Consumer Complaint: I have a mortgage loan serviced by Nationstar Mortgage # XXXX. My XX/XX/XXXX Principal payment they totally screwed up. I submitted a handwritten and signed instructions to apply to principal only. They disregarded and applied to the XX/XX/XXXX payment of interest. I obtained a payoff from Nationastar and sent good funds in the form of a cashiers check drawn on XXXX XXXX XXXX in XX/XX/XXXX and mailed it to their payoff address on the demand with extra days interest. On XXXX XXXX, Nationstar cashed my cashier check. They started contacting me about being delinquent on my loan. After talking to them I provided from my credit union a copy of the endorsed and cashed check ... .endorsed by Nationstar Mortgage. They submitted the dispute and on XXXX XXXX they send a letter XXXX saying theyXXXX made no error and that they were unable to locate my XXXX last check. I called on XX/XX/XXXX and talked to one of their service people who said he could clearly see they endorsed the check and cashed it. I am getting calls from Nationstar daily for being delinquent on the account. Obviously now that it is almost two months later and still unresolved from when they cashed my check they will erroneously report my credit profile as being 30 and now 60 days late. This is ridiculous. Within the past couple days I received a notice of a certified letter. My wife drove 30 minutes to the post office and back XXXX cities away to find a certified letter saying I am late on this account. I have had upwards of XXXX mortgage loans and this is by far the most incompetent servicing I have seen in my life. I called today and it is still not resolved. There is no process to expedite resolution which is a major flaw in their system. You should not go to the back of the resolution line and start your 7-30 day process over again. They should be able to email a manager and get it done now. Instead evidently I will continue to be harassed day and night and perhaps by mail on my so called delinquent account that I paid off just short of two months ago.

Consumer Complaint: History : XXXX XXXX XXXX held Several loans, I applied for Home Loan Modification and XXXX they gave me the run around as they ended up having to pay XXXX ( DOJ lawsuit ) as a result. Nonetheless, XXXX sold my loan to Nationstar Mortgage. When this particular loan was moved to Nationstar they told me that I had a Home Loan Modification @ 2 % FIXED for 40 years. I told them okay. ( See attachment with screenshot of 2 % FIXED 40 years ) Well recently, late XXXX/XXXX they increased my mortgage payment and denied I ever had the Home Loan Modification and is now telling my I have an APR??? What? I 'm so frustrated because they CONTINUE to get away with these type of things. Naturally, I paid the increased mortgage payment ( Because my credit has been RUINED not making payments. I did n't want to stop because it would not help while I 'm trying to rebuild. I decided to write instead. I want my 2 % FIXED 40 Year Mortgage re-instated. I 've requested from Nationstar..instead they are moving again to different Company name " XXXX XXXX '' because they are trying to hide from the same illegal practices XXXX was sued for.

Consumer Complaint: Nationstar Mortgage company paid another client 's mortgage insurance out of our escrow account in XX/XX/XXXX in the amount of {$5300.00}. We had not realized the error until XX/XX/XXXX when we were notified from XXXX that our insurance had not been paid. Our insurance payment is {$3800.00}. I contacted Nationstar and was informed that an error was made. Our insurance was then paid by them but the {$5300.00} was never replaced in our escrow as we are told it ca n't be until they receive money from the client that they paid the insurance. They are unable to contact the client and therefore say our money ca n't be replaced. I keep being assured after numerous phone calls it will be taken care of with no results. Yesterday an escrow analysis was posted to our account and states our monthly payment is going to be increased more than {$400.00} per month beginning XX/XX/XXXX ( due to their error ). They fully admit they made a mistake - we were told the other client 's name was vaguely similar and had an account with them - but does not pay insurance out of escrow - so they are sorry but they have to get money from them. I have spent hours on the phone since XX/XX/XXXX and keep being told they are investigating the error - but have not credited our escrow which now is in a negative balance. I feel our escrow money has been fraudulently compromised and needs to be replaced immediately.

