to fix the problem and told me she would credit all the late fees. Two, three months, later the issue was not fix. I would get on the phone and had to explain all the issues again, the reps would argue with me and tell me that the fees had not been paid until I would tell them to read the notes. Then they would say " the system will give you the credit ''. I have called many times for two years and they continue to tell me the same thing. Every time I call I 'm having to explain the whole scenario to the Reps and tell them to read the notes because they argue that the fees are still outstanding and we still owe the money and late fees. It is now XXXX XXXX, two years later and the issue with all the late fees has not been solved. The fees have gone up to {$500.00} + and I 'm sure with interest. This is creating a lot of stress in my life. At my age, I do n't need this kind of stress. I do n't want to spend more time on the phone with Nation Star because I do n't think anything will get fixed. I 've called them sent them letters, sent emails on their website and there has been no response. I 'm coming to you in hope that you can help me address this issue with Nation Star. I need the fees to be reduced, the interest charged to be restored, and my any wrongful or derogatory information on my credit to be restore.
