Consumer Complaint: I am asking the CFPB for help for which purpose it was created by XXXX to protect us from " Debt Collectors and THEIR ATTORNEYS '' ( Nationstart Mortgage LLC and " XXXX XXXX XXXX '', XXXX XXXX XXXX ), who have submitted fraudulent paperwork stating that these submitted papers are the factual basis by which they have STANDING and the right to collect. We are exercising our right in the DOT under the Borrower 's Covenant where it is stated. BORROWER WARRANTS AND WILL DEFEND GENERALLY TITLE TO THE PROPERTY AGAINST ALL CLAIMS AND DEMANDS, SUBJECT TO ANY ENCUMBRANCES OF RECORD. # 1 The Corporate Assignment BY MERS OF THE DOT dated XXXX XXXX, XXXX is a " COPY '' NOT RECORDED IN THE XXXX XXXX RECORDERS OFFICE # 2 The recording was requested by XXXX XXXX XXXX, a fabricator of fraudulent documents # XXXX The recording is to be mailed to Nationstar Mortgage LLC A-The fraudulent submission of this Corporate Assignment of the DOT dated XXXX XXXX by Nationstar Mortgage LLC and XXXX XXXX XXXX, XXXX XXXX, indicate that the parties have submitted evidence indicating that for Good and Valuable Consideration (??? ) that they are now the owner. Nationstar Mortgage LLC XXXXNationstar Mortgage LLC and XXXX XXXX XXXX, XXXX XXXX, with the submission of this evidence indicate that they are the owner of the DOT XXXX However, a subsequent official recording in the rightful XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, seems to indicate another Corporate Assignment by MERS this time to XXXX Bank XXXX This is over 8 years after the fact. Question ... ... .How many more Corporate Assignments can take place? If Nationstar Mortgage LLC, attorney XXXX XXXX, do state that this is the prove of their legal beneficial interest in this DOT and STANDING, they should not hesitate but sign an affidavit according to these facts. Are they the Holder in DUE COURSE, not just the Holder? Are they representing the Lender? Who is the Lender? Or are they representing the the beneficial party in interest? The reason the CFPB was created is to stop excessive abuse by debt collectors. Nothing will do until they will sign affidavits according to their rightful Standing or stop presenting fraudulent papers and commit fraud on the court.

Consumer Complaint: I originally had a home loan through XXXX XXXX XXXX in XX/XX/XXXX. I took our a VA mortgage to purchase my first house but had to move shortly after. in XX/XX/XXXX the renters in my house cause over {$15000.00} worth of damages to my home. The house was not livable without costly repairs. I spent all of the money I had repairing the house and could not afford to pay the mortgage. After my home was in foreclosure my loan was transferred to Nation Star Mortgage. I completed a loan modification packet half a dozen times and returned it to nation star. Each time I was never given a resolution. After a year and a half of trying I finally signed a document waiving Soldiers and Sailors Relief Act rights. I instructed the bank that they could sell my home now because I was told that because this was a VA loan they could not. It has been an additional year now and I am no closer to moving on with my life. The payments have piled up a level I can never hope to pay and I just want the bank to do what they have been threatening to do since XX/XX/XXXX. I gave them permission when I waived my rights and I have sent this documentation to the bank multiple times. This house has not been occupied since XX/XX/XXXX and it is destroying me financially.

Consumer Complaint: In XXXX, we filed for bankrupcy, got discharged and approved for a mofification loan with Nationstar Mortgage. For six years, the payments were always automatically withdrawn from our bank accounts. We also chose the option of receiving the electronic billing statement. Suddenly since XXXX XXXX, we could not access the online account and did not receive any regular hard copy statement. Called Nationstar many times, all representatives promised to fix it in 4 days, 10 days but nothing happens. All representatives looked at the bankrupcy records and confirmed it had been closed a long time ago and absolutely not in active status. Now every month I try to call them to make a payment, they wanted to charge me XXXX dollars for processing fee and did not even send me a receipt or a confirmation letter. How could they been allowed to do that?