Consumer Complaint: I faxed tax exemption paperwork ( veteran credit of {$300.00} for the year ) from the XXXX, NH town hall with selectmen signatures and state seal and approval from the state of New Hampshire to Nationstar on XXXX XXXX. I instructed them to speak with XXXX from the XXXX, NH town hall who is in charge of the XXXX, NH taxes. They told me it would take about XXXX business days to look over paperwork. Nationstar will not recognize the credit as they said they reached out the town hall and Nationstar said there is no credit on my account per XXXX. I do not think they called the correct town hall, as I told them to speak with XXXX. I then called the XXXX, NH town hall and XXXX from the XXXX, NH town hall verified that I have had the credit on my account since XXXX XXXX, 2016! So, Nationstar is overcharging me for escrow by {$300.00} since they are not doing their jobs properly. I have called Nationstar over 7 times and it seems that I am dealing with escrow customer service and managers that just do not want to look into the matter. I am very confused with the fact I submitted the appropriate paperwork and they do not want to recognize, this is illegal on their part.

Consumer Complaint: My wife and I were part of a modification on our home with an attorney we hired to represent us and our mortgage company. We got approved for a modification and received a copy to sign. My attorney also got a copy and told us that this modification was a good one and urged us to sign it and mail it back to the mortgage co as soon as possible. We were excited that the payment was what we could afford. Our attorney we thought read through the agreement before advising us to sihn it. He never mentioned anything about the other numbers we latter found out were involved that soon lead us to defaulting on our modification. We were completely unaware that the payments we were sending to the mortgage company were insufficient. We knew the figure as being correct. The mortgage company was sending all statements and communications about our modification directly to our attorney and not to us at all. We had no idea we were defaulting. Our lawyer refused to answer any of our calls or further emails from us to him. Our attorney never informed my wife and I that he was getting all mail from our mortgage co. His address was even on all the statements. Our mortgage company is now in active foreclosure of our home. We are extremely unhappy with how our mortgage company conducts business with it 's clients. We were never made aware of what exactly our numbers would be on a monthly payment basis. We desperately want to save our home from another foreclosure attempt.

Consumer Complaint: Nationstar Mortgage has failed to respond to our requests and clarification of the following : 1. They are not crediting or applying the correct payment amount we made towards the principal since XXXX 2016. 2. They created an escrow account to pay the property taxes and the home insurance without our knowledge and/or consent. 3. They made payments for the property tax for a bill we had already paid on time, they also paid the home insurance that was not due until the end of XXXX, 2016 4. The Tax Collector office rejected the duplicate payment from Nationstar and sent the money back to them ; however, Nationstar still has an escrow balance on our account even though the Tax Collector returned the money to them We have several requests in writing as well as by phone to correct the principal balance, which is off by about {$5400.00} to no avail. We get transferred from one person to another and they promise to send an explanation letter but they never do. We requested to close the escrow account since we are taking care of the property tax and home insurance ; they still have the account and the balance due for something we do not owe. PLEASE HELP. Nationstar has refused to modified our loan twice, the current rate on our loan is 5 % which is about 1.5 % above the current rate

