Consumer Complaint: U.S. Bank, as trustee for the benefit of XXXX XXXX XXXX XXXX, perpetrated fraud in a foreclosure action against me and procured an unjust windfall of {$350000.00} at my expense. In XXXX XXXX I consented to pay or re-finance the {$680000.00} unpaid principal ( inclusive of unpaid interest added to the original {$670000.00} amount ) of a loan I had received from XXXX. in XXXX that XXXX allegedly had acquired. In XXXX XXXX, I received a statement from XXXX, the purported loan servicer, indicating that my " unpaid loan balance '' was {$650000.00} and that my " new monthly payment '' would be approximately {$1000.00}. Assuming this was the bank 's loan modification offer pursuant to XXXX XXXX XXXX XXXX, I sent the first month 's payment to XXXX. However, U.S. Bank did not cancel the sale, and my home was sold for {$1.00} XXXX. I spent the next year trying to set aside the wrongful foreclosure sale but was unsuccessful. In XXXX XXXX the court disbursed {>= $1,000,000} to U.S. Bank, which was {$350000.00} more than I owed to the Trust. And now I can not find an attorney to represent me because the original foreclosure judgment is more than a year old.

Consumer Complaint: On XXXX the first I was told I had to do a loan modification to keep my home I was behind 90 days they refused to help me get caught up on XXXX XXXX XXXX I was rushed to the hospital XXXX .so any way then on the not XXXX I was issued a terrible attorney letter from XXXX XXXX XXXX XXXX Indiana then on the XXXX of XXXX I was sued by nationstar from the court I had a case number so I called nationstar so they told me numerous times to diss regulars any letters from the court I was in a loan modification well after another hospital stay and XXXX I went to a XXXX seminar they told me to file a complaint that all these fees XXXX dollars in attorney fees etc is all illegal they are helping me to work this out but I was vey XXXX and have XXXX of equity and these people wants to push me out of my home with my XXXX XXXX XXXX mother I the care of I have filed a complaint XXXX as well Indiana my loan number is XXXX I did n't even want a loan modification then I get a phone call today I have been denied XXXX XXXX XXXX and to keep my home I now need a crazy figure my name is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I am working with the get XXXX program with my state and they are going to help me but they told me to file this complaint beaus why thy di under my loan modification was illegal

Consumer Complaint: My ex wife asked me to sign a quit claim deed so she and her boyfriend could get my name off mortgage in which I sign the quick claim deed she then modified the mortgage on our joint property that we own together in order to remove my name from said property that was over XXXX years ago now I have not only my name on the property but an extra {$60000.00} in debt that I never signed any of this paperwork I did sign a quick claim deed being told that that starts the process of me getting my name off the property but I was not told in any way shape or form that I was going to be modifying the mortgage I never gave Nationstar my permission to do that I would have never signed any of those contracts I am taking my ex to court over 2 times they have all been found in contempt each time of violating the divorce decree but she does not have the credit nor the ability to refinance the property because now the property is owed {$160000.00} its value is only worth {$70000.00} I am remarried and this now cost me my financial ability because I am still in debt on that property with no way to be able to remove it please help me in this situation Nationstar Mortgage did wrong by doing this. There is no way for me to be able to sell the property I have tried to do that but she owes way too much. And what am I supposed to do for my children out on the street I do n't think that would work anyhow this is going to cost me my second marriage by this continuing on please email me or contact me by phone for any questions thank you XXXX

Consumer Complaint: We are trying to split a parcel of land located in XXXX XXXX, Minnesota. We have been approved by XXXX XXXX to subdivide the lot and filed new deeds with the county, but the entire parcel is still being held for collateral by Nationstar Mortgage. The mortgagee and our neighbor is XXXX XXXX. He has given my husband and I permission to submit paperwork on his behalf. We had to have an appraisal done for Nationstar as part of the application for land release from them. XXXX XXXX 's parcel, after the split, is worth {$190000.00}. His loan balance is approximately {$20000.00}. Yet Nationstar is requiring he pay {$2900.00}, to be applied to principal, in order to release the property. We are just wondering if, per the statement pertaining to the OVL formula, if this is fair since the appraised value of the property by far exceeds the current principal balance. I believe this is the clause in the Partial Release Application pertaining to our situation : If monies are needed to secure the value of the loan, the borrower will be contacted and advised of the amount. This amount must be paid and applied to the mortgage loan as a principal payment reducing the outstanding balance prior to the execution of the partial release, or, might be used for property improvements. The resulting loan to combined value ( CLTV ) ratio after the release is completed can not exceed the C LTV before the release. Nationstar Mortgage 's value in the property must be secured in order to process a partial release. Any reduction in value can not exceed the principal payment received.