Consumer Complaint: I am a XXXX year old man trying to hold on to my home. I was two months behind when I contacted XXXX XXXX around XX/XX/XXXX at Nationstar bank trying to set up a payment plan. After about an hour or so being on the telephone we hammered out a payment plan : The agreement is as follows : XXXX payment for {$290.00} Confirmation # XXXX : XX/XX/XXXX payment for {$1000.00} Confirmation number XXXX, XX/XX/XXXX payment for {$1000.00} confirmation number XXXX. Prior to the confirmation of the payment arrangement by Nationstar I had to be qualified on on the telephone. Per Nationstar instructions a telephone call had to be made every two months to set up the automatic payments going forward. I contacted Nationstar who gave me a confusing answer about my payments, Nationstar said they were returning 3 payments back to me of {$1800.00}? According to the payment plan which I have kept, Nationstar should have received the aforementioned payments of {$290.00} and {$1000.00} which does not equal {$1800.00}, because I have never received a escrow analysis I have no idea what the lender is holding in my escrow account to be applied to my payments. Nationstar in my estimation is trying to take my home illegally, despite the fact that I made arrangements with them to pay back my loan, Nationstar is breaching our agreement, and I am to old and frail to fight back.

I made attempts via phone calls as well as online to obtain an answer on why it was n't cancelled only to be given different information each time. According to the HPA law as well as my Private Mortgage Insurance Disclosure statement my PMI termination date is XXXX/XXXX/XXXX. However my monthly payment still reflects PMI owed for the XXXX XXXX payment.

Consumer Complaint: We closed on our mortgage with Nationstar on XXXX/XXXX/15 and wired the payoff funds the same day. 2 days after closing and after recieving the funds via wire, Nationstar changed their payoff amount due and refused to accept our wire. They then held up the process for 16 days, not accepting the new wire amount until XXXX/XXXX/15. For these 16 days, they refused to refund us our mortgage interest, as the payoff at closing was thru XXXX and any days before that date were to be refunded. When I submitted written proof of this discrepency, Nationstar completely ignored the documentation and continues to state that they are correct and that they do not owe us for the lost 16 days, even though we submitted the correct payoff on the date of closing and Nationstar changed that payoff AFTER closing. If this is a legal practice, then any mortgage company could do this to any customer and steal mortgage interest from them - this could be a XXXX dollar scheme defrauding customers of their money.

Consumer Complaint: NationStar Mortgage acting as the Servicer of this mortgage has failed to meet all of its requirements under XXXX and is attempting to illegally foreclosing on our personal home by selling it at auction on XXXX XXXX, 2015 with the assistance of a Foreclosure Trustee named XXXX XXXX XXXX XXXX. The direct violation of XXXX law is based on NationStar Mortgage improperly and unfairly reviewing our loan modification request for relief which was never processed by them because they lost the file and all documents. I submitted a complete loan modification direct via fax and have been forced to resubmit the same package several times at no avail. In addition, NationStar Mortgage has repeatedly denied me help several times and we never get a single person or SPOC to answer our questions honestly or directly. They always have several of their reps pass off our file amongst each other just to create delays. They have mishandled our documents and file several times and failed to properly communicate with us throughout the process. We intended to keep our home and we meet all eligibility criteria. They have never offered any help or relief and continue to threaten to take our home. NationStar Mortgage Mortgage illegally commenced and is conducting a foreclosure while reviewing attempting to find workout relief options for us. They simply wish to foreclose and kick us out onto the streets. They have clearly violated XXXX specifically under the " dual tracking '' clause. Now NationStar Mortgage instructed and allowed the Foreclosure XXXX named XXXX XXXX XXXX XXXX to illegally start foreclosure on my property. NationStar Mortgage. So there no valid or justifiable reason why NationStar should have denied our request or started foreclosure on our home. As a foreclosure avoidance option, I hired a RE Agent Named XXXX XXXX at XXXX XXXX to handle and start a short sale. We accepted an offer and now NationStar Mortgage refuses to accept the offer that she submitted in early XXXX of 2015 and said they will continue with the foreclosure sale. The sale is still set and they wont stop it to process the short sale which is wrong and illegal.

Consumer Complaint: On XXXX XXXX, XXXX we applied for a shortsale on our home as an alternative to foreclosure. After the bank did there bpo, and appraisal they want a price for the home that was too high and wasnt a true market value. After marketing the property for some time with a realtor we finally got a offer once they reduce the price and had another bpo and appraisal done ( 8 months later ). While marketing the property and maintaining it we received an offer in XXXX XXXX and submitted it thru the equator system. We alos received in the same month a foreclosure letter saying that the property was scheduled to be foreclosed on XXXX XXXX, XXXX. In accordance with Cfpb laws a bank is not suppose to have a scheduled foreclosed date when a homeowner has provided the necessary document 37 days prior to foreclosure when they are trying to work out an alternative to foreclosure. During the same month that we provided a contract we received a foreclosure date. In addition we received an email from the equator system in XXXX XXXX saying that the bank was now denying any shortsale proceddings. Not only were Nationstar actions unlawful in accordance with the cpfb laws but they were misleading and costly to myself, the listing and selling agent, the real estate companies, the attorney, the negotiators and others.