This amount they reported includes {$32000.00} of deferred principal that is not due/payable until the loan matures in XXXX/XXXX/XXXX. This deferred principal of {$32000.00} was granted in my mortgage loan modification with XXXX XXXX effective XXXX XXXX, XXXX. This fact of {$32000.00} deferred principal, which is not currently due or past due, is stated in the attached HAMA Loan Modification Agreement under item XXXX on page XXXX XXXX. Consumer Complaint: Predatory lending from Nationstar Mortgage Bank in 2010 XXXX XXXX XXXX rejected our plead for a modification of mortgage on the basis that we were on time in all our payments and after months of calls and request an agent told us that XXXX will only be able to help us if we were on default. Three months later we were on foreclosure proceedings and nothing happened. The foreclosure process took 5 five years in which we could only pay our home owners association fees, which we did. After XXXX long and exhausting years we were set for trial but two weeks before XXXX XXXX XXXX sold our account to Nationstar Mortgage and they came to " service '' our account. They asked us to if we wanted to modify our mortgage to which we stated that we were very much interested. We provided XXXX % of the information they requested but at the same time their lawyers were pushing a " deal '' with our lawyers in which we would had to accept a " settlement '' for the modification to move forward. In every communication from Nationstar Mortgage it was very clear that they could get out of the modification of our mortgage if we did n't follow what they said and will immediate face eviction from our home in a matter of days. The settlement came in and it was the most one sided unfair settlement so we made our modifications signed and sent it back. The process moved forward and we got the " modification of our mortgage '', but the modification included the most outrageous and unfair extra fees. They took all the legal, taxes, insurance, late fees and pile them up on top of our mortgage bringing the cost of our home to {$530000.00} when the real value of the house is {$320000.00} leaving us with a {$210000.00} extra charge to our home and increasing our payment to 40 years. It was not our fault that the foreclosure process took 5 years, therefore we must not be obligated to pay for it. The " modification '' they offered us is a lose-lose for everybody, except the Banks. Here are our options : 1. If we stay in our home and pay {$3000.00} plus {$990.00} that Nationstar added including the most expensive Home Owners insurance in the market the monthly total monthly would be {$4000.00}. Oour income, as we demonstrated in our " modification '' application with our taxes and paystubs is {$4200.00} per month. In other words, we are left with {$140.00} per month for a family of XXXX to pay everything else or we will be evicted from our home. 2. Our next option is to stop paying and get evicted after we already paid over {$180000.00} in mortgage payments to XXXX XXXX XXXX and all the other scammers that we the tax payers bailed out when they stole our money. At the end and due to a consistently predatory lending practices we will lose our home, the banks took not only XXXX of the real value of the house in our monthly regular payments before we defaulted, but they got XXXX % of the value paid twice ; once by the PMI ( Private Mortgage Insurance ) that we paid at a rate of {$390.00} per month when we defaulted, but again from the government on the bail out that we as tax payers " gave '' them to keep robbing us. Now they will get again the value of our house while the throw us out on the street ... and they will get paid in full again for the real value of the house and better yet get to take off from their books the bogus {$210000.00} they placed in as " fees ''. In conclusion : the banks took a house that had a real value of {$300000.00} three times and got paid all three times ... and get to keep it to sell it again. This is text book predatory lending at its best and we are just citizens without any help taking the full frontal attack on our family and our way of life.

Consumer Complaint: My mortgage loan is currently serviced by Nation Star and the regular monthly payments were {$1000.00} per month. Nation Star offered a trial loan modification where the payments were increased to {$1300.00} per month ~ see attached. Nation Star has refused to record this modification, claiming they need {$1100.00} to complete the process. The loan modification agreement is demanding {$930.00} per month in monthly escrow payments. The escrow account grossly distorted since my taxes are {$5200.00} per year and insurance is {$800.00} per year. My escrow charges should be {$500.00} per month and total payments should be {$930.00}. Nation Star claims the escrow account is deficient, which is impossible because all the past due escrow has been recapitalized in to the modification agreement. All of the figures listed on the " AFFIDAVIT UNDER SECTION XXXX OF NEW YORK STATE LAW '' do not add up. There is a demand for new money ( {$54000.00} ) and a demand for a total balance due ( {$110000.00} ). I have requested a complete breakdown of the alleged total balance due and Nation Star has refused to furnish it. Nation Star is also pushing a 480 month amortization schedule, which is predatory and unnecessary. I originally borrowed {$66000.00} in 2004 and never refinanced my property. Therefore, there is no way my balance could be {$110000.00}. Nation Star is clearly distorting the escrow account and balance due to the extra equity in the property. I feel cheated and deceived by Nation Star, therefore I am seeking your assistance on this matter