Consumer Complaint: Please see attached CFPB complaint and email correspondence pdf noticing all the main contacts of the parties I have been sending my ongoing requests for documentation to. [ CIVIL CODE SECTION 2332. As against a principal, both principal and agent are deemed to have notice of whatever either has notice of, and ought, in good faith and the exercise of ordinary care and diligence, to communicate to the other. ( XXXX : XXXX ) ] I spoke with XXXX and his supervisor XXXX XXXX XXXX at the CFPB to ask specifically why no action had been taken on my complaint # XXXX that was directed to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX . They said that this company is not " registered '' with the CFPB so they ca n't forward the complaint and that they do n't handle complaints related to this matter! XXXX also told me they submitted my complaint on XXXX XXXX, 2015, to the FTC 's Consumer Sentinal Network developed for civil and criminal enforcement and gave me the FTC number to follow up. ( XXXX ) XXXX. When I called the FTC, the phone prompts referred me back to the CFPB for my mortgage related complaint. I pushed through the FTC phone tree and spoke with XXXX who said they do n't handle mortgage complaints and that is the CFPB 's role. I told her that the CFPB had sent my complaint to the FTC but when she checked the database, nothing came up. I called the CFPB again and spoke with XXXX ( # XXXX ) and updated her on my talk with the FTC and asked her who I could speak with about getting XXXX XXXX XXXX XXXX XXXX XXXX, XXXX registered because they are one of the entities I wanted to report. This debt collector law firm is in violation under the FDCPA, and has been trying to steal my home for the last year with apparent authorization from Nationstar Mortgage, who is a debt collector as well! I am now re-submitting this complaint to Nationstar Mortgage, XXXX, XXXX and XXXX XXXX XXXX and look forward to straight answers and a collaboration that will save us all time, make everyone accountable and with administrative remedy, avoid the court system at all costs. We all need undeniable proof of who is entitled to enforce the alleged note and who exactly the obligation is due, if anyone. On Wednesday, XXXX XXXX, 2015 there is another illegal auction scheduled for my home via XXXX by XXXX XXXX XXXX XXXX XXXX XXXX, XXXX supposedly on behalf of Nationstar Mortgage on behalf of an alleged trust held by XXXX that was never funded on time and remains empty. You must cancel this illegal auction now and produce the documents requested! You have all been noticed, again!

Consumer Complaint: This issue has dragged out over the last 8 months. I have been trying to apply for a Home Loan modification from NationStar Mortgage. I have come under several financial set backs in the 2015 year and wanted to request that I get assistance with my loan. I have applied for several Home Loan Modifications and Appeals with NationStar Mortgage Company, but all were denied. I have had poor customer service from NationStar, and I have requested several times to have a different Loan Specialist assigned to me for the one that was appointed to me would never answer her phone or return my emails. She would call me back at minimum a week later and at that time would explain that I still need to upload more documents for my modification. It was not clear on what documents that I needed and I was referred to the website that would tell me what I need. I have tried contacting her manager in regards to this matter to request someone that would better assist me with my process, but each time I am redirected to her. I have given all the pertinent documents that they have requested online. I received a letter from NationStar stating that I make enough money and was denied any kind of modification assistance. At this time, I have yet to speak with anyone that can offer me any real help and I am not able to speak with anyone that is actually performing the hardship loan. I have tried calling my Loan Specialist every time and she insists that I still have documents that need uploaded. After I upload the documents, I am told to wait and call back a week later to see what they have decided. The loan documents are expiring because I am waiting on NationStar to give me an answer. When I call, I am directed to the customer service center, which has no record of the modification assistance and I am needing to explain again as to why I am calling and why I am requesting assistance with my home loan. I get calls at least 2 to 3 times a week asking when I am going to bring my loan current when all the while I am waiting to hear something from their company. Their one offer to help was for me to pay an amount a month that I am unable to make and there was no other alternative extended. I want the harassment to stop and I would like to move forward with this.

Consumer Complaint: I spent months working with my builder, loan officer, escrow company, title company, and mortgage company to ensure that my total cash to close and my monthly payments would be what they promised. One day after closing on my house, I received a notice that my mortgage payment would be increased from {$1500.00} to {$1600.00}. They state that my escrow account is underfunded and those the need for an extra {$110.00} per month. Why was n't this brought to my attention when I was signing documents? Why send this notice one day after I 'm locked in? I ca n't help but think that something underhanded has happened.

Consumer Complaint: Approximately 18 months ago I restructured my mortgage due to financial hardship with NationStar Mortgage. I was behind in my mortgage and facing the possibility of foreclosure. After all was said and done, I wound up with a 40 year mortgage, with payments only approximately {$200.00} less a month than what I was currently paying. At the time of this restructuring, I only had 7 years ( {$68000.00} ) left to pay on my home that had a market value of {$150000.00} to {$180000.00}. When I asked why I had to pay such a high long term cost for this restructuring, I was told that there were attorney fees, late payments, etc. At the time I was approximately five months behind in payments. I was told that after I reestablish better credit I could refinanace for a better term. With all that considered, I believe a 40 year mortgage term in order to save my home is a bit excessive. In the end I am paying NationStar approximately {$500000.00} for a {$68000.00} loan. I am not sure what recourse I have, if any but any advice would be greatly appreciated. Consumer Complaint: I started having problems with Nationstar Mortgage out of Texas back in XXXX when I was trying to pay one month ahead in case of emergency. Apparently, they will not let you make extra payments on your mortgage without having a specific agreement with them which I was not interested in having. Of note, other lenders I 've had let me pay ahead if I wanted. Anyway, I sent my XXXX XXXX mortgage payment to them which they received on XXXX/XXXX/XXXX. I included an extra {$100.00} to be applied towards principal and indicated I wanted it applied to principal on my payment voucher. The end of XXXX I noticed the extra {$100.00} had been received but not applied to principal so I called Nationstar and was assured the extra principal would be applied when they processed my next voucher which made no sense. Yesterday, XXXX/XXXX/XXXX I received a letter in the mail from Nationstar telling me the {$100.00} was in a suspense account and I quote " As of the date of this letter, the total amount required to bring this account current is {$1300.00}. '' " please remit amount due in order to complete a full payment owed. '' The date of this letter was XXXX/XXXX/XXXX which was 2 days after receiving my XXXX XXXX mortgage payment and posting it on XXXX/XXXX/XXXX! My next mortgage payment is not due until XXXX XXXX, XXXX per their own website so how can I owe them {$1300.00} now? I fear their incompetence is going to hurt my excellent credit rating. Please help!
